        『주민소환법』의 문제점과 개선방안에 관한 연구

        The first trial for recall on the mayor and the city council members of Hanam City, Gyeonggi Province according to Act on the Recall enacted in 2007, has aroused pros and cons. A recall system makes a local self-governing system so as to be more meaningful. Of local self-governing system, the recall was introduced to prevent the arbitrariness of the elected public service and enhance the transparency and responsibility of local finance. However, if abused, the recall menaces the sense of the representative system and increases the financial expenses such as the expense of voting. Looking back the vote for the recall of Hanam, we need to complement the recall system to draw on the merits of the recall. To realize, a cause of demand for recall should be required in Act on the Recall. Also, establishing organization that mediates and arbitrates the discord between residents and local self-government before recall becomes a device that reduces indiscreet recalls, heals up regional feuds, and saves unnecessary expenses, More important thing than complement of system, is a manner that local government heads and local assembly men, in process of drafting and driving of policy, should listen residents closely and promote policy with comprehension and persuasion for residents, if residents are against policy. The best thing saving unnecessary wastes of money and time is mediating concerns with conversation.

        토지관련 법제에 대한 입법평가

        인간 삶의 터전이면서 중요한 경제적 기반인 토지에 관련된 법적 문제는 시대 변화에 따라 다양해지고 있으며, 그에 따른 법적 규율도 다양하게 변화되어 왔다. 토지는 사적 소유의 대상이 되면서 동시에 유한한 자원으로 공적 재화의 면도 가지기 때문에 토지에 대한 법적 규율이 다양한 형태로 나타난다. 「국토기본법」, 「국토의 계획 및 이용에 관한 법률」 등 토지와 관련된 법규들은 토지의 균형있는 이용 및 개발을 위한 규제를 내용으로 하고 있으며, 토지의 종류나 활용 형태에 따라 규제의 형태를 달리하고 있는 실정이다. 토지에 대한 규정을 두고 있는 법률은 크게 토지 소유제한에 관한 규제, 국토 공간의 개발 및 정비 관련 규제, 토지의 이용 계획 관련 규제, 토지 개발 관련 규제, 토지 보전 관련 규제, 개발이익 환수 관련 규제 등의 형태로 나타나고 있다. 토지관련 법제는 약 116개의 법령이 용도지역을 구분하여 토지이용행위를 규제 하는 등 규제의 내용이 복잡하고 행위제한의 일관성이 없는 등 수범자인 국민의 생활을 제약하는 요소로 나타나고 있으며, 토지 규제의 기본이 된다고 할 수 있는 관련 정보수집 및 관리가 미흡하여 토지 정책의 과학적 수립이 어렵고 그에 따른 일선 행정 규제상의 문제도 나타나고 있다. 따라서 토지관련 법제에 대한 종합적이고 체계적인 검토·분석이 필요한 상황이며, 이러한 검토.분석은 최근 도입 논의가 활발하게 전개되고 있는 입법평가 방법을 활용하여 수행이 가능할 것으로 보인다. 다만 토지관련 법제의 방대성, 규제 종류의 다양성 등을 고려할 때 개별 관련법 분야의 전문가들이 함께 입법평가를 수행할 때 토지관련 법제의 정비가 가능할 것이다. 토지공법학회 차원에서 향후 지속적인 관심이 필요하다. According to the changing times, the legal issues related to land, the grounds of human life and major economic foundations, have varied, and subsequent legal rules have been changed in various ways. Because land has become the object of private ownership and at the same time the public goods as a finite resource, legal rules related to land have been various. Land-related laws, such as Framework Act on the National Land, National Land Planning and Utilization Act, and etc., prescribe regulations for balanced use and development, and the forms of regulations are different, depending on the type and use of land. The law which makes provision for land is appearing in many types, such as regulations on land ownership restrictions, regulations on development and maintenance of national land, land use planning-related regulations, land development-related regulations, land conservation-related regulations, restitution of development gains-related regulations, and etc. Legislation related to land which regulates land use activities by about 116 Acts, classifying the zoning and the lack of consistency of restrictions, appears constraining the lives of people and scientific policy making is difficult because of the lack of land-related information collection and management, and statutory administrative issues are appearing. Therefore, it needs the comprehensive and systematic reviewing and analyzing legislation related to land, and this review and analysis using legislation evaluation, recently introduced and actively engaged in discussions, seem to be done. However, considering the wide and diversity of land-related laws, maintenance of land-related laws will be possible with experts in the field of individual laws evaluating legislation. Hereafter, it needs constant attention in terms of “Korea Public Land Law Association”.

        특집 1 : 헌법 특집 ; 입법평가 논의의 현황과 전망

        Law-maker`s duty is to realize the spirit of the constitution and to enact "good law" that protects people`s rights to the utmost and mediates various interests harmoniously. State`s role has been expanded and strengthened in modern society, therefore the regulation on the whole national life has been controled in the form of legislation. In this phase, law-maker should consult objective and reasonable grounds in the course of democratic and efficient so that law-maker can achieve the legislative purpose- "good law", and this process is commonly known as legislation evaluation. Such legislation evaluation is carried out in many different ways such as a cost benefit analysis, a cost outcome analysis, a bureaucratic cost measurement, a labor cost estimate, a understanding probability review, an acceptance review, a normative harmony review, and so on. This paper analyzes the methods and evaluations of legislation evaluation carried out by domestic institutions including KLRI, considering the present stance of legislation evaluation, and then researches the analysis of future directions. Above all, such analysis is mainly carried out with the data of KLRI that has provided the most products of legislation evaluation since 2007. Future legislation evaluation is needed the trial connecting various methods in addition to the most used existing method, the combined study among related studies such as economics, social science, public administration, and so on, and the joint research among various institutions should be activated, and the accumulation and management of the legislative evaluation research achievements is the most essential thing. In the course of such trial, law-maker can advance to the legislative purpose-"good law."

        국회 입법교육 전담기구의 설립에 관한 고찰

        입법학은 일정한 입법목적을 위하여 입법목적에 가장 부합하는 법률을 만드는 방법을 연구하는 학문이다. 입법과 관련된 여러 문제를 과학적인 방법으로 설명함을 통하여, 합리적인 입법을 목표로 하는 학문분야가 발전되어야 한다. 이와 함께, 입법•법제교육의 규모를 확대하고 전문성을 높이기 위하여 국회 입법교육 전담기구를 도입할 필요가 있다. 국회 입법지원조직으로 국회 사무처 법제실, 입법조사처, 예산정책처, 위원회, 각 정당의 연구소와 정책전문위원 등도 있지만, 국회에서의 입법교육은 필요하다. 또한 국회 입법과정의 질적 수준을 제고하기 위해서는 대학과 대학원의 교육과정에 필요한 교과과정을 개설토록 지원하고 필요한 인적 자원을 확보하는 장기적이고도 근원적인 노력이 필요하다. 나아가 정부나 국회의 입법과정에의 국민참여의 필요성도 강조되고 있다. 또한 국회에 입법교육전문기관을 설립하여 국회와 지방의회의 구성원들을 주요 대상으로 한 입법교육과 학생과 일반국민을 대상으로 하는 입법체험교육을 체계적으로 시행하자는 의견 및 의회의 전문성 강화의 중심과제는 의원 개개인의 입법능력의 향상에 있으며, 이를 위해 가칭 ‘입법 소양교육 이수제’를 도입하자는 제안도 있다. 국가적 공동선을 위해서는 정당•정파적인 이익을 떠난 입법을 하는 국회, 사회의 부분의견이나 특수의 견보다는 국민 다수의 일반의사를 사회변화에 적절히 대응하고 국가선진화를 이끌 입법을 하는 국회를 만드는데 입법교육이 기여할 것으로 본다. Nomology is, to achieve a certain legislative purpose, to study scientific methods of the law making best suited for the legislative purpose. In the sense that there is no way to remove the cause of the problem if the based law of the application or the interpretation is not valid, through explaining several problems related legislation in a scientific method, there is a need for nomology of academic research to study social scientific basis to achieve a reasonable legislation. To expand the scale of legislative education and to enhance the expertise of that, it is necessary to introduce the organization to focus on the legislative education in the National Assembly. Though there are the National Assembly`s legislative support organizations such as Legislative Counseling Office of National Assembly Secretariat, National Assembly Research Service, National Assembly Budget Office, Committees, each party`s institute and policy advisors, and etc., the legislative education in the National Assembly is thought to be necessary basically. Also, to improve the quality of the legislation process in the National Assembly, long-term and profound effort is needed to support new class necessary for the curriculum of the college and graduate school and to secure the required human resource. Furthermore, it is emphasized the need of public participation in the legislative process of the government or Assembly. In a related move, though Support for Legal Education Act was enacted in March 2008, and is being implemented, the level of the major nations` legislative education has not been reached. In sum, there are suggestions that the professional legislative education organization be established, and the legislative education for Assembly and local council members and the legislative experience education for students and the general public be systematically enforced, and that the key of enhancing the professionalism of Assembly is to improve the legislative abilities of individuals of Assembly, to achieve it, and the tentatively named the completion of legislative literacy education be introduced. For the nation`s greater good, the legislative education will contribute to create the Assembly that makes laws beyond the party or partisan interests, properly reflects national opinions rather than some of comments or special comments in social change, and leads the national advancement through the legislation.

      • 염산 농도에 따른 p-aminophenol (Rodinol)의 합성에 관한 연구

        p-aminophenol can be synthesized by reaction of p-nitrophenol in the presence of HCI and Fe as a reducing agent. By the reaction, the difference of yield are followed by concentration of HCI, sort of reducing agent, reaction time and reaction temperature etc. In this experiment, it will be purposed that compared with the yield according to HCI in vorious concentration.
