        와이브로 활성화 정책 개선 방안

        WiBro(Wireless Broadband Internet), known as mobile WiMax overseas, is Korea's homegrown technology that lets people on the road remain hooked up to the Internet at the speed of today's fixed-line broadband. Is WiBro the future of broadband Internet services or the next famous high-tech industry bust? It is very difficult to answer the question. Current regulations of WiBro sector has not reflected the actual situation of market promptly. It causes so called 'delay of regulation' which prevents the growth of related industry. To facilitate the WiBro market, what should korean government do? In this paper, it is reviewed the preconditions for WiBro facilitation by specialists survey(FGI). The survey shows that the WiBro regulation is too strong generally, therefore Korean Communications Commission(KCC), the country's broadband and telecommunications regulator has to use some means to improve of WiBro industry. First, The regulator has to allow voice calls on WiBro networks and assigning call numbers to WiBro-enabled devices. Second, it must consider granting a license to a company to voice calls over WiBro as a mobile virtual network operator(MVNO), leasing the networks of KT and SK Telecom. Third, the cheaper price has to be maintained a considerable long time. Finally, it is necessary to make a support policy for WiBro company's overseas expansion.

        방송통신 규제기구 개편과 법제 개선 방향

        This paper explore the reorganization of broadcasting & telecommunications regulation authority and its the related laws and regulations in the convergence age. Its purpose is to get some lessons from the logic of the present situation. In Korea broadcasting and telecommunication industries has been converged fast by digital technology. To deal with convergence between telecommunication and broadcasting, Korea Communications Commission(KCC) is established this year. It regulates broadcasting and telecommunications sectors as an important task. But KCC have some problems which should be improved; professionalism of law enforcement and political neutrality etc. In Chapter Three, I analysed the Act of establishing and operating Korea Communications Commission and the Basic Act of development for Telecommunications & Broadcasting. This is for regulating the Broadcasting & Telecommunications sectors in the same level, according to the so-called "layer model" regulation system. KCC will legislate the Business Act of Broadcasting & Telecommunications in next year. The IPTV Act will be included the Business Act.         병원 및 관련시설의 특허출원제도 개선방안

        In order to increase the efficiency of patent administration, the Patent Office has enacted and operates the "Guidelines for Issuance and Management of Patient Account Number", which is the basic guideline on issuance and management of patent number. According to this guideline, however, only national and foreign persons, national and foreign legal entities and national entities are eligible for the applicant. As society develops and economic behavior becomes more complicated, there are a variety of subjects that are doing economic activities. But they are not legal entities. In the field of health care industry, they operate in the form of a branch office and are not independent corporations, but conduct health care activities and R&D activities. In addition, due to recent social needs, there is also a trend to establish a business incubator center to revitalize start-ups in the health care field. However, since such entities are not recognized as entitled to rights to apply for their patents. This is a problem that it is impossible to apply for patents in their own name to inventions that get through R&D activities or business start-up activities. Recently, the National Assembly is trying to expand the applicant's eligibility for the four types of investment associations through the amendment of intellectual property law such as patent law. However, there are some countries that have recognized the applicant's qualification, in addition to the person and legal entity, and some of the subjects which are participating in economic activities. Furthermore, in the era of the Fourth Industrial Revolution, the development of science and technology, including ICT, has been integrated into the field of healthcare, and from the perspective of encouraging various inventions to reinforce human life and body functions. It is necessary to legally make a way to apply for a hospital or hospital-centered starts-up incubator. 특허청은 특허 행정의 효율화를 위해, 특허고객번호 발급 및 관리에 관한 기본 사항을 내용으로 하는 「특허고객번호 발급 및 관리지침」을 제정‧운용하고 있다. 그런데 이 지침에 따르면, 국·내외 자연인과 법인, 국가기관에만 출원인 적격이 인정된다. 그러나 사회가 발전하고 경제활동의 양태가 복잡해지면서, 법인이 아니면서도 실제적으로 의미 있는 경제활동에 참여하고 있으며, 특허 발명과 이를 이용한 사업화 등을 하는 다양한 주체들이 있다. 보건의료 분야에서도 독립적인 법인이 아닌 분사무소 형태로 운영되지만, 본원과 다름없는 보건의료행위와 연구개발 활동을 하는 주체들이 있다. 또한 최근의 사회적 필요에 의해, 보건의료 분야의 창업 활성화를 위한 창업보육센터 설립 움직임도 있다. 그러나 이러한 주체들은 권리능력이 인정되지 않기 때문에, 연구개발 활동이나 창업 활동 중 발생하는 발명에 대해 자신의 이름으로 특허 등의 출원이 불가능하다. 최근 국회는 특허법 등 산업재산권법의 개정을 통해 네 가지 유형의 투자조합에 대해서 출원인 적격을 확대 인정하려고 하고 있다. 그러나 주요국의 사례를 보면, 우리의 경우보다 넓게 출원인 적격을 인정하고 있다. 더욱이 제4차 산업혁명시대를 맞아 ICT를 비롯한 과학기술의 발전이 보건의료 분야에 접목됨으로써, 우리의 생명과 신체의 기능을 강화시키기나 결함을 보완해 줄 여러 가지 발명들을 장려한다는 관점에서, 분사무소 형태의 병원이나 병원 중심 창업보육센터 등에도 출원할 수 있는 길을 입법적으로 열어주는 것이 바람직할 것이다.
