독일 표현주의 예술과 문학의 동아시아 수용과 그 미학적 의미를 해명하기 위하여 제 1장에는 독일표현주의자들의 동아시아 수용의 전제로서 유럽의 문화적 염세주의에 관련하여 문화적 배경뿐 만 아니라 기존 예술적 전통을 부정하려는 심리적 관점에서 고찰하였다. 특히 표현주의자들은 ‘제 1차, 2차 세계대전’을 경험한 후 그들은 유럽중심주의에 대한 회의적 태도를 발전시켰으며 그 때문에 서구의 내면적 문화 염세주의에 빠지게 되면서 인간의 영혼과 새로운 인간상을 추구하고 있음을 밝히고 있다. 제 2장에서는 표현주의 예술가 그룹인 “다리파”가 추구하는 원시주의와 일본 목판인쇄술(Holzschnittskunst)이 표현하고 있는 원시적 강렬한 색깔과 의 상관성을 검토해 보았다. 특히 필자는 Kirchener의 그림 <일본우산밑에 있는 아가씨, Das Mädchen unter dem japanischen Regenschirm>(Bild2), <만돌린을 치는 여자, Mandolistin>>(Bild3), <Balkonszene, 발코니장면> (Bild4)속에서 원시지향주의적 현상으로 나타나는 강력한 선, 검은 색, 거친 구도가 위에서 언급한 일본적 목판 인쇄술의 기법과 관련성이 있음을 규명하였다. 필자는 Kirchener가 일본의 목판화를 그의 원시적 세계를 묘사하는데 적합한 표현기법으로써 그의 작품 속에 과감히 수용하고 있음을 파악할 수 있었다. 그 외에도 Emil Nolde의 <일본인 무희 Japanische Tänzerin>((Bild6) 작품에 상형문자의 조형성과 아시아의 붓글씨의 자유분방하고 강렬한 화법에 어떠한 상관성이 있는지를 고찰하였다. 또한 Emil Nolde는 그의 표현주의적 작품 <조용한 삶의 탈, Mask Still Life>, , <한국, 길들의 신, Korea, A God of Roads> 과 <선교사, The Missionary> >((Bild8)속에 표현주의적 원시성의 미학을 드러내고 있는 지를 검토해 보았다. 그 결과 다음과 같은 결론을 얻어 낼 수 있었다. 또한 필자는 내적인 세계를 융통성 있으면서 자유분방하게 표현하는 동아시아의 역동적 수묵화를 Emil Nolde의 작품 <일본인 무희>속에 그의 깊은 내면성을 드러내기에 적합한 표현주의적 형식으로 수용하였음을 파악할 수 있었다. 또한 Emil Nolde는 그의 작품 <조용한 삶의 탈>에서 하회마을의 탈을 한국의 민속적이며 소시민적인 이미지를 표현주의적 강렬한 미학으로 반영 하였다. 특히 Emil Nolde는 그의 작품 <한국, 길들의 신>을 창작함에 있어, 이미 베를린민속박물관에서 보았던 <한국의 길들의 신, A God of Roads from Korea>에 표현되어 있는 장승의 얼굴에서 표현주의적 강렬한 선의 미학을 드러내기에 적합한 소재로 인식하고 과감히 그의 작품에 반영하고 있음을 알 수 있었다. 이러한 관점에서 Emil Nolde는 상기한 표현주의적 작품에 한국적 하회탈과 장승의 얼굴을 과감히 도입하고 있음을 찾아볼 수 있었다. 다른 한편으로 독일표현주의자들은 그들의 문학작품 속에 그들의 내면적 주관성을 표현하였으며 표현주의 유토피아로써 새로운 인간상과 새로운 세상을 보여주었다. 그들의 작품 속에 새로운 이방적 요소로서 동아시아 예술과 사상을 실험적으로 새로운 인간상과 새로운 세계상을 창조하는데 수용하였음을 알 수 있었다. 그 외에도 대부분의 표현주의자들은 유토피아적 삶의 공간으로서 아시아에 관심을 두었음을 파악할 수 있었다. 대부분 표현주의자들은 서양의 서구적 전통을 부인하고 새로운 개혁을 가지고 당시의 암울한 시대상을 탈출하기 위하여 새로운 유토피아로써 서양보다는 중국, 일본과 한국과 같은 동아...

In this paper, criterion and algorithm for on-line dissolved gas of a power transformer are studied. For the initial diagnosis of a power transformer, the on-line dissolved gas analysis is one of the most important and acceptable item to preventively diagnose a power transformer. But the criterion and algorithm of this item are not established yet in korea. In this paper, criterion and alarm level of the on-line dissolved gas analysis are based on the analysis of on-line data of operating transformers, Korea industrial standard and operation manual for a power transformer as well as accumulated data of the preventive diagnosis systems which have been operated at nine substations of Korea Electric Power Co.(KEPCO) since 1997. Therefore, the criterion and alarm level proposed in this paper are to be well suitable and are adaptable for the domestic operational environments and conditions of the power transformer. Considering that the conventional diagnosis system is capable only of accumulating and monitoring data of the power transformer operation, the criteria and the algorithms make it possible to accomplish an ultimate goal of the preventive diagnosis system. It is expected, therefore, that they will have a beneficial effect on broad applications of the preventive diagnosis system and the achievement of manless substation system in the future.

The relationship between literature and Globalization becomes more and more important. But is not easy to say, how literature can deal with those global problems. The paper wants to focus and describe the mentioned relationship by being concentrated on the movements of the literary works in the global field and on the strategies behind the works. To reach this aim the field theory of Pierre Bourdieu (1992) shall be used. The theory allows to generate a new perspective on literature in the global field, because the author will be seen as a salesman how offers his products (texts) on the global market. Therefore the paper will first have a look on Johann Wolfgang Goethes Term “Weltliteratur” (“world literature”) and go on with the contemporary German poets Ingrid Drewing, Hasan Özdemir, the German novelist Alexander Campus and Korean novelists Mirok Lee and Kyung-sook Shin. All of the authors give special contributes to the relationship between literature and globalization. It is not the aim of this writing to give detailed analyses of the literary works furthermore it is about to describe, how writers and literary texts find its place on a global market.

This paper discusses the Supreme Court's case decision(2007Da15172,15189) on whether the possessor of real property who has completed a secondary acquisitive prescription can claim a completion of secondary prescription towards the owner of the real property when the registered owner had been changed in the secondary prescription period. It should be assumed that the possessor delays a registration of the ownership according to a completion of the primary acquisitive prescription while the third party registers the real property. The majority opinion of the case said that a secondary acquisitive prescription period could begin from the time of its registry and the possessor could claim a completion of secondary acquisitive prescription. Furthermore, the majority opinion held that the possessor could claim a completion of prescription even if the registered holder had been changed in the secondary prescription period. Accordingly, the court reversed the Supreme Court ruling heretofore demanding the sameness of the registered holder and constancy of the owner during the secondary prescription period as the conditions of prescription. The case can be referred as a significant case clarifying that the second principle of so-called the five case-principles about acquisitive prescription by possession may be applied to not only the primary acquisitive prescription but also the secondary acquisitive prescription. 이 글은 2차 취득시효기간 중 등기명의자가 변경된 경우 2차의 점유취득시효를 완성한 점유자가 그 등기명의자에게 시효취득을 주장할 수 있는지에 관한 대법원 전원합의체 판결(2007다15172,15189)을 다룬 것이다. 대상판결의 다수의견은, 부동산에 대한 1차의 점유취득시효가 완성된 후 그로 인한 소유권이전등기를 하지 않고 있는 사이에 그 부동산에 관하여 제3자 명의의 소유권이전등기가 경료된 경우, 제3자 앞으로의 소유권 변동시를 2차의 점유취득시효의 기산점으로 삼아 취득시효완성을 주장할 수 있고, 2차의 점유취득시효기간 중 등기명의자가 변경되더라도 점유자는 2차의 점유취득시효 완성 당시의 등기명의자에 대하여 시효취득을 주장할 수 있다고 판단하였다. 이에 따라 연구대상판결은 2차의 점유취득시효기간 중 등기명의자가 동일하고 소유자의 변동이 없을 것을 취득시효의 요건으로 요구하였던 종전의 대법원판례를 변경하였다. 연구대상판결은 이른바 판례5원칙 중 제2원칙이 2차 점유취득시효의 경우에도 1차 점유취득시효의 경우와 동일하게 적용되어야 한다는 점을 밝힌 판례로서 의의가 있다.

한국전통음식에 내재한 문화성

In this paper I investigated how Geukgiseong (The power of overcoming), mihakseong (nature of beautity), aesthetics of Sakim (Fermentation), yakriseong (Medical qualtity), Yin-Yang Principle, a culturality of communication which was inherent in traditional foods are represented. In order to get academic results, I accepted the perspectives of Eliades's Initiation and cultural semiotics. As such result I could get following results:I came to recognize that in the korean myth of Tangun, the mysterious power, in which a bear can transform into an ungnyeo(the woman of bear), was originated from medium of Garlic. I found out that the garlic, like food, is emerging as an important symbol, while bear can transform from animal into a human form. Also, I could recognize that the symbol of bear, which can overcome cold winter and have a lot of patience and self-control power, was accepted in this Korean Myth. The fact that after the bear has fed down Garlic, the bear could be transformed into an ungnyeo (woman of bear). It means in Korea, it is an important cultural symbol, which reveals identity of self-control of the nation formed unconsciously. Just like according to the theory of Eliade, after experiencing human trials of initiation, human-being can develop into a stage of death and rebirth, through the process of Sakgim (fermentation). A Korean traditional food like Kimchi, can be produced into a best and ripest KimChi. This process can be interpreted as the same transformation process from a bear to a human-being (woman of bear) appeared in the over mentioned Korean Danggun myth. Also, we can understand this process as the same process in solving Han (chagrin) in Pansori. In other words, it was confirmed that the fermented Korean traditional foods like kimchi has an aesthetic of sakimui (fermentation). Because Koreans have a strong faith that food as medical food, which has mysterious power to heal sick body. Korean people can enjoy eating fermented Kimchi made from fresh vegetables, even in winter time. In short, It was confirmed that Korean people have a practical life of wisdom to prevent lots of disease owing to the lack of body activity during winter. 본 논문은 한국전통음식속에 극기성, 삭임의 미학성, 음양오행의 철학성. 약식동원의 약리성, 소통의 문화성이 어떻게 나타나 있는 지를 살펴보았다. 특히 한국 전통음식 속에 극기의 문화성, 삭임의 미학, 음양오행원리의 철학성, 음식이 보약이라는 약리성, 소통의 문화성을 인류학적인 엘리아드의 성년식이론과 문화기호학의 이론을 도입하여 고찰해 본 결과 다음과 같은 결론을 얻어 낼 수 있었다. 단군신화에서 곰이 웅녀로 변신할 수 있는 힘은 마늘이라는 매개체가 작용한 점과 곰이라는 동물이 인간으로 변신되는 것은 마늘이라는 먹거리가 중요한 기호로 부각되어 있다는 점을 살펴보았다. 곰이라는 추운 겨울을 이겨내며 인내심이 많은 극기의 기호를 도입하고 있다는 점과 곰이 마늘을 먹고서 웅녀로의 변신하는 것은 한국민족의 무의식적으로 형성된 은근과 극기의 정체성을 드러내는 핵심적인 문화적 기호로 파악할 수 있었다. 엘리아드의 성년식의 이론에 따르면 인간의 시련이라는 과정을 견디어서 죽음과 재생의 단계로 발전되어 가는 단계처럼 식품에도 삭임의 과정을 통과해야지 제대로 된 발효식품이 되는 이치는 단군신화에서 곰이 웅녀로 변신되는 과정과 판소리에서 한국인의 한을 삭임으로 푸는 방식과 일맥상통한 면이 있음을 살펴보았다. 다시 말하면 김치와 같은 발효식품에는 삭임의 미학성이 나타나 있음을 확인할 수 있었다. 한민족은 음식이 곧 병든 몸을 병을 치유할 수 있는 약리성의 믿음을 가지고 있었기 때문에 겨울에도 신선한 야채를 겨울에는 항상 먹을 수 있는 김장을 함으로서 활동양이 부족하여 병이 생기지 않게 사전에 대비하는 생활의 지혜를 실천하는 민족임을 살펴 볼 수 있었다. 한국의 전통 음식인 비빔밥은 우주를 상징하는 오방색의 식자재를 사용하여 음성적 식품과 양성적인 식품이 균등하게 조화 있게 섞임으로서 음양오행의 이치에 맞은 전통 음식이 완성된다는 점을 파악할 수 있었다. 이런 점에서 한국 비빔밥이야 말로 우주의 오방색, 음적인 식품과 양적인 식품이 종합적으로 조화를 이루는 음양의 철학성이 담아 있는 음식이라고 정의할 수 있다. 한국 제사상을 조상을 위해서 치러지는 경건한 행사는 생전의 모습을 떠올리며 돌아가신 조상과의 소통하는 의미로 해석할 수 있다. 제사가 끝난 후에는 제사에 참여하는 후손들은 제사상의 차려진 음식을 나누어 먹으며 조상들로부터 복을 나누는 자리이며 제사를 받은 사람과 제사를 드리는 사람 사이에 대화가 오고 가고 그것이 가정 사회의 차원의 담론으로 발전되어 갈 수 있음을 알 수 있었다. 한국전통음식의 세계화는 앞에서 살펴 본 바와 같이 전통음식 속에 내재되어 있는 극기의 문화성, 삭임의 미학성, 약식동원의 원리, 음양오행의 철학성 그리고 조상과의 소통성을 개발하고 연구하여 유네스코 세계문화유산에 등재시키어 서구인들에게 새롭게 인식시켜야 한다. 또한 외국 음식과는 다른 차별화된 다양한 문화성이 담겨져 있는 한국음식의 독창적인 내용을 세계어로 번역하여 콘텐츠화 시키는 과제가 남아 있다.
