죽산 조봉암, 진보당과 21세기 한국의 진보정치

이 논문은 ``오래된 미래``로서 1950년대 조봉암과 진보당의 역사에 대한 반추를 통해 현재와 미래의 대안을 찾으려는 것을 기본 목표로 한다. ``역사란 기억투쟁``으로 (잘못된) 과거에 대한 솔직한 대면 속에서 건강한 미래를 창출하기 위한 현재적 실천이며, 그랬을 때 기억투쟁으로서의 역사는 ``억압-저항-희생-침묵과 방관``이라는 네 개의 차원으로 구성된다. 조봉암과 진보당에 대한 기억을 통해 바라보는 1950년대의 한국정치도 이 네 개의 차원이 어우러진 복합물이라고 할 수 있다. 이러한 문제의식 아래 이 논문은 크게 두 개의 부분으로 구성되어 있다. 1950넌대 조봉암의 정치궤적과 진보당 활동을 살펴보는 것이 그 하나라면, 다른 하나는 그것이 2010년 오늘을 살아가는 우리에게 던지는 시사점을 찾아내는 것이다. 결론적으로, 이 논문은 우리 사회변화의 출발은 무엇보다도 정당정치의 지형을 바꾸는 데에서 시작되어야 함을 강조한다. 민주화 이후 20년의 한국 정치는 사회에 뿌리를 내리지 못한 민주적 정당정치의 부재가 빚어낸 부정적 결과를 잘 보여주기 때문이다. This paper aims to search for alternatives of the here and the hereafter through the political actions of Cho Bong-Am and the Progressive Party in the 1950s. The history as ``memory struggle`` is composed with four levels: ``oppression-resistance-sacrifice-silence``. The memory on Cho Bong-Am and the Progressive Party is the same. This paper is composed with two parts. One is to consider political actions of Cho Bong-Am and the Progressive Party. The other is to find its implications. In conclusion, to overcome the present crisis of democracy in Korea is to realize ``good politics``. Because the very heart of the matter is concrete political practices through a good party.

이 글의 기본 목적은 2004년 17대 총선에서 원내 진출에 성공한 민주노동당을 분석하는 것이다. 그 이유는 민주노동당의 원내 진출이 오랜 실패와 좌절로 점철되어 온 한국 진보정당운동의 역사를 마감하는 의미와 함께, 민주노동당의 향후실천 여하에 따라 한국정치의 명암이 엇갈릴 수 있다는 두 측면에서 한국정치사를 새로 쓰게 한 정치적 사건이기 때문이다. 이러한 문제 의식 아래 이 글은 먼저 17대 총선 결과에 대해 평가를 하고, 민주노동당의 성공 요인과 17대 총선 이후 민주노동당의 쟁점 또는 현안이 무엇인지에 대해 고찰한 뒤, 향후 한국정치 전망과 관련한 민주노동당의 과제를 살펴보고 있다. <br/> 불확정적인 진보의 미래라는 전제 아래 민주노동당이 그 효과를 극대화하면서 우리 사회의 미래를 준비하기 위해서는 자기 성찰과 혁신 속에서 한국을 어떤 사회로 바꿔나갈지, 즉 좋은 사회란 어떤 사회이며, 그 사회는 어떻게 가능하며, 누가 함께 할 수 있을 것인가에 대한 실현가능한 대안 전략의 수립이 있어야 할 것이다. 그것은 민주노동당이 대중성을 확보하면서도 변혁성을 잃지 않는 가운데 사회변혁과 집권의 길을 성공적으로 완수해내어야 하는 무거운 숙제이기도 하다. 결국 이를 위해서 민주노동당은 실용주의적이고 단기적인 문제 해결에 자족하는 단순 해결사에 머물러서는 안 될 것이다. 중요한 것은 부단히 변화하는 세상에 대해 권위와 무게를 지닌 해석자이자, 대안적 헤게모니 프로젝트의 조직가로서의 역할을 민주노동당이 과연 수행할 수 있는가 하는 것이다. This paper aims to analyze reasons of success of the Democratic Labor Party(DLP) in the 17th General Election in Korea. Winning 10 seats by the DLP in the National Assembly should be understood as a great political event which opens up a new political history in Korea. In order to clarify the political implication of the election, the paper is composed of four pacts including important contents as follows;<br/> <br/> First, the result of the 17th General Election shows characteristics as a critical election' in three points. (1) The election solved the political condition of the divided government, in which the administrative power was not agreed with that of the National Assembly. (2) The parry system based on regionalism came to be dissolved. (3) A progress party succeeded entering into the National Assembly through the 17th General Election.<br/> <br/> Second, the eye-opening progress of the DLP in the election should be explained by three major aspects. The DLP's painstaking endeavors for 7 years made the progress possible on the one hand. The public discontent and indignation against ready-made conservative politics as general background should also be taken into account when the result of the 17th General Election is scrutinized on the other hand. And it was result of the systematic effect of party list PR system and accompanying effect by political situation of impeachment<br/> <br/> Third, the DLP should take pains co overcome the following problems CO strengthen the political capacity in order to achieve the public support and participation. how to budd new agenda to enhance political movement on the subjugation of poverty and stabilization of the people's livlihood, for instance reinforcement of coordinative power through various party feud, particularly by leadership of dual guidance and outdated political factions<br/> the flexible mutual assistance case by case for democratic reforms<br/> <br/> In conclusion, It is generally agreed that new political horizon cannot be opened by the major parties' excessive political quarrels nor by Roh's government It produces only 'the politics of depolitization' and accelerates political distortion and reduction called 'criminalization of politics' and 'judicialization of politics'. New politics and historical vision in Korea could created exclusively by maximization of 'the DLP effect' Therefore it is essential for the DLP to establish alternative strategies to enhance democratic reforms coping with rapidly changing world

Gear trains are usually used in industrial machinery, such as automation production lines and exclusive machines. A machine may needs an new motion related not to moving table or frame. This study has been developed a gear train with double motion mechanical driver. The developed gear train in this study applied on CNC wire forming machine and CNC wire bending machine. The driving state of new machines with new gear train was satisfied well to an expcted motion specifications.

최근 힘든 취업 과정을 거치고 취업한 1~3 년차 직장인이 한국 회사 특유의 조직 문화에 대한 부적응과 기대 불일치 등으로 직무 스트레스를 받아 심적 건강이 약해지거나, 퇴사를 하는 사례가 늘어나면서 하나의 사회적 현상이 되고 있다. 이러한 현상은 개인의 경제적 활동에 대한 악영향 외에도 회사의 인적 자원 관리 측면에서도 간과할 수 없는 현상으로 인식되고 있다. 이에 개인의 직무 스트레스에 대한 진단과 관리를 해주는 새로운 서비스가 필요하다. 본 논문에서는 이 사회적 현상의 해소를 시도하고자 개인화된 정보 취득에 용이한 대화형 인터랙션과 AI 기술을 활용하여, 직무 스트레스 및 우울증 등 회사 생활에 영향을 미칠 수 있는 사항을 진단해 주고, 본인의 감정 상태, 스트레스 지수 등을 쉽게 확인할 수 있는 지표를 제공하여 사용자의 직무 스트레스 해소를 지원해 주는 AI 진단 및 대화형 인터랙션 중심의 ‘투모로우’ 서비스를 제안한다. 본 서비스를 통해 직무 스트레스에 대한 인지와 진단에 소홀했던 직장인들의 직무 스트레스를 감소시키는데 도움을 줄 수 있을 것으로 기대되며, 나아가 회사의 인적자원 관리에 대한 이해를 높여줄 수 있을 것으로 기대된다.

기후변화 관련 이사의 책임에 대한 소고

최근 수년간 발생한 대규모 회계부정 등 일련의 사건들을 통하여 회사의 지배구조 개선에 대한 요구가 늘어가고 있는데, 이는 기후변화 문제와 맞물려 이사의 의무와 책임의 강화에 대한 논의의 필요성을 제기하고 있다. 기후변화는 과학적 불확실성이 줄어드는 가운데 전 세계가 대응방안을 마련하기 위하여 절치부심하는 중요한 문제이며, 환경문제를 대변하는 새로운 패러다임으로 볼 수 있다. 전 세계가 기후변화에 대응하기 위하여 법과 제도를 정비하고 있고, 이에 따라 기후변화는 규제 내외적인 변화를 동반하면서 회사에는 위기이자 기회로 작용하고 있다. 한편 회사의 이사는 선관의무와 충실의무를 부담하고, 이사의 책임은 경영판단의 원칙 혹은 경영상 재량범위 내의 권한의 행사여부로 판단한다. 기존의 판례들은 대부분의 경우 이사의 경영상 업무수행과 관련하여 이사의 개인적 책임을 인정한 경우가 거의 없었다고 볼 수 있다. 이사의 업무수행에 기후변화라는 요소가 개입하면서, 기존의 법리가 변경될 것인지 논의가 필요하다고 본다. 이사는 지금까지와는 달리 기후변화 관련 요소를 업무수행에 포함시켜야만 할 것이다. 이는 기후변화 관련 위험의 평가와 관리를 통하여 이루어질 수 있을 것이다. 기후변화 문제와 관련하여 이사의 의무와 책임이 갑자기 강화되지는 않을 것으로 보인다. 그러나 기후변화는 이제 경영상 업무수행에 반드시 고려해야 하는 요소가 되었고, 이를 외면한다면 기존의 법리로도 이사의 의무를 다한 것으로 인정되지 않을 것이다. 이사가 회사를 위하여 충분한 정보에 기하여 합리적인 의사결정을 하기 위하여 이제 기후변화에 관한 정보는 필수적인 요건이 되었으며, 이에 대한 판단이 충분히 이루어졌는지 여부가 이사의 의무이행과 책임인정 여부를 판단하는 기준이 될 수 있을 것이다. It has been required to improve corporate governance recently because there has been some disastrous events such as accounting fraud etc. Climate change will be one of the reasons to reinforce directors’ duties and liability. Lessening its scientific uncertainty, it is one of the most important issues for governments to address climate change, which can be a new paradigm representing global environmental issues. Governments have established their climate change laws and measures, which might have implications for corporations’ opportunities and/or risks both legally and financially. Directors have the duty of care and the duty of loyalty. Directors’ business judgment will be respected by the court if there is no abuse of discretion, which is called the business judgement rule. It is required to discuss whether directors liability should be strengthened regarding climate change issues. It is clear that climate change issues should be on the board’s table. It is recommended to assess and manage climate change risks in a board’s committee. It seems unlikely to strengthen directors’ duties and liability regarding climate change issues immediately. Climate change, however, already became one of the issues which must be considered when making business decisions. If not, it could not be respected as a business judgment even under the current legal principles. When informed decision making, directors should consider climate change related information, which could be a standard whether it meets requirements for the business judgment rule.
