경찰수사과정의 인권보호에 관한 연구

최근에 많은 논의가 있었던 사법개혁은 우리의 형사사법체계에 있어서 많은 변화를 예고하고 있으며, 이 한 가운데 있는 것이 수사상의 인권보호와 관련된 문제들이다. 기존의 수사상 인권보호를 위한 많은 연구들은 형사절차를 중심으로 한, 경찰만의 인권보호라기 보다는 검찰과 함께 얽어진 형사절차상의 인권보호를 중심으로 한 연구가 거의 대부분이었다. 여기에서 착안하여 본 연구에서는 경찰중심의 수사과정에서 발생할 수 있는 인권보호를 중심으로 연구를 전개하였다. 물론, 기존의 연구내용을 중심으로 경찰이 수사과정에서 인권침해의 가능성이 높은 주체로서의 내용도 포함하였다. 그 내용은 첫째, 경찰수사에 있어서 법절차대로 하면 수사가 곤란해진다는 의식이 잔존하고, 적법절차 준수를 확보하기 위한 제도 및 시설이 미흡으로 인한 피의자 인권보다 사건해결이 우선이라는 인식의 팽배, 둘째, 범인검거에 치중하다보니 피해자를 수사의 대상으로 간주하고, 여성, 장애인 등에 대한 사회적 약자에 대한 고려 없이 일률적으로 대응하여 범죄피해자에 대한 지원문제가 상대적으로 소홀하였으며, 셋째, 수사사항의 언론보도로 인해 사건관계인(피해자, 신고자 등)의 신분이 노출로 인한 사생활 침해의 논란, 피해자, 신고자 등의 신변보호시스템이 취약한 등의 피의자 이외의 사건관계인에 대한 인권보호의 부족, 넷째, 감시편의 구조의 시설 개선에 대한 노력이 미흡하였고, 인권보호를 위한 적극적 관리보다 자해 예방 등 소극적 관리로 실질적인 면에서는 유치인을 범죄인과 같이 인식하고 감시 및 통제에 소홀하였던 면 등을 중심으로 연구하였다. 그러나 과거 경찰이 수사상 인권침해의 주체라는 시각에서 탈피하여 경찰수사만의 문제가 아니라 피의자 중심의 현행 형사사법구조 즉, 범죄자 검거 및 수사 중심의 형사사법구조의 문제와 함께 맞물려 돌아가는 문제라는 것을 강조하였다. 즉, 인권보다는 자백을 받아내기 위한 국가기관의 공권력에 맞서 피의자 보호에만 치중하고, 제도를 발전시킨 데에 그 가장 근본 원인이 있기 때문에 인권침해를 한 경찰관 자체의 문제라기보다는 제도적인 문제라는 것이다. 그러므로 인권이라는 측면에 있어서는 경찰은 침해의 주체가 아닌 침해의 객체로서 직무상 위험감수의무를 넘어서는 포괄적인 인권보호의 시각에서 보호되어야 하는 또 하나의 객체라는 측면을 강조하였다. 또한 일탈에 대한 행위책임이 있는 피의자보다는 피해자에 대한 관심과 아울러, 형사사법의 목적을 달성하는데 없어서는 안되는 신고자 등 사건관계인에 대한 인권보장을 위한 체계를 확립하는 것도 중요하다. Human rights derive from the inherent dignity and worth of the human person and they are universal, individual and interdependent. The importance of policing in protecting rights and meeting standards as required by international law, is one substantial reason for advocating that the international dimension to human rights protection should form part of the body of knowledge of all police officials. Another substantial reason is that it is important to introduce or reinforce a human rights culture within police agencies as a means of securing good behavior in policing, especially, during crime investigations. A lawful and ethical investigation of crime can protect the rights to a fair trial whereas an unlawful or unethical investigation can subvert that right even before the trial has commenced. The rights of victims of crime are an especially important consideration. Their basic rights to be treated with compassion and respect; to be informed of their role in the proceedings and of the disposition of cases; to have their views represented and considered. Especially, In this paper, I emphasized human rights of police officers. At present, police officers have a status of the subject of human rights invasion. But, as a conception of human rights is enlarged, police officers also can be a object of human rights invasion.

This study focused about the victims and construction of support network for victim in Korea. In this paper, I emphasized about criminal victim support by NGO. The newly created term of NGO has become a topic of conversation in the field of social science, politics and administration in our society entering upon the 21th century. In our society, role of NGO has became important organization in all sector. In Korea, recently Ministry of Law is enacting a law for protect criminal victim. This law included contents about juridical person for criminal victim support. This point, I examined about its possibility which is related to establishment of juridical person for criminal victim support, financial of juridical person, its function. etc.

지역경찰은 관할지역의 실태를 파악하여 그에 맞는 활동을 하고, 항상 즉응체제를 유지하여 경찰업무 전반에 걸쳐 초동조치를 함으로써 주민생활의 안전과 평온의 확보를 그주된 임무로 하고 있으며 다양한 활동들 중에서 가장 주된지역경찰의 활동은 순찰근무라 할 수 있다. 이러한 지역경찰의 활동이 과연 어떠한 효과가 있는가 하는 것에 대하여는 많은 선행연구가 있지만, 본 연구에서는 급지별 경찰서 2개씩을 임의로 선정하여 지역경찰활동의 가장 기본적인 목표인 범죄예방에 초점을 두어 5대범죄 발생건수를 산출요인으로, 지역경찰관서 배치인원, 방범대상 시설수(금융기관, 현급다액취급업소, 풍속업소), 112신고처리 건수, 관할면적, 관할인구를 투입요소로 하여 DEA 분석을 실시하였다. 분석결과 급지별, 경찰서별 상대적인 차이가 있지만, 분산분석, 상관관계분석, 회귀분석결과에서 언급한 것처럼 1급지경찰서에서는 각 지역경찰관서별로 112신고가 많으면 많을 수록 지역경찰력(총원)이 많이 투입된 지역경찰관서의 효율성이 높게 평가되는 경향이 있었고, 2급지의 경우에는 지역의 특성이 반영되어 경찰서별 지역경찰관서의 투입요소의 차이가 많아 효율성 평가값의 편차가 상대적으로 많은 것으로 분석되었다. 3급지의 경우에는 지역경찰관서에 투입된 지역경찰력(총원)이 관서 운영을 위한 최소한으로 편제되어 있어 효율성 평가값이 기타 다른 요인들의 영향을 받고 있는것으로 분석되었다. The Purpose of Local Police Patrol Service is to ensure security against crime, crisis etc. This study evaluate Local Police Patrol Service through DEA analysis. Used number of police manpower, crime prevention institution, size of land, number of 112 report, number of local population in input variables and number of 5 crime occurrence in output variables for analysis. If see analysis result, first, grade 1 local police patrol service, efficiency of local police patrol service is more high, more number of 112 report, more police manpower. Second, grade 2 local police patrol service, local characteristic has a influence on efficiency of local police patrol service. Third, grade 3 local police patrol service, input variables which has minimal size of grade 3 local police patrol service are influence on diversity factors, for example, resure institution, floating population etc.

지역경찰의 효율성에 영향을 미치는 요인에 관한 연구

모든 경찰활동의 기초가 되는 지역경찰활동은 수동적인 범죄예방활동 자체에 그치는 것이 아니라, 경찰활동 전반에 영향을 미치는 매우 중요한 것이다. 그러나 현재의 지역경찰제도는 관할지역의 크기, 관할지역의 인구 등에 의하여 획일적으로 편제, 조직되어 운영되고 있기 때문에 지역경찰활동의 원래적인 목적인 범죄예방, 초동경찰활동 등의 영향은 반영되어 있지 못하다. 따라서 지역경찰활동을 더 잘 할 수 있도록 하기 위하여는 지역경찰활동에 영향을 미치는 요인들을 살펴볼 필요가 있다. 지역경찰활동의 효율성에 영향을 미치는 요인들은 경찰관의 수, 관할지역 면적, 관할인구, 방범대상 시설(현금다액 취급점, 풍속업소) 등의 수, 112신고 건수, 5대범죄 발생 건수등이 있다. 이들 각 요소들 중에서 5대범죄 발생 건수를 종속변수로, 나머지 요인들을 독립변수로 하여 각 요인들과의 상관성을 분석하였다. 분석결과 지역경찰관서의 효율성에 가장 큰 영향을 미치는 공통적인 요소는 112신고건수와 총원이었으며, 그 다음으로 방범대상시설이 영향을 미치는 것으로 나타났다. 즉, 지역경찰관서의 효율성에 영향을 미치는것은 업무량과 그 업무를 처리할 수 있는 경찰관의 수 인것으로 나타나고 있다. 따라서 지역경찰관서의 효율성을 높이기 위하여는 치안수요에 대비한 인력의 적절한 배치가 중 요한 것으로 보인다. Local police patrol service is very important to passive crime prevention, and also all pattern of policing. But, local police patrol service is not influence on crime prevention, beginning of investigation etc because this system is established by size and population of police district. Therefore, it is necessary for reviewing on impact factor of local police patrol service. According to many proceeding studies, impact factors of local police patrol service are number of policeman, size of police district, population of police district, facilities against prevention activities, number of 112 report, number of main crimes etc. In this study, I set up dependent and independent variables; dependent variable is a number of main crimes and independence variables are the others among impact fators. As a analysis result, impact factors of local police patrol service efficiency are a number of 112 report and a number of policeman. This result reveal that efficiency of local police patrol service are influenced by the quantity of duty and manpower. For this reason, appropriate disposition of policeman is very important to raise local police patrol service efficiency.

한국경찰의 개방형임용제 도입가능성에 대한 검토

개방형 직위제도는 기존의 계급 및 계층제 중심의 조직관리 형식에서 탈피하여 직무수행의 성격에 따라 직위에 대한 적합한 직무수행요건을 충족하는 외부인사를 활용하는 제도로서 일종의 직무중심의 직위분류제적 성격을 내포하는 제도이다. 1999년부터 정부부처의 1-3급 고위공무원을 임용하고 있으며 그 활용범위가 점차 확대되고 있다. 그러나 경찰과 같이 직무의 성격이 타 공직조직과 달리 특수한 환경을 가지고 있는 경우에는 일반적인 개방형직위제도를 그대로 활용할 수 있는가에 대한 논란이 있다. 경찰조직에서는 책임운영기관인 운전면허시검관리단, 경찰청 감사관, 경찰병원장 등을 개방형 직위제로 운영하고 있을 뿐이다. 이와 관련하여 개방형직위제도의 장점을 경찰조직에서 더욱 확대할 수 있는 방안을 모색하고자 한다. The Open Position System is a new personnel management system started in korea, 1999.Open Position System have purpose to use outstanding talents and to expertise from both public and private sector. Korean government adapted open position system in order to use the right man in the right place. And Korean government incresae application of Open Position System. But, in spite of strong good point of Open Position System, We have limitation to apply Open Position System in police organization, generally. Because police have unique characteristics compare with other public organization. There is constant controversy concerning unique characteristics of police organization. Now, Korean police adopt Open Position System in few division: Chiep of Driver's License Agency, Director General for Audit and Inspection of Nation police Agency, Chiep of police hospital. 주요국가의 공인탐정 현황 및 정책적 시사점

탐정제도라는 것은 경찰활동 중에서도 사경찰활동의 내용중 하나이다. 우리나라에는 사경찰활동이라는 개념 대신 그 중의 하나인 민간경비가 사경찰활동의 전부인 것처럼 우리의 생활 깊숙이 들어와 있다. 이러한 현실에서 탐정제도는 우리의 현실상, 사경찰활동이 아닌 ‘심부름센터’, ‘흥신소’ 차원의 공식화되지 못하는 개념으로 일반적으로 곡해될 가능성도 있다. 분명, 국가 경찰력이 모든 국민생활을 보호해주지 못한다는 검에서 사경찰활동 중 탐정제도의 도입 가능성은 비교적 높은 것은 사실이다. 따라서 우리나라에서 공인탐정제도를 도입, 정착시키기 위해서는 우리에게 맞는 탐정제도를 찾아야 한다. 본 연구에서는 공경찰활동과 사경찰활동의 개념, 외국의 사례, 그리고 제도 도입시 반드시 고려하여야 하는 공인탐정제도의 본질 등에 관한 논의를 하면서, 외국의 제도를 무조건적으로 도입하는 것이 아니라 우리의 현실에 맞는 사경찰활동의 개념을 재정림하고 이에 따른 탐정제도의 도입에 관한 논의가 필요함을 기술하였다. Policing is composed of public policing and private policing. Private Investigation system is one of private policing system. In our country, We, Koreans are familiar with private security rather than definition of private policing. Also, our society have a cognition that private security and private policing have same meaning. But, private policing have a many sub-contents like as private security, private investigation, crime investigation, terrorism prevention etc in many foreign countries. That is to say, in foreign countries, public police and private police do a mostly same work exclusive of public characteristics work. Therefore, we must have deep consideration of private policing to fit our country"s systems and culture, especially private investigation of private policing. And we must have re -consider definition and role of private investigation.
