사업장 단위 복수노조제도는 작업장을 어떻게 변화시키는가?: 소수노조의 집합적 무임승차를 중심으로

This paper deals with how the multiple union system at workplace level implemented in July 2011 changed the workplace. The competition of multiple unions in one workplace was a whole new thing that workers and managements in Korean society have not experienced. In general, two important things to protect workers’ rights are unions and labor laws. In this respect, the multiple union system at workplace level was a change in the law on unions to protect workers' rights. What changes did the institutional amendment bring to the workplace? This study seeks the answers to the question by analyzing the actual workings of the multiple union system at the workplace level focusing on the workers’ experiences. Through participant observation field research at university facilities management service workplace, this study observed the following actual changes. Firstly, the second union, without the right to bargain, relied on sponsors for the survival and maintenance of the organization and pursued a strategy of free riding on the first union’s performance. Secondly, minority unions have shown atypical non-standard workers’ unions that emphasize the welfare of their members. Thirdly, the conflict between the two unions in one workplace deteriorated. Based on these observations, this paper points out that the irony of multiple union system at workplace level. The system, which was supposed to contribute to the securing of labor rights by guaranteeing freedom of association and establishment of labor unions based on the free will of the workers, actually brought about the fragmentation of labor and deepening of conflict. 이 논문은 2011년 7월 1일 시행된 사업장 단위 복수노조제도가 작업장을어떻게 변화시켰는지에 대해서 다룬다. 하나의 작업장에서 동일한 조직대상을 두고 벌이는 복수의 노동조합 병존과 경쟁은 이전까지 한국 사회의 노동자와 사용자들이 경험해보지 못한 전혀 새로운 형태의 ‘도전’이었다. 일반적으로 노동자의 권리 보호에 중요한 2가지 제도적 기반은 ‘노동조합’과 ‘노동법’으로 여겨진다. 이 점에서 2011년 7월 시행된 사업장 단위 복수노조제도는 노동자의 권리보호를 위한 하나의 기반인 노동법을 통해 노동자의 권리보호를 위한 또 하나의 기반인 노동조합의 조직형태의 변경이 가능해지는 계기라고 볼 수 있다. 그렇다면, 노조 설립 및 노조 가입의 자유를 보장한 사업장단위 복수제도는 작업장에 어떤 변화를 가져왔는가? 이 연구는 이러한 문제의식에 기반하여 사업장 단위 복수노조 제도 시행 이후 복수노조가 설립된대학 시설관리서비스산업의 간접고용 비정규직 작업장에서 참여관찰 연구를수행하였다. 연구 결과, 교섭권을 확보하지 못한 신생 노조는 조직의 생존과유지를 위해 사측과 상급단체 등의 뒷배를 갈아타면서 기존 노조의 투쟁 성과에 집합적 무임승차를 전개하는 전략을 추구하였다. 신생 소수노조는 이를통해 조합원의 복지를 강조하는 비정형적인 비정규직 노조의 모습을 보여주었고, 작업장에서는 노・노 갈등이 심화되었다. 이러한 관찰을 통해 이 논문은노동자의 자유로운 의사에 기반한 노조 설립 및 가입의 자유가 보장됨으로써 노동의 권리 확보에 기여할 것으로 기대되었던 복수노조 제도가 실제 작업장에서는 노동의 분열과 갈등의 심화를 가져오는 일종의 역설을 보여주고 있음을 지적한다.
사업장 단위 복수노조 형성에 관한 연구: 간접고용 비정규직 작업장에서의 ‘불만족의 삼각동맹’ 형성과정을 중심으로

In July 2011, the multiple union system at the workplace level was implemented in South Korea. How are multiple unions formed in the workplace? The emergence of external changes of law does not necessarily mean that new unions are established at the workplace. Previous studies have pointed out that fragmentation of existing unions was the most important factor when multiple unions were coexisting at the workplace level. Based on the findings of previous studies, this study explores the fragmentation process of existing union as a prerequisite for the formation of multiple union system at the workplace level through participant observation in a facilities management service workplace in ‘University A’. This study analyzes the process of union demarcation by dividing it into cleavage from the inside of the union and threats from outside the union. This study analyzes the formation of ‘dissatisfied triangular alliance’, paying attention to the process of combining internal cleavage with external threats. Workplace actors who are dissatisfied with existing unions have united to resolve their dissatisfaction. This paper examines the linkage between causes for dissatisfaction of each actor and incentives to establish a new union as a way to overcome dissatisfaction. Finally, it analyzes implications for the formation of multiple union system in indirectly employed non-standard workers’ workplace. 2011년 7월, 사업장 단위에서 여러 개의 노조가 병존 가능한 복수노조제도가 시행되었다. 그렇다면, 사업장 단위 복수노조는 어떻게 형성되는가? ‘복수노조제도’라는 외부적 환경 변화가 시작되었다고 해서 작업장 내 기존노조와는 다른 성격의 새로운 노동조합이 자연스럽게 설립되는 것은 아니다. 복수노조제도 시행 이후 작업장에서 2개 이상의 복수노조가 병존하는 경우, 기존 한 개의 노동조합이 두 개 이상으로 분열되는 경우가 가장 많다는 기존연구들의 검토를 배경으로 이 연구는 사업장 단위 복수노조 형성의 전제조건으로써의 기존노조의 분열 과정을 분석한다. 이를 위해 서울 소재 A대학의 간접고용 청소·경비 부문의 시설관리서비스작업장에서 참여관찰을 수행하였다. 이 연구는 원청-하청용역회사-노동자로 이루어져있는 3단계의 작업장의 사회적 관계구조 속에서 노조의 분열을 노조 내부로부터의 균열과 노조 외부로부터의 위협으로 나누어 검토하며, 노동조합 분열과 신생노조 설립의 결정적 조건으로써 내부 균열과 외부 위협이 결합한 작업장 행위자들의 ‘불만족의 삼각동맹’을 분석한다. 기존노조에 대해 불만족한 노동자, 불만족한 용역회사, 불만족한 원청 세 행위자는 각자의 불만족의 원인을 타개하기 위하여 연합하였고, 이 동맹은 복수노조제도 시행과 맞물려 작업장에서 기존노조의 분열과 신생노조의 설립 배경으로 작용하였다. 이 연구는 작업장에서 ‘불만족의 삼각동맹’의 각 행위자들의 기존노조에 대한 불만족의 원인과 불만족을 타개하기 위한 방법으로써 신생노조의 설립 유인이 어떻게 연결되어있는가를 검토하면서, 간접고용 비정규직 작업장에서의 복수노조체제 형성에 대한 함의를 분석한다.

Intravesical Stone Formation around a Hem-O-Lok Clip after Laparoscopic Radical Prostatectomy

We report a case of a bladder stone that formed on a Hem-o-lok clip used to suture an urethrovesical anastomosis. A 65-year-old man presented with intermittent perineal pain, dysuria, and gross hematuria 4 years after laparoscopic radical prostatectomy for localized prostate cancer. Cystoscopy demonstrated a stone formed around a Hem-o-lok clip that had possibly eroded into the urethra. Ultrasonic lithotripsy of the bladder stone with endoscopic extraction of the Hem-o-lok clip was performed.
서비스산업의 고객 주도형 노동조합 조직화 사례 대학 시설관리서비스작업장을 중심으로

이 논문은 대학 시설관리서비스작업장을 중심으로 간접고용 상태인 고령의 노동자들이 어떻게 성공적으로 노동조합을 결성하고 활동을 전개해나갔는지에 대해 분석한다. 이 연구는 비정규직 노동운동의 성공과 지속은 ‘연대’에 달려 있다는 기존 연구들의관찰을 배경으로, 해당 산업의 특성을 고려한 복합적 조직의 현장의 관점에서 어떠한형태의 연대가 시설관리서비스산업의 조직화에 효과적인지를 검토한다. 연구 결과, 대학 시설관리서비스산업의 비정규직 노동자들은 서비스의 고객인 학생들의 주도와 연대를 통해 노동조합을 성공적으로 조직화하고 활동을 전개할 수 있었다. 서비스 수혜자인 고객과 서비스 제공자인 노동자들의 연대가 가능했던 요인은 첫째, 노동자들의 노동공간과 고객들의 생활공간이 일치했다는 점, 둘째, 고객들의 지지가 사용자를 움직이는압력으로 작용했다는 점을 지적할 수 있다. 노동과 자본의 양자관계에 주로 초점이 맞추어졌던 기존 비정규직 노동운동 연구와는 달리 이 논문은 서비스산업 분야의 중요한행위자인 고객이 노동자들의 노동조건 향상에 결정적인 역할을 할 수 있는 가능성을 발견해냈다는 의의가 있다. 이 연구에서 살펴본 대학 시설관리서비스작업장의 고객 주도형 조직화 사례는 해당 산업 특성과 그에 따른 행위자 관계 분석을 통해 서비스산업 비정규직 조직화를 위한 새로운 연합의 가능성을 제시하고 있다. This study deals with how aged workers in indirect employment relations organize their labor union and develop their labor movements. This research is based on the previous studies’ arguments that the success and continuity of non-standard workers’ labor movements are dependent on solidarity. It examines what kind of solidarity is effective in the facilities management service industry from the perspective of multi-organizational fields in social movement theories. This paper argues that non-standard workers in the university facilities management service industry could organize their union through solidarity with students who are the customers of the services provided by the workers. Through the customer-driven organizing and participation, the union has effectively developed various struggles. The reasons for the solidarity between customers and workers in the movements are as follows. First, the worker’s work space coincides with the customer’s living space. Second, customers’ support has acted as pressure to move employers. Contrary to the previous studies that focused on the bilateral labor-capital relations, this paper argues that customers who are the important actors in service industry can play a decisive role in improving workers’ working conditions. Consequently, this study suggests a new solidarity model for the organizing of non-standard workers in the service industry by focusing on the characteristics and actor relationships of the industry.
