Planarization of Wafer Edge Profile in Chemical Mechanical Polishing

Within wafer non-uniformity (WIWNU), which significantly affects the yield of chip products, is mainly caused by non-uniform chemical mechanical polishing (CMP) at the wafer’s edge. This study investigates the origins of the non-uniformity and presents a process that uses an edge profile control ring (EPC ring) to solve the problem. The EPC ring is designed to be positioned between the wafer and the retaining ring and pressed at the same pressure as the wafer by a flexible membrane to reduce the pressure discontinuity between the center region and the edge region of the wafer. Experimental results show that for a WIWNU of 2%, the EPC ring makes it possible to shrink the edge exclusion region from 15 mm to 2 mm without any change in process conditions. This result suggests that the EPC ring is applicable to real fabrication.
공인의 정치적 이념에 대한 표현과 명예훼손 -대법원 2018. 10. 30. 선고 2014다61654 전원합의체 판결-

대법원 2018. 10. 30. 선고 2014다61654 전원합의체 판결(이하 ‘대상판결’)에서 다수의견은 ‘종북’, ‘주사파’, ‘경기동부연합’이라는 표현 중 ‘종북’, ‘주사파’는 의견표명에 해당할 여지가 있다고 판단하였다. 또한 위 표현들이 공인의 정치적 이념에 관하여 사용되는 경우에는 구체적 정황의 제시만으로도 위법성이 조각될 수 있다고 설시하였다. 다수의견의 태도는 위 표현들이 명예훼손에 해당할 수 있다고 본 종전 대법원 판례들과는 대비된다. 한편 반대의견은 대법원의 종전 입장에 따라 ‘종북’, ‘주사파’, ‘경기동부연합’이라는 표현을 사용하여 공인의 정치적 이념을 평가하는 경우 명예훼손이 성립한다고 보았다. 반대의견과 다수의견은 명예훼손의 구성요건 및 위법성 판단은 민·형사상 동일하다는 전제를 공유하면서도 상반된 결론을 도출하였는데, 이러한 입장 차는 명예훼손의 구성요건 및 위법성 판단기준을 다르게 적용하는 데에서 기인한다. 구성요건 단계에서는 ‘종북’, ‘주사파’가 사실 적시와 의견 표명 중 어디에 해당하는지 문제된다. 사실 적시 여부는 검증가능성을 중심으로 한 2단계 심사방법에 따라 판단하는 것이 적절하다. 먼저 어휘의 통상적 의미와 문구의 연결방법 등을 고려하여 진술의 객관적 의미를 확정하고, 이어서 검증가능성을 중심으로 진술의 성격을 확정한다. 대상판결에서 드러나는 ‘종북’, ‘주사파’의 객관적 의미는 “주체사상을 신봉하고 대한민국의 정체성과 정통성을 부정하는 반사회세력”에 가깝다. 위 표현들은 검증 가능한 표현이기 때문에 사실 적시로 보아야 한다. 따라서 위 표현들을 의견표명으로 본 다수의견의 판단은 부당하다. 다음으로 위 세 가지 표현의 위법성이 조각될 수 있는지 문제된다. 공인의 정치적 이념에 관하여 구체적 정황의 제시가 있는 사실의 적시는 위법하지 않다는 상당성 법리를 어느 수준에서 적용할 것인지 여부가 쟁점이었다. 다수의견은 ‘종북’ 등의 표현에 대하여 공인의 정치적 이념에 관한 여타의 표현들과 동일한 수준에서 상당성 법리를 적용하였다. 반면에 반대의견은 ‘종북’ 등의 표현이 소수자를 정치적으로 배제하는 효과를 초래할 수 있으므로, 다른 표현들에 비하여 더 높은 수준의 구체적 정황의 제시를 요구하였다. ‘종북’ 등의 표현이 한국 사회에서 가지는 특수한 효과를 인정하더라도, 법리적 측면에서 이러한 표현들을 차별적으로 취급하는 것은 정당화 될 수 없다. 결과적으로 다수의견이 타당하지만 구체적 정황의 제시가 어느 정도 수준으로 이루어져야 하는지 명확하게 설시하지 못한 아쉬움이 있다. 대상판결에서 다수의견은 ‘종북’, ‘주사파’를 의견 표명으로 판단한 오류가 있으나 결론에 있어서는 타당하다. 그렇지만 공인의 정치적 이념에 관한 표현의 명예훼손 여부를 판단하는 과정은 민주주의 사회를 떠받치는 두 기본권인 표현의 자유와 개인의 인격권 사이에서 이루어지는 만큼 보다 엄밀하고 정치하게 논증될 필요가 있다. According to the Supreme Court en banc decision 2014Da61654 decided October 30, 2018 (hereinafter ‘the case’), the majority opinion held that there exists room to construe the first two among the terms “pro-North Korea”, “North Korea sympathizer” and “Eastern Gyeonggi Coalition” as an assertion of opinion, not a statement of fact. The majority also ruled that using these terms pertaining to a public figure’s political ideology can be justified by presenting concrete circumstances. This judgment is in contrast with the Supreme Court’s previous decisions that the above-mentioned expressions do constitute tort. On the other hand, the dissenting opinion maintained the Supreme Court’s previous ruling. Although the dissent and the majority share the premise that the elements of defamation and judgments on its illegality in civil cases should be the same as those in criminal cases, the dissent’s conclusions are clearly different from the majority’s. This is because the standards that the two opinions applied in determining whether the above criteria are met in the case are unalike. First and foremost, the question arises as to which category the terms “pro-North Korea” and “North Korea sympathizer” fall into, facts or opinions. A distinction can be reasonably made through a two-step approach: first, to confirm the objective meaning of the term considering its ordinary meaning and context, and second, to determine its category based on verifiability. The objective meaning of the two terms in the case would be comprehended as “the antisocial force that believes in Juche Ideology and denies the legitimacy of Republic of Korea.” Then, the terms would be facts because of their verifiability. Thus, the majority’s conclusion that the terms were categorized as opinions is inappropriate. The next question follows as to whether the three terms are legally justifiable. As it turned out in the case, there are conflicting views on the degree to which “Reasonable Belief in Truth Standard” is applied, where an expression on a public figure’s ideology is justified when concrete circumstances are presented with the expression. The majority applied the standard at the same level as the other expressions pertaining to a public figure’s political ideology. On the contrary, the dissent reasoned that the above-mentioned expressions deserve less protection as they exclude political minorities from democratic discourse, and thus stricter standard is required. However, giving certain other expressions preferential treatment cannot be justified under legal grounds, hence the majority opinion stands valid. Nonetheless, there also exist limits as the majority failed to specify the extent to which concrete circumstances should be presented in order to justify the expressive act. In sum, the majority opinion is partially inaccurate in the process of reasoning, but is valid in its conclusion. Yet the process of determining defamation requires more precise and delicate demonstration, as it is done by balancing between the two basic rights that support our democratic society: freedom of speech and personal rights of an individual.
