오늘날 장기이식은 보편적인 치료수단 중의 하나이다. 그러나 장기이식의 보편화는 기술적 가능성의 문제와는 다른 차원의 새로운 윤리적 문제를 야기한다. 이 글은 이런 문제상황에서 어떤 윤리적 원칙을 적용시킬 것인가를 논구한 것이다. 전통적으로 신체를 대상으로 하는 의료행위에서 자명한 하나의 윤리적 원칙으로서 제시되어 온 것에는 "전체성의 원리"와 "이중결과의 원리"가 있다. 이 두 원리는 토마스 아퀴나스 이후 그리스도교 윤리신학의 주요원리로서 논쟁되어 왔지만, 20세기 중반 이후 장기이식이 가능해짐으로써 또한 장기이식의 도덕적 정당성을 입증하기 위한 토대로서 활용되고 있다. 다른 한편으로 장기이식은 기증자와 수혜자, 의사 3자간의 문제이고, 3자간에는 반드시 자율적인 의사소통과 자발적인 "동의"가 필요하다. 그것은 당사자의 권리를 존중해 주기 위함이다. 동의와 관련하여 두 개의 문제상황이 설정되는데, 곧 "충분한 설명에 근거한 동의"와 "추정동의"가 그것이다. 앞의 문제상황과 관련해서는 동의의 필요충분조건을 논의하였고, 뒤의 문제상황과 관련해서는 추정동의를 받아들이기 위한 윤리적 원칙들을 논의하였다.이상의 논의에서 장기이식이 정당화될 수 있는 도덕적 토대를 논증하였고, 장기이식의 윤리적 정당화는 거꾸로 근대과학기술에 대한 오해와 인습적 편견을 시정하고 "윤리적 지평"을 확대하는데도 기여할 것으로 판단하였다. Organ transplantation has been already used to be an available therapeutic means. But in spite of it's usefulness, it also brings about some problems that we should answer: First, an extracting an organ from one's body gives rise to a directly his/her dying, or at least the probability of dying. Second living needs are often confronted with dead interests in the grafting situation. Such problems are answered by an ethical argument. “The principle of totality” and “the principle of double effect” have been regarded to be the principle that can justify an experiment to make body a medical object. I have discussed that these principles can be also applied the ethical criteria of an organ transplantation to be allowed or not. Another principle that can be applied in the situation of organ transplantation is “consent”, which is the legal criteria to be able to transplant organs. In the legal viewpoint, two kinds of consent, namely informed consent and presumed consent are problematic. I have discussed that the necessary-sufficient condition of being allowed the consent in reference to informed consent and the ethical principle that can justify the proxy agents in reference to presumed consent. An ethical justification of organ transplantation requires also the development of the modern medical science and the honest understanding of it, the overthrow of the intolerant convention and the revolution of the ethical mind.
