      • WIPO의 전통지식 등의 지재권 설정 논의에 관한 개략적 방안 모색

        The international government committee is progressing their agreements about intellectual property protection of traditional knowledge(TK1, gene resource(GR), folklore(FL) in WIPO. It is in the course of selection with precedence of TK, GR, FL in WIPO, focused on discussions about listing of TK documents, standardization of DB construction, sharing and profit distribution of GR. There are disagreements between developed countries and developing countries about intellectual property protection agreements of TK, GR. The developed countries insist on using the existing intellectual property protection, but the developing countries ask new ones on character of TK, GR. It causes intangible assets to be valuable trade properties in future world trade. This research Groped for a summary program about intellectual property protection of traditional knowledge(TK) etc. debating in WIPO. This program confirms that such as TK, GR etc. not only to be the cultural property accumulated in human history, but also to be the original resource may be using at present. Therefore, we suggest that the focus of discussion should transfer to UNESCO instead of WIPO which only deal with the intellectual property protection. Besides, the main body which protecting and supporting TK should become its holding organization so as to achieve more effective management about it. In order to protect and support TK, the government should have firstly the recognition that TK is the property belongs to the country. By this viewpoint, it needs to setup DB through overall excavation of the unofficial knowledges in order to protect and support these TK, GR. Because the positive dealing with those WIPO's discussion means to support our TK, GR, so there should have some reorganization about existing related ones, and also needs systemic supporting policies & management system.

        補益藥의 補血機轉에 對한 本草學的 解釋

        Hematopoietic actions induced by administration of Astragali radix, Angelicae gigantis radix, Rehmanniae radix preparat and Cervi pantotrichum cornu were compared in SAM R1 and P6. We measured complete blood cells such as RBC, Hb and Hct using Coulter's method and compared the results each other in a view of traditional Korean medicine. The administration of Angelicae gigantis radix did not induce hernatopoietic actions in SAMs and also was quite different those from the other 3 herbs. Thus, the mechanisms of the hematopoietic action by Astragali radix, Angelicae gigantis radix, Rehmanniae radix preparat and Cervi pantotrichum cornu could be different each other.

      • 물류전자문서교환방식(EDI)이 국제물류업무개선 효과에 미치는 영향에 관한 실증연구

        물류EDI의 활용율에 영향을 미치는 요인들을 분석한 실증연구결과는 다음과 같다. 첫째, 경영자가 국제물류비용에 큰 관심을 갖고 체계적으로 국제물류비용을 관리하는 수출기업에서 물류EDI의 활용율이 높게 나타났다. 둘째, 물류EDI시스템을 구축하기 위해서는 전산시스템에 많은 투자를 하여야 되기 때문에 전산시스템에 대한 투자금액이 많은 수출기업일수록 물류EDI의 활용율이 높게 나타나기 마련이다. 그러나 우리나라 기업의 대부분이 1990년에서 2001년 사이에 기업활동에 관련된 전산시스템에 투자를 하였기 때문에 전산시스템에 대한 투자금액과 물류EDI의 활용율간에 유의적인 차이가 없는 것으로 나타났다. 셋째, 물류EDI에 대한 교육투자가 많은 수출기업에서 물류EDI의 활용율이 높은 것으로 나타났다. 넷째, 수출기업과, 운송회사, 창고, 포장, 내륙컨테이너기지, 하역, 운송주선인, 내륙운송회사, 통관회사, 보세운송회사, 항만간에 국제물류과정에서 정보를 서로 공유하는 정도가 높은 경우에 물류E야의 활용율이 높은 것으로 나타났다. 여섯째, 수출기업과 포워더, 선박대리점, 내륙컨테이너기지, 검수/검량회사, 사설컨테이너야드, 보세장치장, 하역회사, 터미널, 검역소, 해운항만청, 철도청, 관세청, 통관회사간의 고객의식이 높으면 고객요구를 만족시키기 위해서 물류EDI를 이용할 것으로 보았으나 본 연구결과는 유의적인 차이가 없는 것으로 나타났다. 일곱째, 물류EDI를 활용한 수출기업에서 국제물류비용이 크게 감소하여 물류E야가 국제물류 업무를 개선시키는데 중요한 역할을 하고 있는 것으로 분석되었다. The logistics electronic data interchange means the electronic transfer from computer to computer of information, documents an agreed standard among export business firms, marin transportation company, cargo handling, freight forwarder, local transportation company, port authority, air cargo terminal, customs clearance company, container terminal, container yard, container on flat car, bonded transportation company, warehouse. The logistics electronic data interchange can manage the international physical distribution activities and relationship internally within korean export business firms and externally within marin transportation company, cargo handling, freight forwarder, local transportation company, port authority, air cargo terminal, customs clearance company, container terminal, container yard, container on flat car, bonded transportation company, warehouse. The major purpose of this dissertation are to investigate the relationship between the logistics electronic data interchange and the international logistics process improvement. For these purpose, a theoretical model is designed as descriptive forms and three hypotheses are tested with the data collected from 380 korean export business firms. As a result of this research, the following are claimed. First, The more international logistics cost-oriented the Korean export business firms are the higher the utilization degree of logistics electronic data interchange, to improve the export business firm's international logistics cost, Korean export business firms should manage them with logistics electronic data interchange. Second, the more education of logistics electronic data interchange-oriented are the higher the utilization degree of logistics electronic data interchange, to manage the international logistics cost by logistics electronic data interchange, Korean export business fins must educate logistics electronic data interchange continuously. Fourth, the information share-oriented of Korean export business fines, mann transportation company, cargo handling, freight forwarder, local transportation company, port authority, air cargo terminal, customs clearance company, container terminal, container yard, container on flat car, bonded transportation company, warehouse are the higher the utilization degree of logistics electronic data interchange. Fifth, the more relationship of logistics process of Korean export business firms, mann transportation company, cargo handling, freight forwarder, local transportation company, port authority, air cargo terminal, customs clearance company, container terminal, container yard, container on flat car, bonded transportation company, warehouse are the higher the utilization degree of logistics electronic data interchange. Sixth, the utilization rate of logistics electronic data interchange have a good effect on the improvement of the international logistics process.

        스위치 선하증권과 공선하증권을 이용한 중계무역거래에서 적하보험자의 대위권 청구 당사자에 관한 연구

        Purpose This study analyzes the Supreme Court precedent and research the relationship of subrogation rights of cargo insurers to sea carriers based on responsibility for issuing bills of lading and responsibility for transporting, unloading, storing, and delivery of cargo. Design/Methodology/Approach This study performed a literature review and analysis of Korean Supreme Court Decision 2018Da249018 decided on June 11, 2020. Findings The results of this study are as follows. First, if the sea carrier is the employer or agent of the sea carrier who issued the first bill of lading or is entrusted with the authority to issue the bill of lading, he is subject to the subrogation right of the cargo insurer. Second, the issuer of the validity bill of lading is not responsible for transporting, unloading, loading, storage, and delivery of the transport cargo and is not subject to the subrogation right of the cargo insurer. Third, if the issuer of the validity bill of lading is liable for unloading, loading, storage, and delivery from the time the ship enters the port of arrival due to the employer, agent, subcontractor, or shipper of the first bill of lading, he is subject to the subrogation right of the cargo insurer. Research Implications T he party to the claim for subrogation of the cargo insurer means all parties, including sea transport, except the insured, policy holder, and insurer, who are liable for damages to the insured in the same manner as the shipper’s right to claim damages to the sea carrier. In transit trade transactions in which a single cargo is transported on a single route, switch bills of lading cannot be issued due to the trade transaction structure. Nevertheless, when a switch bill of lading is issued, it becomes a validity bill of lading and becomes an illegally issued bill of lading. When a bill of lading is issued, the party to the claim for subrogation of the cargo insurer shall determine whether the party in charge of unloading, loading, storage, and delivery of cargo after its arrival at port is subject to thell of lading should not be regarded as a bill of lading, but as a cargo reimbursement certificate necessary for land transportation in the area where the ship arrives

        선박보험에서 담보(warranty)의 법리적 해석에 관한 연구

        담보특약 위반에 따른 보험자의 책임면제를 인정한 대법원 판례와 담보특약 위반에도 불구하고 보험자의 보험금지급의무가 있다는 대법원 판례를 분석하여 대법원 판결의 문제점을 준거법 기준의 법리적 해석, 국제사법 제7조와 10조의 법리적 해석, 국제사법 제15조 4항과 제27조의 법리적 해석, 선박보험증권에 명시된 준거약관의 법리적 해석, 담보특약의 법리적 해석, 담보특약관 약관의 구분에 대한 법리적 해석, 담보특약 위반의 법적효과 설명에 관한 법리적 해석, 선박의 안전한 항해에 관련된 담보특약의 법리적 해석으로 제시하였다. 대법원 판결의 시사점으로는 선박보험 준거법 약관의 법리적 근거, 담보특약에 관한 입법화의 필요성, 제3자의 이익보호, 선박의 안전한 항해에 대한 담보특약 피보험자의 담보특약 위반의 법적효력에 관한 피보험자의 설명의무로 제시하였다. The “Warranty” under the English Marine Insurance Act is a legal principle that does not exist in the Korean Commercial Act. If the assured breachs the warranty, the insurer is absolved of responsibility for paying the claim amount even if there is no casual relation between the breach and the damage incurred. In korea, a 1996 supreme court decision regarding warranty of hull insurance found that the English governing law clause was valid, and subsequent supreme court ruling recognized the high level of strictness in applying the warranty clauses under the English governing law clause, which may result in the failure to protect the right of the assured, but in 2010, the supreme court held that the warranty clause under the hull insurance was a subject to the general clauses regulation act, the insurer has a duty to sufficiently explain the existence and legal effect of breach of the warranty clauses. The supreme court held that if the insurer fails to explain the legal effect of breach of warranty clause, the insurer must pay the claim amount. In 1996, the supreme court decision is reasonable and the supreme court’ precedents in 2010 shall be changed.

        국가 간 통관자료교환 대상국가 선정기준에 관한 연구

        After the World Trade Center attacks in New York by terrorist on September 11, 2001, the international Organization have actively developed a number of initiative focusing on logistic security issues. WCO developed a regime in order to enhance the security and facilitation of international trade, which was the WCO Framework of Standard to Secure and Facilitate Global Trade. The Countries have developed customs administrations and cargo information system by the standard of WCO. Customs Data between countries is be exchanged to order to enhance logistic security. Customs Data between countries is be implemented by needs of countries. Korea progressed demonstration project of Customs Data between countries with Malaysis, Belgium, Philippines, Russia and exchanged third two items of descriptions, quantity, weight electronically. The swap of Customs Data between countries is not effective because the Countries of Exchange of Customs Data between Countries is be elected without the principles and standards randomly. The criteria that select the Countries of Exchange of Customs Data between Countries proposed follows, Firstly, the major trading countries of korea. Second, Countries concluded FTA Agreements, Third, Countries for risk management. Fourth, Countries implemented advance presentation of cargo manifest. Fifth, Countries concluded AEO MRA, Sixth Countries implemented WCO Data Model, Seventh, Countries implemented UCR, Finally, Countries implemented Single Window. USA, Canada, Japan, China, England, Netherlands, Germany, Italy, Slovakia, Spain, Belgium is elected for the Countries of Exchange of Customs Data between Countries by above selection standard. 2001년 9·11 테러가 미국에서 발생한 이후에 물류보안에 관한 국제적 논의가 있었고 이를 통해 WCO는 세관의 상반된 목적을 달성하기 위해서 물류보안과 무역 간소화에 관한 국제기준을 채택하였다. 각국은 WCO의 국제기준에 의거 관세행정과 이를 수행하는 정보시스템을 정비하고 있고 물류보안을 강화하는 차원에서 국가 간에 통관자료를 교환하여 왔다. 국가 간의 통관자료의 교환은 국가 간에 필요에 의해서 이루어져 왔다. 우리나라도 2004년부터 말레이시아, 벨기에, 필리핀, 러시아와 국가 간 통관자료 시범사업을 진행하여 품명, 수량, 중량, 등 32개 항목에 대해 실시간으로 전자적 방식으로 자료를 교환하였다. 기준 없이 임의적으로 국가 간 통관자료 교환 대상 국가를 선정하였기 때문에 효과는 극히 미비하게 나타났다고 본다. 국가 간에 통관자료를 교환하는 목적은 다르다. 미국은 물류시설을 이용한 테러를 방지하는 목적이 무역관리 목적보다 우선하고 우리나라는 무역지원과 위험화물수입 방지의 목적이 테러방지 보다 우선한다. 따라서 우리나라의 입장에서 국가 간 통관자료를 교환하는 대상 국가를 선정하는 지표를 주요 무역 대상국가, 위험관리, FTA협정 체결국가, 사전 적하목록제도 시행국가, AEO MRA체결국가, WCO Data Model도입국가, UCR도입국가, Single Window도입국가로 선정하였고 이 지표를 충족시키는 빈도수에 따라 국가 간 통관자료 교환 대상국가 선정하였다. 미국과 네덜란드가 국가 간 통관자료 교환 대상국가 선정지표 중에서 7개 지표를 충족시켰고 중국, 독일, 영국, 캐나다, 이탈리아가 6개 지표를 충족시켰으며 호주, 벨기에는 5개 지표를, 일본, 슬로바키아, 프랑스, 스페인는 4개 지표를 충족시켰다. 따라서 4개에서 7개 지표를 충족시킨 국가를 국가 간 통관자료 교환 대상국가로 선정하였다.

        반사형 타원계를 이용한 러빙된 Polyimide 배향막의 초미세 광학 이방성 정밀 측정

        기층의 잔류 이방성에 영향을 받지 않고 러빙된 폴리이미드 배향막의 초미세 광학 이방성을 정밀하게 측정할 수 있는 반사형 타원계를 개발하고 러빙의 세기를 달리하여 제작한 배향막의 광학이방성을 이 반사형 타원계를 사용하여 측정, 분석하였다. 투과형 타원계를 사용하여 측정한 리타데이션과 비교하여 개발된 반사형 타원계의 신뢰도 및 광학 이방성의 측정 재현성을 확인하고 배향막의 형성 여부와 배향막의 형성정도를 정량적으로 평가하였다 We developed a reflection ellipsometer so that one can measure the extremely small optical anisotropy of a rubbed polyimide alignment layer, without being disturbed by the residual anisotropy of the substrate. The optical anisotropy of the alignment layer was measured as rubbing strength was increased, and the measured anisotropy was compared to the retardation obtained by using a transmission-type ellipsometer, to confirm the reliability of our reflection ellipsometer. With this measured anisotropy we could verify the formation of an alignment layer by rubbing, and could quantitatively evaluate the formation of the alignment layer.
