      • 전자상거래시대의 제3자 물류 활성화 방안

        The third party logistics(3PL) is generally understood as the logistics activities providing a comprehensive logistics services, all or partly outsourced by the customers on a larger term contract basis, ranging from making logistics strategies to implementing information technology services. A lot of companies in advanced countries such as the U.S.A. or some of the European countries have actively outsourced to logistics service providers in efforts to increase the efficiencies in logistics operation rather than doing themselves. In light of these environments, outsourcing to third parties has become a strategic issue demanding greater attention in corporate boardrooms. First, after deciding their logistics outsourcing, the companies have to set up their aims of 3PL through the development of logistical strategies. Second, the companies must decide service provider that fits to their business environment and conditions. As it is reported that 3PL services will bring a high rate of return and its potential will be more signigicant, providers and users of 3PL services and government ministry should prepare the way of improvement of logistics institution and plan to activate 3PL services to reach the advanced foreign countries level.

        조각자의 항돌연변이(抗突然變異) 및 항산화(抗酸化) 활성(活性)에 관한 연구(硏究)

        Against the mutagen MNNG and NOPD with SOS chromotest, the antigenotoxic activity of MeOH-soluble extract was much more effective than that of the water-soluble one. When the extract was added to the certain concentration, the antigenotoxic acivity was enhanced. Against the mutagen NOPD with Ames test, the antimutagenic activity of MeOH-soluble extract was better than that of the water-soluble one. The 60.4% of the inhibition ratio for the revertant colony-forming unit was shown at 5 mg of MeOH-soluble extract per plate. Antimutagenecity test with SOS chromotest and Ames test were performed using water-soluble and MeOH-soluble extracts from of Gleditsia sinensis. The antioxidant activity of MeOH-soluble extract with the NBT method was higher than that of the water-soluble one.

      • WTO 전자상거래의 논의동향과 대응방안

        This paper is to analyzes the recent discussions in the WTO and to draw some basic policy implications for Korea concerning electronic commerce. To foster electronic transactions. the WTO agreement should establish a basic legal framework for international transactions to guarantee a stable and predictable environment. The member countries in the WTO, however, have not formed a consensus on the definition, classification, technological neutrality, and domestic regulations dealing with electronic commerce. Digital transfer and classifications of electronic transfer are the most difficult problems to be solved. The discussions on electronic commerce which had been on hold after the Seattle Ministerial is due to begin in a special working group of specialists. Electronic transactions in Korea have been increased rapidly and the implementation of concrete forms and rules of electronic commerce in the WTO will be influential to international trade as we to adopt them in the transactions. Therefore, we have to open our eyes to the trends of international discussions on this matter and to make our rules and laws of electronic commerce to the international levels.

      • 정보화시대의 e-물류 효율화방안

        This study is to understand basic knowledge on e-logistics through the analysis of third party logistics(3PL) as well as fourth party logistics(4PL) and to suggest some activation plans of e-logistics of information era to get competition in the field of international logistics. Compared with advanced countries, Korean companies has not activated 3PL logistics as Korean companies are not inclined to open their business information to others and they didn't recognize the importance of logistics. As the business environments are worsening little by little, there has been greater concerns for e-logistics as a way of focusing on the core-business. Most of Korean companies has outsourced simple and limited scope of 3PL and 4PL services with 1st level of logistics outsourcing. To activate e-logistics, Korean government and private enterprises have to pursue the following strategies. First, Korean government should change the present laws preventing the enterprises specialized in 3PL from doing business and should pursue logistics information and standardization. Also the government needs to support 3PL companies. Second, private companies do their best to retain and develope factors of logistics resources professional and to develope the latest technology. 3PL providers have pursue effective logistics strategies and to invest capitals for the information technology.

        무선 Ad hoc 네트워크의 지향성 통신 성능분석

        Ad hoc wireless networks operate without any infrastructure where a node can be a source and a router at the same time. This indispensably requires high throughput and low delay performance throughout the wireless network coverage span, particularly under heavy traffic conditions. Recent research on using multiple antennas in beam-forming or multiplexing modes over a wireless channel has shown promising results in terms of high throughput and low delay. Directional antennas have shown to increase spatial reuse by allowing multiple transmitters and receivers to communicate using. directional beams as long as they do not significantly interfere with each other. However directional antenna performance asymptotically approaches the omni-directional performance in a high density ad hoc network. Simulation results in QualNet validate that average throughput and packet corruption ratio of directional antenna approach omni-directional performance. Moreover, we further highlight some important issues pertaining to the directional antenna performance in wireless networks. Ad hoc 네트워크는 데이터 발신과 라우터 역할을 동시에 수행할 수 있는 노드들로 구성되며 특정한 네트워크 기반 구조의 지원 없이도 동작할 수 있는 장점을 지니고 있다. Ad hoc 네트워크에서는 무선 네트워크 상의 전체 전송영역에서 높은 처리율과 낮은 지연시간을 반드시 제공할 수 있어야 한다. 최근 들어 빔 생성(beam-forming) 방식이나 멀티플렉싱 방식의 다중안테나 (MIMO)를 이용하여 높은 처리율과 낮은 지연시간을 제공하기 위한 새로운 연구가 수행된 바 있으며, 이러한 연구 결과에 의해 송 수신자들이 서로간에 심각한 간섭을 일으키지 않는다면 다수의 송 수신자가 안테나의 지향성 빔을 이용하여 통신을 위한 공간 재사용 가능성을 높일 수 있음을 검증한바 있다. 그러나 Ad hoc 네트워크에서 노드 밀도가 증가하면 지향성 안테나의 성능은 무지향성 안테나의 성능과 유사하게 된다. 본 연구에서는 QualNet을 이용한 시뮬레이션을 통해 Ad hoc 네트워크 내의 노드 수가 크게 증가하면 지향성 안테나의 평균 처리량과 패킷 에러율이 무지향성 안테나의 성능에 점진적으로 근접한다는 사실을 증명하였으며, 무선네트워크에서 지향성 안테나 성능 개선을 위해 비중 있게 다루어야 할 중요 이슈들에 대해 자세히 기술하였다.

        e-Marketplace is a business concept which is importantly considered in the area of marketing. e-Marketplace provides the public field in which multi-purchasers can efficiently trade with multi-suppliers. Supply Chain Management(SCM) is being widely acknowledged by the development of information technology. SCM is well known as one of the key issues lately. The complexity of supply chains and the associated potential opportunities for gaining a competitive edge by designing a product and process to support supply chain management can be significant. In order to achieve successful implementation of supply chain management system, companies should understand some barriers in implementation and set up effective and integrated information system. Standardization of logistics is needed through the unification of EDI, Bar Code, Pallet and so on. It's effect is magnified on Efficient Consumer Response such as efficient store assortment, efficient replenishment, efficient promotion and efficient product introduction. International logistics management is the integration of key business processes from original suppliers to end user that provides products, services and information that add value for customers. e-Logistics is being used in managing the international logistics. In this study, three basic e-SCM models for the strategic implementation of supply chain management are suggested. Among them, the virtual company can be the best one we can develop in order to cope with the individualized customer needs.

        상품무역거래에서 해상운송인의 법적 책임

          국제상품무역거래에서 해상운송은 국적을 달리하는 이해관계자간의 섭외적 법률이기 때문에 이해 당사자들간에 분쟁이 발생할 경우 법적인 책임문제가 대두된다. 본 논문은 해상운송인의 책임원칙, 책임기간 및 책임제한에 대한 문제를 헤이그?비즈비 규칙(Hague-Visby Rules), 함부르크 규칙(Hamburg Rules) 및 우리나라 상법의 관점에서 비교하여 분석하였다. 해상운송인의 책임원칙에 대해 헤이그?비즈비 규칙은 운송물에 관한 주의의무와 감항능력주의의무를 채택하고 있고, 함부르크 규칙은 감항능력주의의무에 대한 명문규정이 없지만 상당한 주의의무가 있는 것으로 이해되고 우리 상법에서는 과실책임주의 원칙을 채택하고 있다. 책임기간에 대해 헤이그?비즈비 규칙은 선적에서 양륙시까지, 함부르크 규칙과 우리 상법은 송화인으로부터 운송물을 수령한 때부터 수화인에게 인도한 때까지로 규정하고 있다. 책임제한과 관련하여 항해과실과 상업과실로 구분하고 항해과실로 인하여 발생한 손해에 대해서는 해상운송인에게 책임을 부여하지 않고 상업과실로 인하여 발생한 손해에 대해서만 책임을 인정하고 있다.   The purpose of this paper is to explore the principles of liability, the duration of liability and the restrictions of liability of marine carrier which are specified in Hague-Visby Rules, Hamburg Rules and Korean Commercial Law, and to compare the differences among them.<BR>  Hague-Visby Rules stipulates that the carrier shall properly and carefully load, handle, stow, carry, keep, care for and discharge the goods carried. The carrier shall be bound before and at the beginning of the voyage to exercise due diligence to make the ship seaworthy and properly man, equip, and supply the ship. Whether loss or damage has resulted from unseaworthiness the burden of providing the excise of due diligence shall be on the carrier or other person claiming exemption. Hamburg Rules, however, do not stipulate the seaworthiness of the ship. But still Article 5(1) regulates the carrier is liable for loss resulting from loss of or damage to the goods as well as from delay in delivery, if the occurrence which caused the loss, damage or delay took place while the goods were in his charge.<BR>  The duration period of liability is continued from the time the goods are ready to be shipped to the time of unloading at the destination port in Hague-Visby Rules. Hamburg Rules and Korean commercial law guarantee the full period for his liability while the goods are under the custody of the carrier.<BR>  Under article of 4(2) of the Hague-Visby Rules, the carrier is not responsible for loss or damage due to the act, neglect, or default of the master, mariner, pilot or the servants in navigation or in the management of the ship. If carrier"s navigation fault causes damage directly to the cargo, the damage to cargo is not covered by a cargo insurance. For some disputes, it is difficult to judge whether they are navigation fault or commercial fault. Therefore, there is room for argument on that.

        한ㆍ중 FTA 농산물 협상의 주요 쟁점과 협상전략

        Korea and China had completed first-stage negotiations on the bilateral free trade agreement(FTA), setting foundations for more in-depth talks over mutual opening and liberalization. Both sides wrapped up the first-phase negotiations for the Korea-China FTA by agreeing on the modality(basic guidelines). The two countries agreed to abolish tariffs within a certain period of time on 90 percent of all products in terms of the number of items, and on 85 percent of imports in terms of their monetary value. Tariffs on normal items will be removed immediately or within 10 years after the implementation of the FTA, while those on sensitive products will be abolished within 10-20 years after the deal takes effect. Highly sensitive items, which will be excluded from tariff removal, took up 10 percent of the total in the first-stage talks. Economic cooperation, including government procurement and cooperation in industry and agricultural sectors, will be included in the second-stage negotiations. As the FTA agreement is expected to have negative effects on the Korean agriculture and fishery sectors, Korea needs to protect highly sensitive items in agriculture and fishery sectors in order to minimize negative economic effects in those areas. Some specific Korean negotiation strategies for agriculture and fishery sectors for the second-phase negotiations.

        국제물품매매협약(CISG)상 위험이전에 관한 연구

        Purpose The purpose of this study is to provide businessmen involved in international sale of goods with practical information and understanding of practical application about passing of risk by analyzing the provisions on the passing of risk of the CISG. Design/methodology/Approach This study defined the meaning of the risk and examined the relevant provisions of passing of risk under CISG. Findings The Chapter IV of the CISG deals with the passing of risk. Article 66 regulates that loss of or damage to the goods after the risk has passed to the buyer does not discharge the buyer from his obligation to pay the price. Article 67 regulates the passing of risk in the contract of sale involving carriage of the goods. If the seller does not have any obligation to hand the goods over at a particular place, the risk passes to the buyer when then goods are handed over to the first carrier. Article 68 regulates that the risk of the goods sold in transit passes to the buyer when the parties concerned conclude their contract of sale. Article 69 applies to the contract of sale which does not involve carriage of the goods. If the buyer has an obligation to take over goods at the seller’s premises, the risk passes to the buyer when he takes over the goods. Article 70 applies to the contract of sale that the seller commits a fundamental breach of contract. Research Implications By examining the passing of risk and analyzing some case studies for passing of risk, this study provided a guidance for clear understanding of the exact time of passing of risk unde CISG.
