국가계약법상 부정당업자 입찰참가자격제한제도 개선방안에 관한 연구

모든 공공기관과 조달기업은 빠르게 발전하는 정보기술 변화에 따라 입찰공고, 입찰, 계약, 대금지급 등 조달 프로세스 전 과정을 전자화한 국가종합전자조달 시스템을 이용하여 효율적인 조달 업무를 수행하고 있다. 공공시장의 조달규모는 국가 경제발전 및 정보화 증진에 따라 크게 향상되었다. 국내 조달시장은 중소기업의 지원 및 적극적인 참여를 유도하며 안정적인 성장추세에서 국가계약법의 기본 확립이 큰 역할을 수행하고 있다. 국내 공공 조달 시장은 국가계약법 을 근거로 하여 적용범위와 방식을 지정하고 있으며 그에 적합한 자의 입찰참가를 위해 부정당업자의 참가자격을 제한하고 있다. 이러한 조달시장의 근거가 되는 국가계약법에서 일부 제도적 문제점이 발견되었고 그 대표적 형태가 위헤서 언급한 부정당업자에 대한 입찰참가자격제한 제도이다. 기존의 선행된 연구들은 주로 법적인 관점에서 접근하고 있는 사례가 대부분이며 개선방안을 도출하였지만 법적인 관점에서 접근하여 실제로 방안을 적용하기에는 역부족이었다. 실제로 입찰참가자계제한 조치를 받았을 경우 어떠한 문제점이 발생을 하는지 실제사례를 분석하였다. 따라서 본 연구에서는 이러한 문제점을 최소화하고 중소기업을 중심으로 한 선진 조달 분화의 정착과 경쟁력 강화를 위해 현 입찰참가자격제한 제도의 한계를 인식하고 이에 대한 개선방안을 제시하고자 한다. 현조달시장 상황에서 중소기업이 차지하는 비율이 높은 만큼 중소기업의 입장에서 문제점을 도출하고 입찰참가자격제한 제재를 받았을 때의 공공기관을 중심으로 하는 중소기업들의 기업존폐의 위험을 재해석하여 개선방안을 도출할 수 있도록 노력하였다. All the public institutions and procurement agencies supply effective relevant businesses using digitalized on-line E-procurement system for the whole course of procurement process including notice of tendor , bid , contract , provision of payment and so on according to the fast developing change of information technology. Public market s supply scale improved greatly following national economic development and informatization enhancement. Domestic public procurement market is performing a big role about establishing basis of national contract law in stable growing trend by supporting small businesses and inducing active participation. Domestic public procurement market is desiganting a range of application and ways found on the National contract law and is limiting illegal traders of qualification for the participation of a person who s suitable for the law. Part of institutional problems are found in the National contract law which is basis of this kind of procurement market and the typical form of it is the system of limitation of eligibility for participation in bidding mentioned above. Existing preceded studies are mostly approaching in the viewpoint of legal basis and drew improvement plan, but it was beyond its capacity to apply the plan in reality. Analysis about real cases was made to find out what problem occurs when receiving measures of limitation of eligibility for participation in bidding. So in this study, we are going to give ways to minimize these problems and to give improvment plans for the advanced procurement culture and reinforcement of competitiveness with the samll businesses as its center, understanding the limitation of current limitation of eligibility for participation in bidding system . Since the proportion of small businesses taking possesion in current procurement market is high, we ve done our best to find out problems from the point of view of small businesses, and have tried hard to find improvement plans by reinterpreting danger of samll businesses going bankrupt mainly based on the public institutions when they get restriction from the limitation of eligibility for participation in bidding.

위성의 전력계, 질량, 비용 등과 같은 형상 요소들의 개략적인 제원 도출은 본격적인 위성개발 전 반드시 수행되어야 할 중요한 과정이다. 본 논문에서는 최근 개발된 국내외 위성 개념설계 도구들의 주요한 특징들을 조사하고, 이를 바탕으로 초기 개념설계 절차를 정리하였다. 위성 개념설계는 탑재체와 임무에 근거하여 필요한 전력을 추정하고 위성운용에 필요한 태양전지판과 배터리와 같은 전력계를 추정한다. 다음으로 기존 위성들의 데이터베이스를 기반으로 탑재체질량에 따른 전체 위성 및 주요 서브시스템의 질량을 결정한다. 비용 역시 복잡한 계산 없이 기존 위성들의 데이터베이스를 바탕으로 대략적인 추정이 가능하다. Design sketch of electrical power system, mass, and cost of a new satellite is an inevitable step preceding the full-scale development of the satellite. In this paper, major features of recently developed conceptual design tools of satellites are investigated. And, based on the surveying results, we summarize the conceptual design procedure of satellites. The required electrical power to support the operation of the payload mission determines the size of solar panel and battery. The mass of the integrated system and subsystems is then estimated based on the database of the previously developed satellites. Cost can also be roughly estimated using the database without consideration of complex calculations.
