        건물하자 원인분석 및 예방대책에 한 연구

        우리나라는 경제가 지속적으로 발전하면서 부동산 건물의 개발과 이용이 활발하게 이루어지고 있으며 다양한 부동산 건물의 공급이 확대되고 있다. 부동산 건물에 대한 커다란 관심과 함께 국민들의 건설 관련 지식수준이 향상되고 있는 실정이다. 건설 관련 분쟁에 종사하는 전문가들이 많아지면서, 건설 관련 소송이 차지하는 비율이 점차 높아지고 있으며, 그중에 많은 부분이 건물 하자와 관련된 것이다. 하자는 당사자가 예기한 상태나 성질이 결여되어 있는 것으로, 건설 기술이 비약적으로 발전하고 있는 이 시점에도 재래형 하자가 반복적으로 발생하고 있는데, 균열, 결로, 타일탈락 등은 대부분의 건물에서 발생하고 있어서 소송의 원인이 되고 있다. 본 논문에서는 실제로 소송이 진행되었던 사건의 사례 조사를 통하여 하자의 종류 및 원인에 대하여 분석하고, 국내 최고의 전문가들의 면담과 건설 관련 전문서적등 문헌연구를 통하여 예방대책을 수집하고자 한다. 연구결과는 반복적으로 발생하는 하자 예방 및 건설소송 감소에 기여할 수 있을 것으로 사료된다.

        건설관련 소송에 따른 법원 감정 시 건설비 단가 적용에 관한 연구

        오늘날 부동산 건설 환경은 급변하고 있으며, 감정에 관한 환경 역시 변화의 중심에 있다. 부동산환경에 능동적으로 대응하고 자율성을 발휘하기 위하여 감정의 전문성이 요구된다. 근래에 국민들의 건설관련 지식수준이 향상되고, 건설 관련 분쟁에 관심을 가지면서 이를 위한 전문가들이 많아지면서, 건설관련 소송이 차지하는 비율이 점차 높아지고 있다. 대부분의 건설관련 소송에서 건설 전문가에 의한 감정은 필수적이다. 감정결과가 중요한 증거방법이 되어 재판결과에 커다란 영향을 미침에도 불구하고, 건설 감정 공사비 산출 시의 단가 적용에 있어 표준 품제과 실적공사비 적용에 많은 문제점이 내포되어 있고, 소송 당사자들이 만족도는 낮은 편이다. 본 연구에서는 관련 문헌조사, 서울 중앙 지방법원 건설감정인 실무연수자료, 건설감정전문가 면담 등 실증 분석을 통하여 개선방향을 연구하였다. 1. CONTENTS (1) RESEARCH OBJECTIVES The purpose of this research is solution of pricing for construction appraisal (2) RESEARCH METHOD Researching literature and interviews expert and survey major books (3) RESEARCH FINDINGS There are many problems of pricing when construction appraisal.. There are suggested some alternative solution. 2. RESULTS Nowadays construction environment is changed very rapidly. Emotional expertise is required to actively respond and demonstrate autonomy in the real estate. With the growing number of people who have improved their knowledge of the construction and are good for the construction based on conflict, the proportion of cases related to construction about litigation is increasing. Results of construction appraisal have a big effect on result of trial. There are many problems of pricing when construction appraisal. there are suggested some alternative solution.

      • 건설관리(CM)업무 활성화를 위한 종합감리업무 수립방안

        Although constructions are getting diverse, larger in size, and higher-storied, we witness that CM technologies are not coping with such a growing trend. In particular, CM, one of vulnerable areas, shall continue to be given priority hereafter. The research has been conducted with a strong focus on total design and supervision offices already specializing in CM projects, in order to prepare for the future activated CM markets. Authors have sought to find mistakes in the process of being in control of CM works and create measures to boost CM through case-study, documentary research, and interviews with experts. It excludes theoretical research, as many data are already accumulated domestic and abroad.

        Among national properties of various governmental offices and departments, we focused on the public finance. Because the financial balance of national properties of governmental offices and departments has been in deficit.This study focuses on postal administration business which faces the financial crisis. The purpose of our study is to show devices for value improvement of postal administration business headquarters of Ministry of Information and Communication. Research was based on case researches and domestic post offices which were decided to rebuild. Problems of domestic postal administration business were first found out. And for its solutions, research on domestic and foreign cases were carried out, superior cases for benchmarking was regulated so that these can be applied to the post offices to be built or to be remodeled.

        건축턴키공사 입찰안내서의 문제점과 개선방안에 관한 연구 : 클레임예방을 중심으로 Focused on Preventing Claim

        Turnkey project in construction which accounts for about 10% of the total annual construction orders in the nation is expected to grow in size as an effort to strengthen international competitiveness and improve quality of construction work. However, problems of turnkey project in construction raise concern for many possible cases of possible claims. Based on the understanding that bidding guidelines which plays a critical role in turnkey project in construction actually contain some unequal clauses and causes for problems which undermine development of turnkey construction and further create possible cases of claims, the paper aims to identify and analyze the unequal clauses and problems contained in the guidelines in order to make suggestions for improvement. Among all the turnkey construction orders that has been placed since 2000 when domestic turnkey project in construction became relatively formulated, 13 constructions costing more than 50 billion won were selected for this study since their construction scale were large enough that the bidding guidelines for them were regarded as containing little difference among one another. In order to enhance construction technology and to prevent claims while trying to achieve the original purpose of Turnkey system, the parties involved in or schedule to take part in Turnkey project including ordering institution, Construction Company and Design Company should make an effort to have more reasonable bidding guidelines drawn up.

        프로젝트 초기 단계에서의 분쟁방지를 위한 분쟁요인 추출에 관한 연구 : 턴키공사 사례 중심으로 Focusing on Turn-Key Project

        Although we try to increase the order of turn key construction for the international competitiveness strengthening, the construction quality advancement and the productivity enhancement of the public sectors, the problems of the domestic turn key systems are causing the hardships of all the participants and many possible disputes. The home turn key constructions have been activated since 1997. A lot of trial and error had been experienced in these days, and the turn key systems have been changed little by little. But the bases are continuously kept because of their reflecting all the participants' opinions. In the inner turn key constructions the problems of uniform types are repeatedly occurred, and, especially, many problems happen up to the stage of early stage owing to the specialties of the turn key construction. So the dispute factors of the Korean turn key constructions were abstracted through the literature searches, the site document examinations, the case studies and the interviews with the experts. When the technicians meeting the interior turn key construction for the first time and working here now are well acquainted with only these factors, many disputes will be prevented.

        In the inner turn key constructions the problems of uniform types are repeatedly occurred, and, especially, many problems happen up to the stage of pre-construction(from a bid to a contract) owing to the specialties of the turn key constructions. So the claim factors of the Korean turn key constructions were abstracted through the literature searches, the site document examinations, the case studies and the interviews with the experts. When the technicians meeting the interior turn key constructions for the first time and working here now are well acquainted with only these factors, many claims will be prevented. By analysing the degree of claims by claims factors through the questionnaires to the experts about the abstracted factors and surveying the amount of the claims through the case studies, what factors exerted how much of influence on the claims was tested and analyzed. Proposing the response devices to the factors affecting the claims much led the technicians in charge of internal turn key constructions to the prevention and the proper solution of the site claims.
