2006년 5월 31일 제4대 동시지방선거가 실시되었다. 이번 지방선거에서의 가장 큰 특징은 기초의회에 새로 정당공천제, 중선거구제, 비례대표제, 유급제가 도입되었다는 점이다. 2006년 지방선거에서 기초의회 여성의원 비율은 15.0%.로 지난 지방의회의 2.2%에 비하여 6배 이상 증가하였다. 이와 관련하여 본 연구는 기초의회 선거 제도의 변화가 여성의 정치적 대표성제고에 어떠한 영향을 미쳤는지를 파악하는데 주목적이 있다. 아울러, 개정된 선거법이 보다 실효성을 높이기 위하여 개선되어야 할 향후 과제를 제안하고자 한다. 첫째, 정당 공천과 관련하여 전략공천의 확대 및 복수공천시 추첨제로 바꾼다. 둘째, 선거구제의 개편과 관련하여 중대선거구제 당선 보장제를 도입한다. 셋째, 예비선거운동기간의 도입과 관련하여 여성정치발전기금의 확대를 통하여 여성후보 지역구 활동비를 보전해주어야 한다. The 4th local election was held on May 31th in 2006. The biggest characteristics of the local election was that new systems such as party nomination of the assembly candidates, the medium constituency system, the system of proportional representation, and paid system for the elected were induced into the assembly at the base. The percentage of women assemblymen at the assembly at the base in 2006 was 15%, which increased six times more than 2.2% of women assemblymen at last election. Related to the fact above, this study mainly aimed to investigate what effects of the changed system in the assembly at the base on women"s political representation. In addition, this study suggested future studies to increase the practicality of the revised election system. Firstly, strategic party nomination of the assembly should be expanded in relation to party nomination of the assembly as well as lottery system should be induced when multiple candidates get nomination of party. Secondly, women"s being elected should be assured in a medium and large consistency system in relation to the change of consistency system. Thirdly, activity cost of women candidates should be paid through increase of women"s political development fund, in relation to inducement of preliminary election campaign period.

본 연구에서는 여성폭력범죄 중 성폭력범죄에 그 대상을 한정하여 성폭력 판례의 쟁점 변화와 내용 분석을 하고자 한다. 성폭력에 관한 성 편견이나 남성 중심적인 사고를 하는 경향은 「형법」이 제정된 1953년 이래로 아니 그 이전부터 사회문화적 관념으로 존재해 왔으며, 법을 집행하거나 해석하는 사법기관 담당자들의 인식에도 영향을 주었고, 판례도 그 영향을 받게 된다. 판례는 추상적인 법률을 구체적인 사례에 적용하는 과정으로 법 해석을 통해 법률을 적용해가게 된다. 법률에 성 편견적인 규정이 있으면 판례도 그에 따르게 되지만, 법률은 여러 번의 개정을 통해서 이러한 규정들을 개선해 나가고 있다. 또한 판례는 법 해석을 통해 법률을 적용해 나가는데 이 과정에서 성폭력의 피해자 관점, 다시 말해 여성의 관점을 반영하지 못한 사례가 발견된다. 이에 여성폭력 관련 판례분석을 통해 1953년 「형법」 시행 이후 60년이 지나는 과정에서 성인지적 관점에서 긍정적으로 변화된 것으로 볼 수 있는 판결과 아직도 성편향이나 남성 중심적인 인식에 근거한 판결은 어떤 것이 있고, 남성 중심적인 것을 성 중립적인 것으로 개선하기 위해서는 어떤 것이 개선되어야 하는지 제시될 필요가 있다. 이에 본 연구에서는 여성폭력관련 판례 중 성폭력을 중심으로 한 성인지적 분석을 통해 향후 법해석상 변경되어야 할 과제를 제안하고자 한다. A gender-sensitive analysis of precedents related to violence against women is expected to resolve the male-centered social norms while addressing the power imbalance between men and women, thus setting a direction for a balanced life for men and women. It will also contribute to ensuring the human rights of women who make up the majority of violence victims as well as realize what is envisioned by Article 10 of Koreas Constitution “All citizens shall be assured of human worth and dignity.” With the progress in laws relating to women and family, a number of precedents dealing with violence against women have been accumulated. However, there has been no study analyzing those precedents in earnest in quantitative terms, let alone suggestions for improvement. In this study, a gender-sensitive approach will be used to analyze precedents concerning violence against women, particularly sexual violence. This study is about the history of laws related to violence against women, changes in the way these laws have been utilized, a gender-sensitive analysis of precedents concerning sexual violence. Several methods were employed in the study, which include literature research, collection and analysis of precedents relating to sexual violence, workshops for each topic of precedents relating to violence against women, and expert meetings for advice. From the gender-sensitive perspective, legislative tasks proposed from sexual violence precedents include the establishment of disagreed adultery and improvement of sexual violence laws. Other suggestions include raising the awareness of gender sensitivity and human rights sensitivity among law enforcers.
