        정치의 사법화와 준사법기관의 정치화에 관한 연구 : 검찰총장직무집행정지 처분과 고위공직자범죄수사처 설치의 헌법상 쟁점을 중심으로

        Nowadays, in our country, the phenomenon of ‘the judicialization of political and administrative area’ and ‘the politicization of the quasi-judicial agency (prosecutors’ office and judicial police)’ are widespread and serious, furthermore, almost all of the national, social sectors are in chaos on this process. It is said that they cannot help but criticize the behavior of politicial area who depend on heavily the judiciary’s judgment as a final decision. The phenomenon of ‘the judicialization of politics’ often has a kind of side-effects as ‘the politicization of the judiciary’ and ‘the politicization of the quasi-judicial agency’. Especially, it is said that ‘the politicization of the quasi-judicial agencyt’ is more damaging in that it undermines its inherent role in judicial action, causing major side-effects. As a result, it would be said that there is the seriousness in the fact that it can cause of gross and systematic violence against the public. In addition, the media sector which conducts a public opinion poll about the incumbent Chairman of Board of Audit and Inspection, the incumbent Prosecutor General as the candidate of the presidential election next year is also responsible for undermining the nature and level of party politics. We would like to reiterate the importance of alertness against the constitutional regression such as mass production of victims and ‘the Tranny of the Majority’ votes with many other important factors damaged. In addition, I emphasize the afterwardness as the limitation of the judicial procedures should be noted. In the future, on the turning point of two cases, I hope that the objective, fair implementation of prosecutors’ power and the normal management of Corruption Investigation Office for High-ranking Officials is realized, and emphasize that the democratic control and the checking by the political sphere, the journal sphere and civil society etc. must be accomplished surely and consistently. 오늘날, 우리나라에서는 정치와 행정영역의 사법화현상과 준사법기관의 정 치화현상이 광범위하고 심각하게 현출되고 있고, 게다가 이런 과정에서 국가 영역과 사회영역의 광범위한 혼돈상태가 초래되고 있다고 할 수 있다. 최종결 정으로서 사법부의 판단에 과잉의존하고 있는 정치권의 행태를 비판하지 않을 수 없다고 할 것이다. 정치의 사법화 현상은 사법의 정치화라는 일종의 부작용을 자주 동반하게 된다. 또한 사법의 정치화는 사법행동의 고유한 역할을 파훼하는 점에서 더욱 바람작하지 않다고 할 것이다. 그 결과로 총체적이고 체계적인 폭력을 일반국 민들에게 행사하는 원인이 된다는 사실에서 심각성이 크다고 할 것이다. 헌정사상 초유의 법무부장관의 검찰총장 직무집행정지 발령과 검찰총장의 법적 대응, 그리고 그에 대한 헌법재판소와 일반법원의 판결 등이 복잡하게 얽 히며 진행되어 왔고, 고위공직자범죄수사처 설립과 관련되어서도 찬성론과 반 대론의 첨예한 대립을 경유하여 위헌문제와 관련하여 헌법재판소의 판결이 있 었다. 다시 말해, 정치권의 의사결정이 최종적으로 헌법재판소와 일반법원의 판결에 종속되는 상황이 현출되어진 것이다. 추가하여, 차기대통령후보로서 현직 감사원장이나 현직 검찰총장에 대한 여 론조사를 실시한 언론영역도 정당정치의 본질과 수준의 관점에서 책임이 있다 고 할 것이다. 많은 다른 요소들을 손상시킨 채 다수의 희생자와 다수의 전횡 과 같은 헌법적 퇴행에 대한 경고음의 중요성과 사법절차의 한계로서의 사후 성(事後性)에 대해 유념할 것을 강조하고자 한다. 앞으로, 양 사건을 전환점으로 하여, 객관적이고 공정한 검찰권의 수행과 신 설된 공수처의 정상적 운영을 통한 제도상 정착이 확보되어지길 바라며, 긍정 적 측면의 정치의 사법화만이 기능할 수 있도록 정치권과 언론영역, 시민사회 등 각계각층의 견제와 감시 등의 민주적 통제가 반드시 필요하다고 할 것이다.

        랫드 흑질 신경세포의 전기적 특성과 ATP-sensitive K<sup>+</sup>채널의 전류밀도

        Substantia nigra is known to highly express glibenclamide binding site, a protein associated to ATP-sensitive $K^{+}$ ($K_{ATP}$) channel in the brain. However, the functional expression of $K_{ATP}$ channels in the area is not yet known. In this work, we attempted to estimate the functional expression of $K_{ATP}$ channels in neurons of the substantia nigra pars compacta (SNC) in young rats using slice patch clamp technique. Membrane properties and whole cell currents attributable to $K_{ATP}$ channel were examined by the current and voltage clamp method, respectively. In SNC, two sub-populations of neurons were identified. Type I (rhythmic) neurons had low frequency rebound action potentials ($4.5{\pm}0.25Hz$, n=75) with rhythmic pattern. Type II (phasic) neurons were characterized by faster firing ($22.7{\pm}3.16Hz$, n=12). Both time constants and membrane capacitance in rhythmic neurons ($34.0{\pm}1.27$ ms, $270.0{\pm}11.83$ pF) and phasic neurons ($23.7{\pm}4.16$ ms, $184{\pm}35.2$ pF) were also significantly different. The current density of $K_{ATP}$ channels was $6.1{\pm}1.47$ pA/pF (2.44~15.43 pA/pF, n=8) at rhythmic neurons of young rats. Our data show that in SNC there are two types of neurons with different electrical properties and the density of $K_{ATP}$, channel of rhythmic neuron is about 600 channels per neuron.

        Korean Red Ginseng improves atopic dermatitis-like skin lesions by suppressing expression of proinflammatory cytokines and chemokines in vivo and in vitro

        Background: The prevalence of allergic inflammatory diseases such as atopic dermatitis (AD), asthma, and allergic rhinitis worldwide has increased and complete recovery is difficult. Korean Red Ginseng, which is the heat-processed root of Panax ginseng Meyer, is widely and frequently used as a traditional medicine in East Asia. In this study, we investigated whether Korean Red Ginseng water extract (RGE) regulates the expression of proinflammatory cytokines and chemokines via the mitogen-activated protein kinases (MAPKs)/nuclear factor kappa B (NF-kB) pathway in allergic inflammation. Methods: Compound 48/80-induced anaphylactic shock and 1-fluoro-2,4-dinitrobenzene (DNFB)- induced AD-like skin lesion mice models were used to investigate the antiallergic effects of RGE. Human keratinocytes (HaCaT cells) and human mast cells (HMC-1) were also used to clarify the effects of RGE on the expression of proinflammatory cytokines and chemokines. Results: Anaphylactic shock and DNFB-induced AD-like skin lesions were attenuated by RGE administration through reduction of serum immunoglobulin E (IgE) and interleukin (IL)-6 levels in mouse models. RGE also reduced the production of proinflammatory cytokines including IL-1b, IL-6, and IL-8, and expression of chemokines such as IL-8, thymus and activation-regulated chemokine (TARC), and macrophage-derived chemokine (MDC) in HaCaT cells. Additionally, RGE decreased the release of tumor necrosis factor-a (TNF-a), IL-1b, IL-6, and IL-8 as well as expressions of chemokines including macrophage inflammatory protein (MIP)-1a, MIP-1b, regulated on activation, normal T cell expressed and secreted (RANTES), monocyte chemoattractant protein (MCP)-1, and IL-8 in HMC-1 cells. Furthermore, our data demonstrated that these inhibitory effects occurred through blockage of the MAPK and NF-kB pathway. Conclusion: RGE may be a useful therapeutic agent for the treatment of allergic inflammatory diseases such as AD-like dermatitis.

        강원도 가시오갈피의 식물 부위 또는 추출 용매 조건에 따른 항염증 효과

        Background : The purpose of this study was to investigate the anti-inflammatory properties of stems and leaves of Eleutherococcus senticosus (Rupr. & Maxim.) Maxim. (ES) from Gangwon-do. Methods and Results : Stems and leaves of ES were collected from two areas in Gangwon-do: Cheorwon-gun and Samcheok-si. Samples were extracted with water by using the pressurized liquid extraction method and with 70% prethanol A by using the heat reflux extraction method. The anti-inflammatory effects of ES were evaluated through the 3-(4,5-dimethylthiazol-2-yl)-2,5-diphenyltetrazoliumbromide(MTT), lactate dehydrogenase(LDH) assay, nitric oxide(NO) assay, enzyme-linked immunosorbent assay(ELISA), and Western blot analysis in RAW 264.7 macrophages stimulated with lipopolysaccharide (LPS). 1) Results showed that ES leaf extractions were not cytotoxic at a concentration of up to 30 ㎍/㎖. The leaves of 70% prethanol A extractions of ES(30 ㎍/㎖) inhibited NO, interleukin-6(IL-6), and tumor necrosis factor-α(TNF-α) production and decreased the protein level of cyclooxygenase 2(COX-2). There was no significant change in the protein level of inducible nitric oxide synthase(iNOS). The stem extractions of ES did not exhibit anti-inflammatory effects. Conclusions : In this study, the leaves of 70% prethanol A extractions of ES demonstrated anti-inflammatory effect on RAW 264.7 macrophages. The 70% prethanol A extractions have a relatively higher anti-inflammatory effect on RAW 264.7 macrophages than water extractions.

        Inoculation of Lewis lung carcinoma cells enhances formalin-induced pain behavior and spinal Fos expression in mice

        The incidence of lung cancer has rapidly increased and cancer patients at a later cancer stage frequently suffer from unbearable cancer-associated pain. However, the pathophysiology of lung cancer pain has not been fully described due to a lack of appropriate animal models. This study was designed to determine the effect of Lewis lung carcinoma (LLC) cell inoculation on formalin-induced pain behavior and spinal Fos expression in C57BL/6 mice. LLC cells (1.5 × 105, 2.5 × 105, 3.0 × 105 or 5.0 × 105) were inoculated into back or peri-sciatic nerve areas. Back area inoculation was adopted to determine the effect of cancer cell circulating factors and the peri-sciatic nerve area was used to evaluate the possible effects of cancer cell contacting and circulating factors on formalin-induced pain. At postinoculation day 7, LLC cell (5.0 × 105) inoculations in both back and peri-sciatic nerve area significantly increased formalin-induced paw-licking time and spinal Fos expression over those in cell-media-inoculated (control) mice. Enhanced pain behavior and spinal Fos expression were significantly suppressed by ibuprofen pretreatment (250 mg/kg). The results of this study suggest that LLC cell circulating factors and inflammatory responses may be critical in enhancing pain sensation in the early stage of lung cancer cell inoculation.
