        We report a case of thoracolumbar radiculopathy presented with first symptom of leptomeningeal metastasis. A 65- year old man with non-Hodgkins lymphoma with complete remission was referred for further investigation of dull pain and numbness of right lower quadrant of abdomen. Electromyogram revealed right thoracolumbar radiculopathy. After two weeks, he complained severe continuous bilateral frontal dull headache. An examination of the cerebrospinal fluid revealed malignant lymphoid cells. We would like to emphasize that radiculopathy sometimes presents with first symptom of leptomeningeal metastasis.

        난민신청자의 최저 생활을 할 ‘권리를 가질 권리’와 법무부의 생계비 동결 - 영국과 독일의 사법심사를 중심으로 -

        Refugee applicants are in an unstable position regarding legislative protection because they are in a state of pre-recognition of refugee status from state parties to the Refugee Convention. The "right to a minimum standard of living” is the right of "everyone” to enjoy an adequate standard of living, including basic necessities (Article 11 of the Covenant on Economic, Social and Cultural Rights). However, when the political community of a nation-state does not function, the subsistence support for refugee applicants becomes merely “a right to have a right” to a minimum standard of living. This is even more so in crisis situations such as disasters. This paper examines the situation where the subsistence support for refugee applicants has been frozen before and after the outbreak of COVID-19 in South Korea. It compares and evaluates delegated legislation related to subsistence support and the limits of social benefit administration in South Korea by comparing the status of subsistence support, legal systems, and case law in Germany and the United Kingdom. The amount of subsistence support for refugee applicants is determined by the legislative branch in Germany and the executive branch in the United Kingdom. The content and operation of subsistence support for refugee applicants in South Korea are at the discretion of the Minister of Justice and are based on administrative legislation delegated by presidential decree. The subsistence support for refugee applicants, who are not covered by the universal public assistance system, is determined according to the criteria of emergency livelihood support that excludes housing expenses, fuel expenses, etc., and recently, since 2019, it has been below that level except for one year. In particular, this study examines the possibility of judicial review for the protection of refugee applicants through the cases of Germany and the United Kingdom regarding frozen decisions on subsistence support. The judgments of the Federal Constitutional Court of Germany and the High Court of the United Kingdom have been the last resort for the protection of livelihood support for refugee applicants. In 2012, Germany made a constitutional ruling that related regulations were unconstitutional because they did not guarantee a minimum standard of living for refugee applicants. It stated that the right to a minimum standard of living encompasses not only physical livelihood but also social, cultural, and political participation, and discrimination based on residency status cannot be justified. Additionally, in 2014, the High Court of the United Kingdom ordered a reassessment of livelihood support for refugee applicants, and stated that the Home Office had failed to conduct a reasonable assessment of the amount necessary for basic livelihood. Above all, in 2022, the High Court of the United Kingdom issued emergency order for an increase in subsistence support due to the failure to properly reflect consumer price index inflation in subsistence expenses during the COVID-19 situation, and the next day the Home Office implemented an increase in livelihood support. Finally, this paper concludes that it is necessary to institutionalize a professional and rational decision-making process to ensure that the subsistence support for refugee applicants in South Korea meets the minimum requirements for basic living. To this end, it is requested that the Minister of Justice be given the obligation to investigate the decision on subsistence support and legislative alternatives be sought to regularly adjust the subsistence support for refugee applicants. Lastly, it is hoped that the function of judicial review will be strengthened for social minorities such as refugee applicants. 난민신청자는 난민협약 당사자국으로부터 난민지위를 인정받기 이전 상태에 있기때문에 이들에 대한 입법적 보호는 불안정하다. ‘최저생활을 할 권리’는 의식주를포함한 적정한 생활 수준을 향유할 ‘모든 사람’의 권리이지만(사회권 규약 제11조) 국민국가의 정치 공동체가 기능하지 않을 때 난민신청자의 생계비는 최저생활을 할‘권리를 가질 권리’에 불과하다. 재난과 같은 위기 상황에서는 더욱더 그러하다. 이 논문은 난민신청자의 생계비가 코로나 발생 전후에 동결된 상황에 주목하고생계비 관련 위임입법과 법무부 급부 행정의 한계를 독일과 영국의 생계비 현황, 법제도, 판례를 통해 비교 검토한다. 난민신청자의 생계비 지급액은 독일은 입법부에서 영국은 행정부에서 결정한다. 한국의 난민신청자를 위한 생계비 내용과 운영은 법무부 장관의 재량이고 대통령령에 위임된 행정입법의 형식에 기반 한다. 보편적인 공적부조제도의 대상이 아닌 난민신청자의 생계비는 주거비, 연료비 등을 포함하지 않는 긴급생계지원금을 기준으로 삼아 결정되는 데 2019년부터는 한해를제외하고 그 수준에 미달되고 있다. 특별히 본 연구는 생계비 동결 결정에 대한 독일과 영국의 판례를 통해 난민신청자 보호를 위한 사법심사의 가능성을 살펴본다. 독일의 연방헌법재판소와 영국의 고등법원 판결은 난민신청자의 생계비 보호를 위한 마지막 보루가 되어 왔다. 독일은 2012년 난민신청자의 생계비가 최저생활을 보장하지 못한다며 관련 법규정에 대해 헌법(기본법)불합치 결정을 내렸다. 최저생활을 위한 권리는 물리적인 생계 뿐 아니라 사회, 문화, 정치적 생활 참여 등도 포괄하는 것으로 체류자격에 의한 차별이 정당화될 수 없다고 설시한 내용이다. 또한, 2014년 영국의 고등법원은내무부가 기초생계에 필요한 금액에 대한 합리적 심사를 하지 못했다며 난민신청자의 생계비에 대한 재평가를 명령하였다. 무엇보다도 2022년 영국의 고등법원은코로나 상황에서 소비자물가지수 인플레이션이 생계비에 제대로 반영되지 않은 것에 대한 긴급 인상명령을 내렸고 바로 다음날 내무부는 생계비 인상을 단행하였다. 마지막으로 이 논문은 한국의 난민신청자 생계비가 최소한의 기초 생계를 충족하기위해 전문적이고 합리적 의사결정 과정을 정례화하는 것이 필요하다고 판단한다. 이를위하여 법무부 장관에게 생계비 결정에 수반되는 조사 의무를 부여하고 정기적으로난민신청자 생계비를 조정할 수 있는 입법적 대안이 요청된다. 마지막으로, 난민신청자와 같은 사회적 소수자를 위하여 사법심사의 기능이 강화되기를 기대한다.

        Clinical Impact of Pre-transplant Antibodies Against Angiotensin II Type I Receptor and Major Histocompatibility Complex Class I-Related Chain A in Kidney Transplant Patients

        Background: Evidence of antibody-mediated injury in the absence of donor-specific HLA antibodies (HLA-DSA) has recently emerged, suggesting a role of antibodies in targeting non-HLA antigens expressed on renal allograft tissue. However, the clinical significance of pre-transplant non-HLA antibodies remains unclear. We compared the histological and clinical impact of pre-transplant HLA-DSA and non-HLA antibodies, especially angiotensin II type I receptor (anti-AT1R) and MHC class I-related chain A (anti-MICA), in kidney transplant patients. Methods: Pre-transplant HLA-DSA, anti-AT1R, and anti-MICA were retrospectively examined in 359 kidney transplant patients to determine the effect of each antibody on allograft survival and clinical characteristics. Results: Pre-transplant HLA-DSA, anti-AT1R, and anti-MICA were detected in 37 (10.3%), 174 (48.5%), and 50 patients (13.9%), respectively. Post-transplant antibody-mediated rejection was associated with a pre-transplant HLA-DSA (+) status only. The development of microvascular inflammation (MVI) was associated with pre-transplant HLA-DSA (P=0.001) and anti-AT1R (P=0.036). Anti-AT1R (+) patients had significantly lower allograft survival compared with anti-AT1R (−) patients (P=0.042). Only pre-transplant anti-AT1R positivity was an independent risk factor for allograft failure (hazard ratio 4.824, confidence interval 1.017–24.888; P=0.038). MVI was the most common histological feature of allograft failure in patients with pre-transplant anti-AT1R. Conclusions: Pre-transplant anti-AT1R is an important risk factor for allograft failure, which may be mediated by MVI induction in the allograft tissue.

        中古漢語 照二系의 介音 탈락 시기 문제 고찰

        照二系在近古时期不论二等还是三等介音已经全部消失,在≪古今韵会举要≫中就出现在没有介音的字母韵裏。这可以说在进入近古时期之前中古时期介音已经开始脱落了。本文从内外转的角度出发对中古三等照二系进行一系列的分析,着重考察了其介音在中古时期是怎样消失的。≪廣韵≫外转三等照二系大部分也有同摄二等的读音,并且二等韵的又韵照二等字與三等字的字意相同。这说明同一個汉字既有二等的读音也有三等的读音。可以看出这时期外转照二系的介音已经开始消失。内转照二系在慧琳≪一切经音义≫中仍大多以C2类字为反切下字,这说明这时期内转三等照二系仍保存着三等介音。可是,止摄照二系就有所不同。韩国和越南的汉字音裏就與其他声母不同。同时慧琳≪一切经音义≫的反切具有照二系只切照二系的倾向。从而可以看出止摄内转照二系的介音已经开始消失。宕摄也有與此相仿的现象出现,≪古今韵会举要≫和≪西儒耳目资≫照二系就被纳入到独立的字母韵裏。

        Introduction : Syndrome of Inappropriate Antidiuretic Hormone (SIADH) is associated with hyponatremia and water retention caused by several drugs, including carbamazepine and diseases. Case : A 41 year-old man was admitted because of gait ataxia and both hands asterixis for 1 month. On the past history, he was presented with temporal lobe epilepsy for twenty seven years. He had aura with unpleasant feeling before loss of consciousness. He was treated with carbamazepine, valproate and zonisamide for 3 years. He showed hyponatremia and it was corrected by water restriction and oral sodium supplement without tapering of the drug. Conclusion : We report a case presenting SIADH associated with carbamazepine treatment.
