취업규칙 불이익변경에 대한 최근 전원합의체 판결의 의의와 한계 ― 대상판결 : 대법원 2023.5.11. 선고 2017다35588, 2017다35595(병합) 전원합의체 판결 ―

최근 대법원은 전원합의체를 통해 취업규칙 불이익변경에 대한 사회통념상 합리성 법리를 계속 유지할 것인지에 대해 검토하였는데, 대법관 6인은 이 법리를 유지할 것을 주장하였으나 대법관 7인의 다수의견으로 폐기하게 되었다. 근로기준법 제94조 제1항 단서가 신설된 1989년 법 개정의 배경과 그 이후의 법 개정 연혁, 근로조건 대등결정에 대한 헌법적 요청, 사회통념상 합리성 판단의 임의성, 종전의 법리가 노사관계에 미친 악영향 등을 고려하면 사회통념상 합리성 법리를 폐기한 다수의견의 논지가 타당하다고 생각한다. 한편 대상판결은 취업규칙 불이익변경에 대해 ‘집단적 동의권 남용 심사’라는 새로운 법리를 제시하여 종전의 사회통념상 합리성 법리와 마찬가지로 근로자 집단의 동의 없는 취업규칙의 불이익변경이 유효할 수 있는 여지를 남겨 두었는데, 새로운 법리는 사용자가 취업규칙을 불이익하게 변경하면서 근로자 집단의 동의를 받기 위한 노력을 전혀 하지 않은 경우에는 그 불이익변경의 유효성을 인정받을 수 있는 여지가 없도록 한다는 점에서 종전 법리와는 분명한 차이를 보인다. 다만 대상판결은 ‘집단적 동의권 남용 심사’라는 법리를 새로이 제시하면서도 이를 이 판결에서 직접 구체적으로 적용하지 않고 사실심에서 이를 다시 판단하도록 사건을 파기환송하였기 때문에, 향후 파기환송심에서 그 법리의 구체적인 의미와 인정요건을 두고 치열한 공방이 전개될 것으로 예상된다. 또한 임금피크제 등과 같이 최근 문제가 되고 있는 취업규칙 불이익변경 사건들에서도 동의권 남용이 인정될 수 있는지가 문제 될 수 있다는 점에서 새로운 법리의 의미가 보다 구체화 될 필요가 있다. Recently, the Supreme Court, through en banc, reviewed whether to continue to maintain the legal principle of reasonableness regarding disadvantageous changes in Rules of Employment (RoE). Accordingly, six Supreme Court Justices argued for maintaining the legal principle of reasonableness, but the majority opinion of seven Justices ruled that it was not acceptable so the legal principle of reasonableness was abolished. As a result of the review, the background of the 1989 law revision in which the provision of Article 94, Paragraph 1 of the Labor Standards Act was newly established, the history of subsequent law revisions, and considering the arbitrariness of the judgment and the negative impact of the legal doctrine on labor-management relations, I believe that the majority opinion's argument for abolishing the legal principle of reasonableness is valid. Meanwhile, the judgment presents a new legal principle called ‘examination of abuse of collective consent rights’ for disadvantageous changes to RoE, leaving room for disadvantageous changes to RoE without the consent of the worker group to be effective, similar to the previous legal principle of reasonableness. However, the new legal principle is a clear difference from the previous legal principle in that if an employer changes RoE in a disadvantageous manner but does not make any effort to obtain the consent of the worker group, there is no room for the validity of the disadvantageous change to be admitted. However, although the judgment newly presented the legal principle of ‘examination of abuse of the right to collective consent rights’, it didn't apply it directly and specifically to this case. Therefore, the specific meaning of that legal principle will be discussed in future cases. It is expected that a fierce battle will unfold over the requirements for recognition. In addition, the meaning needs to be made more concrete in that it may be problematic whether abuse of the right to consent can be recognized in cases of disadvantageous changes to RoE, such as the wage peak system, which has recently become problematic.
