학교폭력: 실태와 해결방안

학교폭력은 도시학교에서 많이 발생한다. 교육부의 자료에 의하면 학교폭력은 2013년에 감소하였으나 상대적으로 낮은 감소율을 나타내고 있다. 학교현장에서 학교폭력의 피해자들의 평균수는 2012년 8.5%이었으며 2013년은 8.2%이었다. 학교에서 심각한 여러 사건들이 지속적으로 일어나고 있는 가운데 전반적으로 학교폭력은 여전히 한국의 학교현장에서 중요한 문제이다. 학교폭력의 문제를 해결하기 위해 이 연구에서는 법적접근, 학교프로그램 및 상담서비스 등의 다양한 유형의 해결방안을 제시하였다.

자치경찰제 도입에 대한 비판적 고찰: 경찰관들과의 심층인터뷰를 중심으로

한국 경찰의 역사에서 자치 경찰에 관한 논의는 아주 오래되었지만 매우 중요한 주제임에 틀림이 없다. 사실 많은 선행 연구들에서는 국가 경찰과 자치 경찰의 장단점에 대한 논의와 더불어 자치 경찰을 할 경우 어떤 형태와 제도를 따른 것인가에 따른 광범위한 논의를 해 왔지만 합의점을 찾기 매우 힘들었다. 한발 더 나아가 자치 경찰제도에 따른 경찰과 검찰의 수사권 독립 또는 조정의 문제 역시 복잡하게 얽혀 있어 이 부분에 대한 연구 역시 상당히 진행되었다. 하지만, 기존의 자치 경찰 제도의 도입 방향과 형태 등에 대한 광범위한 논의와는 달리 경찰들을 대상으로 한 연구는 많지 않다. 특히 경찰조직에서 하위직 경찰관들이 자치 경찰과 이와 관련된 이슈들에 대한 생각들에 관한 연구는 전무한 실정이다. 이에 본 연구는 대구 경북지역에서 경위 이하 경찰관들이 자치 경찰에 대한 인식과 문제라고 생각하는 부분에 대한 솔직한 의견을 제시하였다.

범죄 두려움에 대한 경찰 활동의 효과: 위계 모형 접근

일반적인 범죄 두려움의 분석 연구는 주로 3가지 모형(범죄 피해 모형, 무질서 무형, 사회 통합 모형)을 통해 분석되어 왔다. 본 연구는 기존의 범죄 두려움의 검증 모형들과 함께 지역사회 경찰활동을 포함한 다양한 경찰 전략이 범죄 두려움에 미치는 영향력을 경험적으로 검증해 보고자 몇 가지 가설을 설정하여 연구를 시도하였다. 2006년 무작위로 선정된 대구 지역의 총 1,230명에 대한 설문조사에서 수집된 데이터를 이용한 위계선형 분석의 결과 범죄 피해 모형에서 성별, 범죄 피해 등은 일관적이고 강한 효과를 보여주고 있음을 발견하였다. 또한 연구결과는 경찰 활동 모형 중에서는 전통적인 억제이론에서 도출한 경찰 순찰 가시성이 시민들의 범죄 두려움을 감소시킬 수 있는 중요한 경찰 전략이 될 수 있으며, 지역 사회 경찰활동 역시 지역 주민들의 범죄 두려움을 감소시킬 수 있는 중요한 경찰 활동임을 발견하였다. 거시적 수준에서 무질서 모형은 범죄 두려움에 별다른 영향력을 미치지 못하였지만, 지역 사회 통합 수준은 범죄 두려움 감소에 효과적인 영향을 미칠 수 있다는 결과 역시 발견되었다. 마지막으로 이 연구는 몇 가지 정책적 제안을 소개하고 있다. In general, the study of fear of crime was commonly analyzed in three influential models that include crime victimization model, disorder model, social integration model. With several hypotheses about police activity model, this study examined the effect of four models on fear of crime. On the basis of survey data on 1,230 randomly selected at Daegu, Hierarchical Linear model analysis found that the effects of gender and victimization experience are positively related with fear of crime. This study also found that police patrol presence originated from classic deterrence theory can decrease fear of crime among police activity variables. In addition, community policing strategies appear to demonstrate the impact of fear reduction. At macro level, while community disorder does not have any influence on fear of crime, social integration is negatively related with fear of crime. In conclusion, this study suggests several policy implications.

자치경찰제도의 문제점에 대한 경찰관들의 인식분석

해방 후 미군정부터 자치경찰제도의 도입을 위해 많은 노력을 해 왔지만 결국에는 무산되었다. 2017년 문재인 정부가 출범하면서 자치경찰제도 도입의 논의가 다시 시작되었다. 2020년 12월 8일 마침내 자치경찰제도 도입을 위한 법안이 통과되어 2021년 7월 1일부터 자치경찰제도를 시행하게 되었다. 비록 다수의 경찰관이 자치경찰 도입에 반대하였지만, 이미 도입이 결정된 만큼 자치 단점 을 잘 보완하고 다양한 문제점에 대해 보완할 필요성이 있다. 본 연구는 자치경찰제도에서 경찰관들 이 찬성하는 이유와 반대하는 이유에 대해 경험적으로 연구함으로써 현직 경찰관들의 자치경찰제도 에서 우려하는 부분에 대해 제시함으로써 자치경찰 도입에 도움을 주려는 목적으로 수행되었다. 전국 1,227명의 경찰관들을 대상으로 한 회귀분석의 결과 자치경찰제도의 장점을 더 많이 인식하 는 경찰관들은 자치경찰제도의 도입에 더욱더 긍정적이지만 자치경찰제도 도입으로 인해 치안유지 기능의 약화, 공권력 약화, 공정성과 정치적 중립성 문제, 치안 서비스 인건비의 차이, 부정부패의 문제점들에 대해 더 많이 인식하는 경찰관들의 경우에는 자치경찰 제도의 도입에 더욱 부정적인 인 식를 가지고 있는 것으로 나타났다. After liberation, the government has made great efforts to introduce the autonomous police system, but it was eventually failed. With the inauguration of the Moon Jae-in administration in 2017, discussions on the introduction of the autonomous police system began again. On December 8, 2020, a bill for the introduction of the autonomous police system was finally passed, and the autonomous police system will be implemented from July 1, 2021. Although many police officers objected to the introduction of autonomous police, it is necessary to make up for the shortcomings of self-government well and various problems as the introduction has already been decided. This study was conducted with the aim of helping in the introduction of autonomous police by presenting concerns in the autonomous police system of incumbent police officers by empirically researching the reasons that police officers agree and disagree in the autonomous police system. As a result of a regression analysis of 1,227 police officers nationwide, police officers who are more aware of the merits of the autonomous police system are more positive about the introduction of the autonomous police system. Police officers who are more aware of the issues of political neutrality, differences in security service personnel costs, and problems of corruption were found to have more negative perceptions of the introduction of the autonomous police system.

절차적 공정성과 정당성 확보가 시민의 법준수 인식에 미치는 영향

Police require voluntary cooperation from the general public to be effective in controlling crime and maintaining order. Previous researches show that citizens are more likely to cooperate with the police and obey the law when they view the police’s authority as legitimate. one way that police can increase their legitimate and gain cooperation and respect from citizens is by using procedural justice. The purpose of this study was (1) to assess the impact of the procedural justice on legitimacy, compliance of law, empowerment for the police, and cooperation with the police; and (2) to examine the effects of legitimacy on compliance of law, empowerment for the police, and cooperation with the police. This study compared this normative perspective with instrumental perspective with seven hypotheses. On the basis of survey data on 2091 randomly selected in Seoul at 2013, this study finds that procedural justice influence on legitimacy, compliance of law, empowerment for the police, and cooperation with the police, after controlling instrumental variables. Further, this study finds that legitimacy influence on empowerment for the police and cooperation with the police. However, instrumental variables, such as degree of police crime fighting effectiveness, and perception of risk, also had strong effects on legitimacy, compliance with law, empowerment of police and cooperation with the police. Finally, several implications for future police policy are discussed. 경찰은 범죄와 질서유지에 효과적으로 대응하기 위해 시민들의 자발적인 협조가 필요하다. 선행 연구들은 시민들이 경찰을 보다 정당하다고 인식할 때 더욱 경찰에 협조한다고 보고하고 있다. 경찰이 시민들로부터 그들의 정당성을 높이고, 협조를 그리고 존경을 받기 위해서는 절차적 공정성에 노력할 필요가 있다. 이 연구의 목적은 첫째, 경찰의 정당성, 역량강화, 시민의 법 준수, 그리고 시민의 도움 의지에서 절차적 공정성의 효과를 분석하고, 둘째, 경찰의 정당성이 시민의 법준수, 경찰 역량강화, 그리고 시민의 도움 의도에 어떤 영향을 미칠 것인가를 분석하기 위함이다. 이 연구는 이러한 규범적인 관점과 도구적 관점을 7가지 가설을 통하여 비교하였다. 연구는 2013년 서울에서 무작위 추출된 2091명의 설문조사에서 획득한 데이터를 분석하였다. 우선 본 연구는 절차적 공정성이 도구적 변수들을 통제한 후에도 정당성, 법 준수, 경찰 역량강화, 그리고 시민협력 의도에 긍정적으로 영향을 미치고 있음을 보여준다. 또한 연구는 경찰의 정당성이 경찰의 역량강화 그리고 시민의 협력 의도에 영향을 주고 있음을 발견하였다. 그러나 경찰의 범죄 대응 능력에 대한 효과성과 처벌의 위험성 등과 같은 도구적 변수들도 경찰의 정당성, 법 준수, 경찰 역량강화, 그리고 시민의 도움 의도에 매우 강한 영향을 주었다. 마지막으로 연구는 미래의 경찰 정책에 대한 몇 가지 제안을 하고자 한다.

성범죄자신상공개자분석: 대구거주자를대상으로

급변하는 현대사회에 다양한 범죄행위와 일탈적 행위가 발생하고 있다. 이들 중에는 일반인의 상식으로는 이해할 수 있는 극단적인 형태의 범죄와 일탈 행위들이 포함되어 있어, 언론과 대중들의 폭발적인 관심과 두려움 또한 유발하고 있다. 특히 이러한 행위 또는 사건들은 사회로 부터 광범위하고도 극단적인 사회 반응을 유발하는 경우가 많은데, 성폭력범죄가 대표적인 형태라고 할 수 있을 것이다. 최근에 한국사회에서도 성폭력범죄에 취약한 어린 아이들을 대상으로 한 엽기적인 범죄 사건들이 연달아 일어남으로서 성범죄 자들에 대한 다양한 처벌과 제재를 부과하는 법률이 만들어 지고 있는 상황이다. 대표적인 것이 법률이 성범죄자 신상 공개제도라고 할 수 있을 것이다. 성범죄자 신상공개 대상자에 대한 많은 논란에도 불구하고 경험적인 분석연구는 한 번도 시도되지 않았다. 많은 논문들이 법적인 문제에 집중해 온 것이 사실이다. 본 연구에서는 신상공개 대상자들에 대한 연구를 데이터를 이용하여 경험적으로 접근해 보았다. 대구 지역에서의 성범죄자 신상 공개 명령을 받은 자들에 대한 기술적 분석을 통해 성범죄자 신상 공개자들에 대한 탐색적 연구를 시도해 보고자 한다.
