        擔保責任의 本質論

        The problem of security responsibility is one of the most important in the responsible legal system of civil law. About this, our present civil law has several provisions and their ambiguity is bringing about many discussion in interpretation. Above all things the theory of essence is the main issue.In regard to the theory of essence, the theory of legal responsibility and the theory of responsibility of default are contrasted and the former is supported incapability as a logic reason. Mainly the theory of legal responsibility takes that of a certain subject dogma and primitive. But this causes the inconsistence with the provisions of civil law. Even though of legal the theory is looking for the logical reason in the governer's claim right of Rome law, not inherited historically. The theory of legal responsibility based on the law of Rome cannot admit of being applied and the theory results in the over-estimation of sellers, causing the problem of distribution of profits. Therefore the essence of security responsibility should be that of default. If so, we can interprete indefinite subject transaction, sort-transaction, and security responsibility etc.Generally and consistently, the security responsibility of all the profitable contracts can be accounted for and consistent with the worldwide legislature trend. But as an effect of security responsibility, there remains the problem of the range of compensation for damage and general default.

        The problem of defective security responsibility is one of the most important in the responsible legal system of civil law.         This thesis deals with the effect on exercise of actio pauliana. It is very important to adjust every interests in the institution of actio pauliana because the institution of actio pauliana has the purpose that preserves the responsible property for all obligees and interferes in another legal acts. The relative nullity theory that majority opinions and precedents assert has fundamental questions. So for the purpose of avoiding that several theories has been evolved, but they has serious problems. Therefore if relative nullity theory is abandoned, the theory that regards the cancellation of actio pauliana as absolute nullity like cancellation of substantial law is rational in view of substance and theoretical fitness. Besides in concrete effect of actio pauliana need that must give canceling obligee right to be paid preferentially can be in existence. But because civil code article 407 regulates that all obligees are equal, suitable construction for civil code article 407 must be done. And the defendant of actio pauliana must include not only beneficiary but also rebeneficiary, too. I regard to construe like this as appropriate on the nature and the conformity of theory.

      • 템플릿 변형과 Level-Set이론을 이용한 비강성 객체 추적 알고리즘

        본 논문에서는 템플릿 변형과 Level-Set 이론을 사용하여 모델과 에지 기반의 객체 추적 방법을 제안한다. 제안된 방법은 배경의 변화, 객체 자체의 모양변화, 객체간의 겹침 등이 있는 경우에도 객체를 추적할 수 있다. 먼저, 객체 추적을 위해 템플릿과 목적 프레임간의 상호 영역 차이(Inter-region distance)와 에지 값으로 구성된 에너지 함수 PDEF(Potential Difference Energy Function)를 새롭게 정의한다. 이 함수는 객체 위치 및 경계 예측과 객체 모양 재결정 단계에서 사용된다. 객체 위치 및 경계 예측 단계에서는 객체의 변화가 어파인(affine) 변형을 따른다는 가정 하에 객체의 대략적인 모양 및 위치를 예측한다. 객체 모양 재결정 단계에서는 퍼텐셜 에너지 지도(Potential energy map)와 수정된 Level-Set 운동 함수를 사용하여 객체의 정확한 형태를 재결정한다. 실험결과에서 제안된 방법은 기존의 방법보다 배경의 변화가 큰경우, 객체 자체의 모양변화가 심한 경우, 객체간의 겹침이 있는 경우 등 다양한 상황이 포함된 동영상에서 정확하게 객체를 추적할 수 있음을 확인할 수 있다. In this paper, we propose a robust object tracking algorithm based on model and edge, using deformed template and Level-Set theory. The proposed algorithm can track objects in case of background variation, object flexibility and occlusions. First we design a new potential difference energy function(PDEF) composed of two terms including inter-region distance and edge values. This function is utilized to estimate and refine the object shape. The first step is to approximately estimate the shape and location of template object based on the assumption that the object changes its shape according to the affine transform. The second step is a refinement of the object shape to fit into the real object accurately, by using the potential energy map and the modified Level-Set speed function. The experimental results show that the proposed algorithm can track non-rigid objects under various environments, such as largely flexible objects, objects with large variation in the backgrounds, and occluded objects.

      • 워크스테이션 클러스트 환경에서 병렬 BMA의 구현 및 성능 분석

        본 논문에서는 동영상에서 움직임 벡터를 찾는 방법 중의 하나인 BMA(Block Matching Algorithm)를 워크스테이션 클러스터(cluster of workstations) 환경하에서 구현하고 이에 대한 성능 분석 모델을 제시한다. 동영상에서 움직임 벡터를 찾는 BMA는 영상처리 및 컴퓨터 비전 분야에서 널리 사용되는 방법으로 병렬화를 통해 처리 속도를 단축시킬 수 있는 알고리즘이다. 그러나 워크스테이션 클러스트 환경하에서는 데이터의 분할 및 각 노드간의 통신 방법에 따라서 전체적인 성능에 많은 영향을 미친다. 따라서 본 논문에서는 최적의 데이터 분할 및 각 노드간의 통신을 최소화하는 병렬 BMA를 설계 · 구현한다. 또한 데이터의 분할 및 각 노드간의 통신을 고려한 성능 모델을 제시하여 프로세서의 증가 및 데이터의 분배에 따른 성능을 예측하고, 실험 결과를 통하여 제시한 모델의 타당성을 입증한다.
