        중미(中·美)양자투자조약 협상을 통해 본 중국의 투자정책에 있어 변화

        그간 알려진 중미간 BIT 협상의 결과를 평가해 보면, (i) 규범적 측면에서 중국의 기타결 투자협정에 비해 투자자의 보호 및 대우 수준에서 가장 높은 협정이 될 것은 분명하며, 이 점에서 중국의 투자정책에 있어 진전으로 평가되나 미국이 요구한 “높은 기준”의 투자협정에 도달할 것인지는 아직 불명확하다. (ii) 시장접근 측면에서는 금번 중미간 BIT 협상은 중국이 네거티브리스트를 이용해 투자자유화를 약속한 최초의 사 례가 되었다는 점에서 중국의 기존 투자정책에서 최대 변화로 평가할 수 있다. 다만, 중국 측이 4차 협상까지 제시한 유보목록 제안에서의 투자개방 범위와 수준이 아직도 상당히 제한적일 뿐만 아니라 개방 영향이 큰 주요 산업 및 업종을 포함하고 있어 질적 측면에서는 한계를 보여준다. 이밖에 (iii) 투자협정의 전형적인 규율대상은 아니지만 미국이 협상의제로서 제기한 뉴 이슈들-데이터 흐름(data flows)에 관한 규칙 및 기타 데이터 관련 요건, 국영기업, 중국의 독점금지법과 같은 일부 국내법의 비차별적 적용, 강제 기술이전이나 현지화(localization) 정책 등-중 일부라도 협정문에 채택될 경우 이 는 상당히 진보적인 BIT로서 평가받게 될 것이나 중국이 이를 수용할 가능성은 높아 보이지 않는다. 중미간 BIT 협상에 대한 전망을 살펴보면 오바마 행정부에서의 협상 타결은 사실상 어려워졌고, 따라서 이는 차기 트럼프 행정부에게 넘겨지게 될 것이다. 트럼프 행정부 의 통상정책은 미국 우선(America First)을 강조하고 있고, 특히 중국에 대한 공격적인 무역정책을 예고하고 있는 관계로 중국이 상당히 전향적인 태도를 취하지 않는 한 중 미간 BIT 협상의 타결 가능성이 그만큼 낮아질 것으로 전망된다. Judging from the outcome of the ongoing negotiation of China-US Bilateral Investment Treaty as of December 2016, it is very certain that the China-US BIT would be the highest level of investment treaty which China has ever concluded in terms of the treatment and protection of investment and investor, compared with China’s other concluding investment treaties. In this respect, China-US BIT reflects the advance in China’s investment policy. However, it is still uncertain whether or not China-US BIT would reach “the high standard” of investment treaty which US has pursued. From the market access aspect, the China-US BIT negotiation can be evaluated as the biggest change in China’s existing investment policy in that China has accepted the investment liberalization commitments for the first time. However, they have limits both in quantitative and qualitative aspects in that China’s negative list not only contains lots of reservations to prohibit or limit the investment, but also excludes the core sectors or activities. Actually, the conclusion of China-US BIT will be up to Trump administration. The prospect of the China-US BIT negotiation seems to be dark because Trump administration has very tough stance toward China in its trade and investment policy.

        The Current Article begins by setting out some fundamental elements of the negotiations on opening of legal services market. It discusses the scope or the definition of legal services market as it pertains to WTO/GATS negotiations; introduces several standards in characterizing various types of legal services; analyzes distinct characters and current status of legal services market; and examines the demand for legal services and its trends. The current article goes on to overview the legal structure of, and standing commitments under WTO/GATS as regards the legal services market based on the List of MFN Exemptions and the Schedule of Specific Commitments. It finds that specific commitments made by member states of the WTO are generally characterized by restrictions of diverse fashion, leaving a lot of room for further liberalization. With negotiations on liberalizing legal services market set to be advanced as part of services negotiations under Doha Development Agenda (DDA), the current article tries to offer policy recommendations for Korea's request and offer as mandated by DDA negotiations. The current article analyzes key elements of legal services negotiations and viable options for each. It forecasts that Korea will face considerable pressure from main players in the negotiations including U.S. and EU, and recommends a comprehensive approach that encompasses demand as well as supply side of the equation to maximize positive effects of further liberalization while minimizing its ill effects.

        음경 배부정맥에 발생한 표재성 정맥혈전염 (음경의 Mondor병)

        Herein, two cases of penile Mondor's disease are described. The first was a 45-year-old man who complained of a small subcutaneous induration, with localized discomfort at the distal rim of the coronal sulcus of the penis. The other was a 46-year-old man who complained of similar symptoms of penile induration. The lesions were surgically removed under local anesthesia, and found to be thromboses of the penile superficial dorsal vein. As a result, the diagnoses of Mondor's disease of the penis were confirmed. (Korean J Urol 2004;45:399-401)

        인체 근육유래줄기세포의 말초신경재생 유도 효과

        Purpose: In this study, we evaluated the extent of functional and histological axonal regeneration after resection of the sciatic nerve. The nerve was repaired with silicone tubes filled with human muscle derived stem cells(MDSCs) and neuronal progenitor cells(NPCs) in nude mice. Materials and Methods: The human muscle samples were obtained from the rectus abdominis muscle of 12 patients that underwent a laparotomy. The MDSCs were isolated using a modified preplate technique. Using the MDSCs, neurogenic differentiation was induced by dissociating neurospheres produced in a neurosphere culture medium containing neuronal induction agents. A part of the sciatic nerve, approximately 7 mm in length, was excised bilaterally, and a 9mm long silicone tube guide was placed at the resulting gap in 40 nude mice. The transplanted sites were divided randomly into three groups according to the type of grafting cells: silicone tube guides filled with PBS(P group, n=20), silicone tube guides filled with MDSCs(M group, n=40) and silicone tube guides filled with NPCs(N group, n=20). Histological observations and a nerve conduction study were performed 12 weeks after the graft. Results: The number and diameter of the myelinated axons were significantly increased in the M and N groups(p<0.001). In a nerve conduction study, the amplitude of the compound muscle action potential(CMAP) and motor latency of response were significantly higher and shorter in the M and N groups(p<0.001). Moreover, reaction with neuronal class Ⅲβ-tubulin(Tuj1, a neuronal marker) and antiglial fibrillary acidic protein(GFAP, a glial marker) was observed in the regenerated nerve that originated from the M and N groups. Conclusions: These results show that MDSCs can differentiate into NPCs and improve the peripheral nerve regeneration rate after transplantation into a nerve guide.
