역사 왜곡과 법적 규제: 제주4·3특별법 제13조를 중심으로

Since the beginning of 2023, the distortion of history has become prominent, through the spread of false information about Jeju 4·3 and slander of victims and bereaved families. As a countermeasure, an amendment to reinforce the penal provisions in the 4·3 Special Act has been proposed and is pending in the National Assembly. This study questions the premise that increasing historical distortions can be re- sponded to through criminal regulations. The amendment to 4.3 Special Act (Article 13), which is linked to the penalty clause is expected to prevent the distortion of history; however, it is difficult to consider it a preemptive measure in a society where slander and disgrace are rampant. In addition, there is a risk that the issue of distorting history will deviate from the context of past liquidation and will be ghettoized as an issue confined to the bill while being separated from society. This study emphasizes the need for long-term planning tocritically ex- amine past liquidation experiences and analyze the causes and actual conditions across legal boundaries. The revision of the law is one of many options, and attention focused on it needs to be dispersed. In ad- dition, it is necessary to find the cause from a long-term perspective of the background and emotional structure of historical distortions that oc- cur and spread. It is time to list the specific tasks required to live in a society where historical distortion does not occur.
