분해기법은 일 단위 강수시계열 자료를 시간단위로 분해하는 데 주로 사용되고 있으며, 시단위 자료는 홍수예측을 위하여 주요하게 사용될 수 있다. 그러나 현재까지 제시된 대부분의 분해기술은 강우데이터가 추계학적 특성을 가지고 있다는 기본 가정을 전제로 하고 있기 때문에 모형을 구성하는데 있어서 강우자료의 물리적 특성을 반영하는 데는 한계를 보이고 있다. 이에 본 연구에서는 강우자료를 각기 다른 해상도로 변환하는데 따른 가중치의 동역학적 거동이 카오스 특성을 Disaggregation techniques are widely used to transform observed daily rainfall values into hourly ones, which serve as important inputs for flood forecasting purposes. 미국 캘리포니아주 법원에서의 애플 v. 삼성 간의 침해금지 가처분 청구 소송 및 항소심 판결

Since Apple, Inc. filed at lawsuit against Samsung Electronics,Inc. alleging that the defendant infringed Apple’s rights in design patents, utility patents, trademarks and trade dresses, similar lawsuits have been filed in other major countries. On July 1, 2011, Apple moved for a preliminary injunction seeking to enjoin Samsung from making,using, or selling two of its smartphones and a tablet computer. The Federal District Court for the Northern District of California, after thoroughly reviewing arguments and evidences proffered by both parties, denied the motion for preliminary injunction, from which Apple immediately appealed. The Court of Appeals for the Federal Circuit affirmed the lower court’s denial of a preliminary injunction with respect to the design patents related to smartphones and vacated and remanded for further proceedings on the part related to the design patents related to iPad table computer. On the design patent related to smartphones (D’087), the appeals court reversed the lower court’s decision on the validity of the design patents but did not vacate the denial of preliminary injunction because it affirmed lower court’s finding that there was no irreparable harm from refusing preliminary injunction. On the design patent related to table computer (D’889), the appeals court reversed the lower court’s finding of invalidity of the design patent. Since it affirmed the lower court’s finding of the existence of irreparable harm, the appeals court remanded the case for further proceedings on the remaining elements necessary to be reviewed for decision on the preliminary injunction. The order by the lower court and the decision by the appeals court render guidance as to how product designs created under the minimalist design trends will be protected by the court, how the court will delineate the scope of design rights, and standards of determining the validity of designs and infringement. 2011년 4월 15일 애플사가 미국 캘리포니아주 연방북부지법에 삼성전자를상대로 지식재산권 침해 소송을 제기한 이래 양사 간의 법적 다툼은 여러 나라로확대되었다. 2011년 7월 1일, 애플사가 삼성의 스마트폰과 타블렛 컴퓨터에 대한 판매금지 가처분 청구를 동일 법원에 제기하였다. 2011년 12월 2일 연방북부지법은 가처분 청구에 대한 기각 결정을 내렸고, 애플사는 항소했다. 2012년5월 14일에 연방순회항소법원이 하급심 법원의 가처분 기각 결정에 대해 일부지지, 일부 취소 환송 판결을 내림으로써 가처분 소송에 관련된 디자인, 특허와스마트폰, 타블렛 컴퓨터 간의 법적인 관계가 비교적 명확해졌다. 항소법원은 아이폰에 관한 디자인과 아이패드에 관한 디자인의 권리 유효성에대해 엇갈린 결론을 내렸던 하급심 결정을 뒤집고 모든 디자인에 대해 권리 유효성을 인정했다. 가처분 결정에 있어 중요한 요소인 치유불가능한 위해 가능성에대해서 항소법원은 하급심 결정을 일부 지지하고 일부 취소하였다. 결국, 아이폰관련 디자인에 대해서는 하급심의 가처분 기각 결정이 지지되었고, 아이패드 관련디자인에 대해서는 취소 환송을 통해 추가적인 검토를 통해 가처분 결정 여부를판단하도록 명령했다. 연방북부지법의 가처분 기각 결정과 항소심의 일부 취소 판결은 미니멀리스트디자인이 지배적인 추세가 된 현재의 디지털 기기 시장에서 미니멀리스트 디자인에 대한 디자인 권리의 보호 범위에 대한 지침을 준다.

일 강수발생모형을 이용한 월 단위 GCM의 축소기법에 관한 연구

본 연구에서는 IPCC DDC를 통해서 제공되는 월 단위 기후모형의 결과를 바탕으로 일 강수를 발생할 수 있는 일 강수 발생모형을 제안하고, 이를 이용해 기후변화가 일 강수빈도에 미치는 영향평가 기법을 기상청산하 서울지점을 대상으로 제시하고자 하였다. 본 연구에서 제안하는 일 강수발생모형은 2 state 마코브 체인 모형을 기반으로 개발되었으며, 강수를 발생시키는데 필요한 천이확률과 강수의 양을 결정짓는 Gamma-2 분포의 규모매개변수 및 형상매개변수는 회귀분석에 의한 월 총강수량과의 관계를 통해서 산정되었다. 제시된 회귀분석 결과에 기후모형으로부터 K-NN방법에 의해서 서울지점으로 축소된 월 총강수량을 적용하여 기후변화가 고려된 일 강수를 발생시켰다. 기후모형으로는 BCM2모형을 사용하였으며, 20c3m 시나리오를 기준시나리오로 하여 A2 시나리오에서의 일 강우빈도의 차이를 산정하여 관측된 일 강우 빈도에 적용하였다. 빈도해석을 위한 분포형으로는 Gumbel분포를 선정하였으며, 매개변수 추정을 위하여 확률기중모멘트 방법을 적용하였다. 연구결과 미래 서울지역의 빈도별 일 강수량은 2020s에는 다소 감소, 2050s, 2080s 에는 다소 증가하는 것으로 예상 되었다. This paper describes the evaluation technique for climate change effect on daily precipitation frequency using daily precipitation generator that can use outputs of the climate model offered by IPCC DDC. Seoul station of KMA was selected as a study site. This study developed daily precipitation generation model based on two-state markov chain model which have transition probability, scale parameter, and shape parameter of Gamma-2 distribution. Each parameters were estimated from regression analysis between mentioned parameters and monthly total precipitation. Then the regression equations were applied for computing 4 parameters equal to monthly total precipitation downscaled by K-NN to generate daily precipitation considering climate change. A2 scenario of the BCM2 model was projected based on 20c3m(20th Century climate) scenario and difference of daily rainfall frequency was added to the observed rainfall frequency. Gumbel distribution function was used as a probability density function and parameters were estimated using probability weighted moments method for frequency analysis. As a result, there is a small decrease in 2020s and rainfall frequencies of 2050s, 2080s are little bit increased.
