Deleuze and Agamben are two important philosophers in the modern world who explore the concept of ‘law’. Deleuze’s examination of law is closely intertwined with his theory of time, while Agamben’s study of law centers around the exclusion-inclusion structure. Both philosophers draw from Kafka to develop their ideas further. Deleuze interpretation of Kafka’s “Before the Law” highlights that the law, with its elusive concent, is only known through the imposition of punishment. He also delves into the relationship between law and time, particularly through the character of Titorelli, the painter in The Trial, who emphasizes the absence of absolute acquittal but instead mentions a state of “deferment.” Agamben approaches Kafka through Derrida’s interpretation of "before the law," which reflects on the situation of standing in front of an open door, where entry is “possible” but not allowed at the moment. This signifies our perpetual deferment of accessing the law. Agamben also conceptualized our relationship with the law as an exclusion-inclusion structure, where we exist in a state of neither f reedom nor unf reedom, unable to enter the law despite having the freedom to do so. Agamben’s reading of Kafka aligns with Deleuze’s idea that the law compels us even though its content remain hidden. By examining Deleuze and Agamben’s interpretations of law together, this paper aims to elucidate how they envision liberating individuals from the coercion of law.
