A Study on the Tasks and Prospects of Interational Commercial Arbitration in Northeast Asia

동북아시아 국가들은 세계 무역 및 투자에 중요한 역할을 담당하고 있다. 동북아시아 역내 및 역외 국가들과의 경제교류는 앞으로 계속 늘어날 것으로 전망되며, 이로 인한 국제상사분쟁은 국제상사중재 등 ADR에 의해 해결될 수밖에 없을 것이다. 동북아시아에서 ADR 제도가 발전되기 위해서는 무엇보다도 한국의 대한상사중재원, 북한의 조선국제무역 중재위원회, 중국의 중국국제경재무역중재위원회, 일본의 일본상사중재협회, 러시아의 러시아상공회의소 부설 국제상사중재법정, 카자흐스탄의 카자흐스탄국제중재기관, 몽골국가 중재법정 상호간의 중재 업무 전반에 관한 협력제제가 구축되어야 할 것이다. 국제상사중재에 관하여 동북아시아에 새로운 바람이 불고 있다. 경제자유구역 및 남북간 경제교류와 관련한 상사분쟁이 상사중재로 해결될 수 있는 법, 제도적 기반이 마련되었기 때문이다. 지난 해 한국에서는 대한상사중재원 주도하에 무역클레임 센서스가 실시되고 국제중재세미나가 개최되었으며 국제중재규칙이 제정(2007년도 2월 1일 시행 예정)된바 있다. 동북아시아 지역에서 국제상사중재제도가 발전되고 저변이 확대되기 위해서는 중재기관들 간의 협조체제가 구축되어야 할 것이다. 한편 한국도 동북아시아의 중재허브로 성장하기 위해서는 국제금융, M&A 등 중재 영역을 확대하고 경제자유구역 및 남북상사중재 등과 같은 새로운 영역에 대처를 잘 해야 할 것이다. 아울러 정부 당국의 재정적 지원과 행정적 배려도 수반되어야 할 것이다.

이 글에서 최근 영국 행정심판제도의 개혁에 관하여 다루었다. 영국은 전통적으로 행정사건을 특별하게 취급하지 않는 사법제도 국가라고 알려져 있다. 그러나 실상을 조사해 보면 행정사건을 처리하기 위한 많은 행정심판위원회가 존재하고 있음을 알 수 있다. 최근의 행정심판에 관한 대개혁을 살펴보면 영국의 행정사건 처리를 위한 별도의 사법제도가 생긴 것과 같은 현상을 목격할 수 있다. 영국식 법의 지배는 국가와 시민을 구별하지 않고 모두 보통법의 지배를 받는 것으로 이해되어 온 가운데 이런 변화는 우리에게 가히 충격적이라고 할 것이다. 영국의 행정심판은 이번의 법개정으로 전면적으로 개편되었다고 할 수 있다. 다이시가 말한 영국의 법의 지배는 행정에 관한 특별한 심리작용이 존재하지 않음을 의미하는 것은 아니고, 그러한 기능을 전담하는 특별한 법원이 설치되어 있지 않음을 의미했을 따름이다. 영국의 행정심판 개혁은 많은 시사점을 준다. 우리나라는 행정실체법은 대륙법제에 가까우면서도 절차법은 영미에 가까운 독특한 구조를 취하고 있다. 특히 현재의 행정심판위원회 제도는 영미의 제도의 영향도 많이 받았다. 영국은 전통적으로 행정에 관한 특별법원의 필요성을 부인하고 행정사건도 일반법원에서 처리하여야 한다는 원칙이 지켜져 왔다. 그럼에도 불구하고 실제적으로는 당사자들의 사법기관에 대한 출소의 길이 보장되어 있지 못하는 등 권리구제에 부족한 측면이 있었다. 2007년 영국 행정심판제도의 개혁은 행정사건에 대한 사법심사의 길을 활짝 열었다고 할 수 있는데 그런 의미에서 역설적으로 다이시가 말했던 법의 지배에 가장 가깝게 접근하는 기회가 되었다는 평가를 받기도 한다. 종전에 우리나라 행정심판제도의 개혁에 있어서도 행정심판의 사법적 성격 강화가 중요한 쟁점이 되었다. 재결청의 독립성 보장, 위원의 법적 지위 보장과 전문성 강화 등이 주장되었다. 또한 심판절차에서의 대심주의, 심리에서의 청구인의 절차적 권리보장 등이 강조된 바 있다. 종래 행정심판위원회를 설치하여 재결청과 독립된 법적 지위를 부여한 것도 당사자의 권리보장과 행정심판의 객관성 제고를 위한 조치로 평가할 수 있다. 이러한 개혁에도 불구하고 현재의 각종 특별행정심판은 종래 행정심판이 가지고 있던 불합리한 요소를 그대로 가지고 있다고 할 수 있다. 영국제도와의 비교법적 연구를 통하여 국민의 권리구제와 행정작용의 적법성 및 적정성 통제 등 행정심판의 이념실현을 위한 새로운 제도 구상의 시사점을 얻을 수 있었다. This study focuses on the recent reform of the British administrative review system. Traditionally, Britain has been known as having a judicial system that does not have special handling measures for administrative affairs. However, if we look closely, we can see that there are many administrative review councils operating that are devoted to dealing with administrative affairs. Looking at recent major reforms in administrative review in Britain, we can find Britain now has a separate judicial system for administrative affairs. As the traditional British judicial system does not differentiate between the nation and its citizens, all being governed by the Common Law, this change has come as a surprise. It can be said that the British administrative system has been completely reformed with this recent law revision. Dicey's rule of law did not mean that there was no special adjudication work for administration: it meant only that there was no special court set up to deal exclusively with such affairs functionally. British administrative reform is important for people in Korea. Korea's administrative substantive law is similar to the European legal system, but adjective law follows a particular structure close to the Anglo-American systems. In particular, the current Korean Administrative Appeals Commission system was influenced by the Anglo-American systems. Traditionally Britain has denied the necessity of special courts for administrative affairs and has maintained the principle that administrative affairs should also be dealt with in general sessions courts. However, in reality there have been shortcomings in rights protection as there is no guaranteed route for legal actions for the involved parties in the judicial system. The reform in the British administrative system in 2007 therefore opened up the judicial review for administrative affairs and in that sense, paradoxically, it has advanced to a position closest to Dicey's rule of law, as some observers have noted. Previously when reforms were made to the Korean administrative judicial system, it was considered important to reinforce the judicial character of administrative review, and suggestions were made such as securing the independence of the administrative tribunal, safeguarding of the legal position of the commissioners and reinforcing their professionalism. The adversarial system in the judicial review procedure and adjective right protection for applicants in w procedure anere also emphasized. The existing administrative judicial review commission was established to provide an independent legal position from the administrative tribunal, w ach can be evaluated as a n fsure to enhance the objectivity of administrative review and rights protection for those involvedproespite s and rform, various current al review ministrative reviews still contain irrational g en nts w ach nere present in traditionalew ministrative reviews. Through ctioarative res frch into the British legal system, this study aims to gain a fresh perspective for a new system to realize the ideals of the administrative review system such as rights protection for people and the legality and authenticity of administrative actions.
