반국가단체 북한의 국가 참칭의 내용적 메커니즘에 관한 연구

북한이 반국가단체라는 것은 우리 헌법질서에 따른 확고한 규범적 요청이다. 그렇지만 반국가단체론에 대한 이론적 뒷받침은 거의 없고, 국가보안법과 그 근거가 되는 헌법의 영토조항은 강한 개폐압력에 처해 있다. 이 논문은 반국가단체 북한에 대한 이론적 탐구를 해보려고 하는 시도로서, 반국가단체 북한의 국가 참칭의 내용적 메커니즘에 대한 연구라고 명명하였다. 북한의 '헌법'과 주요 개별'법'을 통해 북한'법'에만 고유한 조문의 내용을 살펴보면 북한은 '국가'를 혁명하는 조직으로 상정하고 있다. 곧, 북한은 '법'을 통해 국가의 조직과 운영에 필요한 부분을 포함하여 국가를 참칭할 수 있는 외양을 갖추고 있으나, 본질적인 부분은 국가가 아닌 혁명조직임을 표방함으로써 스스로 반국가단체에 불과함을 잘 드러내고 있다. 또한 이 논문은 반국가단체 북한의 국가 참칭의 메커니즘에 대한 이론적 설명을 시도하였다. 국가학에 비추어 북한 '국가'의 성격을 살피는 시도의 모순성을 지적하고, 범죄단체론 일반의 확대 적용을 통한 이론적 적용이 필요함을 제시하였다. 후속적으로 반국가단체 북한의 국제법적 외연에 대한 연구, 곧 북한이 국가가 아닌 국제법 주체로서 갖는 성격에 대한 탐구가 필요하다. 이는 국내법적으로뿐만 아니라 국제법적으로도 반국가단체 북한의 국가 참칭의 내용적 메커니즘이 인정되어야 하기 때문이다. North Korea is an anti-government organization by the Constitution and the National Security Law. This paper is to study theoretical basis on North Korea as an anti-government organization. Outwardly North Korea is a nation but it is a group of revolutionaries in reality by North Korean laws. North Korea can be called a revolutionary nation as a crime group.

선원의 과학적 및 주관적 수면측정과 수면효율성에 영향을 주는 환경요인 분석

Purpose : We conducted a study to propose comparing subjective sleeping states data that was collected through scientifically measuring by using smartwatch and surveys for seafarers. In addition, we conducted a study to provide sleep though analysis of the environmental factors that influence the sleep efficiency of seafarers. Methods : For scientific measurement of seafarers’ sleeping states, we measured the sleep hours and sleep efficiency for at least 3 days by using the healthcare function of smartwatches which are wearable devices. As for subjective sleeping states, we collected data on sleep hours and satisfaction rates on the quality of sleep through a survey. Lastly, as for the environmental factors that affect the sleep efficiency which is measured by smartwatches such as physical environment, bedroom space, bedroom furniture, bedding, a survey by self-evaluation method was conducted. Results : There were significant differences in the scientific sleep hours measurement values for all seafarers and the average sleep hours in the subjective survey. There were significant differences in the scientific sleep efficiency measurements of all the seafarers and the sleep satisfaction of the subjective survey, and there was no correlation between the scientific sleep efficiency and the subjective sleep satisfaction of all the seafarers. Among the environmental factors affecting the sleep efficiency of the seafarers, humidity variable had the most influence, and vibration and illuminance variables were also shown to have a very significant effect. Conclusion : We propose the measuring method that can analyze the quantitative and qualitative sleep states of the seafarers by using small activity recorders. In addition, it is very important to control humidity, vibration, and illuminance among ship environmental factors, and comfort, noise and bedroom size should also be reflected.

This paper is an overview of how North Korea itself considers the change of North Korean laws 70 years. The study is important because of its macroscopic perspectives although general studies of North Korean laws has been doing by approaching sub-themes respectively. It seems that there is little theoretical achievement of legal studies in North Korea since the late 1980s. Although the “Kwangmyeong Encyclopedia” the 3rd published in 2009 is the latest and simple, it covers North Korean general recognition of the change of North Korean laws 70 years. Because it is a kind of an encyclopedia it is believed to be handled the theme synthetically and systematically. The traditional knowledge is that socialistic laws are superstructure as reflection of base but North Korea regards laws as . This study shows the following results of North Korean laws 70 years ; North Korea considers the history of laws accompanied by the history of the regime. It asserts that both the regime and laws are consistently strengthened and developed through the leadership of the Great Leaders. The strengthening and developing direction is from superstructure as reflection of base to means of state management. This recognition has been constitutionalized since 1992. 이 논문은 70년간의 북한법의 사적 흐름을 북한이 스스로 어떻게 인식하고 정리하고 있는지를 개관한다. 기존의 북한법에 대한 일반적 연구는 각론적인 관점에서 이루어졌다는 점을 고려하면, 총론적 관점을 제공한다는 점에 이 연구의 중요성이 있다고 할 것이다. 1980년대 후반 이후 북한에서 법 관련 학술지는 계속 발간되고 있지만 주목할 만한 연구 성과라고 할 수 있는 것을 찾기는 어렵다. 그렇지만 2009년에 발간된 ‘광명 백과 사전’은 비교적 최근의 문헌이고 간략하면서도 백과사전의 특성 상 북한의 북한법에 대한 인식을 종합적으로 체계화하고 있다. 전통적인 맑스주의는 법을 토대의 반영에 불과한 상부구조로 보았지만 북한에서 법은 사회주의 국가관리의 도구로 적극적인 자리매김을 하게 된다. 이 연구를 통해 70년간의 북한법사에 대해 다음과 같은 결론에 이를 수 있다. 북한은 법에 대한 사적 흐름을 정권의 역사와 함께 살핀다. 정권도 법도 수령의 영도에 따라 일관되게 강화발전되어 왔다는 주장을 하고 있다. 북한의 법의 기능에 대한 인식은 ‘토대의 반영에 불과한 상부구조’라는 소극적 인식에서 ‘사회주의 국가관리의 도구’라는 적극적 인식으로 근본적으로 변화했다. 법의 위상과 관련한 북한의 근본적인 인식의 변화는 규범적인 지위까지 갖게 되었다. 1970-80년대 북한은 법제 정비를 본격적으로 시작했고, 그 성과를 바탕으로 1992년 헌법 조문에 국가관리의 기본 무기로서 법의 위상을 직접적으로 명시하기에 이르렀다.

북극해항로 선박운용 특성에 대한 연구 : 쇄빙연구선 아라온호 승선 중심으로

해양수산부는 2013년 북극해항로 시범운항을 계기로 북극해항로 상용화에 대비한 운항전문인력을 양성하기 위해 한국해양수산연수원에 사업을 위탁하여 극지해역 운항선박에 승선하는 선장과 항해사를 교육대상으로 하는 Ice Navigation 기초 및 직무교육과정을 개발하였다. 이 개발과정 중 전문교원이 극지연구소 소속 쇄빙연구선 아라온호에 승선훈련을 실시하여 북극권 고위도 해역에서의 항해장비와 통신장비 특성 및 운용, 얼음 및 운항정보, 결빙해역 쇄빙 및 선박조종 특성 등을 직접 경험하여 확인한 정보를 공유하고자 한다.
