영국보험법상 공동피보험자에 대한 보험자대위권의 행사

영국보험법상 보험자의 공동피보험자에 대한 보험자대위권 행사의 가부 및 그 법률적 근거는 최근까지 쟁점이 되어왔다. 이와 관련하여 본고에서는 논의의 전제로써 공동피보험자에 대한 피보험이익의 인정근거 및 보험자대위권의 인정근거가 되는 배상의 원칙에 관해 간단히 언급한 후 공동보험자에 대한 보험자대위권의 인정근거에 관한 영국판례의 변천에 관해 논의한 후 그 법률적 근거를 도출하고자 하였다. 이와 관련하여 순환청구배제의 원칙(Principle of Circuity), 보험계약상 묵시적 규정에 의한 접근방식(Implied Terms Approach) 및 기초계약의 해석(Construction of underlying contract)에 의한 접근방식이 이론적 근거로 제시되었는데, 관련 판례들의 내용을 검토함으로써 그 근거를 모색하고자 하였다. 특히, 최근에 선고된 영국 대법원의 The Ocean Victory 판결에 관하여 상술함으로써 선체용선계약상 공동피보험자에 대한 보험자대위권 행사의 근거를 살피고자 하였다. 이에 따라 영국법상 공동피보험자에 대한 보험자대위권의 행사의 근거로 인정된 보험계약상 묵시적 규정에 의한 접근방식 및 기초계약의 해석에 의한 접근방식 에 관한 논의가 우리 법상 어떤 의미를 가질 수 있는지에 관하여도 고찰하였다. Subrogation against co-insured has been much debated issue under English law. Before elaboration on the main topic, issues of insurable interest and principle of indemnity have been briefly touched upon and then detailed discussion for insurer’s entitlement to subrogation against co-insured under the composite insurance has been made with introduction to some of the representative English court judgments for the main issue. English court precedents have suggested various juridical basis for the insurer’s entitlement to subrogation against co-insured as principle of circuity, implied terms approach under the contract of insurance and construction of underlying contract. After review of English court precedents for main issue, detailed discussion is made for ‘The Ocean Victory’ case recently delivered by English Supreme Court. Lastly, possibility of the application for English court’s juridical basis such as implied terms approach under the contract of insurance and construction of underlying contract approach to the issue of subrogation against co-insured under Korean law is discussed.

경호직 직업윤리정립을 위한 경호무도교육 방안 연구

This study intended to consider precedent studies on professional ethics and security marital arts, analyze professional ethics education situation security marital arts education situation of the department related to guard and suggest the measures of security marital arts education for establishing professional ethics of bodyguard by dividing into studying and teaching aspect, systematic aspect and political aspect as follows. The first, security marital arts education must secure variety of educational methods from the studying and teaching aspect. The current classes of security marital arts focus on physical training of security marital arts. And, there is no theoretical class or it is progressed formally. Also, although students got marital arts training, all of them neither be excellent for the ability of marital arts nor have ideal spirit of marital arts mentally. So, when considering both mental aspect of marital arts and its physical training from monistic aspect which is the basic of marital arts, they can be professional bodyguards who have literary and martial arts. For that, the educational methods suitable for the standard of learners must be developed and applied by considering conditions of teaching method, limitations, effectiveness, etc. In most of departments related to guard, there are classes of security marital arts every semester from freshmen to seniors, so long-term educational methods must be studied so as to play an important role of majors by raising the rate of credits. The second, qualifications and professionalism of professors in charge of the subject of professional ethics of the guard must be considered from the systematic aspect. It's necessary to train professors who can suggest the solutions of professional ethics of the guard concretely based on the knowledge of understanding for bodyguard's ethical conflicts occurred in actual working place, sense of duty and general ethical philosophy and theory and teach them how to study. In the current universities and graduate schools, the subdivision of majors such as professional ethics, security marital arts, etc. is not achieved. In the training course of universities, graduate schools, etc, they must complete subjects related to professional ethics and security marital arts so that they can understand profession and professional world as well as obtain the knowledge of security marital arts' spirit and physical training for establishing professional ethics of the guard sufficiently. In addition, marital arts training for the measures of professional ethics education of the guard must be fulfilled not only schools but also general company lives after their graduation, so academic fundamental studies on the importance of security marital arts spirit's cultivation for the solution of ethical problems bodyguards are experiencing in educational institutions such as universities, graduate schools, etc. must be conducted continuously. The third, the opportunities of periodical training or seminar for establishing ethics of the guard in all kinds of societies and associations related to the guard must be provided from the political aspect. In addition, the opportunity developing level test for physical training of security marital arts and education which cultivates the guard's own professional ethics for mental training must be prepared in the qualifying examination related to the guard. 본 연구에서는 직업윤리와 경호무도에 관한 선행연구를 고찰하고 경호 관련학과의 직업윤리 교육 현황과 경호무도 교육 현황을 분석하여 경호직 종사자의 직업윤리정립을 위한 경호무도 교육 방안을 학습 및 교수 측면, 제도적 측면, 정책적 측면으로 구분하여 제시하면 다음과 같다. 첫째, 학습 및 교수 측면에서 경호무도교육은 교육방법의 다양성을 확보해야 한다. 현행 경호무도 수업은 경호무도의 육체적 수련을 위주로 이루어지고 있으며 이론수업이 없거나 형식적으로 진행되고 있다. 또한 무도수련을 했다고 하여 모두 무도 능력이 탁월한 것이 아니며 정신적으로 무도의 이상적인 정신성을 갖고 있는 것이 아니다. 그러므로 무도의 기본인 일원론적인 측면에서 무도의 정신적인 면과 육체적 수련이 함께 할 때 비로소 문무를 겸비한 전문 경호직 종사자로 거듭나기 위해서는 수업 방법의 조건, 제한점, 효과성 등을 고려하여 학습자 수준에 맞는 교육방법을 개발, 활용해야 한다. 대부분의 경호 관련학과에서는 1학년부터 4학년까지 매 학기 경호무도 수업이 있으므로 학점의 비율을 높여 전공과목의 중요한 역할을 할 수 있도록 장기적인 교육방법을 연구해야 한다. 둘째, 제도적 측면에서 경호직 직업윤리 과목 담당 교수의 자질과 전문성이 고려되어야 한다. 실제 직장에서 발생하는 경호직 종사자의 윤리적 갈등 상황에 대한 이해력, 사명감, 전반적 윤리철학과 이론에 대한 지식을 바탕으로 경호직 직업윤리문제 해결방안을 구체적으로 제시할 수 있는 교수의 양성과 연구 교육이 필요하다. 현재 대학, 대학원에서는 직업윤리, 경호무도 등 전공의 세분화가 이루어져 있지 않다. 대학과 대학원 등의 양성과정에서 직업윤리 경호무도 관련 교과목을 이수하여 직업과 직업 세계에 대한 이해뿐 아니라 경호직 직업윤리정립을 위한 경호무도의 정신성과 육체적 수련에 대한 지식을 충분히 습득하도록 해야 할 것이다. 또한, 경호직 직업윤리교육 방안을 위한 무도수련이 학교에서만 실시되는 것이 아니라, 졸업 후 직장 생활 전반에 걸쳐 실시되어야 하므로 대학과 대학원 등 교육기관에서 경호직 종사자가 겪고 있는 윤리적 문제에 대한 해결방안을 위한 경호무도정신을 함양의 중요성에 관한 학문적 기초 연구가 지속적으로 전개되어야 할 것이다. 셋째, 정책적 측면에서 경호직과 관련한 각종 학회 및 협회에서 경호직 윤리정립을 위한 정기적인 연수 또는 세미나의 기회도 제공되어야 한다. 또한 경호직 관련 자격시험에 경호무도의 육체적 수련을 위한 승단시험과 정신적 수련을 위한 경호직 특수 직업윤리를 함양할 수 있는 교육으로 발전할 수 있는 계기를 마련해야 한다.

중학생의 운동기능 수준에 따른 불안에 관한 연구

The purpose of this study is to investigate state anxiety level by making general middle school students objects. For this study, general middle school students whose numbers are 120 boys and 120 girls(total 240) are devided into each three 40 students according to their athletic skill levels. The implement of this investigation is the CSAI-2 which is invented by Martens in 1983. The way of analysis is performed by thinking that an athletic skill level (High Rank group/ Middle rank group/ Low rank group) is an independent factor, both state anxiety and sex distinction are dependent factors. The allowed level of hypothesis is established under (p $gt; 0.05) and in the case that there is a mutual working effect, the individual comparison of average is used through the way of Newan Keuls, verification.(P .05) As the result of analysis of this investigation, my research comes to conclusion as following; 1. In cognitive anxiety according to athletic skill levels of three boy groups, low rank group appears higher than middle rank group. middle rank group higher than high rank group. In the other words, there is a notable difference statistically. (P $lt; .05) 2. Although the somatic anxiety according to athletic skill levels of three boy groups appears high in middle rank group and low rank group, them is no notable difference statistically, and the somatic state anxiety level appears high between low and high rank group between middle and high rank group, there is a notable difference statistically. (P $lt; .05) 3. In the self-confidence according to athletic skill levels of three boy groups, there is a notable difference between high and middle. rank group, and between high and low rank group. But there is no notable difference between middle and low rank group with some statistic difference. (P $lt; .05) 4. In cognitive anxiety according to athletic skill levels of three girl groups, cognitive state anxiety appears high in low, middle and high rank group in the order described before and there is a notable difference statistically. (P $lt; .05) 5. In the physical anxiety according to athletic skill levels of girl groups. the somatic state anxiety level appears high between three groups, but there isn`t notable difference. (p $gt; .05) 6. In self-confidence according to athletic skill level of throe groups, the high rank group appears higher than middle and low rank group and middle rank group higher than low rank group and there is a notable difference statistically between them.(P $lt; .05) 7. About sex distinction of boy and girl, there is a notable difference between both ranks and sex distinctions. There is a mutual working effect between ranks, sex distinction.(p $lt; .05) 8. As there appears a notable difference between sec distinctions, conditions, there exists a mutual working effect. In other words, they effected each other. (p $lt; .05) 9. Because among sex distinctions, ranks, and conditions them is a notable difference, a mutual Working effects exist between them. (P $lt; .05)

차크라와 잉크젤을 융합한 네일아트 디자인 연구

This study applied color chakras and gemstone chakras using seven different energy wavelengths to the new gel nail art technique, ‘ink gel nail art’. Each chakra has its own position, feature, influence, and color, distributing energy all over the body following the gi (energy) flow path. The seven different doors of the chakra are associated with the colors of the rainbow. The color of the chakra ensures emotional stability through color therapy. Depending on the energy wavelength of the rainbow chakra, a base is created, using the thickness and contrasts of the ink gel through watercolor and marbling techniques. In addition, the dynamics of line art were emphasized using a hair pencil. Furthermore, an object was made with the gemstone for each chakra, expressing glamour and splendor with the active formative aspects of the color expressions. This study attempted to overcome the limitations of conventional nail art techniques by selecting colors, patterns, and gemstones for each image while suggesting and expressing a new nail art technique as well as proposing unique and creative convergence nail art patterns.

The purpose of this study is to analyze corporate Image of potential customers of the Kangwon-Iand casino and verify the relationship between the general image of the Kangwon-Iand corporation and ordinary impression of the Kangwon-Iand Casino. Therefore the effective marketing plan to improve the satisfaction of potential customers would like to visit the Kangwon-Iand and the corporate image. To accomplish this purpose, 201 out of 399 data were analyzed and then 6 factors of the Kangwon-Iand corporate image were drew from the factor analysis. The regression analysis demonstrated the effect of the corporate image factors to the overall recognition of the company and the impression of the Kangwon-Iand Casino.

지역문화축제 참가자의 관광행태 분석 및 경제적 파급효과 추정을 통한 발전방안 도출

Yul-Gok Cultural Festival 2008 is one of the most potential and representative one among the others in Paju city. In this research, economic impact of Yul-Gok Cultural Festival will be estimated through the investigation of visitors` behavior of visitation and the propensity to consume. In addition, the probability of Yul-Gok Cultural Festival as a representative one of the Paju city and the economic impact to Paju economic area will be presented with indication of development plan. The reason why the economic impact of Yul-Gok Cultural Festival was figured out very low comparing to budget is the most of visitors were came from Paju city, their residential area. Therefore, various plans to revitalize Yul-Gok Cultural Festival as a representative one of Paju, such as various advertisement and public relations attracting visitors from other cities, are needed. In order to bring the economic impact from this festival, various marketing plans including the relating area tour program through the medium of Yul-Gok Cultural Festival and expending lodging facilities to accommodate visitors needs to be established. Additionally, contingent valuation method (CVM) of cultural heritage needs to be discussed to understand cultural and educational value of grave of Teacher Yul-Gok as a precious history-cultural resource.

IPA 및 중요도 실행도 불일치(Gap)모형을 이용한 관광목적지로서 동굴의 활성화 방안 도출

The purpose of this paper is to analyze the effect of service quality to consumers` behavior of the visitors by applying IPA(Importance-Performance Analysis) and GAP model. To execute this research, the service quality according the importance and satisfaction of cave destination is measured through IPA. After that, Gap factors of the cave destination`s service quality are divided into positive, negative and overall discordance. Finally, the affects to the consumers` behavior is analyzed. The data for this study was collected from Aug.5th~6th, 2006 through the survey conducted to the visitors of the cave Go-Ci. Total 260 surveys were distributed to the visitors according to the convenience sampling method. By applying SPSS(15.0) and LIMDEP statistics package program, the final 251 surveys were used for analysis. According to the results of IPA for cave destination`s service quality, IPA matrix of cave visitors` shows us what needs to be kept up the good work, what needs to be concentrated here, what the low priority are, or what the possible overkill are. Additionally, the GAP model using the difference between Importance and Performance tells us it includes most of the items needs to be managed importantly found out from IPA. Although, both positive and negative gap affect to customers` re-visitation similarly, planning for reacting about the negative gap will more clearly improve the customers` satisfaction and re-visitation.
