        성폭력 피해자의 목소리 되살리기 : 박지원의 「함양(咸陽) 장수원(張水元) 의옥(疑獄)에 대해 순찰사에게 답한 편지」 연구

        본고는 연암(燕巖) 박지원(朴趾源, 1737∼1805)의 「함양(咸陽) 장수원(張水元) 의옥(疑獄)에 대해 순찰사에게 답한 편지」를 분석함으로써 박지원이 하층 여성 대상 성폭력 사건의 심리에서 어떠한 점을 중시했는지를 살펴보았다. 본고는 작품 분석에서 다음의 측면에 유의하였다. 첫째, 성폭력 사건 판결에서 중시되어야 할 피해자의 목소리를 박지원이 어떻게 담아냈는지 주목하였다. 둘째, 이 작품은 문학사, 생활사, 법제사가 교차하는 텍스트로서, 학제적 방법론을 바탕으로 심층 분석을 수행하였다. 이 작품에서 박지원은 성폭력 피해자 한조롱이 자살하기 전 남긴 머리카락에 주목하였다. 한조롱의 머리카락은 피해 사실을 증언하고자 한 한조롱의 목소리를 상징한다. 머리카락의 의미를 서술함으로써 박지원은 성폭력 피해자를 위한 ‘대신 말하기’의 책무를 수행하였다. 이를 통해 박지원은 피해자를 비난하며 사건을 왜곡하려던 가해자의 시도를 차단하였으며, 공적 담론에서 소홀히 다루어졌던 피해 여성의 감정과 목소리를 표면화하였다. 피해자의 목소리를 중시해야 한다는 박지원의 지향은 그의 법적 판단에도 일관되게 적용되었다. 박지원은 『대명률』의 위핍인치사 조에 따라 가해자 장수원을 사형에 처해야 한다고 생각하면서도, 현실적으로는 성폭력 사건에서 위핍인치사 조 적용에 보수적이었던 정조의 입장을 의식할 수밖에 없었다. 당대의 사법 관행을 염두에 두면서 피해자의 입장이 최대한 반영될 수 있도록 박지원은 위핍인치사에 버금가는 강간 미수의 죄율을 적용하자는 결론을 내렸다. 이러한 결론은 머리카락에 담긴 한조롱의 목소리에 근거한 것으로, 성폭력 피해자의 고통에 대한 박지원의 예민한 감수성을 보여 준다. This article examines Yeon-am(燕巖) Park Ji-won(朴趾源, 1737∼1805)’s perspective on sexual violence toward low class women by analyzing The Letter to Sunchal-sa(巡察使) on Hamyang Jang Soo-won’s Case. The analysis of this prose pays particular attention to the following aspects. First, how Park Ji-won expressed the victim’s voice in this letter, which is a crucial element in the case of a sexual violence. Second, taking an interdisciplinary approach to this work, since it is a literary, life history, as well as a legal history text. In this work, Park Ji-won paid attention to the sexual violence victim Han Jo-rong’s hair, which she left before committing suicide. Han Jo-rong’s hair represents Han’s voice and desire to testify her pain as a victim of sexual violence. Through narrating the meaning of her hair, Park Ji-won carried out his responsibility for ‘speaking for the other.’ It blocked the assailant’s attempt to blame the victim and distort the truth and allowed the female victim’s voice heard, which was often neglected in public discourse. Park Ji-won’s belief that the victim’s voice should be regarded important was also reflected in his legal judgment of this case. Though he thought that the assailant Jang Soo-won should be executed according to wee-peep-in-chi-sa(威逼人致死: harassment leading to death) clause of The Great Ming Code(大明律), Park practically had to consider Jung-jo’s conservative attitude in applying this clause to sexual violence cases. Park tried to consider the position of the victim as much as possible when determining Jang’s sentence, while keeping in mind the judicial practice of the time. Therefore, he concluded Jang should be punished for attempted rape, which was second in severity to the wee-peep-in-chi-sa crime. His conclusion was based on the voice of Han Jo-rong which was implied in her hair, and it shows his keen sensitivity to the pain of the sexual violence victim.

        섬유보강 다공성 옥상녹화 황토콘크리트의 물리·역학적 및 온도변화 특성 평가

        The physical, mechanical, water purification and temperature properties of fiber reinforced porous hwang-toh green roof concrete have been evaluated in this study. The effect of the depending on replacement ratio of blast furnace slag to cement was investigated such that the replacement ratio is varied to 0 % and 30 %. Also, the replacement ratios of hwang-toh were 0, 20 and 30 %. The polyvinyl alcohol fiber was used for the reinforcing fiber. A series of pH test, unit weight, void ratio, compressive strength, after purification and variation of temperature test have been performed to evaluate the performance, water purification effect and temperature properties of the fiber reinforced porous hwang-toh green roof concrete. The test results indicate that the physical and mechanical properties of fiber reinforced porous hwang-toh green roof concrete is affected by the replacement ratio of the blast furnace slag and hwang-toh contents. Results of purifying water showed that the water purification effect of porous hwang-toh green roof concrete is about 40 %. Also, the temperature properties test results indicate the green roof blocks using fiber reinforced porous hwang-toh green roof concrete have insulation and temperature reduction effect.

        혼수상태의 외상환자에서 초음파를 이용한 흉부 및 복부손상의 진단

        The need for rapid diagnosis and treatment of life-threatening thoracic and intra-abdominal injury result in controversy over the appropriate triage of unconscious blunt trauma patients. To aid in early decisions for these patients, a prospective analysis of 98 patients with glasgow coma scale(GCS) scores≤8 was undertaken. Although intra-thoracic and intra-abdominal injuries were frequently identified based on systolic blood ressure, the use of clinical signs alone resulted in more missed injuries than did using the emergency ultrasonography. In normotensive patients(n=34), intra-thoracic injuries was identified in one patient(2.9%), and intra-abdominal injuries were in 7 patients(20.6%). In shock(systolic blood pressure<90mmHg) Pa-tients(n=64), thoracic injuries and intra-abdominal injuries were diagnosed in 8(12.5%) and 27 patients(42.3%), thoracic and abdominal combined injuries were identified in 11 patients(17.2%). The sensitivity, specificity, and accuracy of emergency ultrasonography were 96.3%, 91.7%, 94.9%. This study suggests that all unconscious trauma patients undergo immediate emergency ultrasonography to prevent missing life-threatening injuries.

        비소성 무기결합재를 사용한 무시멘트 다공성 식생콘크리트의 물리·역학적 특성 및 동결융해저항성 평가

        The physical, mechanical and freezing and thawing properties of non cement porous vegetation concrete using non-sintering inorganic binder have been evaluated in this study. Four types of porous vegetation concrete according to the binder type is evaluated. The pH value, void ratio, compressive strength, repeated freezing and thawing properties were tested. The test results indicate that the physical, mechanical and repeated freezing and thawing properties of porous vegetation concrete using the non-sintering inorganic binder is increased or equivalent compared to the porous vegetation concrete using the blast furnace slag + cement and hwang-toh + cement binders. Also, Vegetation monitoring test results indicate the porous vegetation concrete using the non-sintering inorganic binder have increasing effects of vegetation growth.

        These experiments were conducted to investigate the pharmacological difference between Soo-Bi-Jeon and Kwi-Bi-Tang extract,, clinically used in gynecology, on the hemostasis and the contractile force of the isolated uterine muscle. For this purpose, the effects of the extracts on the bleeding time in mouse tail and prothrombin time in vitro were estimated. Forthermore, its activity on the isolated uterine muscle in rats were investigated. The results obtained were as following; The bleeding time and prothrombin time were significantly shortened compared with the control group in all samples, The uterotonic action produced by Kwi-Bi-Tang(Sample II), Sample III and IV (the same component crude drugs between not blocked by atropine (10^(-7)M) and cyproheptadine (10^(-7)M). but inlhibited by pretreatment of verapamil (10^(-7)M). On the oter hand, Soo-Bi-Jeon(Sample I) extract relaxed the uterine muscle.

        반응표면 분석법을 이용한 천연마섬유보강 순환굵은골재 콘크리트의 성능 평가

        In this study, evaluated ware the strength and durability of the vegetated water purification channel concrete to which recycled aggregates, hawang-toh and jute were applied. Box-Behnken method of response surface analysis in statistics was applied to the experimental design. Experimental variables are as follows, recycled coarse aggregates, hawang-toh, blast-furnace slag and jute fiber. In the experiment, conducted were the tests of compressive strength, chloride ion penetration, abrasion resistance and impact resistance the replacement rate effects of the recycled aggregates, blast-furnace slag and hwang-toh on the performance of vegetated water purification channel concrete were analyzed by using the response surface analysis method on the basis of the experimental results. In addition, an optimum mixing ratio of vegetated water purification channel concrete was determined by using the experimental results. The optimum mixing ratio was determined to be in 10.0% recycled coarse aggregates, 60.0% blast-furnace slag, 10.1% hwang-toh and 0.16% jute fiber. The compressive strength, chloride ion penetration, abrasion rate, and impact number of fracture test results of the optimum mixing ratio were 24.1 MPa, 999 coulombs, 10.30 g/mm3, and 20 number, respectively.

      • Kitamori Model을 利用한 安定化 多變數制御系 設計

        본 논문에서는 부분모델 매칭법을 사용하되, 안정성확보를 위해 극배치를 고려한 다변수제어계 설계법을 제안하고 예제를 통해 이의 효용성을 입증하였다. 이 설계법은 폐루프 전달함수를 저차에 우선하여 Kitamori Model과 매칭시키되, 상승시간 Σ를 가변 파라미터로 한 후 안정성 확보를 위해 폐루프전달함수의 극점들이 복소평면 135°∼225°내에 있되, 우세근 실수부의 절대치가 최대가 되는 근집합의 Σ를 선정함으로써 제어기를 설계하는 방법이다. In this paper, a design method based on partial model matching and pole placement for stability, which is applied to multivariable control system and illustrate the effectiveness by a design example. Namely, closed loop transfer function having priority of low order is matched with kitamori's reference model, and the rising time Σis designated to variable parameter. For stability, Σof controller is selected so that poles of closed loop transfer function are located in complex plane 135°∼225° and absolute value of dominant pole is maximum, and then the controller is accomplished in accordance with the value of Σ.

      • 강원도 삼척지역의 스멕타이트질 점토의 산상 및 특성

        The smectite-rich clays were found locally in Paleozoic calcareous sedimentary rocks in the Samcheok area. Their occurrences were investigated in detail, and the physico-chemical properties of the clays were also determined by X-ray diffraction, chemical analysis, thermal analysis and cation exchanging experiment. The smectitie clays occur as the fissure filling dyke developed in calcareous semimentary rock and as alteration products of instrusive rhyolite. Most of clays occur at the contact between the sedimentary rock and the rhyolite, and the alteration zone was observed only in rhyolite body close to the contact. Judging from their occurrences, it is believed that the smectite-rich clays in this area were formed by the hydrothemal alteration. The smectite clays from the area are mainly composed of Ca-montmorillinite, and associated with small quantities of quartz, opal-CT and feldspar. The montmorillinites from this area lower in Fe content, and higher in exchangeable Ca ion, compared to those of bentonite from the Yangnam-Yeongil area.
