포괄적보육서비스 담당 사회복지사의 슈퍼비전에 관한 탐색적 연구

본 연구는 포괄적보육서비스와 슈퍼비전에 대하여 이론적으로 검토하고 보육시설에서 포괄적보육서비스를 담당하는 사회복지사에 대한 경험적 슈퍼비전 사례를 카두신의 슈퍼 비전 모델에 근거하여 분석하였다. 또한 포괄적보육서비스를 담당하는 사회복지사에 대한 슈퍼비전 사례분석에 따른 함의를 모색하였다. 특히 본 연구자가 3년간 담당한 포괄적보육서비스 담당 사회복지사 슈퍼비전 사례를 분석하여 보육현장에 적합한 포괄적보육서비스 담당 사회복지사의 슈퍼비전 방향을 제시하고자 하였다. 본 연구는 현재 보육시설에 근무하는 사회복지사의 수가 많지 않으나 경험적 사례연구를 통하여 사회복지사의 자질을 제고할 수 있는 슈퍼비전 방향을 제시함으로서 향후 시행 예정인 포괄적보육서비스 담당 사회복지사의 자질 향상에 적용 가능한 슈퍼비전 방법을 제시하였다는데 의의가 있다. This study reviews comprehensiveness of child care services and supervision in theories. Based upon Kadushin's model of social work supervision, this paper analyzes experienced supervision of social workers who take charge of comprehensiveness of child care services in day care center. Also it searches for implication with regard to social work supervision in comprehensiveness of child care services. Especially this paper closely looked into the case of social workers' supervision in comprehensiveness of child care services for three years. Even though there is only a few social workers who are active in child care center, it is significant that applicable models of supervision are discussed in this paper in order to raise qualifications of social workers through experienced case studies.

저작권법상 링크와 링크사이트의 법적 성격에 관한 검토

링크사이트가 웹하드에 이어 불법 콘텐츠 유통의 주요 채널이 되면서, 세계 각국에서 이의 규제에 관한 논의가 확대되고 있다. 유럽사법재판소는 Svensson 판결에서 링크로 인하여 저작권자가 최초 전송을 허락할 때에 고려되지 않은 ‘새로운 공중’에게 접근이 가능하게 된 경우에는 그것이 저작권자로부터 허락을 받아야 하는 공중전달(이는 우리 저작권법상 전송에 해당한다)이 된다고 판시했다. 이 판결은 공중의 링크 대상 정보에의 접근 가능성을 기준으로 링크를 분류할 필요가 있음을 시사한다. 이에 본고에서는 링크를 공중의 접근이 금지된 정보에의 링크, 공중의 접근이 제한된 정보에의 링크, 그리고 공중의 접근이 개방된 정보에의 링크 세 가지로 분류할 것을 제안하였다. 이 중에서 공중의 접근이 금지된 정보에의 링크를 통해 정보가 공중이 접근가능하게 되었다면 그것은그 정보를 처음으로 공중 또는 새로운 공중의 이용에 제공하는 것이므로, 그 자체가 전송에 해당하고, 일본 저작권법상 제5의 송신가능화 행위에 해당할 수 있다. 유럽사법재판소는 사용료의 지불을 통한 회원가입 등 이용자가 선택가능한 접근 제한을 우회하는 링크를 통해서도 ‘새로운 공중’ 기준이 충족된다고 보았으나, 새로운 공중 기준은 공간이나 시간 등에 관한 제한처럼 이용자가 선택할 수 없는, 시장을 분할할 수 있는 제한을 우회하는 것에 의해서만 충족될 수 있다. 잠재적 이용자는 새로운 공중이 될 수 없다. 정보에의 접근을 지원하는 서비스를, 야후로 대표되는 디렉터리 서비스와 구글로 대표되는 검색 서비스에 이은 큐레이션 서비스의 세 가지 서비스로 제시하고, 링크와 달리 링크사이트가 저작권 산업에 파괴적 위력을 발휘하고 있는 이유를 그것이 이 제3의 서비스인 큐레이션 서비스의 형태를 취하고 있음에서 찾았다. 링크사이트 운영의 특징을 실제로 분석하면서, 그것이 저작 권법이 정하고 있는 네 가지 면책 요건에 부합하지 않는 것을 확인하였다. 큐레이션 서비스는 운영자의 주의 깊은 지속적인 관리를 필요로 하기 때문에 속성상 이들 요건을 충족할 수 없기 때문이다. As the link-sites has become the main channel of trafficking illegal content following cyber-lockers, there has been hot debate on how to regulate them. Court of Justice of the European Union ruled in 2015 that where a link makes it possible for users which were not taken into account by the copyright holders when they authorized the initial communication of the protected work, the users must be deemed to be a ‘new public’ and accordingly the holder’s authorization is required for such a communication to the public. This reasoning asks a new classification of links on the basis of the possibility of public access to the targeted works. Accordingly I propose to classify links into three types, i.e. links to the works to which the public is prohibited to access, links to the works to which the public is restricted to access, and links to the works to which the public is free to access. Where a link makes it possible for public to access to a work to which the public is prohibited to access, it means that the link makes the works available to the public for the first time. In this case, the linking could be 5 th type of making transmittable in Japanese Copyright Act. CJEU ruled that ‘new public’ criterion could be fulfilled with the link that circumvent restriction which could be disposed by the users, such as subscription or paywall. The potential users who cannot access to the protected works due to the disposable restriction should be considered the public which was taken into account at the time of the initial communication to the public. Accordingly the restriction related to the new public should be restricted to the one which could not be disposed by the users, so could devide markets for the works, such as space restrictions, e.g. accessible for the specific country IP only, and time restrictions. The potential users cannot be the new public.The services which assist users to access to the information on the Internet can be classified into three types, i.e. directory service represented by ‘Yahoo’, search service represented by ‘Naver’ and ‘Google’, and curation service. The reason that rink-sites have such a destructive influence on the content industry differently from mere linking could be explained by the fact that link-sites provide curation service which complements the shortcomings which search service and directory service has. Accordingly link-sites as a curation service could hardly satisfy the four conditions enumerated in the Copyright Act for a safe harbour, because curation service means careful and continuous management by the operators.

종교단체부설 지역아동센터의 사례관리 발전방안에 관한 연구

최근 교회가 지역사회에서 봉사를 수행함에 있어서 양적으로 볼 때 지역아동센터가 차지하는 비중이 높다. 본 연구는 2013년 지역아동센터 심화평가에서 종교단체에서 운영하는 131개소(11.5%)의 지역아동센터가 운영하는 지역아동센터 심화평가결과 중 아동영역을 분석하고 이에 대한 보완점을 모색하고자 하였다. 분석결과 아동영역에 대한 평가결과는 다른 영역에 비해 평가결과가 다소 낮게 나와 개별 아동관리, 즉 사례관리에 대한 접근이 아직까지 체계적으로 진행되지 못하고 있음으로 사례관리에 대한 체계적인 지원과 교육이 필요한 것으로 보인다. 이에 따라 아동영역의 발전을 위한 사례관리 강화방안을 제시하였다. Recently when the church services in the community society, the community child center quantitatively covers the most. We studied to analyse and to seek supplement point the children area from community child center deeper evaluation results operated by 131(11.5%) community child center managed by religion center from 2013 child community center deeper evaluation. The results of the analysis of the evaluation result about children area is less than other areas. The individual child care, in the other word the case management, is still not systematically progressing so it seems to need systemic support and education for case management. Thus we adduce a strengthening of case management plan for child area development.

사회복지사 윤리의식이 전문성을 매개하여 직무만족도에 미치는 영향

본 연구는 경기북부지역에서 활동하고 있는 사회복지사의 윤리의식 수준을 파악하고, 윤리의식과 전문성 및 직무만족도와의 관련성을 통해 사회복지사로서의 윤리의식 수준이 전문성과 직무만족에 어떠한 영향을 주고 있는가를 확인함으로써 전문가로서 효율적이고 질적인 서비스 수행을 위해 필요한 제도 및 정책적인 제안을 목적으로 한다(이정숙, 2020). 연구를 위해 경기북부지역 복지관에 근무하는 사회복지사를 대상으로 설문조사를 실시하여 146명이 설문에 응하였고, 그중 불필요한 2부를 제외한 총 144부를 활용하였다. 분석결과, 첫째, 사회복지사 윤리의식의 하위요인 중 동료 윤리기준은 직무만족도에 유의한 영향을 미치는 것으로 나타났다. 둘째, 사회복지사의 윤리의식은 전문성에 영향을 미치는 것으로 나타났다. 셋째, 사회복지사 윤리의식과 직무만족도의 관계에서 전문성은 부분 매개역할을 하는 것으로 나타났다. 위의 결과를 바탕으로 사회복지사의 윤리의식의 향상은 자신의 전문성과 직무만족도를 높임으로써 서비스이용자가 체감하는 복지의 수준을 향상시키는 데 기여할 수 있을 것이라는 결론을 제시하였다. 따라서 사회복지사의 윤리의식을 향상시키기 위해서는 보다 실질적인 대책이 마련될 필요가 있다. The purpose of this study is to identify the level of ethics of social workers working at social welfare sites in Gyeonggi-do, and to identify how the level of ethics and professionalism and job satisfaction affects professionalism and job satisfaction. In order to achieve the research purpose, a survey was conducted on social workers working at the Northern Gyeonggi Welfare Center and 146 people responded to the survey, with a total of 144 copies being used in the study. First, among the sub-factors of social worker ethics awareness, peer ethics standards have been shown to have a positive (+) significant effect on job satisfaction. Second, ethics awareness of social workers has been shown to have a positive influence on professionalism. Third, professionalism has been shown to play a part in the relationship between social worker ethics and job satisfaction. Based on the above results, it was concluded that enhancing the ethics of social workers will contribute to raising the level of welfare that clients feel by increasing their professionalism and job satisfaction. As a result, more practical measures need to be taken to enhance the ethics of social workers.

중국 농촌 조선족 저소득층 결손가정 아동의 심리사회적 특성에 영향을 미치는 요인 연구

This study classified the low-income broken family, brought by rapid social changes such as chinese economic reform and opening to foreign nations, as a new family form and analyzed main factors effecting psychosocial characteristics of low-income broken-family korean-chinese children living in china’s rural communities. As a result, it was found that the main cause of broken family formation was due to going abroad to make money, unlikely divorcing in korea. And it was analyzed that korean-chinese children’s aggression and nurturing attitudes and school support by their guardians were more positive than those of korean children. Especially it was found that korean-chinese children’s satisfaction level of their present lives had the biggest influence in their pychosocial characteristics and the next was the nurturing attitudes of their guardians. Based on the findings, it was asserted that various program treatments to improve up children’s present lives and active interventions on their guardian’s nurturing attitudes were required. 본 연구는 중국의 경제개혁과 대외개방 등 급격한 사회변화로 인해 발생한 저소득층 결손가정을 새로운 가족형태로 분류하고, 중국 농촌 조선족 저소득층 결손가정 아동의 심리사회적 특성에 영향을 주는 요인을 분석하는데 주목적이 있었다. 연구결과, 조선족 아동의 결손가정 형성의 주요 원인은 한국과 같이 부모의 이혼이 아니라 외국인력 송출이었으며, 한국아동에 비해 공격성, 보호자양육태도, 학교지원이 긍정적이었다. 특히, 아동의 현재생활에 대한 만족도가 아동의 심리사회적 특성에 가장 큰 영향력을 미쳤고 그 다음으로는 보호자의 양육태도로 분석되었다. 이러한 연구결과에 터해 아동의 현재생활 만족 향상을 위한 프로그램 투입과 보호자의 양육태도에 관한 적극적인 개입이 필요함을 밝혔다.

아동양육시설 자립지원전담요원의 직무수행실태에 관한 연구

본 연구는 아동양육시설의 자립지원전담요원들의 직무수행 실태를 분석하고 그에 따른 개선방안을 제시하는데 연구목적이 있다. 이를 위해 2015년 3월 2일부터 10월 2일까지 총 7개월간 전국 240개의 아동양육시설 자립지원전담요원을 대상으로 자료를 수집하고, 전수조사를 실시하여 114명의 설문지가 본 연구의 분석대상으로 활용되었다. 분석방법은 SPSS(PASW) 18.0을 통해 연구대상자의 인구사회학적 특성과 직무수행 실태를 살펴보기 위하여 빈도, 백분율, 평균, 표준편차 등의 기술통계 분석을 실시하였다. 연구 결과를 요약하면 다음과 같다. 자립지원전담요원 대다수(89.5%)가 자립지원업무 이외의 추가 업무를 하고 있는 것으로 나타났다. 자립지원전담요원의 역할 중 어려운 점을 조사한 결과, 업무과다로 인한 어려움이 57.1%, 아동들의 참여 동기 부족이 51.8%, 필요한 예산의 부족이 36.8%의 순으로 나타났으며, 직무수행상의 자율성은 대체로 갖고 있다(46.5%)가 가장 많은 비율을 차지하였다. 이러한 연구결과를 토대로 정책적·실천적 차원에서 함의와 제언을 제시하였다. 본 연구는 아동양육시설 자립지원전담요원의 전수조사를 통해 이들이 각 시설에서 수행하고 있는 직무영역에 대한 세부 내용과 영역별로 초점을 맞춰 구체적으로 조사했다는 점에 의의가 있다. This research has a purpose of analyzing reality and level of Independent Support Specialist who work at Children Nurturing Facility in charge of the self-reliance process, and discharge and propose an improvement plan for difficulty in task performance. From March 2nd of 2015 to October 2nd, total of 7 months, we have given survey questionnaires in order to gather data and done a total inspection of specialist in 240 facilities nationwide. There were 119 specialists, who participated in this research, but we excluded dishonest answers, 114 responses were used. The qualitative research method has used SPSS(PASW) 18.0 to analyze research target`s demogr aphic characteristics and frequency, percentage, average, standard deviation for the actual perfor mance task. Looking through Independent Support Specialist`s working condition and facility`s Independent Operation System`s current status; it has shown that most of the specialists (89.5%) are doing additional duties besides Independent Support duties. As of difficulties in working as Independent Support Specialists, 57.1% has answered excessive task, 51.8% answered childre n`s lack of participation motivation, 36.8% for shortage of necessary budget and 46.5% of speci alists have answered that they have a flexible schedule in handling tasks. As the research results are stated, when we suggest practical and policy-based. Through this research, we were able to look into Independent Support Specialist`s specific tasks in different areas. Also, we were able to surpass the limitations by combining quantitative and qualitative research.

목회자가족의 아동복지시설 운영사례연구 : 피얼스애육원 설립자(정원근 목사)가족을 중심으로

The Korean War left tons of war orphans and it led many foreign organizations to support and protect the war orphans by installing nationwide child welfare institutions. Since most foreign organization were started as a part of mission strategy, they built or supported a child welfare institution with Christianity background. This study is based on a case study of operation of Won Geun Jeong family’s child welfare institution. Pastor Jeong named the institution a Pierce Infantorium because he had a connection with Pastor Robert Pierce, the founder of World Vision International. The analysis was based on the life history analysis of Pastor Won Geun Jeong, the founder of Pierece Infantorium, and his books. Also it was based on the process of his spouse, the second director, his second daughter, who worked as a secretary general, and his daughter-in-law, the third director. There were many cases of operating child welfare institution as a pastoral family at that time. However few cases have been concretely summarized. From the Korean War up to the present day pastoral families have contributed to social welfare in various ways, but they are confronting criticism as well as compliment. Through this case study, I hope that more objective research on the participation of pastoral families in social welfare will be actively conducted so that it will be a lesson for future generations.
