치안서비스 민간참여에 관한 연구

오늘날 공공분야의 민간위탁은 비용효과와 수요자 변화에 따른 탄력성 확보가 유리하고, 사업의 관리가 용이하다는 이유로 대부분의 공공사업 분야에서 실시되고 있는 상태이다. 이러한 사회적 변화는 치안구조와 지역방범체계의 변화 등과 함께 공공 치안서비스 부분의 민간위탁제도를 도입하는 문제에 대하여 많은 논의가 이루어지고 있다. 그러나 위탁사업 대상 범위의 제한, 민간 참여의 어려움 그리고 위탁 계약방식의 한계와 같은 문제점들로 인하여 치안서비스 분야의 민간위탁사업 시행에는 아직 많은 걸림돌이 있는 실정이다. 이러한 문제점들을해결, 보완하기 위하여 치안서비스 모델을 변화시켜 예산절감과 조직의 재구성을 도모하고, 가변성을 가질 수 있는 부분위탁형태의 개발 및 민·관 협력체제 확립 및 계약방식의 합리화가 필요하다 할 수 있다. 본 연구는 업무상의 특수성을 감안하여 치안서비스 분야의 민간위탁 기준을 제시해보았다. ①치안분업모델의 설계 ②양자의 의견을 존중하고 타협점을 찾을 수 있는 새로운 혼합형태의 시스템 모델구축 ③다자간 접근법을 통한 사회 모든 구성원의 참여기회 확대 ④지명경쟁입찰을 통한 계약 방식의 확립 등이다. 이처럼 공공안전 서비스 분야의 민간위탁은 타 정부분야의 민간위탁 형태와는 다른 형식으로 이루어져야 하며 국민의 안전을 담보로 한다는 점에서 업무선정과 방식에 대한 기준을 높여야 할 것이다. These days, the majority of public service area presents increment of utilizing a contracting-out with the following reasons such as cost-efficiency, maintenance of population changes in flexible manner, and convenience of management. The social changes have influence on policing structure and regional security system as well as problems associated with accepting the contracting-out in the public policing sector. However, many issues such as limited contracting-out sector, difficulty of encouragement of participation to private sector, and limitation of making a contract with contracting-out would be brought up when initiate contracting-out to the public policing sector. Changing security system to lower budget, planning restructure of organization, developing alterable partial contracting-out, establishing private and public cooperate system and rationalizing contract system are the suggestions to solve and modify the raising problems. The private contracting-out in the public security service sector should be manage in different manner compare to other private contracting-out in government -oriented public service sector. Since work performance of each private contracting -out agency is strongly bond to safety of every civilian in the nation, it is essential to increase its standard of qualification of each agency.

재난관리의 효율화 방안에 관한 연구

본 연구는 구미 불산 누출사고는 산업화에 따른 인적재난의 제반문제점을 내포하고 있고, 지난 몇 번의 위해화학물질사고의 안이한 대처와 시정이 지연되고 있는데 대한 경고의 의미를 갖는다. 사고자체의 원인과 문제점 분석에 해결책이 있다하기 보다는 안전관리 체계를 구성하는 요소들의 사회적 환경개선 방안을 강구하고자 한다. 우리나라의 국가적 재난대응체계의 문제점을 살펴보고 이를 개선하기 위한 효율적인 재난관리 방안을 제시하였다. 첫째, 안전에 대한 총체적인 국민의식이의 계몽되어야 한다. 공공재로서 안전은 소중한 모두의 자산이라는 관점을 업체, 기관, 정부, 모든 국민들이 수용하여 실천하여야 한다. 둘째, 법령, 제도개선은 부단히 변화하는 환경에 적응하여 수정ㆍ보완하여야 한다. 셋째, 조직이 힘을 발휘할 수 있도록 기능을 보강하고, 소요되는 예산을 정확히 배정하여야 한다. 넷째, 위해물질이 많은 산업단지를 위주로 지방의 재난관리 체계를 정비하여야 한다. 따라서 첨단 장비 및 물자, 정보체계의 구비, 응급체계 등 재난관련 기반조건을 중앙에서 모델을 설정하여 지원하여야 한다. 다섯째, 복구능력을 최대한 발휘하여 피해의 확산을 예방하고, 인적, 물적 피해에 대한 신속한 보상으로 정상적인 생활환경을 조성하도록 지방 및 중앙정부, 그리고 민간단체의 지속적인 지원이 이루어져야 한다. 이제는 현실을 정확히 평가하여 미래를 위해 앞서 제시한 재난관리의 효율화 방안을 반드시 실천해야 한다. Review of the national disaster response system problems and to improve it for effective disaster management measures are presented. Disasters through case analysis presented the following implications. First, it should be Overall national enlightenment and innovation for safety. Second, improvement of laws and institutions to suit the changing environment should be complemented. Third, empowering the organization and takes exactly budget should be allocated. Fourth, Emergency management system of local government is should be maintained by Industrial Complex Fifth, Local and Central Government, and NGO'S should be made Unleash the ability to recover and to prevent the spread of damage. Now, face reality, and for the future, presented above, the efficiency of emergency management plan should be sure to practice.

일반논문 : 경찰공무원의 가치수준에 따른 사회적가치 인식에 관한 실증 연구

현대의 경찰공무원들은 전통적인 임무와 역할, 그리고 지역사회 중심의 문제지향적인 해결자로서 즉, 지역주민과 지역사회를 위한 적극적 봉사자로서의 역할 또한 강조되고 있다. 따라서, 경찰공무원들의 가치체계에 관한 연구는 지역사회의 범죄통제를 위한 판단 및 행동의 준거틀로서만이 아닌, 지역사회 공동체에 초점을 맞춘 확장된 개념에서의 연구가 요구되고 있다. 이에 본 연구는 경찰공무원들의 가치체계에 관한 이론적 틀로서 소개되고 있는 궁극적가치, 수단적가치의 수준을 기준으로 상호 교차시켜 4개 집단을 도출하였다. 그리고 4개의 집단별 사회적가치에 대한 인식수준과 각 집단으로 유형화된 경찰공무원들의 개인적 특성 및 환경변화에 따른 사회적가치 인식 수준을 비교 분석하였다. 분석결과를 토대로 지역사회경찰활동의 성공적인 모델개발 및 실천그리고 정부의 사회적경제를 지원하는 정책들의 수행을 위해서는 제도적인 틀을 정립하는 것도 중요하겠지만, 근본적으로는 경찰공무원들이 추구하는 가치로부터 진단과 평가 및 모델정립을 통한 실천의 프로세스가 요구되어짐을 확인하였다. Police officers in a modern society take the roles of problem solution providers for communities as well as taking traditional missions and roles. In other words, police officers are often regarded as the providers of proactive services for communities and neighborhoods. Accordingly, researches on the value systems of police officers should involve more than the base structure for decision-making processes and actions centered upon criminal control within a given community. Such studies must comprise expanded investigation focused on the values of local communities. This study categorized police officers into four groups through reciprocal crossing based on terminal value and instrumental value, the two factors introduced as the theoretical framework for the value systems of police officers, and provides comparison among the four groups of the levels of recognition of social values for each group and the levels of recognition of social values according to the differences in individual characteristics and environmental changes for the police officers belonging to each group. It is important to establish the institutional framework to assist in the execution of polices for social and economic goals of the government as well as the development and realization of successful models of local community-based police activities based on the results of the analysis of the comparison. But it is essentially more important to act upon the results of the diagnosis, assessment, and model establishment from the value systems pursued by the police officers.

民選 地方自治團體長의 바람직한 役割

지방선거란 이른바 “지방행정의 꽃”이라 일컬어지는 주민자치에 의한 지방주민의 대의기관을 구성하거나 대표를 선출하는 지방자치단체의 선거를 말한다. 지난 6월 27일 4대 지방선거가 실시된 가운데 지방선거를 계기로 본격적인 지방자치 시대가 개막되었다. 지방자치 단체장은 지방자치단체의 집행기관의 하나로 의결기관이 결정한 의사에 따라 지방자치단체의 목적을 구체적·적극적으로 실현하는 기관이다. 실제로 지방선거 이후 전국 각 지역에서는 주민이 직접 선출한 지방자치단체장이 그 지역 국회의원보다 더 막강한 힘을 행사하게 될 것이다. 과거 지나치게 상관지향적임과 동시에 단기근무로 인하여 임명된 장들의 말과 행동이 일치하기 어려웠으며, 따라서 지역사회 발전을 기하기가 어려웠다. 그러나 지방화시대에 따른 선임된 지방자치단체장은 임명된 장이 지니고 있었던 취약점을 보완할 수 있을 것이며 진정으로 지역사회의 발전에 크게 공헌할 것으로 기대되는 것이다. 이런 막중한 역할을 해야할 지방자치단체장은 그 지역 문제에 대해 전문식견을 가진 정치보다는 행정·경영전문가로서 변화에 대한 대응능력과 국제적 감각을 가지고 능동적인 지도력을 발휘하여 지역발전에 힘써야 할 것이다.

公務員의 政治的 中立性이란 論題下에서 公務員制度의 成立과 公務員의 政治的 中立性이 必要한 이유, 政治的 中立을 確立하기 위한 各國에서 취하고 있는 制度, 특히 公務員의 政治的活動의 問題에 대하여 論하고 公務員의 公務員의 政治的 中立의 保障은 行政의 能率性, 公平性, 專門性을 保障하고 공무원의 身分保障과 職業公務員制를 구현하는데 필요한것이다. 특히 현대 行政國家化 현상에서 政治行政의 一元論的 입장에서 행정의 중립성이론이 二元論을 토대로 先進國에서는 확립된 이론이고 보장이 되고 있는데 비해, 開途國 현상에서는 政治의 獨走, 獨裁現象에서의 行政의 시녀화가 국가발전명분으로 美化되고 있는 실정에서 참된 政治發展과 平和的 政權交替, 政治參與意識의형성, 公職論理의 확립의 측면에서 公務員의 政治的 中立은 重要하다고 하겠다.

A value of pubic administration called by democraticism has been eliminated in the name of convenience of administration for administrative efficiency and preservation of Korean past rulers' system. Korean people's dis satisfaction has been accumulated in our society as well as to result in the serious imbalance of distribution of wealth by growth, as claiming to stand for the efficiency-centered developmental policy. Namely, Korean people was released from a poor living, and reguirement of residents to exgress and participate their opinions became to increase relatively. In the meantime the executive-oriented policy function is now controlled by local council, and it resulted in more changes to perform the local administration. Especially, an increase of educated population and middle classes be came a factor to improve the national level of political consciousness by 1970s, and they are going to reflect their own creative ideas to policy decision course directry and indirectly according to its desire about policy palrticipation. We have faced upon the current request of times when will grope for an institutionalization through the high trend of democratization since the bth republic. The desirable reform measures of local council due to enforcement of local autonomy system are summarized as follows: First, the closed political participation of resident will be preceded for the smoothful development of local council that is "Rot of Grass." However, a size of basic local council will be downward adjusted, because it is difficult for local council to make fixed the self-government of residents under the existing law. Second, because what professional councilmen operate local council are very important as well as to affect residents greatly, their expenses will be properly supported for councilmen of participating into seminars of university and special college, and all the activities necessary, not only to eguip with guality of Specialization, but to concentrate upon, council activity. Also, the expert advisors system will bel more activated by setting up legishative reference library in the local council to complement difficulties in collecting actual datas. Third, many problems can happen due to the connection between the local government and Central government, because participation of political parties was allowed in case of the great sphere local self-governing body. Accordingly, and insfitutional device will be provided to exclud interference of political parties to operation of the local council. Fourth, the abuse of session and bill, and arrogation of local councilmen should be advanced and executed within the legal limit. Fifth, the finance is essential to operate local council. Accordingly the financial independence of local self-governing body should be raised by handing over a part of present national tax to local taxes sharply. Sixth, the concern and participation of local residents to local self-governing administration are the most important. To deside the quality of local self-governing and local council is the local residents. Though, it is a good system, it is important for local residents, local councilmen, and officials of local governing body to work together, in order to operate it effectively. Now, problems that occur in that institution and operation of present cocal council will be positively improved in order that local councilmen and the executive can meet an expectation and desire of local residents as representative and responsible persons of that district because local council was already formed by enforcement of local autonomy system after a long interval in Korea. The democratic potential cocal development will be acted by harmonizing those reform measures fittly.
