이 논문에서는 18세기 후반 20세에 청상이 된 김기화 처 조씨가 남편의 죽음에 임하여 자결을 결심했다가 포기한 과정을 기록한 『□긔록』의 분석을 통해 여성이 당시 사회 지배적 가치였던 극단적 열부 관념을 어떻게 수용하고 이에 대응했는지를 살펴보았다. 조선 후기 양반 남성 지식인들은 사망한 남편을 따라 자결한 여성들을 남편에게 절의를 지켰다는 이유로 칭송했다. 심지어는 부모의 만류를 뿌리치고 자결하는 경우에도 남편에게 절의를 지킨 것만을 내세워 칭송할 정도였다. 조씨는 『□긔록』에서 자결을 남편에게 절의를 지킨 것으로 인식했던 양반 남성 지식인들의 논리를 철저하게 내면화한 모습을 보여준다. 그런데 조씨는 사망한 남편을 따라야 한다는 당위성을 역설하면서도 결국 이를 실행에 옮기지는 않았다. 이를 통해 조선 후기에 과도한 열부 관념에 사로잡힌 사람들은 비단 양반 남성 지식인들과 열부만이 아니었음을 알 수 있다. 열행을 실천하지 않은 여성들마저도 남성 지식인들의 열부관을 수용하고, 이 관념을 여성 자신들의 언어로 재탄생시키며 이를 실천해야 한다는 압박을 받고 있었다. 그렇다면 어떻게 조씨의 인식과 행동에 이러한 괴리가 나타나게 되었을까? 17~18세기의 많은 남성 지식인들은 처의 남편에 대한 절의를 중시하고 그들의 극단적 열행을 칭송하면서도 자결까지 하는 것은 과도하다고 인식했다. 조씨는 이와 같은 남성 지식인들의 이중적 인식체계의 틈새를 놓치지 않고, 아버지, 백부 등의 자결 만류에 힘입어 아버지와의 천륜의 정을 저버릴 수 없다는 효심과 시부모 봉양 등을 내세우며 자결을 포기했다. 이렇게 조선 후기의 여성들은 극단적 열부 관념이 지배하는 사회에서 양반남성들이 형성해 온 논리들에 동조하고 순응해야 했지만 극단적 열부 관념에 배태되어 있는 모순이 있기에 스스로 목숨을 끊어야 하는 극단적 상황에서는 이를 타개할 논리를 만들어갈 수 있었다. 그러나 이는 여성 혼자 힘으로 할 수 있는 일이 아니었다. 조씨도 친정 아버지를 비롯한 주위 사람들의 도움이 있었기에 아버지와의 천륜의 정을 당당하게 내세우며 삶의 길을 선택할 수 있었다. 극단적 열부 관념에 저항하지 못하고 그대로 수용하면서 주위의 도움을 얻어 자신 한 몸 죽지 않을 수 있는 설득력있는 논리를 만드는 것이 극단적 열부관념이 지배하고 있는 사회에서 여성들이 할 수 있는 전부였다는 것이 당시 사회의 한계였다. 지역 사회 혹은 가문에서 열부 관념의 압박이 심한 상황에서 친정의 도움을 받을 수 없는 한미한 집안의 여성이 청상이 된 경우 주위의 압박에 의해 혹은 여성들 스스로 내면화한 가치에 의해 죽음을 선택할 수 밖에 없는 상황에 처하게 될 수도 있었다. This article examines how women in late Joseon Korea engaged with the notion of yeolbu(烈婦觀: the idea that a wife should be so loyal to her husband as to kill herself upon his death). It takes as its primary lens the Jagirok, a late 18th century memoir penned by Lady Jo, who had become a widow at age 20 upon the passing of her husband, Gim, Gi-hwa. Jo`s Jagirok records both the process of her deciding to kill herself, and that of her later deciding to reverse this decision. The discursive world of the late Joseon dynasty in which Jo struggled with her decision was one in which male intellectuals of the yangban class praised those women who had taken their lives out of loyalty to their late husband - even going so far as to praise widows who had killed themselves over the objections of their parents. As the Jagirok shows, Jo had internalized this male-generated logic. Yet, despite declaring that it was only right that she follow her husband into death, Jo ultimately did not kill herself. Jo`s experience demonstrates that even women who did not in the end commit suicide in order to express their loyalty toward their late husbands did to some extent embrace and engage with the concept of yeolbu. Late Joseon women, under pressure to engage in yeolbu practice, had turned the concept into a means of expression, rephrased in their own words. Many male intellectuals of 17th and 18th centuries were ambivalent about lauding women who had killed themselves inaccordance with yeolbu notions, finding the practice excessive. Exploiting these divided opinions, Jo outlined several reasons why she did not have to kill herself. On the one hand, late Joseon women had to conform with extreme logics that dictated their death. On the other hand, they could create logics to dictate their continued existence. But they could not present those logics by themselves. They needed the support of others. This support is precisely what Jo brought to bear in presenting her reasons for not killing herself - the objections of other men in her family, in this case, those of her father and uncle. That establishing such logics within the confines of the yeolbu discourse - and not protesting the concept outright - was the only choice available to late Joseon women testifies to the limits that their society and its discourse had placed on them. In such conditions, widows who could not count on the aid of their parents might have been forced to choose death as a result of a combination of social pressure and internalized values.

N/A Background: The majority of patients with locally advanced, unresectable, non-small cell lung cancer(NSCLC) were treated with conventional thoracic radiation therapy Throcic radiation therapy produces tumor regression in most patients but few cures and dismal 5-year survival rate. Several randomized studies have demonstrated that systemic chemotherapy controls micrometastasis and improve survival ratNes for patients who have locally advanced NSCI.C. Hut the optimal frequency of chemotherapy and sequence for chemotherapy and radiotherapy are yet to be determined. In this study, we analyzed response rate, median survival time, side effects and prognostic variables according to the frequency of chemotheray in locally advanced NSCLC patients, Methods: We separated locally advanced, unresectable, NSCLC patients into two groups according to given number of chemotherapy cycles. Among 28 patients evaluated, eleven patients were classified to group A, receiving above 3 cycled chemotherapy and seventeen patients, classified to group B, receiving 3 cycled chemotherapy. In both groups, thoracic irradiation of 5940 cGy was given to all patients after chemotherapy. Results: 1) Median survival time was 12.9 months for group A, 12.8 months for group B but there was no statistically significant difference(P>0.05), 2) Overall response rates were not significantly different between two groups(P>0.05). 3) Frequency rate of local failure and distant metastasis were not significantly different between two groups (P>0.05). 4) The grade and frequency of toxicities during treatment were not significantly different between two groups (P>0.05). 5) Clinical stage was the only major prognostic factor for overall survival (P<0.05). Conclusion: Median survival time, response rate, toxicities and frequency of local failure and distant metastasis were not significantly different between two groups. So, when we treat locally advanced, unresectable, NSCLC patients in sequential combined treatement, we should consider planned therapy(limiting chemotherapy cycles given), because planned therapy reduces many troubles of patients, that is, economic loss and time consuming, psychiatric anxiety etc, during treatment period. The optimal frequency of chemotherapy is remained to be validated in large scale study in the future in the setting of combined treatment.
의자(義子)의 양자(養子) 지정 사례를 통해 본 16세기의 수양(收養), 시양(侍養) 관행 - 「1584년 나주목 결급 입안」의 향리가 양자 사례를 중심으로 -

이 연구에서는 「1584년 나주목 결급 입안」의 16세기 향리가 여성인 정 조이가 남편의 막내아들을 양자로 삼아 그의 대부분의 재산을 증여한 사례가 조선 전기의 수양, 시양의 관행과 16세기 가족·친족 관계와 사회질서 내에서 어떠한 의미를 지니는지를 파악하고자 했다. 이 입안에 수록된 소송은 本族과 義子 사이의 쟁송에서 출발했지만 의자 중 막내인 나기년이 정 조이의 양자로서 그의 대부분의 재산을 증여받았다는 것이 인정되어 의자측이 승소한 사건이다. 수양과 시양은 입양 대상과 목적에 제한이 없었던 입양 관행이다. 그러나 고려시대부터 계승되어 온 친족관계와 원 재주의 혈속 외에 재산을 주는 것을 꺼리던 증여·상속의 관행에 따라 夫妻의 친족을 수양 자녀나 시양 자녀로 삼을 때에는 남편과 처가 각각 자신의 친족을 양자녀로 삼고자 하는 것이 일반적이었다. 그런데 이 사례는 자신과 혈연관계가 없는 남편의 아들을 양자로 삼은 사례이다. 15세기에도 남편의 아들이나 손자를 양자로 삼은 사례가 나타나지만 왕실이 아닌 민가에서 많은 재산을 상속받은 여성이 남편의 직계 자손을 양자로 삼아 자신의 대부분의 재산을 증여한 것은 이 사례가 유일하다. 16세기 의자를 양자로 삼아 재산을 증여한 이 사례의 의미는 다음과 같이 파악된다. 이는 계모와 어려서부터 기른 막내 의자 사이에 친밀감이 형성되어 자신의 대부분의 재산을 주고 사후 제사를 부탁한 사례이다. 정 조이는 막내 의자 나기년을 양자로 지정하고 다른 의자와 차별화하여 그에게 자신의 대부분의 재산을 증여했을 뿐 아니라 다른 재산 상속권자인 본족에게 재산을 주지 않았다. 그의 재산 증여는 그의 사후 벌어진 이 소송에서 정당성을 인정받았다. 이렇게 수양 자녀나 시양 자녀의 지정은 재산 증여에 재주의 의사를 자유롭게 반영하기 위한 방법이 되기도 했다. 16세기 일부 양반가에서는 기존 입양 관행과는 달리 자식이 없는 여성이 夫家의 가계계승자를 수양자나 시양자로 삼아 자신의 대부분의 재산을 증여하고 자신과 남편의 사후 제사를 부탁함으로써 유교적 제사형태 정착을 지향하는 정부 정책에 부응한 사례들이 나타난다. 그런데 이 사례는 이와는 달리 장자를 봉사자로 지정한 남편과 별도로 막내 의자를 양자로 삼아 자신의 봉사자로 지정한 사례이다. 남편과 처가 자신의 재산을 이어받을 각자의 계승자를 지정하던 이전의 입양 관행을 답습한 사례인 것이다. 그럼에도 송관이 정 조이의 재산 증여를 인정한 것은 조선 정부에서 국초부터 유교적 제사형태를 정착시키기 위해 심혈을 기울여 여러 제도들을 만들어가면서도 이를 위해 새로 제정한 입후법에 의한 입후와 기존 입양 형태인 수양, 시양의 공존을 인정한 것과 같은 맥락에서 파악할 수 있다. 16세기 실제 대민 통치를 하던 수령 역시 개인이 자신의 감정이나 이익에 따라 기존 입양 관행에 의해 양자를 선택하더라도 이러한 선택이 법에 위배되거나 풍속을 해치지 않는 한 이를 존중하며 그 관계를 적극적으로 인정해 주는 방식으로 통치했다는 사실을 파악할 수 있다. This paper analyzes the “1584 Naju-mok Civil Docket” concerning the adoption by local clerk family member Ms. Jeong of her youngest stepchild, as well as the corresponding passing down to that child most of her property. It assays the significance that this case held within the suyang (收養) and siyang (侍養) adoption customs of early Joseon, and within the familial and relative relations ― as well as the social order ―of the 16<sup>th</sup>century. This suit began as a dispute between Jeong’s side of the family and the stepchild in question. With the legal recognition of youngest stepchild Na Ginyeon’s receiving the majority of Jeong’s estate in his capacity as her suyang/siyang adoptee, the suit wound up as a legal victory for the stepchild’s side. Both suyang and siyang adoption practices were unrestricted in the objects or purposes of adoption. However, according to the relative relations and the estate bequeathing and inheritance practices of the time, in a married couple’s selecting among their blood relatives a suyang/siyang adoptee, both the husband’s family and the wife’s family commonly preferred to select from among their own lines. Yet the 1584 case was one of the adoption of a husband’s stepchild, with no blood relation to the adopter. Although there exist some 15<sup>th</sup>century examples of a woman’s adopting a husband’s son or grandson as her own, among those outside the court, the 1584 case stands out as the only one in which a wife ―having inherited a sizable estate from her parents ―takes a direct descendant of her husband as the adoptee and passes on to him the majority of that estate. The significance of this 16<sup>th</sup>century adoption of a stepchild and corresponding bequeathing of estate can be understood as follows. This was an instance of a close bond forming between a stepmother and the stepchild she had raised from an early age, and that stepmother’s bequeathing the majority of her estate to that child with the request that he perform rites for her after her death. Ms. Jeong did not just adopt Na Ginyeon as her own child and treat him differently than her other stepchildren, bequeathing him the majority of her estate. She moreover elected not to give property to those among her own side of the family who held inheritance rights to her property, and through this lawsuit arising after her death, ultimately secured recognition for her preferred manner of passing down her estate. This became a means for the designation of one’s suyang/siyang adopted children to freely reflect a property owner’s estate planning intentions. In the 16<sup>th</sup>century, certain yangban families ―diverging from established adoption customs and responding to the government’s policies of promoting Confucian ancestral ritual forms ―began to designate as a childless woman’s suyang/siyang adoptee the husband’s family successor, and to bequeath the majority of her estate to that child, together with the request that the child continue to perform rites for both adopted parents after their deaths. But the 1584 case stands apart from this trend; it was a case of a wife’s selecting, separate from her husband’s successor, her youngest stepchild as her adopted child, and of naming him the keeper of her rites. In other words, it was the implementation of an earlier form of adoption, in which the husband and the wife each designated their own successor and heir to their estate. That despite this, the suit’s presiding official recognized Ms. Jeong’s passing down of her estate can be understood in light of the fact that, even though Joseon’s government had ―since the start of the dynasty ―focused intensely on ensuring the spread and establishment of Confucian ancestral ritual forms, developing numerous systems to hasten the process and even creating a new adoption law, it also recognized the coexistence of the preexisting adoption forms suyang and siyang. This case also reveals that for the 16<sup>th</sup>century magistrate directly interfacing with those he governed, providing that one’s choice of adopted child ―even if that choice were made on the basis of preexisting adoption practices and according to one’s personal feelings and to one’s own benefit ― did not violate the law or disturb the customs of life, respecting and actively acknowledging those adoption choices was a real strategy of rule.
살옥(殺獄) 판결을 통해 본 조선후기 지배층의 부처(夫妻)관계상 - 『추관지(秋官志)』 분석을 중심으로 -

본 논문에서는 『추관지』에 수록된 부처(夫妻)간의 살인사건에 대한 판결을 분석함으로써 정조대 위정자들이 지향하였던 부처관계상을 살펴보았다. 조선시대의 기본 형률이었던 『대명률』에서는 남편이 처를 살해한 경우에는 교형에, 처가 남편을 살해한 경우에는 고의성 여부에 따라 능지처사나 참형에 처하도록 하였다. 두 경우 모두 사형에 처하도록 하였으나 등급에 차이를 두었음을 알 수 있다. 그리고 계획적으로 남편을 살해한 경우나 간부(奸夫)와 공모해서 남편을 살해한 경우와 같이 처가 남편을 배반하고자 하여 살해한 경우에는 능지처사에 처하도록 하였다. 반면에 남편이 간통 현장에서 처를 살해하거나 시부모나 시조부모에게 폭력을 행사하거나 욕하는 불순한 행위를 한 처를 살해한 경우에는 논죄하지 않거나 매우 가벼운 형벌에 처하도록 하였다. 조선후기에는 이에 이념적인 요소가 더욱 강화되었다. 『추관지』에 수록된 정조대 부, 처 살해에 대한 판결도 그 연장선상에 있다고 할 수 있다. 처가 남편을 살해한 경우에는 예외없이 형률에 의해 엄정하게 처벌하였다. 반면에 남편이 처를 살해한 경우에는 모두 사형이 감면되었다. 『대명률』에서 사죄(死罪)로 규정되지 않은 경우는 물론이고 증거가 없거나 고의성이 없다고 판단한 경우에도 사형이 감면되었다. 사죄를 범한 사람들에 대하여 사형을 감면하는 것은 정조대 판결의 주된 경향이었다. 그런데 남편의 처 살해에 대한 판결 과정을 살펴보면 일반 사죄 판결과 구별되는 특징이 있다. 이는 남편의 처 살해에 고의성이 없을 것이라고 판단하여 사형을 감면한 사례에서 잘 나타난다. 정조와 당시의 관료들은 부처관계는 강상(綱常)에 속하여 지극히 친밀한 관계이기 때문에 처가 남편의 심한 폭력에 의해 사망하였다 하더라도 사망한 처가 남편을 죽게 함으로써 원한을 풀고자 하지 않을 것이라고 인식하였다. 이러한 인식에 의해 위정자들은 가해자인 남편에게 관대한 처분을 하였다. 이에 의거하면 부부관계는 서로 감싸주고 포용해주어야 하는 매우 친밀한 관계였다. 그러나 이러한 강상의 해석은 부처에 동일하게 적용되지 않았다. 가해자가 처인 경우 강상윤리를 무너뜨렸다는 논리에 의해 엄정하게 단죄되었다. 반면에 피해자가 되더라도 처는 남편의 행동에 원한을 품지 않고 남편과 아이들을 배려하는 존재가 되어야 했다. 당시의 위정자들은 이러한 형정 운용을 통해 부(夫)를 중심으로 한 부처관계와 그들이 추구하는 처의 모습을 백성들에게 주입해 나갈 수 있었다. In this article, the judgments displayed in spousal murder cases documented inside 『Chugwan-ji』 are analyzed, in order to examine the image of a relationship between husbands and wives that the leading figures of the Jeongjo(正祖, 1777~1800) government wished to establish and support. According to 『Daemyeong-ryul(大明律)』, which had served as the primary penal code of the Joseon dynasty, husbands that killed their wives were to be put to death by strangling, and wives that killed their husbands were to be executed either by beheading or dismemberment, decided by whether the act was intentional or not. When the wife killed the husband with a clear intention of betrayal(when the wife clearly plotted and planned to kill her husband, or killed her husband with the help of her lover), she would be put to death by dismemberment. On the other hand, when the husband killed his wife, at the site where he was found cheating with his lover, the husband would not be put to trial, and when the husband killed the wife under the reason of the wife`s being disobedient to the husband`s parents or grandparents, he would receive only a very mild punishment. In the latter half period of the Joseon dynasty, ideological effects were being reinforced. And the judgments on murder cases that victimized either a husband or a wife documented inside 『Chugwan-ji』 were produced in such atmosphere as well. When a wife murdered a husband, she would be punished according to the penal law without exception or any special consideration. On the other hand, in a case reversed(husband killing the wife), the death sentence would be lifted. The husband would not receive a death sentence, not only in cases that were not dictated to be resolved by a death sentence in 『Daemyeong-ryul』, but also in cases that the evidences were considered insufficient or the motives were considered not intentional. It was a general trend during the reign of king Jeongjo to exempt people, who committed crimes that should be punished with a death sentence, from being actually put to death. Yet for cases in which the husband murdered the wife, there was a different twist to employing such general principle. The authorities would presume that it would not have been an intentional killing, and mitigate the sentence from death to something less harsh. They reasoned that the relationship between husband and wife was a matter of a moral order called Gangsang(綱常) and so a very intimate one as well, so even when the wife is killed due to the husband`s abusive violence they figured that the wife would not want to revenge herself by putting her husband to death as well. On such very basis the authorities ordered a generous sentence, implying that the spousal relationship was a one that should be based upon embracing and sheltering of each other. Yet this kind of interpretation based on the issue of Gangsang and order was not applied to the wife indiscriminately. When the wife was the offender, she was severely punished under the charge of undermining Gangsang. And when the wife was a victim, she was still required not to hold a grudge or resentment toward her husband, and try to take care of her family which undoubtedly included the husband. Through this kind of penal administration, the authorities could establish a husband-wife relationship they supported, and insert an image of a wife they pursued into the public`s mind as well.

This case study intends to present the ways how you can activate the infants dance lessons with mom as a part of a dance education program as well as the method of early education, and also the questions which are designed to find the physical, emotional and social influence of this program on the 4 - 5 years old infants. The objects of this study consist of six participants of the infants dance program with their mother at the cultural center of H department store and one assistant instructor. I analyzed the collected materials of 40 minutes lessons once in a week from March to August in 2010 through participating observation and in-depth interviews. As a result, I could obtain the positive effect on the above three goals and also the conclusion that the emotional effect is the biggest out of those three domains when they can take dance lessons with their moms.
