중국 전자상거래법제상의 문제점과 해결방안에 관한 연구

중국의 WTO가입, 높은 경제 성장과 함께 중국의 인터넷도 급격한 성장을 하고 있다. 중국의 IT산업의 발전에 따라 중국의 전자상거래 또한 빠르게 성장하고 있다. 그러나 중국의 2008년 e-readiness 지수는 64개국 중 49위를 기록하여 하위권에 머물러 있는데 중국에는 전자상거래 발전을 저해하는 다양한 요소들이 존재하고 있기 때문이다. 본 논문은 중국 전자상거래의 현황분석을 통하여 중국의 전자상거래발전변화, 중국 정부의 전자상거래에 대한 정책 및 법률의 입법현황과 내용을 살펴보면서 전자상거래에 있어 법체계상의 문제점과 해결방안을 모색함으로써 중국 전자상거래의 발전에 기여하는 것이 그 연구목적이다. 중국 전자상거래가 급속히 발전하고 있는 관점에서 중국 전자상거래의 법률 환경을 분석하고 문제점과 해결방안이 연구되고 있다는 점에서 그 의의가 있다. With entry of WTO (World Trade Organization), and high economy growth, China’s Internet has also been boosted dramatically. According to the development China’s IT industry, e-commerce in China has been rapidly growing in its density. But China’s e-readiness ranked 52th among 64 countries in 2008. There are multiple factors that contribute to the slow development of e-commerce in China. The purpose of this paper is to contribute to the development of e-commerce in China by analysing the problems of China’s e-commerce law system and solutions to them by way of studying the present condition, development and changes of China’s e-commerce, legislation and contents of the Chinese government’s policies and law on e-commerce. The significance of this paper is that in view of items of the fast-developing e-commerce of China, the problems of China’s e-commerce laws and solutions to them are studied.

중국 전자정부의 구축에 대한 고찰

20세기 중반, 컴퓨터의 등장으로 정보 혁명이 본격화 되었다. 정보기술의 글로벌화에 따라 최대 정보처리 조직인 정부는 심각한 도전에 직면하게 되었다. 중국 정부는 전자정부를 구축하기 위한 추진 계획을 제정해서 중국 전자정부의 발전을 추진했지만 다른 나라와 비교하면 상대적으로 미흡하다. 이웃나라 한국의 전자정부의 구축은 이미 세계 리더의 자리에 위치하고 있다. 중국과 한국은 전자정부의 구축측면에서 큰 차이가 존재하고 있다는 것을 살펴볼 수 있다. 따라서 본 논문에서는 중국과 한국 양국의 전자정부의 발전 상황에 대해 기술하고, UN의 전자정부 실적 평가 보고를 살펴본 후에 중국 전자정부의 문제점을 제시하고, 한국의 전자정부 구축사례를 통하여 중국 전자정부의 구축 방안에 대하여 제시하고자 한다. Since the computer came out in the 1940s, the information revolution has developed vigorously. Accompanied with this great kind of information technology, it is a serious challenge for the government which is the largest organization of information processing. Although the Chinese government worked out a whole set of plans about the constitution of e-Government affair to promote its development, it is still backward compared with other countries. As a neighbor of China, it’s the Koreans who are making the running in the field of e-Government affair. Considering the differences on construction of e-Government affairs between two counties, in this paper the development for e-Government affairs from Korea and China is summarized. By the researches which the UN did on e-Government affair’s performances around the world, we can find some drawbacks that existed on construction of Chinese e-Government affairs, adopting the experiences from Korea, and then raise a new proposal for Chinese e-Government affairs in order to consummate them.

중국 B2C 온라인쇼핑몰 현황과 발전방안에 관한 연구

B2C e-commerce, as one of the initial types of e-commerce in China, is coming into a mature period after developing over the past decade. However, B2C model that has the same target market as C2C model is less than half of C2C model in proportion of e-commerce retail market. According to a survey by China E-commerce Research Center, a certain phenomenon is appeared and concerned to be continued that, accompanied with a rapid expansion in a part of B2C e-commerce companies with large scale, a number of B2C e-commerce companies with relatively small scale are going bankrupt rapidly. Therefore, the proportion of B2C e-commerce market in China is less than B2B e-commerce market and the development of B2C operating companies is polarized. Consequently, the representative examples with various operating forms in B2C e-commerce are analyzed in this paper and the reasons for the operating forms are explored. Appropriate development policies are also proposed to level up China’s B2C e-commerce, reduce the gap between B2C and C2C e-commerce market and promote China’s B2C e-commerce environments.

e-Policy에 관한 연구동향과 향후 연구방향 고찰

전자무역에 대한 심도 있는 연구의 필요성에 따라 전자무역연구지가 출간하게 되었 다. 전자무역연구지는 2003년 창간호의 발행을 시작으로 7년간 발간되어 왔으므로 연 구동향 및 향후 연구방향을 재조명해 볼 필요가 있다. 본 논문에서는 전자무역정책에 관한 과거 연구동향을 분석하고 향후 연구방향을 제 시하는데 연구목적이 있다. 과거 연구동향은 국내 주요 학술지의 논문과 국회 도서관 과 각 대학 도서관 사이트에서 검색이 가능한 학위논문을 위주로 정리하였다. According to needs for in-depth research in e-Trade, E-Trade Review wad published. There are needs to organize the past trends and provide the future trends of research because E-Trade Review starting with the first issue of 2003 issue is published until 7 years. At this paper the trend of the past research and future research directions proposed by the research needs to be done. The purpose of this paper is to analyze past research on e-Trade policies, trends and future research directions for research purposes. Past research trend in every possible sites which were Korea National Assembly Library and the University Library site was mainly clean.

UCP 600의 새로운 개념도입상의 문제점과 해결방안에 관한 연구

UCP 600 as the latest version of the Uniform Customs and Practice for Documentary Credits was valid on July 1, 2007. The latest revision of UCP was substantial for the practice of documentary credit and improved the exactness and clearness and plainness. UCP 600 introduced the definitions Article and Interpretations Article for clearness for application of UCP 600 to the practice of trade communities. And in the definitions Article are introduced new terms such as complying presentation, credit, honour, negotiation etc. In particular as new important term honour meas to pay at sight, to incur a deferred payment undertaking and pay at maturity and to accept a draft and pay at maturity. But honour does not include to negotiate without recourse. Under UCP 600, a nominated bank can prepay or purchase a draft accepted or a deferred payment undertaking incurred by that bank as the issuing bank is allowed to authorise the bank to do so. This paper deals with the new definitions of UCP 600 and the problems and solutions in the application of new definitions to the practice of documentary credits. The purpose of this paper is to contribute to the understanding of UCP 600 by studying the problems and solutions in the new definitions of UCP 600.
