자율주행자동차의 대중화와 제조물책임법상의 법적쟁점

본 연구에서는 세계적으로 자율주행자동차의 필요성이 높아짐에 따라 자율주행자동차를 대중화시키기 위해 사고 또는 결함에 있어 운전자에게 책임부담을 덜어 줄 수 있는 방안을 제조물책임법의 적용을 통해 알아보았다. 현재 자율주행자동차는 소프트웨어와 자동차를 결합해 만든 제조물로써 제조물책임법을 결함에 적용하였을 때 발생할 수 있는 법적쟁점을 설계상 ·제조상 · 경고상 결함을 통해 각각 알아보았다. 자율주행자동차를 대중화하기 위해서는 사고와 결함에 있어서 운전자인 소비자의 책임부담을 덜어주는 것이 중요하다고 생각한다. 제조물책임법은 제조물의 결함으로부터 소비자를 보호하고 입증책임을 제조업자에게 부담하는 법으로써 자율주행자동차의 특성상 운전자의 의무보다는 제조업자가 가져야할 의무가 더 크다. 하지만 현행 자동차손해배상보상법에서는 일반 자동차처럼 자율주행자동차의 사고 책임을 운전자에게 두고 있기 때문에 제조업업자에게 책임을 지울 수 있는 제조물책임법을 적용해야한다. 제조물책임법을 적용했을 때 법적쟁점이 될 수 있는 부분을 판단하여 추후 자율주행자동차가 대중화되었을 때 쟁점이 되는 내용들을 개선하여 운전자가 부담 없이 자율주행자동차를 운전할 수 있도록 해야 한다. In this study, as the need for self-driving cars increases globally, we found out how to reduce the burden of responsibility on drivers in accidents or defects to popularize self-driving cars through the application of the Product Liability. Currently, Autonomous Vehicle is manufactured by combining software and automobiles, and legal issues that may arise when the Product Liability Act is applied to defects have been identified through defects in design, manufacture, and warning, respectively. In order to popularize Autonomous Vehicle, I think it is important to ease the responsibility of consumers who are drivers in accidents and defects. The Product Liability Act protects consumers from defects in their products and imposes burden of proof on manufacturers, which is more obligatory for manufacturers than for drivers due to the nature of Autonomous vehicle. However, under the current Automobile Damage Compensation Act, drivers are responsible for accidents of Autonomous vehicle like ordinary cars, so the products responsibility law that can hold manufacturers accountable should be applied. When the Product Liability Act is applied, it is necessary to determine what may be a legal issue and improve the contents of the issue when autonomous vehicles become popular in the future so that drivers can drive autonomous vehicles without any burden.

자율주행자동차의 상용화에 따른 법적쟁점과 자율주행상의 사고 책임

본 연구에서는 비대면이 일상화되면서 무인운송은 무역수단의 필수적인 요소가 되고 있다. 이에 따라 무인운송인 자율주행을 선도하는 캘리포니아 주의 사고특성과 유형을 정리하고 자율주행의 기술단계에 따라 일반 자동차와 비교하여 사고의 책임을 정리하고 있다. 캘리포니아에서 일어난 2020년의 사고를 DMV에서 제공하는 사고정보보고서를 통해 조사한 결과 발생한 자율주행차량의 사고의 경우 가해자 대부분이 일반 차량이었고, 일반자동차에 비해 사고의 확률이 현저히 낮았다. 따라서 자율주행을 통해 무인운송이 보편화 된다면 운송에 대한 위험을 줄일 수 있고 만에 하나 발생하는 사고에 대해서는 제조물책임법에서는 자율주행운송수단을 제조물로 판단하기 때문에 제조물책임법과 불법행위법을 통해 운전자를 보호할 수 있다. 이 연구는 무인운송인 자율주행이 최초로 허용된 캘리포니아에 대한 최근 사례연구를 통해 급성장하고 있는 무인운송시장에 대한 최신 사례를 제공한다. 그리고 한국 또한 자율주행자동차의 보편화를 앞두고 있기 때문에 앞서 미국에서 발생한 사고를 통해 운전자를 보호할 때의 요건과 책임을 살펴봄으로써 앞으로 한국에서 발생할 수 있는 사고에 대한 책임과 부담에 대해 제시하고 있다. In this study, as untact transactions become routine, unmanned transportation becomes an essential element of trade means. As a result, the state of California, which leads the autonomous driving of unmanned transportation, is sorting out the nature and type of accident and the responsibility of the accident compared to ordinary cars according to the technology level of autonomous driving. The 2020 accident in California was investigated through a DMV incident information report, and most of the autonomous vehicles that occurred were regular vehicles, and the probability of accidents was significantly lower than that of regular cars. Therefore, if unmanned transportation becomes common through autonomous driving, it can reduce the risk of transportation and protect drivers through the Manufacturing Liability Act and the Illegal Act because autonomous transportation is considered manufactured under the Manufacturing Liability Act. The study provides the latest examples of the fast-growing unmanned transport market through a recent case study of California, where autonomous driving of unmanned transportation is first allowed. And since Korea is also set to become more common in self-driving cars, it presents responsibility and burden for possible accidents in Korea by looking at the requirements and responsibilities of protecting drivers through previous accidents in the U.S.

자발적 1인 가구를 위한 감정공유공간 연구

과거에는 결혼적령기가 지나도 싱글인 이들에 대해 더러는 일반적이지 못하다, 혹은 정상 궤도에서 벗어난 사람이라는 인식이 있었으나 최근에는 이들에 대해 자기개발에 집중하고 개개인의 삶의 질을 향상시키는 것을 목표로 사는 사람으로 인식이 바뀌고 있고, 자발적으로 싱글을 선택하는 1인 가구가 증가하면서 이들을 중심으로 한 새로운 문화도 생기고 있다. 자발적으로 싱글을 선택한 1인 가구는 자신을 자발적이고 독립적인 인간형으로 규정하면서도 한편으로는 외로움과 심리적 불안감의 정서를 갖기도 한다. 우리나라의 경우도 30년 후에는 10가구 중 4가구가 홀로 살게 된다는 예측 결과도 있는 만큼 이러한 1인가구의 외로움이라는 감정은 더 이상 개인의 문제만이 아닌 새로운 사회적 문제로 바라보고 그 지원 방안에 대한 고민이 필요해 보인다. 이와 관련해 현재도 1인 가구를 위한 많은 정책이 시행되고 있지만 자발적 1인 가구라는 새로운 형태의 그룹에 대한 이해와 그 안에서 발생하는 외로움 등 새로운 문제를 지원해 줄 수 있는 ‘공간’은 부재하다. 따라서 자발적 싱글족들의 라이프스타일 특성과 새로운 문화, 그리고 이들이 어떤 방법을 통해 정서적, 일상생활적, 여가 및 교류 등의 문제를 해소하는지에 관한 연구를 통해서 이들을 지원해 줄 수 있는 공간적 개념과 공간의 특성을 정의해보고 공간 디자인 방안을 모색해 보고자 한다. 이를 위한 연구의 분석결과는 다음과 같다. 첫째, 자발적 1인 가구의 새로운 문화로 자신의 솔직한 감정을 고백하는 싱글기념식이라는 새로운 문화를 발견할 수 있었다. 이 기념식을 통해 나다움을 찾아보고, 자신을 그 자체로 선언한다. 현재는 이러한 싱글 기념식을 위한 특화된 프로그램이나 장소는 부족한 상황으로 이러한 문화를 지원할 수 있는 특화된 공간이 필요하다. 둘째, 1인 가구의 가장 큰 문제점으로는 감정적 ‘외로움’의 문제를 들 수 있다. 싱글족들이 많이 하는 여가 생활을 조사한 결과 외로움을 해소하기 위한 방법으로 티비 관람이 가장 높은 비중으로 나타났고, 성별로는 남성은 게임을, 여성은 지인 만남으로 나타났다. 따라서 이들의 감정적 외로움의 문제를 해결하기위한 방안으로는 생활공간의 범위 내에서 일상적 교류 활동이 이루어질 수 있는 접점이 고려되어야 할 것 같다. 이를 위해 서로가 원하는 일상적 여가활동을 같이 하거나 공유주방 등을 통해 밥 친구가 되는 등의 활동을 지원해줄 수 있는 공간이 제공되는 것이 필요해 보인다. 셋째, 1인 가구는 직장생활 외의 시간에 취미활동에 대한 관심이 높은 것으로 파악되며 취미 공방이나 동호회 공간, 1인 가구를 영위해 가는데 도움이 되는 팁들을 공유할 수 있는 커뮤니티 공간 등의 교류공간의 제공이 필요하다. 과거 다소 부정적 시선을 받던 싱글족들이 자발적인 선택을 하고 선언에 나서는 등 사회적 인식과 문화가 바뀌고 있는 만큼 자발적 1인가구를 위한 감정공유공간에 관한 연구는 이들이 이끄는 새로운 라이프 문화를 발전시키고 문제를 해결하여 긍정적인 에너지를 만들고, 사회적으로 연장될 수 있는 다양한 문제를 방지할 수 있는 도움닫기의 공간으로서 역할을 할 수 있을 것으로 기대한다.

글씨쓰기 명료도 평가의 정량적 영상처리 분석

선수능력의 발달 미흡과 신경학적 손상으로 인해 나타나는 쓰기 장애는 의미전달의 혼동을 줄 수 있고 가독성이 떨어지며 학습, 사회정서 문제 유발 가능성이 높다. 이에 문제 파악과 적시 개입을 위한 평가가 요구되고 있지만 임상에서는 수기에 의한 채점 방식을 채택하며 주관적인 평가에 따른 오류 가능성이 발생한다. 본 연구는 성인의 오프라인 필기체 문자를 영상처리를 통해 글자의 크기비율, 위치를 데이터화 하고 정량화 하며 수기 채점방식과의 비교, 분석을 통해 보다 객관적이고 정확하게 쓰기 수행을 평가하고자 하였다. 2018년 11월 12일부터 16일까지 신경학적 손상이 없는 성인 20명을 채택하여 10단어, 2 문장 자극을 평소 쓰기 습관을 유지한 후 연필을 사용해 따라 쓰며 쓰기 검사 데이터를 수집하였다. 본 연구에서 개발한 글씨 측정 알고리즘 결과 단어의 높이가 폭에 비해 1.2배 정도 크고 왼쪽 아래로 치우치는 경향을 보였으며 평균 9㎜의 간격을 두고 띄어 썼다. Paired T test를 통한 수기와 본 시스템의 분석 결과, 단어 검사와 문장 2의 검사는 고도의 상관관계를 보여 추후 검사 도구로써의 가능성을 보였다. 본 연구는 성인의 오프라인 필기체 문자를 영상처리를 통해 보다 객관적이고 정확하게 쓰기 수행을 평가하였으며 수행 규준을 위한 예비자료를 제공하였다. 향후 다양한 연령대의 쓰기 진단의 기초 자료로 제시될 수 있으며 아동의 경우 쓰기 장애 개입에 깊이 있게 활용될 수 있을 것이다. Although evaluation of writing disabilities identification and timely intervention are required, clinicians adopt a manual scoring method and there is a possibility of error due to subjective evaluation. In this study, the size ratio and position of letters are digitized and quantified through image processing of offline handwritten characters. We tried to evaluate objectively and accurately the performance of writing through comparison with existing methods. From November 12th to 16th, 2018, 20 adults without neurological injury were selected. They used a pencil to follow the 10 words, 2 sentence stimuli after keeping the usual habit, and we collected the writing test data. The results showed that the height of the word was 1.2 times larger than the width and it tilted to the lower left. The spacing interval was 9㎜ on average. In the Paired T test, a high correlation was showed between our system and existing methods in the word and sentence 2. This demonstrated the possibility as a testing tool. This study evaluated objectively and precisely writing performance of offline handwritten characters through image processing and provided preliminary data for performance standards. In the future, it can be suggested as a basic data on writing diagnosis of various ages.

1980년대 이후 최근까지 주거문화에 관한 연구 경향 분석

Housing culture can be defined as a subculture that characterizes a society, a region, and a time period. Therefore, identifying the housing needs of people is an effective way of understanding the housing culture. The purpose of this study was to identify the research trend of housing culture since 1980s until the recent year based on the keywords of previous literature. Seventy-one research articles were analyzed using content analysis as a research method and analysis framework which was composed of 4 aspects - physical, social, psychological, and living/welfare - was drawn for further analysis. As a main result, housing needs in social and living/welfare aspect were increasing as time passes. In general, researches related to physical aspect showed the highest ratio among 4 aspects. Specifically, research interests in community and social relationship among neighbors, natural environment, and housing welfare has remarkably increased since 2000s. The findings of this study showed that the housing culture is the comprehensive result or the process reflecting the needs and context in political, social, and economical background of those days.

초등학생의 자기조절학습 역량 향상을 위한 협력적 학습컨설팅 모형 개발: 수석교사의 역할을 중심으로

본 연구의 목적은 초등학생의 자기조절학습 역량을 향상시키기 위해 학습컨설팅을 실시할 때 초등수석교사가 적극적으로 참여하는 협력적 학습컨설팅 모형을 개발하는 것이다. 이를 위해 문헌연구와 초등수석교사 6인을 대상으로 한 포커스 그룹 인터뷰를 통해 얻은 자료를 토대로 ‘초등학교 수석교사의 학습컨설팅에 관한 인식 및 요구조사 설문지’를 개발하였다. 개발된 설문지를 전국의 초등수석교사 203명에게 배포하여 회수된 설문지 중 성실하게 답변한 202부를 분석하였다. 분석결과 첫째, 초등수석교사는 학생의 자기조절학습 역량을 강화할 필요성과 중요성을 인식하고 있었으며 그러한 역량을 자신들이 직접 향상시킬 수 있다고 믿고 있는 것으로 나타났다. 둘째, 초등수석교사는 수업시간을 통해 학생에게 직접적 학습컨설팅을 실천하거나 담임교사를 지원하여 학생에게 간접적 학습컨설팅을 실천하고 싶은 것으로 나타났다. 이러한 결과와 이론적 근거를 바탕으로 학교 구성원은 물론 외부전문가와 함께 학습컨설팅을 실시할 수 있는 협력적 학습컨설팅 모형을 개발하였다. 초등수석교사가 학습컨설턴트로서 활동하기 위해 필요한 역량을 찾아보고 학교현장에서 효과적으로 협력적 학습컨설팅을 활용하기 위한 방안을 논의하였다. The purpose of this study was to develop a collaborative learning consultation model which could be accepted willingly by the elementary master teachers to enhance students’ self-regulated learning skills. To achieve this purpose, we had 3 FGI sessions to explore master teachers’ conceptions of learning consultation and to develop a nation-wide questionnaire master teachers’ beliefs and needs of learning consultation at schools. The data were collected from 202 elementary master teachers. To analyze the data, we conducted frequency analysis. Results of this study were as follows. First, elementary master teachers tried to enhance their students’ self-regulated learning skills with the belief that their students have to equip with higher level of self-regulated learning skills. Second, they wanted to provide students with direct learning consultations at the classroom by personally as well as to conduct indirect learning consultations through helping the other teacher or parents. Based on these findings, we developed a collaborative learning consultation model which can be useful to enhance elementary students’ self-regulated learning skills.

한글 모음 및 표정 변화에 따른 안면 분석 시스템

Face deformation is caused by various causes such as facial paralysis or asymmetry. Therefore, accurate cause analysis and diagnosis are required, but CT, MRI, and Nottingham Grading System are subjective in nature and are affected by clinician proficiency and fatigue. In order to reduce the time and cost burden of patients who have to continuously visit specialized institutions for treatment, this study aims to develop a facial analysis system according to changes in Korean vowels and facial expressions. First, the coordinate value of the face landmark was extracted based on the webcam image, and then the distance value between the left and right face landmarks was calculated. In addition, quantification was performed based on the actual length of the eyes and lips and the results of the system derivation, and the final system analysis results could be checked with figures and charts.
