Objectives Obsessive-compulsive disorder (OCD) and schizophrenia have many common clinical and neurocognitive features. However, not all of them share the same underlying mechanism. The aim of this study was to discover evidences that indicate a pathophysiological mechanism specific to OCD by comparing correlations of quantitative electroencephalography (QEEG) patterns and neurocognitive function in patients with OCD and schizophrenia. Methods Resting-state QEEG data of total 265 patients were acquired retrospectively and parameters such as absolute power, relative power and peak frequency were analyzed from the data. Stroop test and Trail Making Test results as well as demographic features were reviewed for this study. The correlation of neurocognitive functions and brain electrical activities in each group were assessed and compared by correlation analysis. Results Compared with the OCD group, the schizophrenia group performed poorly in neurocognitive tests. Mean values of QEEG parameters in patients with OCD and schizophrenia did not show significant differences. Both absolute and relative power of alpha rhythm in central and frontal regions showed significant positive correlation with Stroop test results in OCD patients. Conclusions Findings in this study shows distinctive correlations between frontal executive dysfunction and frontal alpha rhythm in the OCD patients, both of which might be a candidate for endophenotype underlying obsessive rumination.

영국 월레스 컬렉션의 상설 보존 전시관 운영을 통해 본 보존과 일반 대중과의 교류

영국 국립 박물관 중의 하나인 런던의 월레스 컬렉션은 보존과 관련된 상설 전시를 하고 있는데, 유물의 제작 기법과 재료를 다룬 전시뿐 아니라, 보존에 관한 특별 주제로 전시를 하기도 한다. 월레스 컬렉션의 현재 보존관련 상설전시와 특별 전시 그리고 영국 내 다른 박물관의 예를 통해서, 보존과 일반 대중과의 관계와 교류의 변화를 살펴보고자 한다. 박물관은 기존에는 수동적 정보 전달의 역할이었지만, 현재는 보다 적극적인 교육에 초점을 맞추면서, 보존도 일반 대중의 위한 프로그램과 전시를 통해 이러한 변화에 동참하는 추세다. The Wallace Collection in London (one of the national museums in the UK) has a gallery dedicated to conservation related displays. As well as permanent displays on the manufacturing techniques and materials of artifacts, there is a specially designed space for temporary conservation exhibitions. Through the example of the current conservation exhibition at the Wallace Collection and similar exhibitions and displays from other museums in the UK, this paper will study how the relationship and communication between the conservation profession and the general public have changed, from conservation as a behind-the-scenes and little-known activity to a closer interaction with the public and as a direct educational tool. The general function of a museum can be seen to have evolved from providing passive information to its visitors to offering more active and various forms of education. Conservation has developed with this change towards more awareness of the profession and its role in the preservation of cultural heritage through public outreach programs and displays.

공직선거법상 기부행위제한 위반죄와 지방의회의원의 업무추진비 집행행위의 위법성 ― 대법원 2017. 4. 28. 선고 2015도6008 판결 ―

대상판결은 각 구의회의 의장 부의장 상임위원장인 피고인들이 법령의 근거 없이 업무추진비를 사용하여 선거구민인 공무원 또는 공공기관의 직원 등에게 식사를 제공한 행위에 대해, 구청 소속 공무원들에게 식사를 제공한 행위는 공직선거법상 기부행위의 구성요건에 해당하지만 사회상규에 위배되지 않는 행위에 해당하여 위법성이 없고, 그 외의 사람들에게 식사를 제공한 행위는 공직선거법상 기부행위 위반죄에 해당한다고 보았다. 집행기관의 광범위한 재량이 허용되는 업무추진비의 경우 그 집행기준에 관해 사전적 규범적 통제의 필요가 있고, 이 점은 지방자치단체장 외에 지방의회의장 등의 경우에도 마찬가지이므로 2015년 개정된 ‘지방자치단체 업무추진비 집행에 관한 규칙’ 은 지방의회의장 등에게 지급되는 업무추진비의 집행기준에 관한 규정을 두었다. 동 규칙에 따른 행위는 공직선거법 제112조 제2항 제4호 가목의 법령에 의한 금품제공행위에 해당하며, 이에 해당하는 경우 같은 법 제257조 제1항의 기부행위금지규정 위반죄의 구성요건해당성이 없다. 대상판결에서 피고인들의 행위는 위 규칙 개정 전의 행위로서 법령에 의한 금품제공행위에 해당하지 않는다. 하지만 해당 구의회 사무과는 지방자치단체장에 관한 위 규칙을 유추적용하여 피고인들의 업무추진비에 관한 회계처리를 하였고 피고인들 또한 자신들의 행위가 위 규칙에 의해 허용되는 것으로 생각하였는바, 이와 같은 사정 및 구청 공무원에 대해 식사를 제공한 행위는 지방의회의원인 피고인들이 조례 제정이라는 본래의 업무 수행을 위하여 필요한 범위 내의 행위로서 사회상규에 위배되지 않는 행위에 해당하여 위법성이 없다고 하였다. 피고인들의 본래의 업무인 조례제정을 위해 구청장의 의견을 확인하기 위해서는 구청 소속 공무원과의 간담회 개최가 반드시 필요한 점, 피고인들이 제공한 식사비용, 식사제공의 시기 및 횟수 등에 비추어 사회상규에 위배되지 않는 행위의 일반적 성립요건인 행위의 동기와 목적의 정당성, 행위의 수단이나 방법의 상당성, 보호이익과 침해이익의 법익균형성, 긴급성, 보충성의 요건을 갖추었다고 판단한 것으로 보인다. 이와 같이, 대상판례는 지방의회의장 등이 지방자치단체 업무추진비 집행에 관한 규칙에 따라 식사를 제공할 수 있는 대상의 범위에 관한 판단기준을 명확히 하고, 기부행위의 예외사유에 해당하지 않는 행위의 경우에도 제반 사정을 고려하여 공직선거법상 기부행위제한규정 위반죄의 위법성이 조각될 수 있는 요건을 제시하였다는 점에 그 의의가 있다. The target sentence above was made on the act in which the defendants such as the chairman, and vice chairman of local gu-council and chairman of its standing committee in a gu-level council spent the business operating promotion expenses by providing the public officials who were the constituency or the public organization's employees with meals without reasonable legal grounds. In the decision, the court considered that the act of providing public officials working for gu-office constitutes the requirements of contribution acts according to the Public Official Election Act (the Act) but does not belong to any acts which are in violation of social practices. Therefore, it concluded that the act does not violate any laws except for the act of giving the meals to other people other than specified above, which constitutes a violation of the contribution acts which shall be complied with according to the said Act. As business operating promotion expenses are the expenses which are allowed in the wide discretion of the executing organization and there is much room in handling or spending, it is necessary to proactively or normatively control the spending standard. That also applies to the case of any chairman of the district council in addition to any head of local governments. Therefore, there is a regulation in the Rules on the Execution of Business Operating Promotion Expenses for Local Governments (the Rules) which was revised in 2015 specifying the rules of execution standard for business operation promotion expenses to be spent by any chairman of council of the local government. If an Act complies with the Rules, it falls under the money giving acts according to Article 112 (2) (4) (a) of the Act and in such case, it should does not violate any prohibited contributions specified in Article 256 of the Act. However, the administrative office of the gu-district council applied the Rules on the head of the local governments to account for the accounting of the business operating promotion expenses spent by the defendants, and the defendants also thought that their act was is allowed by the Rules. So, it was determined that there is no violation of any social practices, therefore having no illegality because the act of providing meals is within the scope extent required for the implementation of duties of establishing ordinances, and the act does not violate social practices. The decision seems to consider the following facts; that the holding of meeting held with the public officials working for the gu-office level public official is required in order to establish the ordinance, which are the main job of the defendants, and confirm the opinion of the head of gu-office, and that the expenses, time and frequency of proving meals to the gu-office level public officials do not violate social practices such as meeting the general requirements for non-violation in terms of motive or goal of the act, the social properness of the means and method of the act, the legal balance between protective benefits and the infringement benefits, as well as urgency and complementation. As such, the target decision by the court has implications in that it has clearly specified the standard on how much the head of local council can provide the public officials with the means according to the Rules. This has led to a suggestion of the requirements of avoiding the illegality in terms of violation of prohibited contributions specified in the Act, considering the circumstances of the act even when the act does not fall on the exception of the contributions.

자해 청소년에 대한 대중의 반응 및 태도 : 네이버와 다음 뉴스 댓글을 중심으로

청소년의 자해에 대한 온라인 콘텐츠가 급증하고 있는 시점에서, 본 연구는 자해 청소년에 대한 한국인 온라인 이용자의 반응을 네이버와 다음이 발행한 자해 청소년 관련 뉴스의 댓글을 수집하여 텍스트마이닝 자연어 분석하였다. 공기어 분석을 통해 댓글에 빈번하게 사용된 단어 간 관계성을 시각화하였으며, LDA 토픽 모델링 분석으로 전체 댓글에서 가장 주된 다섯 개의 토픽(주제)을 도출하였다. 연구 결과, 한국인 온라인 이용자의 반응은 자해 청소년을 향한 공감·위로와 조롱·비난으로 양분되었다. 다수의 댓글이 현대 청소년의 자해를 입시위주의 교육 등 환경 맥락과 관련된 사회문제로 해석해야 한다고 설명했지만, 예방 및 개입방법에 대한 실질적인 논의는 발견되지 않았다. 본 연구를 통해 자해 청소년이 온라인상에서 접하게 되는 다양한 사회적 반응들을 살핌으로써, 온라인 경험이 청소년의 자해 행동에 행사할 수 있는 긍정적 및 부정적 영향을 예측해보고, 추후 청소년 자해 관련 가설 검증적인 연구를 수행하는 데 기초자료로 활용할 수 있다. 아울러 상담 장면에서의 개입을 위한 참고사항을 논의하였다. While recent news highlighted the severity of Korean adolescents’ Non-Suicidal Self-Injury (NSSI), the current study text-analyzed Korean online users’ reactions reflected in comments of news about self-harming adolescents. Via natural language processing, co-word analysis was conducted to visualize the relationship between frequently used words, and Latent Dirichlet Allocation topic modeling was used to draw five prominent topics in the online comment data. Results elucidated Korean users’ reactions were polarized to two extremes - empathy and comfort or criticism and ridicule. Although many users understood adolescent NSSI as a form of social problem in relation to high academic pressure and poor environment, no practical discussion about ideas for intervention was shown. By exploring diverse reactions the self-harming adolescents can encounter, this study allows to make plausible predictions about the influence of these reactions to be tested in future studies. Suggestions for counseling and treatment are provided.
