본고는 공식교육이 정치 엘리트 충원에 어떠한 기능을 가지는가를 규명하고 그것의 정치적 충원 양상을 고찰하고 있다. 이를 위하여 이론적 배경으로 교육의 정치적 의의와 교육의 정치적 기능을 규명하여 교육이 정치체계에 대해 갖은 기능 중에서 정치지도자의 선발, 충원, 훈련 기능을 연구의 분야로 정하고 있다. 또한 이론적 배경으로 엘리트의 개념과 기능, 순환을 일별하여 정치엘리트의 개념 규정과 그것의 교육과의 관계를 규명하고 있다.

Conversion of rental housing to unit ownership perhaps brings substantial profits to the building owner, while often giving rise to completely reverse effects to others involved, including vulnerable customer-tenants who are unable or unwilling to purchase the apartments they occupy and are thus forced to find alternative accommodation. The conflict of interests needs a legislative or judiciary intervention, for each conversion reduces the available rental accommodation, thereby increasing the hardship of displaced tenants seeking comparable alternative accommodation to replace well-located, old, but nevertheless solid rental apartments that are the prime target for conversion, which can lead to serious sociological and psychological problems. There has been genuine pressure on the legislature to control conversion for the benefit of the public, hence mostly advanced legal systems, such the United States, South Africa, Germany and Austria, granting existing tenants a right of pre-emption on conversion of their rental apartments into sectional ownership as well as devising tenant protection through ex ipso transfer of existing landlords’ legal status to purchasers. The Korean Housing Lease Protection Act currently contains some drops of conversion control but needs to be improved in crucial matters. This article therefore puts forward several necessary legislative measures for efficient protection of tenants’ interests. 임대주택의 분양전환은 건물주에게는 상당한 이익을 가져다줄 수 있지만, 다른 당사자들에게는 정반대의 효과를 낳을 수 있는데, 특히 주택소비자에 해당하는 임차인의 입장에서는 자신들이 살고 있는 아파트를 구입할 여력이 없거나 아예 구매의사가 없는 때에는 부득이 다른 살 곳을 찾지 않으면 안 되는 곤란함을 초래하곤 한다. 이러한 이익의 충돌 상황에는 입법부와 사법부의 개입을 필요로 하는 경우가 많은데, 분양전환이 있으면 필연적으로 임대주택의 공급을 줄어들기 때문에, 자기가 살던 곳에서 나갈 수밖에 없게 된 임차인이 기존의 위치 좋고 비록 낡았지만 튼튼했던(그렇지만 그렇기 때문에 분향전환의 주된 대상이 되었던) 임대아파트를 대체할만한 다른 집을 찾기가 더욱 어려워지고, 경우에 따라서는 이러한 어려움이 심각한 사회적, 심리적 문제점을 야기할 수 있기 때문이다. 공공의 이익을 위하여 분양전환을 통제해야 한다는 입법에 대한 압박이 계속해서 있어왔기 때문에 미국이나 독일, 오스트리아와 같은 대부분의 선진적인 법제에서는 기존 임차인에게 자신들의 임대아파트가 분양될 경우에 선매권을 부여하거나 분양아파트의 양수인에게 기존 임대인(양도인)의 법률상 지위가 당연히 이전되도록 하는 식의 임차인 보호 장치를 마련하였다. 우리나라의 주택임대차보호법에도 분양통제에 관한 맹아적 조항이 없는 것은 아니지만, 중대한 문제를 대처하기 위해서는 개선이 필요하다. 그래서 본 논문에서는 임차인의 이익을 보호하기 위하여 시급하게 필요한 입법조치가 필요함을 제안하였다.

별정우체국 폐국에 따른 손실의 보상 기준— 공무위탁관계에 대한 민법상 위임규정의 유추적용 —

A private person consigned of public services is a traditional phenomenon illustrating privatization of public services as well as civic participation in public administration. Recently, more and more government affairs have been variously and widely consigned to the private sector together with the advancement of deregulation, for the trend seems to draw more private competence without overburdening the current political and legal situations. The article scrutinizes the internal relationship between government and privates consigned of public services(here, focusing on specific post office), which had rarely been academically discussed so far. Specific post office system was introduced to Korea during the Japanese occupation period, and legally established in 1961; thereafter, it has been managed for nearly 60 years to be faced with latest criticisms of ineffectiveness. In this context, compensations are often asked for closure of long lasting specific post office, to answer which firstly reviewed are general theories about privatization, then the conditions and effects of a public officer’s deciding for privatization, and lastly possibly all the legal problems around the relationships thereupon that are usually changing step by step ― from the beginning through continuing to the ending. In conclusion, the author has reached to find the legal ground for compensations in the law of contract (mandate) that can be expanded by analogy to the parties of public contracts. 공무수탁사인은 공역무의 민간위탁, 사인의 행정참여의 고전적 형태이다. 최근 규제완화와 민영화의 진전과 더불어 광의의 공무위탁은 보다 다양화한 모습으로 널리 이용되고 있는데, 그 배경에는 비교적 기존의 법체계를 훼손하지 않고 민간의 역량을 적극적으로 활용할 수 있는 가능성을 열어주고 있다고 평가받기 때문이다. 이 글에서는 그동안 비교적 소홀히 다루어졌던 공무위탁의 내부관계, 즉 공무위탁자와 공무수탁자 사이의 관계를, 공무위탁의 고전적인 예로서 흔히 언급되는 별정우체국장의 경우를 중심으로 살펴본다. 일제 강점기 때 우리 땅에 도입되었던 별정우체국 제도는 1961년 법제도가 정비된 이래 지금까지 60년 가까이 운영되어 왔으나, 최근 들어서는 여러 가지 비판에 직면하여 축소되고 있는 상황이다. 이와 관련하여 별정우체국 폐국에 따른 보상을 요구하는 주장이 있는바, 공법관계인 공무위탁관계에 민법상 위임규정의 유추적용 가능성을 검토하기 위하여 공무위탁관계에 관한 일반이론을 살펴본 후, 원칙적으로 국가가 담당해야 하는 공역무를 위임하기로 하는 결정의 조건 및 효과, 그리고 그로 인하여 성립하는 법률관계의 내용을 성립-존속-종료라는 시간적 순서에 따라서 각각의 단계에서 발생하는 법률적 논점을 다루었다. 그리고 별정우체국 폐국에 따른 정당보상의 법적 근거는 민법상 위임규정의 유추적용에서 찾을 수 있다는 결론을 도출하였다.

3차원저천단구조물(LCS) 주변에서 파동장의 변동특성

In recent years, countries like Europe and Japan have been involved in many researches on the LowCrested Structure (LCS) which is the method to protect beach erosion and it is regarded as an alternative to the submerged breakwaters, and compiled its results and released the design manual. In the past, studies on LCS have focused on two-dimensional wave transmission and calculating required weight of armor units, and these were mainly examined and discussed based on experiments. In this study, three-dimensional numerical analysis is performed on permeable LCS. The open-source CFD code olaFlow based on the Navier-Stokes momentum equations is applied to the numerical analysis, which is a strongly nonlinear analysis method that enables breaking and turbulence analysis. As a result, the distribution characteristics of the LCS such as water level, water flow, and turbulent kinetic energy were examined and discussed, then they were carefully compared and examined in the case of submerged breakwaters. The study results indicate that there is a difference between the flow patterns of longshore current near the shoreline, the spatial distribution of longshore and on-offshore directions of mean turbulent kinetic energy in case of submerged breakwaters and LCS. It is predicted that the difference in these results leads to the difference in sand movement. 최근, 유럽이나 일본 등은 해빈유실방지대책공법의 하나이며, 잠제의 대안으로 여겨지는 저천단구조물 (LCS)에 관한 많은 연구를 수행하였고, 그의 결과들을 집약하여 설계매뉴얼까지 편찬하였다. 지금까지 LCS에 관한 연구는 2차원적인 파랑전달율과 피복재의 안정중량산정에 치우쳐 있으며, 이들은 주로 실험에 기초하여 검토·논의되 었다. 본 연구에서는 투과성의 LCS를 대상으로 3차원수치해석을 수행한다. 수치해석에 Navier-Stokes 운동방정식에 기반한 오픈소스 CFD Code인 olaFlow를 적용하였으며, 이는 쇄파와 난류해석까지도 가능한 강비선형해석법이다. 이로부터 수위, 흐름 및 난류운동에너지 등의 분포특성을 검토·논의하였으며, 동시에 잠제의 경우와도 비교·검토하였 다. 이로부터 해안선 근방에서 연안류의 흐름패턴과 평균난류운동에너지의 연안방향 및 종단방향의 공간분포에 관해 잠제와 LCS의 경우에 각각 차이가 발생하는 것을 알 수 있었다. 이러한 결과의 차이는 모래이동에서의 차이로 이어 질 것으로 판단된다.

클라우드 환경의 Thin-Client 모바일을 위한 동적 자원 분배 기술

The study of Cloud based system is emerging to become the core technology in IT field due to the tremendous growth of Cloud Computing. Researches to deliver applications to Thin-Client based mobile virtual machine and Desktop as a Service(DaaS) using Cloud Computing are conducted actively. In this paper, we propose a Cloud system to run the mobile application in the mobile Thin-Client device and resource allocation mechanism Dynamic Resource Allocation Manager for Mobile Application(DRAMMA). Thus, through performance check, we show DRAMMA has improved the utilization of Cloud system, less migration of virtual machines and decreased the error rate of resource allocation. Also our proposed system delivers service more efficiently than the previous resource allocation algorithm. 클라우드 컴퓨팅의 폭발적 성장으로 IT를 활용하는 다양한 분야에 걸쳐 클라우드 기반의 시스템을 이용한 연구가 활발하게 진행되어 왔다. 특히, 클라우드 시스템을 이용하여 가상 머신 기반의 데스크탑 환경(DaaS, Desktop as a Service) 및 가상 모바일 환경을 구축하여 씬 클라이언트 형태로 어플리케이션 서비스를 이용하는 연구가 활발하게 진행 중에 있다. 본 논문은 씬 클라이언트 모바일 단말에서 모바일 어플리케이션 수행에 필요한 클라우드 시스템과, 자원 분배 시스템인 DRAMMA(Dynamic Resource Allocation Manager for Mobile Application)를 제안하고 있다. 또한 성능평가를 통해 DRAMMA가 기존의 클라우드 환경의 자원 분배 알고리즘과 비교하여 클라우드 시스템의 활용성을 높였고, 더 적은 가상머신의 이동, 자원 할당에 나타나는 오류를 줄여 보다 효율적인 서비스가 가능함을 확인 할 수 있었다.

현행 대리규정에 관한 입법론적 검토

From the comparative viewpoint, the Korean representative statutes(arts. 114-136 of the Civil Code) could be positioned in the rank of codifications deeply influenced by the German Civil Code(1900). However, those statutes are facing some moments of recodifiaction for some reasons: firstly, social changes resulted by bio-technological developments, inter alia for prolonging human life or re-production secondly, theoretical developments based on comparative legal studies thirdly, newly worked-out codes and instrumental devices such as PECL, UNIDROIT Principles and DCFR and lastly, influences of new institutions, e.g. class actions or adult guardianship, (in)directly concerned with representative schemes. This article introduced some of the author's experiences as participant in the Civil Code reform committee under the auspice of the Ministry of Justice. The reader should keep in mind that the article reflects the limited discussions in the committee only until the October 2009 for some reasons including the author's private affairs.
