일본 가네미오일 사건의 사회적 구성: 식중독인가, 식품공해인가?

The study analyzed why the Kanemi oil disaster could not be an important social issue in Japanese society even though it caused a large number of victims. Questions are the followings: First, what is the Kanemi oil scandal, and how japan government, the companies and the victims responded to it? Second, why the Kanemi oil scandal did not emerge as a major social problem? The results for the first question are as follows. First, japan government suppressed the human rights of the victims and maintained their own interests. Also, the government didn't fulfilled its duty to protect victims' lives. Second, the companies of Kaneka and Kanemi were reluctant to pay compensation to victims and accept the existence of the YUSHO. Third, the victims blamed companies and the government mainly through the a legal battle which was main resource mobilization. Kanemi oil scandal could not be organized as an important social issue because of three reasons: First, it was difficult to unite the opinions of the plaintiffs and took long to reach an agreement. Victims were lack of experts who can solidify with them and other civil society. In addition to this, financial problems damaged the credibility of lawyers. Moreover at the result of withdrawn of lawsuit, the victims had to pay back the money from the japan government and this made them fall apart. Second, the government framed the disaster to a ‘food poisoning’ issue not ‘pollution problem’ and this frame worked against the victims' movement in fatal way. Third, it was difficult for victims to fight against Japan's strong stance on developing countries. 이 글은 4대 공해사건과 동시대에 발생했음에도 불구하고 피해자에 대한구제가 거의 이뤄지지 못한 가네미오일 사건을 분석함으로써 공해 물질로 인한 건강피해 사건이 ‘환경문제’나 ‘사회문제’로 어떻게 구성되는지, 만약 ‘환경문제’나 ‘사회문제’로 부각되지 않는다면 그 원인은 무엇인지 밝히는 데 목적이 있다. 연구 질문은 다음과 같다. 첫째, 가네미오일 사건은 무엇이고 정부, 가해 기업, 피해자 등 시민사회는 어떻게 이 사건에 대응했는가? 둘째, 가네미오일사건이 일본의 4대 공해사건 등에 비해 큰 사회문제로 부각되지 않은 원인은 무엇인가? 첫째 연구질문에 대한 결과는 다음과 같다. 첫째, 가해 기업은 기업의 지속가능성이라는 기준을 중심으로 피해자들의 인권을 억압하고 자신들의 이익을지속하고 정당화했다. 둘째, 일본 정부는 자본주의 국가로서 자본 혹은 기업의지속가능성을 위해 피해자의 생명, 건강, 인권을 보호하는 책무를 방기했다. 정부는 피해자 운동이나 시민운동조직의 자원동원능력이 약하고, 공론장이활성화되지 않은 조건 속에서 자본축적 책무를 충실히 수행했다. 셋째, 피해자운동 조직들은 소송에 집중함으로써 정부와 기업에 대한 시민운동의 장과 공론장을 형성하는 데 실패했고, 피해자들과의 연대, 피해자들과 전문가, 시민사회와의 연대에도 성공하지 못했다. 이런 맥락 속에서 피해자들은 건강 피해뿐만 아니라 사회적, 정치적으로 고립되고 경제적으로 고통 받게 되었다. 둘째, 연구질문과 관련하여 가네미오일 사건이 중요한 사회문제로 구성될 수 없었던 사회적 원인은 다음과 같다. 첫째 자원동원 방법 측면에서 피해자들이 소송에만 자원을 집중했고, 전문가의 지원을 조직하지 못했다. 소송 중 피해자들의 결속도 약했으며, 변호단과의 협력도 원활하지 못했다. 둘째, 피해자들은 정부의 ‘식중독’ 프레임에 맞서 ‘식품공해’문제 또는 환경보건 문제로이 사건을 프레임하는 데 실패했다. 셋째, 1999년 이후 다이옥신 문제로 이사건이 재해석되면서 변화의 가능성이 생겼고, 그 결과 부분적인 제도개선이이루어졌지만 거시구조적으로 일본의 자본주의 국가 또는 개발국가의 기조가강력한 상황에서 피해자들이 시민사회와의 연대를 형성할 수 있는 정치적 기회가 거의 없었다.
Case Study for Sustainable Management of Jeju Experimental Forest

Since the Rio World Summit of 1992, a new paradigm of sustainable forest management has developed and concerns have been mainly focused on how forest sustainability will be objectively achieved, assessed and measured. Attention has focused on developing criteria and indicators for sustainable forest management and getting forests certified. This study aimed to transform Jeju Experimental Forest, located in the warm temperate zone of Halla mountain on Jeju Island in Korea, into an exemplary model forest by implementing sustainable forest management at the ground level and pursuing forest management certification. As a pre-requisite for forest certification, an extensive, 900-man-day field survey was conducted in 2004 over the 2,741ha of Jeju Experimental Forest to determine the ecological, social, economic and managerial aspects. Based on the survey results, the database systems for flora and fauna and site conditions of Jeju Experimental Forest were established and a 10-year forest management plan was developed with greater consideration for intangible forest values such as biodiversity, landscapes and water resources using forest function classification mapping. The forest function classification program was found to be a useful tool for supporting the decision-making process for forest management planning. The preparation for forest certification became a long process to meet the pre-requisites for implementation of sustainable forest management at the ground level.
