실질과세원칙에 관한 소고

조세법은 조세의 부과 징수에 필요한 모든 사항을 국회에서 제정한 법률에 의한다는 형식면 에서의 조세법률주의와 조세는 국민으로부터 그 담세력에 근거하여 공평하게 배분되어야 한다 는 내용면에서의 조세평등주의 원칙을 중요한 기본원칙으로 삼고 있다. 그리고 조세법의 내용면 에서의 기본원칙인 조세평등원칙을 실현하기 위한 실천적 원리로서 실질과세 원칙이 있다. 실질 과세원칙은 실질적인 담세력에 따라 조세를 부과함으로써 공평부담을 실현하고자 하는 조세평 등주의의 실현원리이다. 그러나 조세법을 해석하고 적용함에 있어서 실질과세의 원칙만을 중시 하게 되면 조세법률주의가 형해화되어 법적안정성과 예측가능성을 침해할 수 있고, 반면에 조세 법률주의만을 고수하게 된다면 조세가 담세력과 유리되어 조세부담의 공평이 깨질 수 있다. 그 러므로 조세부담의 공평을 도모함과 동시에 법적안정성과 예측가능성을 보장하기 위해서는 조 세법을 해석하고 적용함에 있어서 실질과세의 원칙과 조세법률주의를 어떻게 조화를 이루게 할 것인가 하는 문제로 귀착된다 할 것이다. 이러한 관점에서 본고에서는 구체적으로 조세법의 ‘입법’, ‘해석’ 그리고 ‘적용’의 각 단계에서 실질과세원칙이 어떻게 적용되는지를 살펴본 후, 구체적인 적용사례와 제한을 통해 조세법률주 의와의 조화 아래에서 어떻게 기능해야 하는지를 다음과 같이 도출해 보았다. 첫째, 조세부담의 공평을 실현하고 조세회피행위 금지나 특정한 자의 부담세액을 면하는 것을 방지하여 조세법률주의의 실질적인 이념을 실현하기 위해서는 법률상의 형식과 경제적 실질이 서로 부합하지 않는 경우에 경제적 실질을 추구하여 경제적 효과에 기초한 과세가 이루어지는 것이 타당하다. 둘째, 실질과세원칙은 헌법상 원칙인 조세평등주의의 파생적 원칙일 뿐만 아니라 조세평등주 의와 실질적 조세법률주의를 실현하는 원칙으로 당연히 헌법에 근거를 두고 있는 원칙이라고 할 것이다. 셋째, 조세법은 헌법상의 원칙인 조세법률주의를 그 본질적 지위에 있는 법원칙으로 하여 법 적안정성과 예측가능성의 보장을 추구한다. 그러므로 실질과세원칙이 세법의 본질적 지위에 있 는 법원칙인 조세법률주의의 테두리 내에서만 기능한다고 생각된다. 넷째, 조세법상 개념의 해석은 원칙적으로 통일설의 입장을 취하면서 경우에 따라 실질과세원 칙에 근거하여 경제적 실질에 따라 차용개념을 조세법 독자적인 의미로 파악하는 것이 바람직 하다고 본다. 결론적으로 조세법률주의와 실질과세 원칙 가운데 조세법률주의를 보다 근원적인 기본원칙으 로 인정하여 실질과세의 원칙이 조세법률주의를 본원적으로 침해하지 않는 범위 내에서 기능하 여 그 조화를 이루도록 해야 할 것이다.

염산피밤피실린의 마이크로캅셀에 관한 약제학적 연구

Pivampicillin hydrochloride is a kind of broad spectrum antibiotics with bactericidal action, and is used in many countries, although it has bitter taste, unpleasant odour and side effects of irritating gastric mucosa, nausea, penicillin allergy, etc. For the improvement of such side effects of pivampicillin hydrochloride, microcapsules, with wall of ethylcellulose, have been prepared by coacervation method. The shape was observed through the scanning electron microscope, the release of the drug into an aqueous medium was studied and the effects of core: ethylcellulose ratio were interpreted as well as making sensory evaluation of taste and odour. There was decreasing trend in dissolution rate of the drug with the increase of core: ethylcellulose ratios, and the smaller microcapsules released their contents more rapidly. A linear relationship was established between the amount of ethylcellulose and the time for 60% release of the drug, and the release pattern was found to have similar characteristics to the release of the drug from an insoluble porous matrix. The release of the drug in the artificial intestinal fluids (pH 6.8) was found to be similar to that in water, while the release in the artificial gastric juice (pH 1.2) was slightly slower. Bioavailability of microcapsule was compared with that of pivampicillin hydrochloride in rabbits using serum concentration and urinary excretion measurements. Microcapsule gave showed slightly higher serum level than pivampicillin hydrochloride from 2 hours after administration, while no significant difference was observed in the accumulated urinary excretion rate between pivampicillin hydrochloride and microcapsule. The ulcer index of pivampicillin hydrochloride administered group was 2.6, and microcapsule administered group was 1.5, while control group was 0.8. Therefore it may be concluded that microencapsulation of pivampicillin hydrochloride is a useful pharmaceutical approach to protect the gastrointestinal tract from being injured by direct contact of pivampicillin hydrochloride without any significant difference of bioavailability.

We show that every unbounded approximate Pexiderized exponential type function has the exponential type. That is, we obtain the superstability of the Pexiderized exponential type functional equation f(x + y) = e(x; y)g(x)h(y).From this result, we have the superstability of the exponential functional equation f(x + y) = f(x)f(y).

멀티미디어 콘텐츠의 지역축제에서 활용 방안에 관한 연구

This paper is a study on the introduction and utilization of multimedia content in local festivals. Recently, local governments are finding a remarkable achievement and introducing a variety of local festivals to local revitalization purposes. Such a feature is a similar situation at a local festival in overseas as well as domestic. However, many local festivals are being held at home and abroad, intensifying competition between the local festivals, Some competing local governments are struggling to attract visitors. Under these circumstances, the local government has introduced a local festival content and multimedia technologies for the success of local festivals is getting good reviews from visitors. In this study, the selection of the successful national and international festivals 4 places being evaluated by the introduction of multimedia content in local festivals through the empirical analysis of the multimedia type content, and to find ways to take advantage of multimedia content in future festivals. Also, The purpose of this study is that more and more local governments to take advantage of a variety of multimedia content using the local festivals in the future. 본 논문은 지역축제에 있어서 멀티미디어 콘텐츠의 도입과 활용방안에 관한 연구이다. 최근에 지방정부들은 지역 활성화 목적으로 다양한 지역축제를 도입하고 있으며 괄목할만한 성과를 내고 있다. 이와 같은 특징은 국내 뿐만 아니라 해외 지역축제에서도 마찬가지 상황이다. 하지만, 많은 지역축제가 국내외에서 개최되어 지역축제 간 경쟁이 심화되고 있고, 일부 경쟁지역간에는 방문객을 유치하는데 어려움을 겪고 있다. 이러한 상황에서 지방정부는 지역축제의 성공을 위해서 지역축제 콘텐츠에 멀티미디어 기술을 도입하고 있으며 방문객으로부터 좋은 평가를 받고 있다. 따라서 본 연구에서는 지역축제에 멀티미디어 콘텐츠를 도입하여 성공적으로 평가를 받고 있는 국내외 지역축제 4곳을 선정하여 멀티미디어 유형별 콘텐츠의 실증분석을 통해서, 향후 지역축제에서 멀티미디어 콘텐츠를 활용할 수 있는 방안을 모색하고자 한다. 또한 향후에는 더욱 많은 지방정부에서 지역축제에 멀티미디어를 이용한 다양한 콘텐츠를 개발하여 활용할 수 있도록 하고자 한다.

고사성어를 활용한 글쓰기 교육방안 연구

Study of Writing training with Idiom originated in an ancient event Lee, YoungHwan(Sehan University) In trend which the humanities is more and more concerned, writing field is extend its territory. The lecture about writing or composition method, and new teaching method, reference are studying very impassionedly. Writing training with Idiom originated in an ancient event suggest to join together 'what to write' in situation of being inclined 'how to write'. Idiom originated in an ancient event have a perfect narrative structure and the humanistic scarcity value, and they become the writing' material sufficiently. Student access to writing easily with this characteristic. And they can make opportunity to look back their life and to seek a new direction. They choice idiom and analyze to interpret and can find motto, and then express it with writing. Writing is adjacent with thinking and introspection. Writing is not limited to technical side, but make convergence of the studies. 고사성어를 활용한 글쓰기 교육방안 연구이영환(세한대학교) 인문학에 대한 관심이 높아지는 가운데, 이와 관련된 글쓰기 분야도 지속적으로 영역이 확장 되는 추세이다. 글쓰기 또는 문장 작법에 대한 강의가 대폭 늘어났으며, 새로운 교육 방법과 자 료가 연구되고 있다. 고사성어를 활용한 글쓰기는 ‘어떻게 쓸 것인가’에 치우쳐 있는 상황에서, ‘ 무엇을 쓸 것인가’를 아우를 것을 제안한다. 지금까지 고사성어를 활용한 글쓰기 연구는 학술 논 문의 형태로 연구되지 않았다. 이런 주제의 연구는, 고사성어에 의한 유도 작문의 형태이기에 아 이디어 생성 측면이 약화될 우려가 있다. 그러나 고사성어를 현실에 적용하고 창의적으로 해석하 는 자체가 이미 아이디어 생성 과정이다. 오히려 고사성어가 품고 있는 탄탄한 서사 구조와 오랜 시간을 통해 검증된 고전 인문적 가치는 글쓰기의 소재가 되기에 충분하다. 학습자는 이러한 특 징을 활용하여 글쓰기에 쉽게 다가갈 수 있으며, 삶을 되돌아보고 새로운 방향을 모색할 수 있 는 계기를 마련할 수 있다. 관심 있는 고사성어의 선택과 분석을 거쳐, 내용을 현대적으로 해석 하면서 인생의 좌우명을 이끌어내고 그것을 글로 표현하는 것이다. 글을 쓰는 과정이 사고하고 성찰하는 분야와 맞닿아 있으며, 글쓰기는 기술적 측면에 국한되지 않고 인접한 여러 학문 분야 와 통섭의 작용을 한다.
