        기간제법 상 기간제 근로자 사용기간 제한 예외에 관한 고찰

        The fixed term employment act is to stipulate the upper limit for the employment that lasts for a specified period for regulating the abuse of the fixed term employment; provide, it still approves various exceptions. Since such exceptions could infringe the specified purpose of the fixed term employment, which is to protect the fixed term employees, they should be limited to the cases stated and stipulated in the fixed term employment act, and the causes of exceptions should be limited to the ones stating as the main causes of exceptions in the fixed term employment act. Moreover, the causes of exceptions should be the ones that could be reasonably anticipated by both employees and employers upon settlement of the fixed term employment. Along with the regulations and interpretation of the fixed term employment, the important issue relevant with exceptions of the fixed term employment act is that it is challenging for employees to identify and recognize the causes of exception of the fixed term employment act. In the case of employers, they could easily identify the cases that could be considered as exception of the fixed term employment act since they supervise the entire employment process even from the planning of the corresponding business project. However, employees may have no opportunities to recognize such cases unless employers notifies or indicates them. Amid the blockage of those important information, employers could unilaterally notify the termination of the fixed term employment by claiming the corresponding employment is an exception to the fixed term employment act after 2 years of the fixed term employment and consequently, the transition of employment type to the unlimited term employment could not be protected. In consideration of the anticipation of fixed-term employees for the transition to unlimited term employment and general knowledge that there would be a transition to unlimited term employment after 2 years of the fixed term employment, the aforementioned situation could be inappropriate. Therefore, it would be proper to impose employers to notify their employees of the fixed term employment with any causes of exemptions of the fixed term employment act upon settlement of the employment act, and this issue could be easily resolved with the revision of relevant acts.

        임플랜트의 지대주 연결방식, 임플랜트의 직경 및 지대주 연결부위의 직경 차이에 따른 응력분포에 관한 삼차원 유한요소분석

        Statement of problem. Higher incidence of prosthetic complications such as screw loosening, screw fracture has been reported for posterior single tooth implant. So, there is ongoing research regarding stability of implant-abutment interface. One of those research is increasing the implant diameter and prosthetic table width to improve joint stability. In another part of this research, internal conical type implant-abutment interface was developed and reported joint strength is higher than traditional external hex interface. Purpose. The purpose of this study is to compare stress distribution in single molar implant between external hex butt joint implant and internal conical joint implant when increasing the implant diameter and prosthetic table width : 4mm diameter, 5mm diameter, 5mm diameter/6mm prosthetic table width. Material and method. Non-linear finite element models were created and the 3-dimensional finite element analysis was performed to see the distribution of stress when 300N static loading was applied to model at $0^{\circ},\;15^{\circ},\;30^{\circ}$ off-axis angle. Results. The following results were obtained : 1. Internal conical joint showed lower tensile stress value than that of external hex butt joint. 2. When off-axis loading was applied, internal conical joint showed more effective stress distribution than external hex butt joint. 3. External hex butt joint showed lower tensile stress value when the implant diameter was increased. 4. Internal conical joint showed lower tensile stress value than external hex butt joint when the implant diameter was increased. 5. Both of these joint mechanism showed lower tensile stress value when the prosthetic table width was increased. Conclusion. Internal conical joint showed more effective stress distribution than external hex joint. Increasing implant diameter showed more effective stress distribution than increasing prosthetic table width.

        공무원의 단체행동

        공무원법, 공무원노조법 등을 통해 공무원의 단체(집단)행동은 엄격히 규제된다. 공익을 추구하여야 할 공무원이 자신들의 사익을 위해 단체행동을 함으로써 공공질서나 공익에 영향을 미칠 수 있기 때문이다. 하지만 한편으로는 공무원도 공무원이기 이전에 기본권 주체로서 국민의 한 사람이자 근로자라는 점에서 공익을 침해하지 않는 범위 내에서는 공무원도 당연히 단체행동을 할 수 있다고 보아야 할 것이다. 특히 공무원노조법에 따라 노동3권이 보장되는 공무원은 근로자로서의 지위가 강조되는 만큼 다른 공무원보다 폭 넓은 단체행동이 보장된다고 하겠다. 공무원노조법은 공무원에게 일체의 쟁의행위를 금지하고 있으므로 공무원의 단체행동이 쟁의행위에 해당하게 되면 노조법에 따른 정당성 여부의 판단 없이 곧바로 불법적인 행동이 되고 만다. 따라서 공무원의 단체행동이 쟁의행위에 해당하는지는 매우 엄격하게 판단할 필요가 있다. 우리 노조법은 쟁의행위를 노동당사자가 주장을 관철할 목적으로 행하는 행위로서 업무의 정상적인 운영을 방해하는 행위라고 정의하고 있다. 공무원의 단체행동이 쟁의행위에 해당하는지 여부도 이 정의에 따라 주체, 목적, 행위 등의 요소를 갖추고 있는지를 중심으로 판단되어야 한다. 공무원은 쟁의행위가 제한되지만, 쟁의행위를 제외한 단체행동은 공무원 노동조합의 정당한 활동 범위 내라면 당연히 보장된다고 해석하는 것이 공무원의 노동3권 보장 취지에 적합하다. 그리고 노조활동 범위 내에서는 공무원은 공무원의 지위보다 근로자의 지위가 더 강조되는 자라고 할 수 있으므로 공무원관계법상의 공무원 의무를 엄격히 적용하는 것은 적절치 않다고 생각한다. 공무원도 근로자로서 자신들의 근무조건과 사회적・경제적 지위 향상을 위한 행위를 할 수 있는 권리는 당연히 보장되어야 하기 때문이다. Public official`s collective action is limited on law related to public official. Because public officials influence public order and benefit by their collective action. But on the one hand, public official is also one of the public and worker who has basic right on constitutional law. Therefore Within the scope of which do not violate the public interest, collective action of public officials be permitted. A act of dispute is typical limited public officials of collective action. public officials`s industrial action is illegal with or without justification. Therefore there is need to judge strictly whether public official`s collective action is industrial action or not. We have to judge whether it is industrial action or not in accordance with concept on the labor union law. Without industrial action, public official`s collective action is guaranteed by regal within the scope of a legitimate labor union activity. And public official is emphasized status of the worker in labor union activity. Because public officials’ right are also guaranteed that improve their labor condition and social status.

      • 항로표지 분야 정보표준 검증을 위한 S-200 테스트베드 개발 연구

        국제항로표지협회(IALA)는 담당 분야(AtoN, AIS, VTS, PNT)의 정보교환 표준개발을 위해 국제수로기구에서 개발한 S-100(범용 수로데이터모델)을 적용하기로 결정하고, S-200 시리즈의 제품 사양서(Product specification)을 개발하고 있다. 개발 중인 S-200 시리즈 제품 사양서로는 S-201 항로표지, S-210 IVEF, S-230 ASM, S-240 DGNSS 기준국 목록 등이 있으며 일부 표준은 개발 완성 단계에 있다. S-200 제품 사양서는 정보 교환을 위한 내용, 구조, 포맷, 심볼 등의 기술사항이 포함되어 있으므로 표준을 검증하거나 현업으로 적용방안을 검토하기 위해서는 테스트 베드를 통한 검증이 요구된다. 본 연구에서는 항로표지 분야 정보교환 표준인 S-200 시리즈 제품 사양서가 개발되고 있는 것과 관련하여 S-200 테스트 베드 설계 및 시범 개발 결과를 소개 한다.

        Peptidomimetic Small-Molecule Compounds Promoting Cardiogenesis of Stem Cells

        Embryonic stem (ES) cells may be used as an alternative source of functionally intact cardiomyocytes for ischemic heart disease. Several natural and synthetic small molecules have been identified as useful tools for controlling and manipulating stem cell renewal and differentiation. Currently, there is an urgent requirement for novel small molecules that specifically induce differentiation of stem cells into cardiomyocytes. To identify compounds that promote cardiomyogenesis of stem cells, cell-based screening of a peptidomimetic small-molecule library was carried out. A series of β-turn peptidomimetic compounds, including CW209E, increased the expression of α-MHC promoter-driven enhanced green fluorescent protein (EGFP) and ratio of beating embryoid bodies (EBs) without inducing cytotoxicity in mouse embryonic stem cells. CW209E also increased the number of beating EBs in human embryonic stem cells (hESCs) and human induced pluripotent stem cells (hiPSCs). Thus, this chemical compound should be useful for elucidation of the molecular pathway of cardiogenesis and generation of cardiomyocytes ex vivo, which can be further applied for experimental or clinical cell therapy for ischemic heart diseases.

      • Development of electrodes for multifunctional battery based on carbon fabric

        Recently, as the development of electrical vehicles, unmmaned drones, and transportations using electricity are progressing, researches on not only improvement of performances but also size and efficiency are getting attention. In order to maximize the efficiency of such devices, a battery that functions as energy storage and structure at the same time is required. As to meet such requirements researches on multifunctional battery are highly encouraged thesedays. In this study, carbon fabirc is used for current colloector of both cathode and anode since it is well known to have good electric conductivity and mechanical property. Then, nickel-cobalt and vanadium oxide were grown directly onto carbon fabric by simple hydrothermal methode to complete the anode and cathode respectively. SEM, TEM, XPS, XRD were performed to see morphology and electrochemical properties were examined. Finally, tensile test was performed for mechanical property.
