이 논문은 박지원이 지은 열녀전 형식의 事狀과 「烈女咸陽朴民傳」을 종합적으로 검토하여 「열녀함양박씨전」의 형식과 주제를 새롭게 분석하고자 하는 목적에서 작성되었다. 열녀전은 유교적 가부장체제에 순응하는 여성상을 이상적인 여성상의 典型으로 선전하였던 전근대의 문학양식이다. 특히 조선 후기 열녀전은 ‘남편이 죽으면 부인은 따라죽어야 한다’는 왜곡된 윤리관을 유포하여 많은 여인들을 죽음으로 이끌었다. 박지원은 「열녀함양박씨전」을 창작하기 이전에 열녀전 형식의 事狀을 세 편이나 작성하였다. 이 세 편의 사장을 창작 시기 순으로 살펴보면 과부의 從死 문제를 바라보는 박지원의 시각이 점차 비판적인 방향으로 변화하고 있었음을 확인할 수 있다. 박지원은 열녀전의 형식을 교묘하게 파괴한 「열녀함양박씨전」의 새로운 형식을 창출하여 인간의 자연스러운 성정에 위배되는 가혹한 예법을 비판하였다. 따라서 박지원의 「열녀함양박씨전」은 ‘天理의 이름으로 殺人’을 하는 봉건 예법과 이러한 예법을 선전하였던 인습적인 문학양식을 비판하기 위해 창작된 破格的인 烈女傳이라고 할 수 있다. This study aimed at analyzing the form and theme of Park, Ji-won's 「Yeollyeo Hamyang Parkssi-jeon」 in a new perspective by comprehensively examining it and Park's three other writings written in the form of Yeollyeo-jeon. Yeollyeo-jeon is the literature of the pre-modern era that promoted a woman following the Confucian patriarchal system as an ideal model for women. Especially Yeollyeo-jeons written in the later Joseon era spread the distorted ethical view that a wife should killed herself following her husband's death. leading lots of women to commit suicide. Before writing 「Yeollyeo Hamyang Parkssi-jeon」, Park produced three writings in the form of Yeollyeo-jeon. A look into the three writings in the order of their creation date reveals that Park gradually became critical of social norms that encouraged widows to commit suicide to follow their husbands in death. Park expressed advanced critical views of feudal social norms by writing 「Yeollyeo Hamyang Parkssi-jeon」, a new style of Yeollyeo-jeon that tactfully avoid the established style. Therefore, it can be said that Park's 「Yeollyeo Hamyang Perkssi-jeon」 is a unconventional Yeollyeo-jeon aimed to criticize feudal social norms that tolerated murder in the name of the laws of nature and conventional literature that promoted such social norms.
