세력 변동하의 평화 구상 -한스 모겐소의 정치적 분쟁론을 중심으로-

21세기에 들어 중국, 한국, 일본 사이에서 대립의 강도가 높아지고 있다. 하지만 일련의 대립으로 표현되고 있는 구체적 분쟁은 새롭게 생겨난 문제가 아니라 오히려 오래전부터 존재해 온 문제와 관련이 있다. 요컨대 중국과 일본, 한국과 일본 사이에서 쟁점이 되는 무인도를 둘러싼 영토분쟁은 지난 세기 중반부터 이미 존재해 왔다. 오래전부터 존재해 온 분쟁이 새롭게 강화되는 배경에는 동아시아에서 진행되는 세력 관계의 변동이 있을 것이다. 세력 관계의 변동으로 고양된 대립 관계가 종래의 분쟁을 강화시키고 있는 것이다. 세력 관계의 변동으로 생겨난 국가 간의 ‘긴장 (tensions)’과 결부됨으로써 ‘분쟁(disputes)’이 강화된다는 사고방식은 모겐소(Hans Morgenthau)의 『국가 간의 정치(Politics among Nations)』를 통해 이미 잘 알려져 있다. 그렇다면 현재 동아시아의 국제 관계를 고찰하기 위해서는 세력 변동하에서 어떻게 안정적인 질서를 구축해 나갈 것인가라는 관점이 필수적이다. 세력 변동의 문제는 일반적으로 국제정치학적 주제로 이해된다. 그러나 실제로는 국제법학의 역사에서 굉장히 중요한 의의를 지녀 왔다. 1870년대 이후부터 전간기까지 독일을 중심으로 하는 유럽 국제법학에서는 법의 현상과 세력 관계 사이의 괴리라는 문제가 이론적 과제로 논의되었다. 그리고 국제연맹 시기의 평화사상에서는 포괄적 인 분쟁 해결 절차를 구축해야 한다는 관심에서 분쟁의 성질론에 대한 논의가 활 발해졌으며, 세력 변동으로 생겨나는 분쟁이라는 관념(동태적 분쟁)이 일반화되었다. 동태적 분쟁은 신흥 세력이 요구하는 법의 변경과 종래의 지배적 세력이 요구하는 현상 유지(status quo) 사이에서 생겨나는 분쟁이다. 이러한 분쟁 이해는 전 간기에 정치적으로 매우 중요한 의의를 가졌던 노동법학에서도 공유되고 있었다. 모겐소는 저명한 노동법학자 진츠하이머(Hugo Sinzheimer)의 영향 아래 국제법 이론을 구축했다. 그는 당시 국제법 이론에서 논의되던 동태적 분쟁 개념을 실마리로 현상 유지를 요구하는 세력과 그 변경을 요구하는 세력 간의 대립 관계를 기축으로 하는 국제질서사상을 구축했던 것이다. Since the turn of the 21st century, confrontations among China, Korea and Japan have been growing ever more intense. Yet these confrontations are not prompted by newly emerging issues, rather they derive from territorial disputes between China and Japan, and between Korea and Japan, over uninhabited islands which have been argued over since the middle of the last century. The reason why such long-standing disputes have recently become more heated, with significantly more confrontational relations, is the ongoing shift in power dynamics in East Asia. The principle that disputes tend to escalate when they become entangled with international tensions arising from such shifts is well established, as noted in Morgenthau’s Politics among Nations. The current state of international relations in East Asia, and in particular how to establish a stable order, can only be understood by studying this changing landscape of power dynamics. Such power shifts are generally considered within the context of international politics, but in fact they have also played a very significant role in the history of international jurisprudence. Thus, international jurisprudence in Europe gave rise to an important theoretical discourse, centered mainly around Germany during the period between the 1870s and the inter-war era, which debated the gap between the existing legal structures and the prevailing power dynamics. Also, during the era of the League of Nations, in attempting to create a philosophy of peace, efforts were made to establish comprehensive dispute resolution procedures, which resulted in active theoretical discussions on the nature of disputes, and a generalization of the notion of disputes arising out of power shifts as ‘dynamic disputes.’ A dynamic dispute is one that arises between an emerging power’s demand for the revision of existing laws, and a dominant power’s demand for the preservation of the status quo. Morgenthau used this idea of dynamic disputes to develop a conception of international order which is centered mainly around confrontational relations between forces seeking to preserve the status quo and forces demanding to change it. This way of understanding disputes was also shared with labor jurisprudence, having a very important political impact during the inter-war period. Indeed, Morgenthau had established his theory of international law under the influence of Hugo Sinzheimer, a renowned jurist specializing in labor law.

원시적인 척삭동물인 멍게에서 초기 배 세포운명은 모성 세포질인자와 유도적 상호작용에 의하여 결정된다. 매우 단순한 구조를 하고 있는 멍게 올챙이형 유생의 주요한 중배엽 조직으로 척삭, 근육 및 간충직이 존재한다. 근육 세포의 형성은 세포의 자율적인 과정으로, 초기 배의 후부 가장자리에 국재하는 모성 macho-1 mRNA에 의하여 근육 세포의 운명이 결정된다. 이에 반하여, 내배엽 전구세포의 유도작용은 척삭과 간충직 세포의 운명결정에 있어서 중요한 역할 In ascidians, a primitive chordate, maternal cytoplasmic factors and inductive interactions are involved in the specification of cell fates in early embryos. The larval structure of ascidians is relatively simple, and the major mesodermal tissues of the tadpole larva are notochord, muscle, and mesenchyme. Formation of muscle cells is a cell-autonomous process, and localized maternal macho-l mRNA specify muscle fate in the posterior marginal zone of the early embryo. In contrast, inductive influence from endoderm precursors plays important roles in the specification of notochord and mesenchyme fates. FGF-Ras-MAPK signaling is involved In the induction of both tissues. The difference in responsiveness of the posterior mesenchyme and anterior notochord precursors to FGF signaling is caused by the presence or absence of intrinsic factors that inherited from the posterior-vegetal egg cytoplasm, respectively. In these inductions, directed signal polarizes the induced cells and promotes asymmetric cell divisions to produce two daughter cells with distinct fates.
