본 논문은 도덕이론의 관점에서 칸트의 무관심성의 역할에 대한 고찰이다. 무관심성은 취미판단과 연관된 바, 직접적으로 윤리학에 결부된 개념은 아니다. 이러한 개념이 칸트의 윤리학 체계에서 어떤 역할을 수행하는지 살펴보기 위해서 필자는 칸트의 윤리학체계가 변모되는 과정을 발전사적 관점에서 재구성해 보았다. 인간의 행동들을 구분하는 기준이 ‘동기’에서 ‘욕구능력’으로, 그리고 다시금 ‘관심’으로 전화되는 과정이 그것으로, 이에 따라 칸트의 윤리학은 체계적인 통일성을, 특히나 ‘구별의 원리’로서 도덕성과 ‘실행의 원리’로서 도덕성 간의 간극을 메우는 통일성을 획득한다. 이 통일성은 행위 주체로서 이성의 통일성에 직결된 바, 칸트 윤리학의 성패를 좌우하는 가장 핵심적인 요소가 아닐 수 없다. 특히 분석의 최종 종착지인 관심의 본질을 규명하는 데 있어 취미판단의 무관심성은 새로운 발견술처럼 기능한다. 본 논문의 의도는 이 발견술적 역할을 규명함과 동시에 그로부터 도덕법칙과 도덕감정의 일치, 그리고 덕윤리와 의무론적 윤리의 화해가능성을 검토해 보려는 데 있다. Ce travail a pout but de mettre en examin le sens de l’indifférence kantienne dans la perspective de moral théorie. Etant donné que Kant use de la notion ‘indifférence’ pour caratériser exclusivement l'expérience esthétique, sa signification morale n'apparaît pas directement. Pour cette raison, nous proposons de lire Kant dans la perspective génétique, et de trouver le rôle de la notion d'indifference dans la construction du système moral de Kant. Comme on le sait, Kant s’évertue à réunir la raison pure et la raison pratique, dans la mesure où l’unité des deux système est l’unité même de l’ésprit humain. Celle-ci conduit Kant à reconnaître l’insuffisance des descriptions de l'activité humaine selon les motifs ou selon les capacités de désirer, et à développer une phénoménologie de l’intérêt au profit de la conception de la finalité, telle que la Critique de la faculté de juger l'apporte. Dans ce cadre, la notion d’indifférence joue le rôle d’une heuristique nécessaire à la découverte de la structure générale de l’intérêt humain. Elle ne manque pas de dévoiler sa signification morale, et cela dans un sens tout différent de celle que le Stoïcisme ancien a attribué à l’apatheia.

본 논문에서 필자는 1780년대 초반 벤담이 직면했던 이론적 위기의 실체를 규명해 보고자 한다. 스스로 ‘형이상학적 미궁’이라 칭한 이 위기는 벤담이 『도덕과 입법의 원칙에 대한 서론』을 미완의 상태로 남겨 둔 실질적 원인이 되었다. 근대 법리학의 전통에서 상호대립적인 관계로 인식되어 온 형법과 민법의 경계를 새롭게 설정하려는 벤담의 노력은 두 경계를 오히려 모호하게 만들었고, 위법행위의 유형학을 구축하는 데 사용했던 자신의 방법론을 스스로 번복케 하는 결과를 초래했다. 현대의 법실증주의 계열의 해석자들이 벤담의 이 이론적 위기에 대한 여러 접근법을 제공해 왔는데, 그들의 설명방식은 근본적으로 벤담의 철학적 소명과 부합하지 않는 것처럼 보인다. 본 논문에서 필자는 법-실증주의적 해석의 문제점들을 지적하면서, ‘형이상학적 미궁’의 실체가 인식체계와 기대체계의 불가분성에서 기인함을 증명해 보일 것이다. 방법론의 위기는 이 불가분성을 보여주지 못하는 형식논리들의 한계에 대한 자각이라 할 터인데, 해당 자각이 벤담의 공리주의적 법리학에서 갖는 실천철학적 의미를 결론에서 밝힐 것이다. In this paper, I will focus on Bentham’s theorectical crisis in early 1780 which he termed 'the metaphysical maze', and which brought to a halt his attempt to complete his Introduction to the Principles of Morals and Legislation. This crisis started with the simple task of distinguishing penal from civil code of law. These two branches of law were often set in opposition one to another in the modern history of jurisprudence. But, in Bentham's investigation, they appeared inseparably interwoven and they led him to doubt the validity of the method by which he had erected the typology of offenses. One possible approach to the methodological problem Bentham uncovered here would have been offered by the legal-positivist interpreters. But I thinks that they misunderstood principally Bentham's philosophical vocation. In this paper, I will propose an alternative approach. What we called the methodological crisis consisted in recognizing the limit of the formal logics which were not proper to explore the logical connection between knowledge and expectation. The main target of this paper is to realize the full practical implications of this recognition in Bentham's utilitarian jurisprudence.

What is the essence of Bentham’s political radicalism? We may finish, as many scholars did actually, by distorting Bentham’s thought, if we apply to him the political frame offered by the historical debate between Burke and Paine, which still represents the conflict between the conservative and the progressive. For an accountable evaluation of Bentham’s radicalism, it is urgent that we should detach him from this frame. In this Paper, I will (a) expose Bentham’s critique against two sides in his Fragment on Government and Anarchical Fallacies, and (b) bring out Bentham’s original point of view about the government, and (c) examine Bentham’s conception of sovereignty and of public opinion tribunal in his Constitutional Code with the intention of showing why Bentham adhered to the system of representative democracy. 벤담 급진주의의 정확한 실체는 무엇인가? 버크 대 페인의 정치논쟁으로 대변되는 진보와 보수의 대결구도 하에서 벤담의 급진주의는 실체적으로 왜곡되기 일쑤였다. 어떤 면에서 그의 이론이 급진적인지를 파악하기 위해선 이 친숙한 진보와 보수의 구도로부터 벗어나는 일이 급선무이다. 필자는 『정부에 관한 단상』과 『무정부주의적 오류』를 통해 각 진영에 대한 벤담의 비판을 살펴보고, 이를 바탕으로 벤담 정치이론의 독창적 면모를 부각시켜 볼 것이며, 『헌법전』의 ‘주권’ 개념과 ‘여론법정’ 개념을 중심으로 민주주의에 관한 벤담의 입장을 검토해 볼 것이다.

농촌형 · 도시형 교통모델 현황 및 대중교통 취약지역 개선효과 분석

2014년부터 전국적으로 확산된 농촌형 · 도시형 교통모델은 버스서비스 공급이 원활하지 못한 지방 농촌도시의 대중교통 취약(사각)지역 주민의 이동권을 확보하며 삶의 질 개선에 긍정적인 교통수단으로 평가되고 있다. 그러나, 해당 평가결과가 농촌형·도시형 교통모델 이용자를 대상으로 한 설문만족도 수준에 머무르고 있어, 사업 확대를 위한 객관적인 비교 가능성을 확보하지 못하는 단점이 있다. 따라서, 본 연구에서는 농촌형 · 도시형 교통모델이 도출한 사회적 영향 즉 대중교통 공백지역의 서비스 개선효과를 측정하여 농촌형 · 도시형 교통모델 사업추진에 필요한 의사결정모델을 구축한다. 이를 위해, 대중교통 취약(사각)지역을 조작적으로 정의하고 지리정보시스템(GIS)의 인접분석, 공간결합, 중첩분석을 통해 충청남도 시 · 군 지역을 대상으로 농촌형 · 도시형 교통모델 사업으로 인한 대중교통 취약(사각)지역 해소율을 비교 · 분석하고, 사업을 체계적으로 관리하기 위한 목표지향형 관리모델 도입을 제안한다.
