        경찰손실보상 심의사례의 경찰법적 검토

        The Constitution stipulates the national organization’s duty of protecting the safety of the nation and its people, and as a component police rights should also contribute to the safety of the people and to guarantee people’s basic rights. But in criminal procedures, such as the suppression of a crime or arresting a criminal, the loss of people’s lives, bodies, or property may occur, and police actions for prevention of danger such as suicide prevention can also cause loss of people’s lives, bodies and property in the process. Like this, the damage to people’s lives, bodies, and property may be caused by an unlawful duty of the police, or by a lawful duty of the police. Except for cases where the duty of the police is illegal and direct losses, we must file a suit for national compensation or damage compensation to request additional compensation such as a mental damage. Among these, the typical remedy for violation of the people’s rights due to legitimate police actions is the police loss compensation system. It has been five years, since the loss compensation system was introduced under the Act on the Performance of Duties by Police Officers. It is time to prepare concrete standards for loss compensation to analyze a number of cases of review. To specify the criteria for the target and scope of loss compensation and to establish a certain principle, it is very important that assessing the danger, applying the police responsibility principle, imputation of responsibility for cause of loss and judgment on complying with the principle of proportion. So the police action is based on the premise of danger, if there is sufficient probability that concrete danger will occur and if the police action is consistent with the principle of proportion, the police action is considered legitimate. However, police officers will face not only real dangers but also outward dangers or suspicious dangers. Therefore, in order to establish a detailed standard for loss compensation, it should be given priority that assessing the outward dangers, suspicious dangers and preparation for dangers as well as the real dangers. A detailed review of equity and scope of loss compensation is required in relation to the determination imputation of responsibility for cause of loss. Especially the loss compensation problem of outward person in the police responsibility is complicated, recognition of loss compensation for him depends on whether he can be held accountable for the specific circumstances that have led to the appearance of the danger. It is also very important to observe the principle of proportion in the police action. As a result, the legality or illegality of the police action and the scope of loss compensation may change.* Professor of Chodang University, Ph.D in Law. In short, to determine the target and the scope of police loss compensation, I emphasize once again that it is very important to assess danger, imputation of responsibility for cause of loss. Finally, I hope that this research will serve as a basis for establishing the review criteria of the committee on loss compensation in fact, by taking a step further from the legal dogma of the police law about dangers. 헌법은 국가기관에 대하여 국가와 국민의 안전을 위한 보호의무를 규정하고 있으며, 이를 위한 한 요소로서 경찰권도 국민의 안전과 기본권 보장에 기여해야 한다. 하지만, 범죄진압이나 범인체포 등 형사사법절차에서 국민의 생명․신체 또는 재산에 손해를 끼치는 경우가 발생할 수 있으며, 자살방지 등 위험방지를 위한 경찰작용도 그 과정에서 국민의 생명․신체․재산상 손실을 야기할 수 있다. 이처럼, 국민의 생명․신체․재산상 손해는 경찰의 위법한 직무활동에 의해 발생할 수도, 적법한 직무활동에 의해 발생할 수도 있다. 경찰관의 직무집행이 적법하지 않은 경우와 직접적인 손실 이외에 정신적 피해 등 위자료를 추가로 청구하기 위해서는 국가배상이나 손해배상 소송을 제기해야 한다. 이 가운데, 적법한 경찰작용으로 인한 국민의 권리침해에 대한 대표적인 구제제도가 경찰손실보상제도이다. 경찰관직무집행법상 손실보상제도가 도입된 이래 5년이 되어간다. 이제 다수의 심의사례를 분석하여 손실보상의 구체적 기준을 마련해야 할 때다. 손실보상의 대상과 보상범위의 기준을 구체화하고 일정한 원칙을 세우기 위해서는 위험의 평가, 경찰책임원칙의 적용, 손실발생원인의 귀책성 및 비례의 원칙 준수 여부를 판단하는 것이 중요하다. 경찰조치는 위험을 전제로 하고 있으므로, 구체적 위험이 발생할 충분한 개연성이 있고, 그에 따른 경찰조치가 비례성의 원칙에 부합한다면 경찰조치는 적법한 것으로 평가된다. 그런데 현장경찰관이 경찰권을 발동함에 있어서 맞닥뜨리는 위험은 진정한 위험뿐만 아니라 외관상 위험이나 위험이 의심되는 상황도 많을 것이다. 따라서 손실보상의 세부적 기준을 세우기 위해서는 진정한 위험뿐만 아니라 외관상 위험, 위험에 대한 의심, 위험의 사전대비 등에 대한 평가가 우선되어야 한다. 손실발생원인의 귀책성의 판단과 관련해서는 형평성 및 보상범위에 대한 세밀한 검토가 필요하다. 특히, 이와 관련하여 외관상 경찰책임자의 손실보상문제가 복잡한바, 손실보상의 인정 여부는 위험의 외관을 초래하게 된 구체적인 상황에 대해 책임을 물을 수 있는지에 달려있다. 경찰조치를 함에 있어서 비례의 원칙을 준수했는지도 매우 중요하다. 이에 따라 경찰조치의 위법․적법 여부, 그리고 손실보상의 범위가 달라지기 때문이다. 요컨대, 경찰손실보상 대상과 범위를 결정하기 위해서는 위험의 평가, 손실발생의 원인에 대한 책임 여부와 정도를 밝히는 작업이 매우 중요하다는 것을 다시 한번 강조한다. 끝으로 이 연구가 위험에 대한 경찰법적 도그마에서 한발 더 나아가, 실질적으로 손실보상심의위원회의 심의기준을 정립하는데 기초가 되기를 기대한다.

        고속액체 크로마토그라프법을 이용한 제제중 Aclatonium Napadisilate 의 정량 및 함량균일성에 관한 연구

        A convenient high performance liquid chromatographic method was established for the quantitative determination and content uniformity test of aclatonium napadisilate preparation. This method was more simple to make the sample solution for injection, and easy to determine the content in the preparation. Aclatonium napadisilate was chromatographed using a Lichrosorb-NH₂ column (4㎜ × 25 ㎝, and acetonitrile-water mixture (83:17) as an eluent at a flow rate of 1.8 ㎖/min. RI-detector response was linear over a range of 0.5∼2.0% aclatonium napadisilate under above conditions. Reproducibility studies gave relative standard deviation of 1.29%.

        Performance Evaluation of Cold In-place Recycling Mixtures Using Emulsified Asphalt Based on Dynamic Modulus, Flow Number, Flow Time, and Raveling Loss

        The need for a Cold In-place Recycling using emulsified asphalt (CIR-emulsion) mixture with specific engineering properties calls for the use of a mix design and, recently, a new mix design procedure was developed for CIR-emulsion. As a part of CIR-emulsion mix design process, dynamic modulus, flow number, flow time and raveling tests were conducted to evaluate short- and long-term performance of CIR-emulsion mixtures at various testing temperatures and loading conditions. Based on the test results, the optimum emulsified asphalt content for CIR was determined. Dynamic modulus, flow number and flow time of CIR-emulsion mixtures using CSS-1h (cationic slow setting emulsion) were higher than those of HFMS-2P (high-float medium-setting emulsion modified with a polymer). Flow number and flow time of CIR-emulsion mixtures using RAP materials with softer residual asphalt was higher than those of CIR-emulsion mixtures using RAP materials with harder residual asphalt. The dynamic modulus, flow number and flow time were affected by both emulsion type and residual asphalt stiffness of RAP materials. Raveling loss of CIR-emulsion mixtures with 1.5% emulsified asphalt was significantly less than those with 0.5% and 1.0%

        장관 영양제의 임상적 적용

        Some pediatric patients who can not eat orally depend on enteral tube feedings, and some patients require more nutrients and calories to achieve the catch-up growth. If a patient is counting on the parenteral nutrition, early initiation of enteral feeding, orally or enterally, is a very good for the intestinal mucosal maturity and motility. There are numerous kinds of formulas and supplements for the enteral feeding for neonates, infants, and children. Depending on the intestinal symptoms, allergic symptoms, requirement of special nutrients, we can choose regular infant formula (milk-based, soy-based), protein hydrolysate formula, amino acid hydrolysate formula, elemental formula. Proper use of these formulas would help for the pediatric patients to recover from their diseases, to facilitate the intestinal mucosal maturity and to achieve their goal of growth.

        Analysis of 6He + 12C Elastic Scattering at 38.3 MeV/nucleon

        Elastic scattering of the 6He + 12C system at 38.3 MeV/nucleon has been analyzed by extending the optical limit approximation to the Coulomb-modified Glauber model. Assuming that the 6He nucleus consists of a 4He core and two weakly-bound neutrons, we take the 6He density to be a sum of the densities of the core and the two halo neutrons. The calculated differential cross section, taking into account the halo effect, is found to be in fairly good agreement with the observed data. The oscillatory structure observed in the angular distribution can be explained as being due to the interference between the near-side and the far-side amplitudes. We investigate the halo neutrons' effects on the density, the angular distribution, the imaginary phase shift, the transparency function, and the reaction cross section. We found the introduction of the halo structure of 6He to be important in the description of 6He + 12C elastic scattering.

        First-Order Eikonal Model Analysis for ^(11)Li + p Elastic Scattering at 62 MeV/nucleon

        The elastic scattering of the ^(11)Li + p system at 62 MeV/nucleon has been analyzed within the framework of the ¯rst-order eikonal model. Assuming that the 11Li nucleus consists of a core of ^9Li and two neutrons, we take the nuclear potential as a sum of contributions due to the core and the two halo neutrons. The calculated angular distribution, taking into account the ¯rst-order eikonal phase shift, is found to be in very good agreement with the observed data. We investigate the e®ects of halo potentials on the effctive potentials, phase shifts, and the cross sections. We found that the break-up e®ect of halo neutrons is important to understanding ^(11)Li + p elastic scattering.
