온라인상에서의 상거래활동은 오프라인 상거래와 다르기 때문에 새로운 형태의 분쟁과 문제를 유발시킨다. 오프라인을 중심으로 되어 있는 기존의 분쟁해결제도만으로 복잡 다양해진 분쟁을 해결하기에는 다소 어려운 것이 현실이다. 그러므로 인터넷과 컴퓨터 네트워크를 이용한 온라인분쟁해결(ODR)이 등장하게 되었고, 인터넷 사이트들을 이용한 분쟁해결에 일익을 담당하고 있다. 본 논문에서는 국내․외 ODR의 동향을 다루고 실제 운영되고 있는 ODR서비스기관이 또한 소개된다. 본 논문의 목적은 ODR시스템의 문제점과 해결방안을 연구함으로써 글로벌 ODR의 활성화에 기여하는 것이다. On-line e-commerce causes new kinds of disputes and problems owing to being different with off-line commerce. It is difficult to resolve the complicated and various disputes in international commerce only using existing ADR which is based on off-line. Therefore ODR using internet and computer network was introduced and plays an important role in the disputes resolution using internet website. This paper describes ODR’s trend at home and abroad and existing ODR service organizations are introduced as well. The purpose of this paper is to contribute to the activation of ODR globally by studying the problems and solutions in ODR systems.

오늘날 전 세계적으로 전자문서의 관리와 전자정보의 전달은 영업활동이나 경영활동의 큰 부분을 차지하고 있다. 컴퓨터 기반 정보의 전 세계적인 사용이 더욱 더 증가될 것으로 기대된다. 전자문서는 종이기반의 세계보다 전자적인 세계에서 훨씬 다른 의미를 내포하고 있다. 전자문서는 전자적 수단에 의하여 작성, 생성, 발송, 전달, 수령 또는 저장되는 계약서나 기타 기록물을 말한다. 본 논문은 전자무역의 도입으로 인하여 대두되고 있는 전자문서의 개념과 한계성 그리고 이러한 전자문서의 효율적인 관리를 위한 전자문서보관소의 개념과 필요성에 대해 알아보고자 한다. 따라서 전자상거래와 전자무역의 원활화를 위해 공인전자문서 보관소의 활성화에 기여하는 것이 본 논문의 목적이다. Recently, electronic document management and electronic information transmission constitute an extensive part of commercial and administrative activities. It is expected that the world-wide use of computer-based information will still increase dramatically. The electronic documents have quite different meanings in the electronic world than in the paper world. The electronic documents are generated by the electronic record which means data created, generated, sent, communicated, received, or stored by electronic means. This paper deals with not only concept and problems of electronic documents which was at issue owing to the increased use of electronic trade but Authorized Electronic Data Depot as an integrated system for the efficient management of electronic document. The purpose of this paper contribute to activate the Authorized Electronic Data Depot for streamlining e-Commerce and e-Trade.

최근 베트남의 경제환경은 향상되었고, 경제성장율도 8%정도에 이르게 되었다. 그리고 베트남의 발전은 각 지역과 세계로부터 많은 이익을 받고 있다. 인터넷의 발전은 거래의 효율을 매우 높여주었으며, 베트남은 전자상거래 활동에 적극적으로 참여하게 되었다. 그러나 베트남의 전자상거래 시스템은 아직 미흡하고, 그 효율은 다른 나라와 비교하였을때 상대적으로 매우 낮은 실정이다. 그러므로 베트남에서 경제를 성장시키고 전자상거래를 발전시키기 위해서 문제점들에 대한 해결방안을 찾는 것은 당연히 이루어져야 할 일이다. 이 논문의 목적은 베트남의 전자상거래 발전에 기여하고자 하는 데에 있다. Recently, Vietnam economic environment has been improved, economic growth rate is equally at about 8%. Therefore, the development of Vietnam has received a lot of interests from the regional countries and the world. Together with the development of internet and the modernized tendency in business to get high efficiency, Vietnam has started to be interested and joined in the e-commerce activities. However, the e-commerce system in Vietnam is still poor, therefore, the efficiency is too low compared with country potentiality. Therefore, finding the solutions for the development of e-commerce in Vietnam is necessary and also the current problems of Vietnam on the way of economic growth. The purpose of this paper is to contribute to speeding up the development of e-commerce of Vietnam.
