In this thesis, I have first summarized Chubb & Son, Inc. v. Asiana Airlines (2nd Cir. 2000), which was explained in my former thesis-“Whether the United States and the Republic of Korea were in a treaty relationship under the Warsaw Convention system.” And I have introduced the recent rulings of the U.S.'s courts, which include ① Fujitsu Limited v. Federal Express Corporation, 247 F.3d 423 (2001), ② In re Air Crash at Agana, Guam on August 6, 1997, No. 1237 HLH (J.P.M.L., Aug. 28, 2000), ③ Motorola Inc. v. Federal Express Corp., 308 F.3d 995, 999 n. 6 (9th Cir. Feb. 13, 2002), ④ G.D. Searle & Co. v. Federal Express Corp. 2003 WL 943690 (N.D.Cal. Jan. 23, 2003) and ⑤ Leonard Schopenhauer v. Compagnie Nationale Air France No. CIV. 00-7131(LBS) 2003WL1793035 (March 31. 2003). Furthermore, I have also explained the recent ruling of Korean Supreme Court's 2002DA32523/32530, which was handed down on October 22, 2002. Lastly, I have analyzed and compared the positions which the U.S. and Korean courts have taken after Chubb's case and the U.S.'s entry into the Montreal Protocol No. 4.

Background: Charcot joint or neurogenic arthropathy in diabetes is a late complication invading the foot and ankle that results in dislocation, instability, and deformity of the affected area. Sensory neuropathy leads to numbness and malalignment of the foot and ankle or inadequate post-traumatic response, which results in progressive fractures, multiple joint dislocations, ulcerations, osteomyelitis, and amputation. Because of such serious consequences, understanding of pathophysiology is important in determining treatment strategies. Early diagnosis and appropriate treatment can prevent this destructive process. Current Concepts: The number of adults diabetic patients continuously increases. Health care and life expectancy will continue to improve with the development of medicine. As a result, the incidence of diabetes-related complications will increase. Diabetic Charcot joint will have a serious negative impact on the quality of life and financial burden on the diabetic patients. The goal of treatment for Charcot joint is not to build a normal foot, but to make a stable plantigrade foot that can be worn shoes. Therefore, it would be most important to understand the progress and characteristics of the disease and to develop an appropriate plan in order to select the appropriate treatment method. Discussion and Conclusion: Understanding Charcot joint and familiarization with its appropriate treatment should reduce the number of the cases of diabetic Charcot joint patients with disabilities or amputations.

In this thesis, I have first, introduced and studied Chubb & Son. Inc. v. Asiana Airlines, 214 F.3d 301 (2nd Cir. 2000), which held that at the time that the dispute in this case arose, there was no treaty relationship between the United States and South Korea under the Original Warsaw convention, the Hague Protocol, or a treaty consisting of those provisions of the Original Convention that were not amended by the Protocol. And I have analyzed U.S. government's position that was expressed in Brief for the United States as Amicus Curiae on petition for a writ certiorari to the 2nd Circuit on Chubb & Son case and 2nd Circuit's Fujitsu Limited v. Federal Express Corporation, 247 F.3d 423 (2001) which was held in a related question afterwards but was somewhat inconsistent with Chubb & Son's holding. Furthermore, I also examined U.S. government's measures which have been considered and taken to cope with consequences of Chubb & Son case's ruling. Lastly, I have examined several effects which Chubb & Son's ruling would give our nation's airlines and suggested our government's countermeasures.

Achilles tendinopathy has seen good results with conservative management. However, the management of Achilles tendinopathy lacks evidence-based support, and tendinopathy patients are at risk of long-term morbidity with unpredictable clinical outcomes. Data suggests that 29% of tendinopathy patients required surgical intervention during the follow-up period. Chronic pain after damage to the Achilles tendon is a result of incomplete recovery of fibrous tissue. Recently, many procedures, including various injection treatments, have been tried without understanding proper preservation techniques and procedures for faster tendon recovery, especially for patients who want to quickly return to their daily lives. This article is an extensive literature review on nonoperative management of Achilles tendinopathy.

Purpose: To suggest for the following experimental study of antioxidant by reviewing recent oriental medicine journals that have been published since 2007 in Korea. Methods: We investigated various types of studies in relation to antioxidant through 79 articles that have been published from 2007 to 2009 in recent oriental medicine journals were registered National Research Foundation of Korea. Results: In this study, most of studies performed using herbs or medicinal plant for medical disorder such as liver, Cardiac & Vascular, Diabetes Mellitus etc. Most of these herbs have positive effects against oxidative stress and free radicals. Conclusion: This result will provide useful information of field of Oriental medicine for the development of new anti-oxidative prescriptions or antioxidant. We will have to carry out comparative study between each herbs or each extract method.
