在中탈북자의 國際法的 地位와 그 問題解決에 관한 硏究 = (The) legal status and protection of North Korean defectors to China in international law

국문 초록 (Abstract)

본 연구는 국제사회의 쟁점으로 떠오르고 있는 탈북자들의 법적 지위 즉 탈북자들의 난민 지위와 인권보호 측면을 중국 내 탈북자문제에 접합시켜, 한국정부의 재외탈북자 보호를 위한 국제 협력방안의 모색과 특히 재외탈북자들이 집중되어 있는 중국에서의 탈북자문제를 해결하기 위하여, 중국정부 뿐만 아니라 한국 그리고 북한 및 국제사회의 체계적인 노력으로 인해 누적된 국제사회의 힘으로 탈북문제의 원만한 해결에 기여할 수 있는 방법을 밝히고자 연구하게 되었다.
탈북자문제는 그 동안 중국 사회에서 심각한 사안으로는 대두되지 않았다. 그러나 최근 북한의 경제난·식량난 등으로 한국이 인도적인 차원의 대북지원문제가 국제적 이슈로 등장하고 북한을 이탈하는 탈북자가 급증하면서 주중 외교공관이나 외국학교에 진입하여 한국행을 요구하는 탈북자가 늘어난 후부터 문제가 심각해졌다. 중국은 더 이상은 조용히 탈북자문제를 처리할 수 없게 되었고 따라서 탈북자들의 법적 지위를 연구한 결과 탈북자를 난민으로 인정함이 탈북자문제를 해결하는 근본적인 방법이라는 것을 깨닫게 되었다.
본 논문에서는 연구범위를 중국에서의 탈북자 문제에 한정하여 중국에서의 탈북자들의 법적 지위를 연구했다. 중국정부는 비록 1951년 난민협약과 1967년의 난민지위에 관한 의정서의 당사국이긴 하나 이 문서들에서 나오는 난민의 개념은 단순히 전통적 난민개념에 속할 뿐이므로, 즉 탈북자들은 정치난민이 아닌 경제적인 요인으로 자국을 떠난 사람이라 보기에 난민지위를 인정할 수 없다는 견해다. 이로써 중국이 시대와 걸맞지 않게 전통적 난민개념에만 매달리고 있다는 것을 알게 되었고 외교부대변인의 발언을 통해 중국에서 탈북자들을 처리하는 방식에 대해 알게 되었다. 현재 세계의 변화에 알맞게 확대된 난민개념을 원용함으로써 재중 탈북자문제를 원만하게 해결해 나가는 것이 제일 중요하다고 생각 된다.
탈북자 문제를 검토하면서 주로 탈북자의 법적 지위를 연구하였는데 이 과정에서 난민보호의 가장 기본이 되는 두 협약이 시대와 국제사회의 변화에 따른 한계점을 드러냄으로써 이와 함께 출발한 난민보호기구인 UNHCR 또한 난민보호에 있어서의 한계를 드러낸 것이다. 사실상 UNHCR은 시대가 변함에 따라 다양한 원인으로 난민이 증가함에 따라 UNHCR도 그 보호대상을 협약상의 난민에만 한정하지 않고 그 범위를 확대하여 보호를 제공하여 왔다. 하지만 UNHCR의 지위는 UN에 종속되어 있기에 난민보호에 대한 구속력 있는 결정이 쉽지는 않다. 특히 인도적인 고려가 가장 우선시 되어야 할 난민보호에 있어서도 강대국의 힘의 논리가 반영될 가능성이 높은 것이 사실이기 때문이다. 난민지위를 인정하는 여부에서도 국가의 주권이 우선이기 때문에 난민을 효과적으로 보호하기 어려운 또 다른 요인으로 작용하고 있기는 하다.
난민문제의 해결방안에서 무엇보다도 강조 되어야 할 점은 탈북자의 난민지위와 그 보호문제에 관한 문제라고 여긴다. 본 논문에서 논의한 것처럼 중국이 전통적인 난민의 개념에 얽매이지 않고 현 시대에 맞춰 조금만 그 난민개념을 확대시켜 원용한다면 탈북자들의 난민지위 인정은 시간문제에 불과할 것이다. 그리고 UNHCR도 더는 방관하는 자의 자세로가 아니라 적극적으로 중국을 설득하여 탈북자문제를 해결하는 것이 보다 효과적이라고 생각한다.

다국어 초록 (Multilingual Abstract)

The status of North Korean defectors to China has been the hot issues of the protection of human rights recently. Especially, the number of North Korean defectors is so huge that international society has been striving to properly interpret the legal status of them and protect their human rights. The main focus of thesis is laid on the study about the legal status and human rights of North Koreans in China from international law. Furthermore, it includes the considerations of how legal and political problems arising from North Korean defectors in China can be solved with the cooperation among South Korea, North Korea, People's Republic of China, and other states.
The international society has not paid serious attention to the issues related to North Korean defectors in China for a long time. However, it came to have spotlights in the international community with a series of hot news on economic aid of South Korea to North Korea or defectors' trials to get into foreign diplomatic residences and foreign schools in China for asylum at South Korea. The increasing refugees made China realize that it can't deal with the problem alone and the fundamental method to solving the problems caused from North Koreans in China starts from its granting the status of refugees to them.
On the research scope of thesis, it mainly focuses on the legal status of North Korean defectors in China. Even though China is a party to 'The 1951 Convention Relating to the Status of Refugees' and 'The 1967 Protocol Relating to the Status of Refugees', it maintains that it can't grant 'the status of refugees' to North Korean defectors to China in the sense that as far as the traditional meanings of 'refugees' from these treaties are concerned, they defected to China not from the political but from the economic factors. Judging from the attitude of Chinese government, it applies merely the traditional definition of refugees to solving the problems from North Koreans living in China.
With an in-depth research on North Korean defectors in China, it reveals that the 1951 convention, the 1967 protocol and the UNHCR (United Nations High Commissioners for Refugees) are out of date which are the fundamental basis for protecting refugees in that it doesn't keep up with the changes in international community. In reality, the UNHCR expanded its protection from the traditional category in the international treaties to refugees from different reasons. Because of the organizational relationship between UN and UNHCR, the UNHCR finds it hard to have its own ruling power on refugee protection. The guaranteeing legal status of refugees can be influenced by powerful actors in the World. The protection of refugees faces another difficulty as it should respect the sovereignty of a state.
The status of North Korean defectors and their protection are one of the most important things in solutions to refugees in China. The states and international organizations need to interpret the concepts of refugees in modern ways. In addition, the UNHCR are in request for taking more active actions on the cases relating to North Korean refugees in China.
