지방자치법은 지방자치의 제도적 틀을 규정한 기본법이자 법제도적 기반이다. 현행 지방자치법은 지난 1949년 7월 4일 제정, 공표된 이래 1999년 8월 31일(제16차 개정)과 2000년 1월 12일(제17차 개정)의 부분적 개정을 거쳐 오늘에 이르고 있다.
그러나 우리나라 지방자치법은 제정된 지 50여년이 지났음에도 불구하고 지방자치의 활성화를 위한 성숙한 규범적 기반이라기 보다는 오히려 과거의 국가중심적, 중앙집권적 제약을 온존시키고 있어, 21세기 무한경쟁이라는 전례없는 도전에 직면한 우리 지방자치의 발전을 제약하는 요인이 되고 있다는 비판을 면하지 못하고 있는 실정이다.
따라서 본 연구는 민선자치가 전면 실시된지 6년이나 지난 현 시점에서 아직도 미비점으로 제기되고 있는 각종 쟁점현안들을 중심으로 각계의 의견을 비교, 분석하여 구체적인 지방자치법의 개정방안과 지방자치의 발전방향을 제시하는데 초점을 맞추었다.
비교분석 결과, 세계적인 무한경쟁 속에서 살아남기 위해서는 적극적으로 분궈화를 추진해야하며, 이를 통해 '지방화시대'로 일컬어지는 세게적 추세에 부응하고, 지방자치제도를 선진화하는 가운데 행정의 능률성과 민주성을 조화시키고, 지역의 균형적 발전과 국가경쟁력을 강화시켜야한다는 점을 다시 한번 확인할 수 있었다. 그리고 이 같은 목적을 달성하기 위해서는 첫째로 중앙과 지방의 권한배분에 있어서 중앙정부에 집중된 권한과 관련예산을 대폭적으로 지방에 이양하고, 그에 따르는 책임성을 강화하여야 할 것이며, 둘째로는 지방의회의 권한을 확대하고 위상을 재정립하여 지방자치단체에 대한 감시, 견제기능을 강화하며, 외부통제보다는 자치행정에 대한 주민참여시스템구축 등 내부통제를 강화하여야 하고, 셋째로는 자치조직권의 강화, 자치입법권의 강화, 지방자치단체의 조세권 ㅇ니정, 지방자치단체의 국정참여제도의 도입 등 실질적인 자치기반 확충이 필요하며, 넷째로는 주민참여의 확대강화를 위해 주민발안, 주민투표, 주민소환 기타 감사청구 등 주민직접청구 제도를 도입, 확장하는 등 주민직접참정제도를 강화해야 하고, 다섯째로 자치사무 처리에 있어서 중앙정부와 시, 도, 시,군 및 자치구간의 수평적 관계가 확립되어야할 것이다.
이와 함께 지방자치관련법 개정이 자칫 정치적 이해관계 등에 얽매여 지방자치의 본질적 요소를 훼손한다든지, 과거 중앙집권시대로 회귀하는 방향으로 개악되는 일은 없어야 한다는데 특히 유의해야 할 것이다. 정파의 이익이나, 중앙, 지방관료의 이기심 등 집단이기주의가 개입할 경우, 지방자치 발전의 취지가 희석될 수 밖에 없으며, 중앙정부의 지방자치단체에 대한 지나친 간섭과 통제는 지방자치를 위협하는 최대의 걸림돌이 되고 있다는 점을 최우선적으로 고려하여야 할 것이다.
제도적인 보완과 함께 주민들의 자치의식 함양과 주민참여, 주민통제의 확대, 자치단체의 자율과 권한의 신장에 따른 책임성의 강화, 자치단체장의 의식전환, 지방자치단체에 대한 지방의회의 심의, 견제기능 확대, 중앙정부나 광역자치단체의 기획, 조정, 통합기능의 강화, 언론과 시민사회단체의 감시기능 활성화 등의 노력이 함께 병행되어야 진정한 의미에서 지방자치의 성공을 기약할 수 있을 것이다.
결국 지방자치는 자치개혁이다. 지방자치를 개혁의 과제로 이해할 때 비로소 지방자치를 통해 현재 우리가 겪어 온 국가위기를 극복할 수 있는 활로가 열릴 것이다. 이러한 견지에서 이제 제정 50년을 넘은 지방 자치법이 진정한, 21세기형 지방자치를 위한 법제도적 기반이 될 수 있도록 하기 위한 법정책적 실천이 절실히 요구된다.

Local government act is the basic law and legislative basement, prescribing regional government system. The current "Local Government Act" has been amennded in August 1999(16th Amendment) and January 2000(17th Amendment). However its over 50 years history, the "Local Government Act" still has its shortcomings and therefore has a lot of issues that have to be supplemented, reviewed and amended.
This study focuses on specific plans to amend the "Local Government Act" and to suggest the direction in which the act should be developedfurther, based on comparative with regards to the shortcomings of the "Local Government Act" that has been put into place over the past six years.
The comparative study once again indicates and confirms that in order for Korea to survive global competition, the country has to actively decentralize power through which Korea can follow in the global trend of "localization" of authority;advance the development of the regional government system while striving for a democratic authority and efficiency in administration; and achieve a balanced development among regions while strengthening the competitiveness of the country.
In order to achieve these goals, the central government first needs to transfer the authority and related budgets to the regional authorities in the process of allocating authority between the central and regional governments, while also strengthening the responsibilities of the regional governments as well. Second, it is necessary to develop means of expanding the authority of the regional assemblies and redefine their prominence so that the checks and balances system between the regional government and regional assemblies is strengthened, while strengthening the internal controls, rather than outside controls, of the regional administrations through implementations of local resident participation systems etc. Third, a realistic foundation for regional government needs to be expanded through measures such as strengthening of the rights to organize a local authority and to legislate local government act the rights to taxation by regional authorities, and the participation of regional governments in the nation-al administration process etc. Fourth, in order to strengthen and expand the participation of local residents, a system where local residents can directly demand action from regional authorities such as local-residents'proposal systems, local-residents'election systems, local-residents'citation systems and other processes which support the rights to demand inspection into the local government authorities needs to be introduced and expanded. And lastly, a horizontal relationship between central government and cities- provinces, and cities and townships needs to be established.
A point of caution while addressing these matters is that behind the issues being debated regarding the amendment of the "Local Government Act" is the interests of the ruling and opposition parties, as well as the central administrative government institutions. In other words, the amendments, as a result of different self-interests of the above organizations, in "Local Government Act"cannot be allowed to represent a retraction towards to the past days of centralized authority, or to taint the fundamental elements of regional administration. It is essential to recognize that if the self-interests of different parties are involved, such as self-interests of different factions of parties and central and regional administrators, the objective to develop the regions will, as a result, become diluted, and in addition, excessive authority by the central government ever regional authorities will become the largest obstacle in threatening the administration of the different regions.
With these supplementations, the true success of local government administration of regions will depend on the concurrent development of the responsibilities as a result of increased freedom and rights for regional government organizations; the increased awareness by regional administrators; the expanded checks and balances systems between regional government administrations and local assembties; the strengthening of the planning and consolidations of functions of the central and regional administrations; and the increased monitoring activities of the regional press and civilian monitoring organizations.
In conclusion, regional self-government is equal to the reform of self-autonomy. Only when it is recognized that reform is necessary as a consequence of the establishment of local government, then a breakthrough to the national crisis that we currently face will be found. On this note, it is imperative to abide by a law policy that can allow that "Local Government Act," which has been in place over the past fifty years, to become the foundation for the policies to develop new and modern regional administrations.
