정부는 현대 사회에서 나타나는 다양한 문제를 해결하기 위하여 존재한다. 그러나 정부의 문제 해결을 위한 노력은 정책오차의 가능성을 가지고 있으며, 입법부는 이러한 정부의 정책오차 가능성을 최소화할 수 있는 유일한 수단이라고 할 수 있다. 그러나 현대의 입법부는 정부에 대한 감시와 견제기능 등 의회 고유의 기능을 제대로 수행하지 못하는 의회주의의 위기를 맞고 있다. 이러한 인식하에서 이 글은 한국 의회제도, 특히 상임위원회제도의 제도적인 문제점을 파악하고 그 대안을 제시하기 위하여 상임위원회의 운영실태 및 전문성을 미시적으로 분석하여 보았다. 이 글에서는 상임위원회의 전문성을 개인적 전문성과 구조적 전문성으로 나누어 분석하였다. 본 논문의 분석결과를 간략하게 요약하면 다음과 같다.
먼저 상임위원회 위원의 개인적 전문성에 영향을 미치는 요인으로는 위원의 재선율, 위원의 상임위원회 교체율, 위원의 학력 및 전공 합치도, 위원의 경력 및 경력 합치도의 네 가지 변수를 설정하였다.
첫째, 초선의원의 비율은 매우 높아 40%에서 80% 정도를 보였다. 이러한 높은 초선율은 우리 나라 정치 상황의 변화와 관련이 있기는 하지만, 미국의 10% 이하에 비하면 매우 높은 수준이라고 할 수 있다.
둘째, 상임위원회의 교체율 역시 매우 높다는 것이다. 상임위원회 위원의 교체를 보면 우리 나라 의원의 경우 4년의 임기 동안 평균 3개 이상의 상임위원회를 거치는 것으로 나타났다.
셋째, 우리 나라 국회의원들은 공식적인 학력 면에서 매우 높은 수준을 보이고 있었으나 상임위원회의 전문성에서 보다 중요한 전공과 상임위원회와의 합치도는 법제사법, 국방, 행정위원회 등을 제외하고 대부분 매우 낮게 나타났다. 특히 전문적인 지식이 필요한 건설교통, 경제과학기술위원회 등은 전공자가 거의 없었고 합치도 역시 매우 낮았다.
넷째, 우리 나라 국회의원들의 과거 직업을 분석해 보면, 직업이 일부에만 국한되어 있고 다양하지 못하여 경력합치도는 매우 낮게 나타났다. 따라서 법제사법, 국방위원회 등을 제외하고 전문지식이 필요한 경제과학기술, 건설교통 등의 위원회는 경력자가 거의 없었고 경력합치도도 매우 낮게 나타났다.
다음으로 이 글에서는 상임위원회의 구조적 전문성으로 위원의 선임방식, 위원장의 선출방식, 상임위원회 수 및 회의일수, 공청회제도 및 전문가의 활용정도, 소위원회제도, 보좌체계 등의 여섯 가지 변수를 설정하여 분석하여 보였다.
첫째, 상임위원회 위원의 선임방식의 경우 위원의 배정을 학력이나, 경력 등 일정한 배정 규칙에 의하지 않고, 정당이나 본인의 의사에 따라 자의적으로 이루어지고 있었다. 즉, 위원의 배정이 전문성을 전혀 고려하지 않은 채 이루어지고 있어서 상임위원회의 전문성 향상에는 전혀 도움을 주지 못하였다.
둘째, 상임위원회 위원장의 선출방식 역시 상임위원회에 대한 고참성이나 실질적인 경선 등과 같은 방식이 아니라 정당 간부에 의하여 자의적으로 이루어지고 있어서 전문성은 물론 독립성과 자율성을 저해하는 방향으로 운영되고 있었다.
셋째, 상임위원회의 수 및 회의일 수에 대한 분석에서는 상임위원회의 구성이 업무 분야별이 아니라 정부 부처별로 이루어져 있어서 업무의 중복 현상이 나타났다. 또한 회의 일수의 분석에서도 폐회 중에서 거의 개회되고 있지 못하여 의안의 심도있는 심사가 이루어지지 않았다.
넷째, 공청회제도에 대한 분석에서는 수 많은 안건에 비하여 공청회 개최건수는 거의 없는 수준이었으며, 전문가로부터의 자문도 거의 이루어지고 있지 못하였다. 따라서 이러한 제도를 통한 전문성의 향상은 거의 이루어지고 있지 못하다고 할 수 있다.
다섯째, 상임위원회의 문제점을 보완하고 보다 전문적인 심사를 위하여 도입된 소위원회제도는 전혀 활성화되어 있지 않았다. 소위원회의 구성 수와 회의일수는 매우 낮은 수준이었으며, 소위원회 위원의 구성도 전문성을 가진 위원으로 구성되어 있다고 볼 수 없었다.
여섯째, 의원의 의정활동을 보좌하는 보좌진 및 보좌체계에 대한 분석을 보면, 먼저 우리 나라 의원 개인 보좌진의 경우 보좌진의 수도 작을 뿐만 아니라 대부분이 전문성이 없고, 단지 의원의 수행비서나 지역구 관리 역할을 수행하고 있었다. 그리고 국회내 전문기관도 규모와 전문성에 있어서도 미흡한 수준이었으며, 이들 기관과 의원들과의 교류 및 협조관계 역시 거의 나타나고 있지 않았다.
상임위원회는 본회의에서는 해결할 수 없는 고도의 전문성을 요하는 정책적 쟁점에 대해 심도 있는 토론을 전개하여 나가는 국회 운영의 핵심이라고 할 수 있다. 그러나 현행 한국 의회의 상임위원회제도는 위의 분석에서 살펴 본 바와 같이 그 전문성에 있어서나 운영의 효율성에 있어 국민의 기대치에 크게 못 미치고 있었다.
본 연구의 분석결과와 그 동안의 의정활동에서 얻은 경험 등을 종합해 볼 때 상임위원회의 전문성을 제고시키기 위한 방안 내지는 정책적 제언으로 다음과 같은 것을 지적할 수 있겠다.
첫째, 상임위원회 위원의 선임 및 위원장의 선출과 관련하여 선임자 우선원칙과 같은 전문성을 우선시하는 나름대로의「의회 규칙」을 정하여야 한다. 우리 나라는 상임위원회 위원의 교체율이 지나치게 높게 나타나고 있으며, 이것은 상임위원회의 전문성을 저하시키는 하나의 요인으로 작용하고 있다. 따라서 상임위원회의 배정시나 위원장의 선출시 학력이나 경력, 상임위원회 재임기간 등과 같은 일정한 규칙을 적용하여야 하겠다.
둘째, 상임위원회 운영의 내실을 기하기 위해서는 상설소위원회를 설치하고 이를 정례화 하는 것이 시급하다는 것이다. 많은 안건이 상정되는 상임위원회에서 모든 위원이 전문성을 가지고 토론에 참여하는 데에는 한계가 있다. 따라서 상임위원회를 좀 더 분업화시켜 소수의 전문적 지식을 가진 위원으로 하여금 업무를 분담하게 하여야 하겠다.
셋째, 상임위원회와 소위원회에서 활동하는 국회의원의 전문성을 높이기 위해서는 전문적 지식이 있는 보좌진으로 보좌체계를 구성하여야 한다. 그리고 국내의 입법조사분석실, 법제예산실 등의 전문기구를 확충하고 의원들과 유기적인 합조체제를 이루어나가도록 하여야 한다.
넷째, 현 상임위원회를 보다 세분화하거나 재조정할 필요성이 있다. 또한 상임위원회의 위원정수가 많게는 30명에서 적게는 12명으로 불균형을 이루고 있다. 따라서 현 상임위원회를 정부부처별로 세분화하거나 아니면 업무 영역별로 재조정하교, 각 의원이 두개의 상임위원회에 배정되도록 하여 상임위원회에 소속된 의원의 숫자를 균형 있게 조정하는 것이 바람직하다고 본다.
다섯째, 국회의 예산결산 및 심의기능을 강화하고, 예산결산특별위원회를 상설화 하여야 한다. 현재와 같은 특별위원회 형식으로는 정부의 과도한 예산요구와 복잡한 회계수치에 대한 미시적 분석능력을 확보할 수 없다. 따라서 국회에 예산편성시부터 이를 심의하는 예산결산위원회를 상설로 설치하는 것이 필요하다. 그리고 미국의 의회예산처(CBO)와 같은 방대하고 전문적인 기구인 예산심의전문기관을 국회내에 설립하여 예산의 결산 및 심의기능이 실질적으로 국회에서 이루어지도록 하여야 한다.
여섯째, 국회의 가장 중요한 기능이 입법기능인 만큼 국회내에 법률시행령 연구소를 설치해야 한다. 현재 대통령에 위임된 각종 시행령, 시행규칙 등은 이를 모범과 사전에 조율할 기관이 없어서 법리적 모순, 적용상의 어려움, 용도 폐기된 시행령의 잔존 등 많은 문제점을 야기하고 있다. 따라서 국회내에 이를 전문적으로 담당할 기관을 육성하여 국회 고유의 입법기능을 활성화하는 것이 필요하다.
일곱째, 국회의 가장 중요한 기능 중의 하나인 국정감사 기능을 강화해야 한다. 국정감사는 감사준비 기간중 대상기관이 자기 문제점과 전반적인 업무를 자가 진단할 수 있도록 하며, 기관별 목표설정을 새롭게 하고 나아가 국민과 더불어 국정전반에 대한 토론을 하는 의미를 갖는다. 따라서 국정감사의 기간을 늘리고 수감기관의 무성의와 의원들의 전문성 결여 및 인기위주의 감사를 시정하는 제도적인 장치를 마련하여야 한다.
여덟째, 현재 행정부에 소속되어 있는 감사원을 국회 직속으로 운영하는 것이 바람직하다. 감사원의 행정부에 대한 예산감사, 회계감사, 직무감사 등의 기능은 행정부에 의한 행정부의 감사로는 실질적인 효과를 내기 어렵다. 따라서 감사원이 국회 직속으로 되어야만 상시 감사로 국정감사의 효율성을 제고할 수 있다.
본 논문은 우리 나라의 국회가 상임위원회 중심으로 운영된다는 점을 중시하여 의회의 제기능 활성화에 중요한 요인의 하나인 상임위원회의 전문성을 분석하고 전문성 향상을 위한 정책적인 대안을 탐색하고자 하였다. 이러한 관점에서 볼 때, 본 논문의 가장 중요한 함의는 상임위원회의 전문성에 대한 현황을 실증적, 경험적으로 분석해 보고, 이를 바탕으로 상임위원회의 전문성을 제고할 수 있는 실질적인 정책적 대안을 제시하였다는 것이다.

Government exists to solve various problems occurring in the modern society. However, Government's efforts in trying to settle these problems involves probability of policy errors. The Legislature is the only one means that can minimize the probability of such Government's policy errors. Unfortunately, however, the current Legislature in Korea confronts the crisis of parliamentarism that does not duly execute its unique functions, such as the monitoring and restraining function on Government's activities. Perceiving this weakening role of the Legislature, this study grasped institutional problems of the Korean parliamentary system, especially of the standing committee system, and, in order to suggest alternative measures, analyzed the current status of operations of the standing committee and its professionalization in a micro way. This study analyzed professionalization of the standing committee by diving it into individual member's professionalization and structural professionalization. The results of the analysis are briefly summarized below.
This study set up four variables as the factors affecting professionalization of individual members of standing committee. They included the percentage of re-elected members, members' association opportunities with standing committees, their education and majors, and their parliamentary experiences.
First, the percentage of the newly elected parliamentary members was as high as 40%-80%, depending on committees. Such a percentage of new members, though it is connected with Korea's political situations and changes, is very high, compared to that of the U.S. new parliamentary members, which is 10%.
Second, Korean parliamentary members' association opportunities with standing committees were also high. It was found that members, during their 4-year term, work for at least 3 standing committees on average.
Third, Korean parliamentary members showed a very high level in school education, but congeniality between their majors which are more important with respect to activities of the standing committee than educational level and duties the standing committee was very low, except for the Legislation and Judiciary Committee, the National Defence Committee, and the Administration Committee. In the Construction and Transportation Committee and the Economy, Science and Technology Committee, where professional knowledge and skills are particularly required, few members majored in these or related areas, and congeniality between educational backgrounds of members and activities of their committees was also found very low.
Fourth, as for Korean parliamentary members' past occupations, it was found that their former occupations are limited to certain jobs, showing indiversity. Congeniality between members' experiences and activities executed by committees was very low. Except for the Legislation and Judiciary Committee and the National Defence Committee, few members had experiences related to their committees in the Economy, Science and Technology Committee and the Construction and Transportation Committee, where professional knowledge and skills are especially required, and congeniality between members' experiences and their committee duties was found very low.
This study further established and analyzed six variables with respect to structural professionalization of the standing committee, including the assignment of committee members, the selection of the committee chair, the number of standing committees and the number of meeting days, the public hearing and expert system, the sub-committee system, and the support system.
First, it was found that the assignment of the standing committee members was ordered unsystematically according to decisions by the political party or members themselves, with no criteria for assignment of members such as assignment members' educational backgrounds or experiences. In other words, members are assigned to certain committees, disregarding their backgrounds or professionalization, so that the existing assignment system was of little help to improvement of the standing committee professionalization.
Second, the standing committee chairman was selected by executive members of the political party, not depending on the member' longer association with the committee or not through a competitive election. As a result, the existing selection system of the committee chair was found undermining the committee's independency and autonomy as well as professionalization.
Third, as for the number of the standing committees and the number of meeting days, the organization of the standing committee is based on government ministries and offices, not based. on characteristics of activities done by committees. As a result, some activities were overlapped in some committees. With respect to the number of meeting days, all committees rarely opened during the out-of-session period, so that screening of bills could not be conducted.
Fourth, as for the public hearing system, it was found that the number of public hearings was too low compared to a great number of issues. In addition, advices from professionals in relation to issues was little pursued. Consequently, it is very hard to expect improvement of professionalization through the existing system.
Fifth, the sub-committee system, which was adopted to fill up deficiency of the standing committee and to make more professional judgment, had not been activated at all. Since the number of sub-committee members and the number of meeting days were too low, it was hard to see the sub-committee as an organization consisting of members with professionalization.
Sixth, with respect to aides and the support system that aid members' parliamentary activities, not only the number of aides for Korean Assembly members was too small, but also most of them lacked professional knowledge and skills. They played only the role of suite or manager of the constituency. Moreover, professional organizations in the National Assembly should be improved in size and professionalization, and the interrelationship and cooperation between these organizations and members were little found.
The standing committee can be seen as the core in the operation of the National Assembly providing thorough discussions about political issues that require a high level of professionalization which can be solved in the Assembly plenary session. However, the existing standing committee system of the Korean Assembly, as results of the analysis have shown, is still far behind the people's expectations with respect to professionalization and effectiveness of its operation.
Summarizing analysis results from this study and the author's personal experiences gained while doing parliamentary activities up to now, ideas and suggestions for reconsideration of professionalization of the standing committee were made as follows:
First, as for the assignment of the standing committee members and the selection of the committee chair, certain criteria, such as "Assembly Regulations", which gives priority to professionalization, like the attitude that prefers those having longer parliamentary experiences. In Korea, the shift rate of the standing committee members appears too high, and this is one of the causes declining professionalization of the standing committee. Accordingly, in assigning the standing committee members or selecting the chair, certain rules, such as members' education, experiences, or working period with the committee, should be applied.
Second, for the better internal operation of the standing committee, it is urgent to set up and operate the standing sub-committee. In the standing committee, where many bills are submitted, there are limitations for all members to participate in discussions with professional competency. Accordingly, it is necessary to allow members to take charge in areas in which they have professional knowledge by subgrouping the standing committee.
Third, to help increase professionalization of law makers working in the standing committees and sub-committees, the assistance system should be reorganized so as to consist of aides with professional knowledge. In addition, expert organizations, such as the Legislative Investigation and Analysis Office and the Legislative Budget Office, should be reinforced and maintain an organic cooperative relationship with Assembly members.
Fourth, the standing committee needs to be subgrouped and restructured. Presently, the number of the standing committee members is unbalanced ranging from 30 to 12. Therefore, the existing standing committee should be either subgrouped by government agencies or restructured by characteristics of activities. In addition, it is desirable to balance the number of the standing committee members by assigning each member to two standing committees.
Fifth, the parliamentary functions of the budget balance and deliberation on the budget should be reinforced, and the Special Committee on the Budget Balance should be established permanently. With the existing special committee system, the micro-analysis abilities in relation to the government's demand for huge budget and complicated accounting figures could hardly be expected. Accordingly, it is necessary to establish the Committee on the Budget Balance, which deliberates budgetary matters from the time of compilation of the budget. In addition, it is also required to perform the function of deliberating the budget balance in the Assembly by setting up the organization of deliberation on the budget, a gigantic and expert organization like the U.S. Congressional Budget Office(CBO).
Sixth, because the most important function of the National Assembly is performing legislative activities, a research institute of regulations for the application of a law should be established in the Assembly. Currently, there is no organization that can coordinate many enforcement ordinances and regulations with their mother laws, so that many problems arise, such as contradictions in terms of legal principles, difficulties in application, and existence of abrogated ordinances. Therefore, it is necessary to activate legislative functions unique to the Assembly by instituting an expert agency that will take such functional responsibilities.
Seventh, the function of parliamentary inspection of the administration, one of the most important parliamentary functions, should be stressed. The parliamentary inspection of the administration finds its meaning in helping target agencies, during the period of inspection preparation, self-diagnose their own problems and overall duties, in renewing the establishment of individual agency's objectives, and further in discussing overall parliamentary activities. Accordingly, it is necessary to set up the institutional system that can extend the period of the parliamentary inspection and audit of the administration and correct insincerity of the inspection agency and law makers' lack of professionalization and popularity-oriented inspection and audit attitude.
Eighth, it is desirable to put the Board of Audit and Inspection currently belonging to the Executive under the direct control of the National Assembly. Functions of the Office of Audit and Inspection, such as inspections of the Executive's budget, accounting, and duties, can hardly result in practical results, with inspection by and of the Executive. Accordingly, only when the Office of Audit and Inspection is put under direct control of the National Assembly, it can provide effectiveness of audit and inspection of the administration as an ordinary inspection.
This study analyzed professionalization of the standing committee, one of the important factors for activation of overall parliamentary functions, and sought for alternative measures for improvement of professionalization by emphasizing the fact that Korean National Assembly is being operated centering around the standing committee. From this perspective, the most significant meaning of this study is that it analyzed the current status of professionalization of the standing committee practically and experimentally, and based on these analysis results, it suggested practical alternative measures that can reconsider professionalization of the standing committee.
