In recent years each advanced country has been using a certificate of origin system as a means of trade regulation. Accordingly, the WTO has begun to set up standardization of the provisions of certificate of origin. Korea enacted its own certificate of origin system in 1991 and has used it since then.
The certificate of origin system has tariff purposes and non-tariff purposes as well, which brings direct stimulus to the activation of domestic industries and the expansion or shrinkage of foreign trade with its functions of export promotion and import controls. Thus, the certificate of origin system at last can be a matter of high significance, not only for the protection of domestic industries but for causing trade disputes with export or import partners abroad.
Since Korea's trade volume has mow occupied a substantial amount of the world trade, it is of great importance that Korea, as a responsible member of the world economic system, should be committed to minimizing unnecessary trade discord, promoting national benefits and fostering global economic order by pursuing a reasonable program for improving certificate of origin.
To take account of the appropriateness of this study, the following points were taken into consideration :
1. to classify the provisions of certificate of origin and examine its functions, its applicable fields and its efficiency through reviewing the Kyoto Agreements where the first related documents regarding the rules of certificate of origin were made at the C.C.C. ,
2. to overview, in a new era of transition, the principle of the WTO's unified provisions of certificate origin and make the enacting process of the unified certificate of origin properly understood,
3. to analyze and estimate the present status and usages of the certificate of origin system of such countries as U.S.A., Japan and E.U. whose trade volume with us is substantial, and have our businessmen effectively respond to the provisions of others,
4. to point out the operational state and problems of Korea's certificate of origin system so that it can be compared with those of other countries,
5. and to review a program for improving Korea's certificate of origin system in ways based on the preferential and non-preferential division of the provisions of certificate of origin, and revise it and enact new provisions of certificate of origin for North Korean products, etc.
In the end, for our own sake - and for the sake of world trade, it is hoped that Korea shall first respect the system already achieved at WCO/TCRO up to July, 1988, and secondly Korea will undertake increased efforts to have her national interests reflected through further negotiations and discussions on any outstanding issues.
