公務員 軍加算點 附與制度와 男女平等實現에 關한 小考 : '군 필자 가산점제' 위헌 결정에 따른 보상대책 中心으로

다국어 초록 (Multilingual Abstract)

In December 23rd 1999, Constit ut ion Court made decision t hat the
system, which gives an addit ion point to officers and men who finished
the service in t he reserve at government employee examination, is
unconstit ut ional. Aft er that decision, the pros and cons against addi-
tional point grant syst em rose with social issue.
At t he Korean constit ut ion 39t h section, it is prescribed t hat all
cit izens fall liabilit y for national defense by law wit h adopt ing National
Milit ary Service Syst em. Also, It is forbidden t he t reat ment which is
disadvant ageous because of the execut ion of military service.
Current Korean security sit uat ion, high morale of milit ary service men
and the modernizat ion of equipment toget her is very important and
necessary war potent ial fact ors for keeping the war rest raint. Also,
nat ional compensat ion in necessary for their sacrifice which is caused
by milit ary service during 26 months in t heir young and personal
developing period.
The system, which gives an addition point to the discharged soldier,
should not understood as charact erist ic man & woman discriminat ion
viewpoint or as disadvant age t o t he some youths who did not serve
army. Also, We have to approach t oward t his issue at t he aspect of
high morale and national compensation for milit ary service men who
are devot ing themselves at the front line of national securit y for
country and people. Furthermore, we need t o approach toward this issue
at the aspect of people￠ s participat ion for the nat ional security and
importancy of execut ing milit ary service.
Therefore, t his study are emphasizing that t he issue of military
additional point system should not become t he batt le place of man &
woman discrimination. Also, as I t old above, t he military addit ional
point syst em is not syst em to discriminate woman and people who did
not serve army, but to compensate for discharged soldiers for t heir
sacrifice for national security.
Also, I t hink that revival of military addit ional point system should be
done to fit national profit and high morale of whole military service
men.
There are priorit y on every works. National securit y is first priority
to get right of people￠ s life, ideology, nat ional t errit ory, and democracy.
So, at this point of view, Constit ute Court￠ s decision for military
additional point syst em was very too hast y because execution of army
service to protect our nat ion should be respect ed comparing with ot her
activities.
Therefore, this st udy aimed t o find out compensat ion plan for military
service fit ting our current sit uat ion, t o suggest improving system, and
to pick up the predicted problem according to t he decision of Constit ute
Court against milit ary addit ional point system.
