여성도 남성과 마찬가지로 평등하게 창조되었지만, 평등한 권리를 향유하고 있지 못한 것이 현실이다. 이에 대한 이유를 다각적인 시각에서 접근할 수 있겠지만, 본고에서는 法의 適用이라는 측면에서- 특히 헌법상의 평등권조항에 대한 미국과 우리 나라의 판례들의 견해 속에서 - 平等權審査基準을 중점적으로 비교, 고찰해보고자 한다. 미국의 경우에는 그 나라의 歷史的 經驗과 고유한 政治的, 社會的 背景-이민국가·다인종 다민족국가라는 고유한 상황-을 반영하여 연방대법원의 판례를 통하여 人種, 國籍, 性別, 庶子 등의 평등보호영역을 구분하여 각기 다른 차별금지기준을 확립하였다. 즉 인종·국적·소수인 차별·기본적 권리침해와 같은 민감한 영역에서는 회의적 분류에 속한다고 하여 嚴格한 審査基準을, 성별 ·서자차별문제·외국인차별 등의 영역에서는 中間審査의 基準을, 그 외의 경제정책 및 입법에 관하여는 最小限의 合理性基準으로 세분화하여 適用하였다. 또한 20세기에 들어와서 中間審査基準으로는 미흡한 性別에 의한 평등권보장을 優先處遇理論이라는 새로운 기준을 마련하여 보강함으로써 평등권심사 기준은 時代의 變遷에 따라, 適用對象에 따라 다양하게 변천되어 왔고 또한 適用對象에 따라 그 接近性이 다르다는 것이 특징이다.
우리 나라에서도 급격한 근대화과정속에서 여권신장이론을 받아들여 憲法的 次元에서 명시적으로 성차별을 금지하는 조항들을 구비해놓고 많은 下位法을 통하여 양성평등을 실현하려는 노력을 하여왔다. 헌법적 차원에서 양성평등을 보장하고 있기 때문에 연방대법원의 해석에만 전적으로 의존할 수밖에 없는 미국의 경우와는 달리 우리 헌법재판소는 判決을 통하여 性에 관한 특별한 審査基準을 확립해 놓고 있지는 않고 평등권일반에 적용되는 恣意禁止原則을 적용하여 차별의 합리성을 판단하고 있는 수준이다. 다양한 인간의 생활을 전제한 평등보호의 기준이 하나의 기준으로 획일화되어 있다면, 추상적이며 정밀한 기준이 되지 않는 동시에 오히려 주관적인 판단마저 정당화하여 남용의 우려조차 없지 않을 것이므로 領域의 區分없이 통일적인 하나의 기준을 적용하고 있는 우리의 현실보다 확립된 多元的인 基準을 가지고 다양한 생활영역에 알맞게 적용하는 미국의 심사기준이 더 평등권보장에 기여하게 될 것이라 생각된다.
그러므로 本 論文은 이러한 觀點에서 출발하여, 미국의 시대별 兩性平等權에 관한 사례들 속에서 審査基準을 정립해보는 동시에 현재 우리 나라가 취하고 있는 審査基準들에 대해서도 살펴보면서 그 문제점도 알아보고자 한다.

All men are born equal. It is unreasonable that men and women are treated each other with sex discrimination. But woman throughout the world have a bitter experience that they have been or are treated unequally, compared with man whether there is a certain difference among them. As such consciousness has gradually increased and widely spread, women of today come to form the subconscious power for their social and economic change.
In case of our country unlike the rise of women's position in the western countries there has been a slow pace for modernization in it because of their peculiar position of a good wife and wise mother, their conventional custom and prejudice of prominence of men over women and they have rapidly experienced a social change in a short time. The questions of the way and means for keeping the equality of the sexes have risen in various ways with a background of the given social condition of every country, although the article of prohibition of discrimination of sex is stipulated in the constitution of every country.
Under this paper, I want to study comparatively on legal view of The Equal Rights for women between The U.S. Suprime Court's judical precedents and The Korea Constitutional Court 's judicial precedents.
First, The Suprime Court's attitude against sex discrimination equality may be classified as the following 3 stages. The first stages is the period of practical denial to sexual equality(-1950 before Warren Court).
The second stages is the period of approval by trial sexual equality(1953-1969 Warren Court). The third stages is the period of Constitutional approval on sexual equality(1971-1985 Burger Court).
There has been no consistent principles in judical precedents but sexual equality has been made not be violate reasonable test. The first standard 'reasonable classification test' is that classification should not be arbitrary but reasonable. 'Strict scrutiny test' applied suspect classification, fundamental interests and 'minimum rationality' applied to economic, social problems. 'Intermediate test' requires fair and substantial relationship to the object of legislation so that all persons similarly situated shall be treated alike. 'Preferential treatment theory' is a useful one to give a compensation for past discrimination and is an accept to justify preferential polices by forward-looking principle which aims at future equality of opportunity. The Constitutional revision movement for Equal Rights for Women has been taking place since mid-1860s. The proposed Equal Rights for Women was designed to end legal sex discrimination in terms of absolute equality. The opponent of ERA expressed fear that intrinsic attributes of men and women would be ignored. Although the ERA was defeated, the battle over ratification has had many important effects. It has promoted legislative reform aimed at eliminating sex discrimination from state and federal statutes.
The concept of equality varies with the individual, but the Constitution of Korea accepts it as a constitutional rule in Article 11. The meaning of equality here is understood not absolute but relative equality. My further examination is conducted on how the Korean Constitution regulates the legislative classification, to clarify that it employs dual principle in regulating the legislative process which determines the legislative classification. As the Korean constitution is based on democracy and the separation of powers, the National Assembly, which represents the people, is vested with extensive legislative powers.
Accordingly, judicial investigation into the unconstitutionality of legislative classification is kept to a minimum in principle unless the classification is apparently unreasonable. However, The Constitution also contains exceptional provisions which restrict the legislative power of the National Assembly. I think, in the case of legislation restricting
freedom and rights as in Paragraph 2 of Article 37, or discriminatory legislation based on sex, religion or social status, such as in the secondary part of Paragraph 1 of Article 11, more strict regulations are needed to apply the legislative process which determine legislative classifications. In the end the realization of an equal society can not be accomplished only by constitution law itself. Therefore, We need to cooperate between gender so that the sexual equality would be settled down in our country.
