다국어 초록 (Multilingual Abstract)

This thesis is an attempt to study on the 'Wechselerkla＂rung' by others. The 'Wechselerkla＂rung' like general legal action can be performed by others as well as the principal.
The more the business transactions develop and the more complexed and diversified their mode and contents become , the more the transactions are performed by others.
Also it is expeced that drafts and checks will be more used than cash in a modern economic society, and the 'Wechselerkla＂rung' by others will be increased.
It seems that drafts and checks are considerably issued in our country that the concept of credit society is not still solidified, but there are some cases that they are not used normally, and the forged drawer, payer and endorsor has illegal drafts and checks frequently negotiated..
Accordingly the drafts and checks which are counterfeited and altered have bad influence on our econonic transactions.
Especially in cases that the 'Wechselerkla＂rung' is performed by others, the possibility of abuse is more serious.
The purpose of this thesis is to study the form and requirement of the 'Wechselerkla＂rung' by others and the effect that the 'Wechselerkla＂rung' by others influences the nominal person and the actual actor.
Also this study is to offer the important knowledges to those who perform the 'Wechselerkla＂rung' for others and those who make others perform the 'Wechselerkla＂rung'.
Therefore this study is aimed to reduce the abuse of the drafts and checks and to enforce the credit of them and to secure the negotialbility of them.
This study refered to the text of the law, many theories, cases and interpretations in our country and foreign countries.
As the 'Wechselerkla＂rung' by others is not a legal term, it is hard to define the concept correctly. The 'Wechselerkla＂rung' by others in this study means to be issued, endorsed and guaranteed by agent etc, and forged, altered by others.
This study is divided into 4 Chapters.
In Chapter 1, it deals with the purpose, the method, the scope of this study.
In Chapter 2, it deals with the 'Wechselerkla＂rung' by authorized person, such as an agent and a person who lends his mame to other.
In Chapter 3, it deals with the 'Wechselerkla＂rung' by unauthorized person, forgery and alternations.
Chapter 4 is the conclusion.
Anyway I hope this study will make a little contribution to the draft and check system and the sound economic order.
