    중대재해처벌법은 산업현장에서 발생하는 중대한 재해를 예방하고 종사자의 생명과 신체를 보호하기 위하여 제정된 법률로서, 책임의 구조가 하청이나 현장책임자로 전가되지 않도록 기업의 실질적인 경영책임자등에게 형사책임을 부과하는 독자적인 규범 구조를 도입하였다는 점에서 중요한 의의를 가진다. 중대재해처벌법의 가장 큰 특징은 산업재해 예방을 위한 책임 구조를 기존의 현장 중심에서 기업의 경영 차원으로 확대하였다는 점이다. 중대재해처벌법 제6조는 동법 제4조 또는 제5조의 안전보건확보의무를 위반하여 중대산업재해가 발생한 경우 사업주 또는 경영책임자등에게 형사책임을 부과하는 조항이다. 하지만 중대산업재해 사건의 책임을 묻기 위한 인과관계 판단은 일반적으로 단순하지 않다. 산업재해는 대개 하나의 특정 요인에 의해 발생하지 않고, 다수의 위험 요인이 중첩되어 발생하는 경우가 많기 때문이다. 예컨대 장비의 결함이나 파손, 안전하지 않거나 예기치 못한 작업 방식, 현장관리자의 감독 소홀, 작업자의 몸 상태 나 부주의, 무자격자의 장비 운전 등이 두세 가지 이상 결합하여 사고로 이어질 수 있다. 동일하거나 유사한 위험이 반복적으로 발생하였지만 개선 조치를 취하지 않아 중대재해로 확대되기도 한다. 게다가 중대재해처벌법위반죄는 경영책임자등의 직접 적인 행위가 아니라 안전보건확보의무를 다하지 않은 부작위에 의해 발생한 산업 재해를 살펴봐야야 하는 경우가 대부분이다. 그러므로 중대재해처벌법위반죄의 인과관계를 판단할 때는 위험의 구조와 조직 차원의 관리체계를 함께 고려해야 한다. 이러한 문제의식으로 본고는 판례 분석을 통해 중대재해처벌법위반죄의 인과관계 구조를 파악하고자 하였다. 이를 위해 먼저 중대재해처벌법 제6조의 조문 구조와 안 전보건확보의무의 내용을 분석하고, 이어 산안법위반죄와 업무상과실치사상죄 및 중대재해처벌법위반죄 관련 판례를 통하여 인과관계가 인정되거나 부정되는 사례들을 검토하였다. 종사자의 안전문제는 구조적인 것으로서 산안법 위반뿐만 아니라, 사고 이전의 위험에 대한 예견과 그에 대한 통제, 그리고 전문인력과 예산의 배분 등이 밀접하게 관련된다. 이러한 관점에서 본고는 중대재해처벌법 제6조의 인과관계를 안전보건관리체계의 구축 및 이행 실패와 재해 발생 사이의 구조적 인과관계로 파악하여 유죄판결과 무죄판결을 유형별로 분석하였다. 유죄판결에서는 안전보건관리체계 안에서 현장의 위험 요인이 확인될 수 있었거 나, 작업의 성격상 충분히 예견될 수 있었음에도 그 위험이 개선되지 않은 상태에서 사고가 발생한 경우가 많았다. 끼임 사고, 떨어짐 사고 등의 재해 유형들은 각 작업의 특성상 일정한 위험이 내재되어 있으므로, 이러한 위험이 위험성평가, 작업계획서 작성, 종사자 의견 청취, 보고 체계 등을 통하여 확인되고 개선될 수 있었는지가 중요하게 검토되었다. 반면 무죄판결에서는 안전보건확보의무 위반이 일부 인정되더라도 적정한 관리체계가 작동하고 있었음에도 작업자의 이례적 행위 또는 예견하기 어려운 사정으로 재해가 발생한 경우엔 상당인과관계가 부정되었다. 그러므로 경영책임자등이 사업장의 특성과 작업의 위험성 등 실질을 반영하여 필요한 인력과 예산을 활용하여 안전보건관리체계를 구축하고 이행하였는지 여부가 산업재해 발생에 구조 적으로 영향을 주었는지를 검토되어야 한다. 인과관계의 입증을 위하여 기존의 2단계 인과론으로 판례를 살펴본 결과, 동일하게 산안법상 안전조치를 위반했지만 이행되지 않은 안전보건관리체계상 조치는 사업 장별로 다른 경우도 많았고, 산안법상 위반조치에 대한 판시보다 안전보건확보의무 의 위반에 대한 판시는 상대적으로 추상적이거나 조문을 열거하는 방식으로 제시되는 경향이 있음을 확인하였다. 이러한 분석 결과를 바탕으로 중대재해처벌법상 인과 관계를 재해의 외형적 유형에 따라 단순히 분류하는 것에 그치지 않고, 안전보건관리체계의 결함이라는 관점에서 재구성하고자 하였다. 이를 위하여 판례에 나타난 구조적 인과 유형을 안전조치 위반형 인과, 관리감독형 인과, 인력 및 예산형 인과, 피드백형 인과, 위험 반복형 인과로 나누어 분석하였다. 안전조치 위반형 인과는 현장에서 필요한 기본적 안전조치가 마련되지 않았거나 작동하지 않은 경우이고, 관리감 독형 인과는 위험작업에 대한 지휘·감독이나 점검이 제대로 이루어지지 않은 경우이다. 인력 및 예산형 인과는 안전보건 업무 수행에 필요한 인력이나 예산이 충분히 배정되지 않아 위험이 방치된 경우를 의미한다. 피드백형 인과는 위험성 평가, 사고 보고, 개선 지시 등이 형식적으로 이루어지거나 실제 개선조치로 연결되지 않은 경우이며, 위험 반복형 인과는 동일하거나 유사한 위험이 반복적으로 드러났음에도 이를 제거하거나 통제하지 않아 재해가 발생한 경우이다. 본 연구는 상당인과관계가 부정된 판례들을 비판적으로 검토하였다. 무죄판결에서 는 작업자의 과실, 통상적이지 않은 작업 방식, 경영책임자등이 구체적 위험을 파악 하기 어려웠던 사정, 안전보건관리체계가 일정 부분 운영되고 있었던 점 등을 이유로 중대재해처벌법위반죄의 상당인과관계를 부정하였다. 이러한 판단은 형사책임의 범위와 결과책임을 제한한다는 점에서 일견 타당하다. 그러나 중대재해처벌법의 입 법취지가 기업의 구조적 안전관리 실패에 대한 책임을 묻는 데 있다는 점을 고려하면, 경영책임자등의 구조적 관리책임을 지나치게 축소하는 해석은 바람직하지 않다. 그러므로 인과관계는 안전보건 관리체계의 실질적 운영 및 기능 여부와 위험관리 실패의 구조적 의미가 함께 평가되어야 한다. 또한 제6조의 규범적 귀속을 위하여 경영책임자등의 역할에 따른 규범적 기대, 업 무기인성 법리를 통한 인과관계 판단의 보완 가능성, 경영책임자등에 대한 사전교육 과 근로감독관 등 수사기관의 전문성 강화 방안을 추가적인 대안으로 제안하였다. 본 연구를 통하여 중대재해처벌법의 제정 취지에 부합하도록 경영책임자등의 안전 보건 확보의무에 대한 해석론적 기초를 제공할 수 있을 것이다. 본 연구에서 제시한 인과관계 판단과 해석 기준이 중대재해처벌법의 적용과 중대산업재해 예방, 나아가 종사자의 생명과 안전을 지키기 위한 형사법적 논의에 기여할 수 있기를 바란다.

    The Serious Accidents Punishment Act was enacted to prevent serious accidents occurring at industrial workplaces and to protect the lives and physical integrity of workers and other persons engaged in work. The Act is significant in that it introduced an independent normative framework imposing criminal liability on business owners and responsible managing officers who exercise substantial control over corporate management, thereby preventing responsibility from being shifted to subcontractors or on-site managers. Its most distinctive feature lies in expanding the structure of responsibility for industrial accident prevention from the conventional workplace-centered approach to the level of corporate management. Article 6 of the Serious Accidents Punishment Act imposes criminal liability on business owners or responsible managing officers when a serious industrial accident occurs as a result of a violation of the duty to secure safety and health prescribed in Article 4 or Article 5 of the Act. However, determining causation for the purpose of attributing responsibility in serious industrial accident cases is generally far from simple. Industrial accidents are rarely caused by a single factor; rather, they frequently result from the accumulation and interaction of multiple risk factors. For example, equipment defects or damage, unsafe or unexpected work methods, inadequate supervision by on-site managers, a worker’s physical condition or negligence, and the operation of machinery by unqualified persons may combine in two or more ways and lead to an accident. In other cases, the same or similar risks may repeatedly arise without corrective measures being taken and eventually develop into a serious accident. Moreover, violations of the Serious Accidents Punishment Act usually involve industrial accidents caused not by the direct conduct of responsible managing officers, but by their omission to fulfil the duty to secure safety and health. Therefore, when determining causation under the Act, both the structure of risk and the organizational safety management system must be considered. Against this background, this study sought to identify the causal structure of offenses under the Serious Accidents Punishment Act through an analysis of judicial decisions. To this end, it first examined the statutory structure of Article 6 and the substance of the duty to secure safety and health. It then reviewed judicial decisions concerning violations of the Occupational Safety and Health Act, occupational death or injury caused by negligence, and violations of the Serious Accidents Punishment Act, focusing on cases in which causation was either affirmed or denied. Occupational safety is structural in nature and is closely related not only to violations of the Occupational Safety and Health Act, but also to the foreseeability and control of risks before an accident, as well as to the allocation of professional personnel and financial resources. From this perspective, this study conceptualized causation under Article 6 as structural causation between failures in the establishment and implementation of a safety and health management system and the occurrence of a serious industrial accident, and classified both convictions and acquittals by type. In cases resulting in conviction, accidents frequently occurred where workplace risk factors could have been identified through the safety and health management system, or where the risks were sufficiently foreseeable in light of the nature of the work, but remained uncorrected. Because accident types such as entanglement and falls inherently involve particular risks arising from the characteristics of the work, courts examined whether such risks could have been identified and remedied through risk assessments, work plans, the collection of workers’ opinions, and nternal reporting systems. By contrast, in cases resulting in acquittal, adequate causation was denied where, despite the partial recognition of a violation of the duty to secure safety and health, the safety and health management system had been functioning appropriately and the accident was caused by an exceptional act of a worker or by circumstances that were difficult to foresee. Accordingly, it is necessary to examine whether responsible managing officers established and implemented a safety and health management system reflecting the actual characteristics of the workplace and the risks inherent in the work, utilizing the necessary personnel and financial resources, and whether any failure in that system structurally contributed to the occurrence of the industrial accident. An examination of judicial decisions under the conventional two-stage theory of causation revealed that, even where the same type of safety measure under the Occupational Safety and Health Act had been violated, the measures under the safety and health management system that had not been implemented often differed from workplace to workplace. It was also found that judicial reasoning concerning violations of the duty to secure safety and health tended to be relatively abstract or to take the form of merely listing statutory provisions, compared with the reasoning concerning violations of safety measures under the Occupational Safety and Health Act. On the basis of these findings, this study sought to reconstruct causation under the Serious Accidents Punishment Act from the perspective of defects in the safety and health management system, rather than merely classifying cases according to the external form of the accident. For this purpose, the structural types of causation identified in judicial decisions were classified into five categories: safety-measure violation causation, supervision and management causation, personnel and budget causation, feedback causation, and repeated-risk causation. Safety-measure violation causation refers to cases in which basic safety measures required at the workplace were not established or failed to function. Supervision and management causation concerns cases in which hazardous work was not properly directed, supervised, or inspected. Personnel and budget causation refers to cases in which risks were left uncontrolled because insufficient personnel or financial resources were allocated for safety and health management. Feedback causation concerns cases in which risk assessments, accident reports, or instructions for improvement were conducted only formally or failed to result in actual corrective measures. Repeated-risk causation refers to cases in which the same or similar risks repeatedly appeared but were neither eliminated nor controlled, ultimately resulting in an accident. This study also critically examined judicial decisions in which adequate causation was denied. In acquittal cases, courts denied causation under the Serious Accidents Punishment Act on the grounds of workers’ negligence, unusual work methods, the difficulty faced by responsible managing officers in identifying specific risks, or the fact that the safety and health management system had been operating to some extent. Such reasoning may appear reasonable insofar as it limits the scope of criminal liability and prevents the imposition of liability merely on the basis of a harmful result. However, considering that the legislative purpose of the Act is to impose responsibility for structural failures in corporate safety management, an interpretation that excessively restricts the structural responsibility of responsible managing officers is undesirable. Causation should therefore be assessed by taking into account both the substantive operation and functionality of the safety and health management system and the structural significance of failures in risk management. In addition, for the purpose of normative attribution under Article 6, this study proposed several supplementary measures: the normative expectations arising from the roles of responsible managing officers, the possibility of supplementing the determination of causation through the doctrine of work-relatedness, prior safety and health education for responsible managing officers, and the enhancement of the expertise of labor inspectors and other investigative authorities. This study is expected to provide an interpretive foundation for understanding the duty of responsible managing officers to secure safety and health in a manner consistent with the legislative purpose of the Serious ccidents Punishment Act. It is hoped that the standards for determining and interpreting causation proposed herein will contribute to the effective application of the Act, the prevention of serious industrial accidents, and broader criminal-law discussions aimed at protecting the lives and safety of workers and other persons engaged in work.

Because accident types such as entanglement and falls inherently involve particular risks arising from the characteristics of the work, courts examined whether such risks could have been identified and remedied through risk assessments, work plans, the collection of workers’ opinions, and nternal reporting systems. By contrast, in cases resulting in acquittal, adequate causation was denied where, despite the partial recognition of a violation of the duty to secure safety and health, the safety and health management system had been functioning appropriately and the accident was caused by an exceptional act of a worker or by circumstances that were difficult to foresee. Accordingly, it is necessary to examine whether responsible managing officers established and implemented a safety and health management system reflecting the actual characteristics of the workplace and the risks inherent in the work, utilizing the necessary personnel and financial resources, and whether any failure in that system structurally contributed to the occurrence of the industrial accident. An examination of judicial decisions under the conventional two-stage theory of causation revealed that, even where the same type of safety measure under the Occupational Safety and Health Act had been violated, the measures under the safety and health management system that had not been implemented often differed from workplace to workplace. It was also found that judicial reasoning concerning violations of the duty to secure safety and health tended to be relatively abstract or to take the form of merely listing statutory provisions, compared with the reasoning concerning violations of safety measures under the Occupational Safety and Health Act. On the basis of these findings, this study sought to reconstruct causation under the Serious Accidents Punishment Act from the perspective of defects in the safety and health management system, rather than merely classifying cases according to the external form of the accident. For this purpose, the structural types of causation identified in judicial decisions were classified into five categories: safety-measure violation causation, supervision and management causation, personnel and budget causation, feedback causation, and repeated-risk causation. Safety-measure violation causation refers to cases in which basic safety measures required at the workplace were not established or failed to function. Supervision and management causation concerns cases in which hazardous work was not properly directed, supervised, or inspected. Personnel and budget causation refers to cases in which risks were left uncontrolled because insufficient personnel or financial resources were allocated for safety and health management. Feedback causation concerns cases in which risk assessments, accident reports, or instructions for improvement were conducted only formally or failed to result in actual corrective measures. Repeated-risk causation refers to cases in which the same or similar risks repeatedly appeared but were neither eliminated nor controlled, ultimately resulting in an accident. This study also critically examined judicial decisions in which adequate causation was denied. In acquittal cases, courts denied causation under the Serious Accidents Punishment Act on the grounds of workers’ negligence, unusual work methods, the difficulty faced by responsible managing officers in identifying specific risks, or the fact that the safety and health management system had been operating to some extent. Such reasoning may appear reasonable insofar as it limits the scope of criminal liability and prevents the imposition of liability merely on the basis of a harmful result. However, considering that the legislative purpose of the Act is to impose responsibility for structural failures in corporate safety management, an interpretation that excessively restricts the structural responsibility of responsible managing officers is undesirable. Causation should therefore be assessed by taking into account both the substantive operation and functionality of the safety and health management system and the structural significance of failures in risk management. In addition, for the purpose of normative attribution under Article 6, this study proposed several supplementary measures: the normative expectations arising from the roles of responsible managing officers, the possibility of supplementing the determination of causation through the doctrine of work-relatedness, prior safety and health education for responsible managing officers, and the enhancement of the expertise of labor inspectors and other investigative authorities. This study is expected to provide an interpretive foundation for understanding the duty of responsible managing officers to secure safety and health in a manner consistent with the legislative purpose of the Serious ccidents Punishment Act. It is hoped that the standards for determining and interpreting causation proposed herein will contribute to the effective application of the Act, the prevention of serious industrial accidents, and broader criminal-law discussions aimed at protecting the lives and safety of workers and other persons engaged in work.
